<section id="H7A5C6D8BE73441CDA55C11B50FFF6ABD" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Gender Trafficking of Minors Act</short-title></quote>.</text></section> 
<section id="H2A3E9DCFE9894B328EE2B61FF52DDBEB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> <paragraph id="HBF4BC79EFF034E8DAEBDA9F48D4D4926"> <enum>(1)</enum> <text>A growing body of international medical guidance has advised against the routine use of puberty blockers, hormone therapy, and gender altering surgeries for minors, absent long-term evidence of benefit and safety. The rise in detransition and regret among young adults who underwent such procedures as minors further underscores the need for robust Federal safeguards.</text>
      </paragraph> 
<paragraph id="H7830BD0B9AD445ABAA5F3EEA9B36729F"><enum>(2)</enum><text>The Federal Government has a compelling interest in protecting minors from experimental and irreversible medical procedures that may result in long-term harm, including sterilization, loss of sexual function, and psychological distress.</text></paragraph> <paragraph id="H0F2E8EE93AD84F20816DDE743510D3EF"><enum>(3)</enum><text>The transportation of minors across state lines to receive such procedures constitutes interstate activity subject to Federal regulation under the Commerce Clause of the United States Constitution.</text></paragraph></section> 
<section id="HB7DA7F118DA04E37BEFFDC032A8630D7"><enum>3.</enum><header>Transportation of a minor for gender a transition procedure</header> 
<subsection id="HF869D47E3A124844997F13D504D00DF3"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/55">Chapter 55</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" id="H89B3F3D87D784619828E60F11470A0DD" display-inline="no-display-inline"> <section id="HBF9135FEF5C346C4BF4453DE4427BE56"><enum>1205</enum><header>Transportation of a minor for a gender transition procedure</header> <subsection id="HB3A1EC9D37B64643B9E9A79BFA9577D8"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever knowingly transports in interstate or foreign commerce, or the offender travels in interstate or foreign commerce or uses the mail or any means, facility, or instrumentality of interstate or foreign commerce in committing or in furtherance of the commission of the offense, a minor to facilitate the minor in obtaining a gender transition procedure shall be fined under this title or imprisoned not more than ten years, or both.</text></subsection> 
<subsection id="HF7EAC0ADD3C34915A99B5EE4D68D458D"><enum>(b)</enum><header>Civil action</header><text display-inline="yes-display-inline">A minor or a parent or legal guardian of a minor who has been transported in violation of subsection (a) may bring a civil action in an appropriate district court for injunctive relief, compensatory and punitive damages, and attorneys’ fees.</text></subsection> <subsection id="H4AD5140EC7C24C6495107A25BA0B05F8"><enum>(c)</enum><header>Gender transition procedure defined</header><text>In this section, the term <quote>gender transition procedure</quote> includes any medical or surgical intervention intended to alter the minor’s sex characteristics in a manner inconsistent with the minor’s biological sex, including:</text> 
<paragraph id="HE0A03878BFE54597A74AC53697878E64"><enum>(1)</enum><text>Administration of puberty-blocking medications, including transportation relating to an appointment to obtain such medication or obtaining such medication.</text></paragraph> <paragraph id="HCF662D9D21494183A4F99AFFBCD3B517"><enum>(2)</enum><text>Administration of cross-sex hormones.</text></paragraph> 
<paragraph id="H55F8314DFC9F4D3092CB1B81BFF66C86"><enum>(3)</enum><text>A surgical intervention, including a mastectomy, phalloplasty, vaginoplasty, or other procedure intended to change primary or secondary sex characteristics.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HDD3BB07BEC2D4B14AF7F3AA098DCEFF2"><enum>(b)</enum><header>Federal funding prohibition</header><text display-inline="yes-display-inline">No Federal funds may be awarded to a State, unit of local government, or other governmental entity that:</text> 
<paragraph id="H7B7226E80A124A16838BEC72953F9933"><enum>(1)</enum><text display-inline="yes-display-inline">Enacts, implements, or maintains a policy that permits or encourages a minor to undergo a gender transition procedure by being transported across State lines.</text></paragraph> <paragraph id="H7D8815225856420CA423C1405DE6E0FB"><enum>(2)</enum><text>Declares itself a sanctuary jurisdiction for a gender transition procedure.</text></paragraph> 
<paragraph id="H1E478C703F784A4DA1084088657BEA5B"><enum>(3)</enum><text>Does not cooperate with a Federal investigation of a violation of section 1205 of title 18, United States Code.</text></paragraph> <paragraph id="H05E7DE6C93DF4D86AC3165BC8128D2AD"><enum>(4)</enum><text>Fails to cooperate with Federal investigations or enforcement actions related to this Act.</text></paragraph></subsection> 
<subsection id="H453D0ECFFEA240DABD6EF364635B2950"><enum>(c)</enum><header>Gender transition procedure defined</header><text>In this section, the term <quote>gender transition procedure</quote> shall have the meaning given such term in section 1205 of title 18, United States Code.</text></subsection> </section> </legis-body></bill>
