<section id="HF8758207F43B4241B17B5A2B705C4FB1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PrEP Assistance Program Act</short-title></quote>.</text></section> <section id="HBF71FFCDFED84260A79E08A295B56559"><enum>2.</enum><header>Pre-exposure prophylaxis grant program</header> <subsection id="H128929BF94464C85939DA5EB6AD68B69"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (in this section referred to as the <quote>Secretary</quote>) and in collaboration with the Administrator of the Health Resources and Services Administration, shall establish a program that provides grants to eligible entities to establish and support PrEP programs.</text>
      </subsection> 
<subsection id="H03D5030A64014D9D82930982E4C0290C"><enum>(b)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible to receive a grant under subsection (a), an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including a description of how any amounts awarded shall be used.</text></subsection> <subsection id="HFA4B28817D1742D9A7E5BE5DCF3D4878"><enum>(c)</enum><header>Preference</header><text display-inline="yes-display-inline">In making grants under this section, the Secretary shall give preference to an eligible entity that demonstrates a record of—</text> 
<paragraph id="H795685707A094209A4BC4CD007018B86"><enum>(1)</enum><text display-inline="yes-display-inline">serving communities with disproportionately high rate of incidence for human immunodeficiency virus (in this section referred to as <quote>HIV</quote>), including individuals located in rural communities, uninsured individuals, or individuals in demographic groups at high risk of contracting HIV; or</text></paragraph> <paragraph id="H2166F6E1A73F4F849F03CA9E6E6A2E41"><enum>(2)</enum><text>implementing innovative models to provide items or services, including the use of vending machines, pop-up clinics, and peer-led interventions.</text></paragraph></subsection> 
<subsection id="HDFF7DC14C3B842E4A25F8347A08F20A2"><enum>(d)</enum><header>Amount</header><text display-inline="yes-display-inline">Any grant provided to an eligible entity under this section may not exceed $10,000,000.</text></subsection> <subsection id="H4CAF02030A0E4A35BF493DF9528E65C8"><enum>(e)</enum><header>Use of funds</header> <paragraph id="H2660D768036947B181FA18C35257EFE5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any eligible entity that is awarded an amount under subsection (a) shall use such amount for expenses associated with establishing a PrEP program or supporting an existing PrEP program.</text></paragraph> 
<paragraph id="H29DFEE9BC34C460FA48DA864B075F90B"><enum>(2)</enum><header>Eligible expenses</header><text display-inline="yes-display-inline">The Secretary shall publish a list of eligible expenses associated with establishing a PrEP program or supporting an existing PrEP program. Such list shall include—</text> <subparagraph id="H7CFF5F05665C4E5296101A0CFC059118" display-inline="no-display-inline"><enum>(A)</enum><text>clinic and laboratory fees;</text></subparagraph> 
<subparagraph id="H57C0DA0DDC5A4C1E8348AD5C39AA1A96"><enum>(B)</enum><text>office visits, including telehealth visits;</text></subparagraph> <subparagraph id="H1C14301125294A9BBA4B9BFF6F7A759A"><enum>(C)</enum><text>PrEP medication;</text></subparagraph> 
<subparagraph id="H68E9B809A4C247ED864C2D162E81B7CD"><enum>(D)</enum><text display-inline="yes-display-inline">blood and urine testing as required in association with the use of PrEP medication;</text></subparagraph> <subparagraph id="H9668282A10CB43C09395A15D9EB9D5A0"><enum>(E)</enum><text display-inline="yes-display-inline">sexually transmitted disease testing in accordance with guidelines issued by the Centers for Disease Control and Prevention;</text></subparagraph> 
<subparagraph id="HC6036D313F3E43C1BAEE9202B3D6282B"><enum>(F)</enum><text display-inline="yes-display-inline">adherence services and counseling;</text></subparagraph> <subparagraph id="H086B6881264B4BFE807FAEF907D26513"><enum>(G)</enum><text display-inline="yes-display-inline">outreach activities directed toward assisting health professionals to become eligible to prescribe pre-exposure prophylaxis medications in the State or Indian Tribal government where the program is operating;</text></subparagraph> 
<subparagraph id="HC074195A28F2485A9C98C4F35341BD31"><enum>(H)</enum><text display-inline="yes-display-inline">outreach activities directed toward physicians that provide education about PrEP;</text></subparagraph> <subparagraph id="H673992995EF84E9899E7DAE5CC45054D"><enum>(I)</enum><text>peer navigation;</text></subparagraph> 
<subparagraph id="HCF318DCF3E1746F183ACD51430A1AB10"><enum>(J)</enum><text>case management;</text></subparagraph> <subparagraph id="H83CFBC8D7B214256A70A6F961F9EAFE0"><enum>(K)</enum><text>transportation support;</text></subparagraph> 
<subparagraph id="H383F48C82F444BBC970389A7FA08D361"><enum>(L)</enum><text>mental health services; and</text></subparagraph> <subparagraph id="HF36960C99F934CCD856738768CA9295E"><enum>(M)</enum><text>other similar items or services.</text></subparagraph></paragraph></subsection> 
<subsection id="HD51BAD0337D64794A9B7A77807A8CA3C">
        <enum>(f)</enum>
        <header>Payment for services</header>
 <text>An individual that receives a service or item from a PrEP program established or supported using amounts under this section may not be required to provide payment for such service or item.</text>
      </subsection> 
<subsection id="H7573475DBB324E689872E0BFAEA869D9"><enum>(g)</enum><header>Matching</header> 
<paragraph id="HE7BC2FF641CA46E3875204970718E91F"><enum>(1)</enum><header>In general</header><text>Except with respect to an Indian Tribal government, a grantee under this section shall contribute, to the PrEP program established or supported by the grant, an amount equal to not less than 10 percent of the amount of the grant.</text></paragraph> <paragraph id="H7D2BF4B8F65F4ADAB18B6F9598D628CA"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may waive the requirement under paragraph (1) for a Federally qualified health center, rural health clinic, community-based organization, hospital-based clinic, or university-based clinic if the Secretary determines such a waiver is necessary.</text></paragraph></subsection> 
<subsection id="HEBBF324C41F34582B2C73AEEF3E36B1A"><enum>(h)</enum><header>Report to Congress</header> 
<paragraph id="HC0D7AA44B325472A9D2877113C58F13C">
          <enum>(1)</enum>
          <header>In general</header>
 <text>The Secretary shall, in each of the first 5 years beginning 1 year after the date of the enactment of this Act, submit to Congress, and make public on the internet website of the Department of Health and Human Services, a report on the impact of grants provided to eligible entities under this Act.</text>
        </paragraph> 
<paragraph id="H895D99959CE847CB9804C027DF32AFC5"><enum>(2)</enum><header>Contents</header><text>A report submitted under paragraph (1) shall—</text> <subparagraph id="HCD1BA8421BC24CBBBE49E8A83CF9B2F2"><enum>(A)</enum><text>include disaggregated data by race, gender identity, age, and geographic location; and</text></subparagraph> 
<subparagraph id="H0755101A9C7B4366B12F3D3C0CF5587C"><enum>(B)</enum><text>evaluate, with respect to the period covered by the report, any reduction in—</text> <clause id="HE9368710BDA54458A016E5B0E87CC8F3"><enum>(i)</enum><text>the disparity of the prevalence of PrEP services provided within the demographics described in this paragraph; and</text></clause> 
<clause id="H1DD01B25DC4E496F9CE3FC86B6117B88"><enum>(ii)</enum><text>the prevalence of PrEP.</text></clause></subparagraph></paragraph></subsection> <subsection id="HF9C26EB1ECDF47389688F2883AA23336"><enum>(i)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to carry out this Act $400,000,000 for each of fiscal years 2027 through 2031.</text></subsection> 
<subsection id="H832315E51BE84855B0778727A450F48A"><enum>(j)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text> <paragraph id="HACBB120156E5407A96501400BD465AA0"><enum>(1)</enum><header>Community-based organization</header><text display-inline="yes-display-inline">The term <term>community-based organization</term> means a nonprofit or private organization that—</text> 
<subparagraph id="H50DEC73C98EB478DAFE565A05745FC74"><enum>(A)</enum><text>represents a community or significant segments of a community;</text></subparagraph> <subparagraph id="H5672B5EDED8D4328A16C33E7B6DA2FEB"><enum>(B)</enum><text>provides health care or health-related services to high-risk or high-need individuals in a community; and</text></subparagraph> 
<subparagraph id="H80836A53E6B34B56853B863EE846B25C"><enum>(C)</enum><text>demonstrates effectiveness with respect to such health care or health-related services.</text></subparagraph></paragraph> <paragraph id="HE2AE1F1CF83849F3B83000C905CAFBED"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> 
<subparagraph id="HFC9C8F3F98B24880A6B4ADBD4A5F0668"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text></subparagraph> <subparagraph id="H60AFC0AD4C9441F5BEC1873C9C12867C"><enum>(B)</enum><text>a local government;</text></subparagraph> 
<subparagraph id="H16C7758699CD495CAB90C79772E13486"><enum>(C)</enum><text>an Indian Tribal government;</text></subparagraph> <subparagraph id="H651D9A3973AF454E967F4F7CE0CFAF7C"><enum>(D)</enum><text display-inline="yes-display-inline">a Federally qualified health center (as defined in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>));</text></subparagraph> 
<subparagraph id="HF3FFEBC925A743819107D2C1E89C69FE"><enum>(E)</enum><text display-inline="yes-display-inline">a rural health clinic (as defined in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>));</text></subparagraph> <subparagraph id="HA99B4C8E6DE249ACBF8A61B77693D7AE"><enum>(F)</enum><text>a community-based organization;</text></subparagraph> 
<subparagraph id="HF683F2E4F12D41FDB5652F969682AA66"><enum>(G)</enum><text>a hospital-based clinic; or</text></subparagraph> <subparagraph id="HDEFF738666EE480A90A75692D16A295E"><enum>(H)</enum><text>a university-based clinic.</text></subparagraph></paragraph> 
<paragraph id="H1FCFD66757FD468DAFF01C64E05FC377"><enum>(3)</enum><header>Indian Tribal government</header><text display-inline="yes-display-inline">The term <term>Indian Tribal government</term> means the governing body of any Indian tribe (as defined in section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>)).</text></paragraph> <paragraph id="HA96D2556E2A343CBA06CC0A37A0A5940"><enum>(4)</enum><header>PrEP program</header><text display-inline="yes-display-inline">The term <term>PrEP program</term> means a program designed to provide pre-exposure prophylaxis and pre-exposure prophylaxis-related services to individuals.</text></paragraph> 
<paragraph id="H973D1F0FA1EE43E2A4DBFF19CBDE07B9" display-inline="no-display-inline"><enum>(5)</enum><header>PrEP medication</header><text display-inline="yes-display-inline">The term <term>PrEP medication</term> means any medication approved by the Federal Drug Administration and designed to prevent individuals at risk of contracting HIV from contracting HIV.</text></paragraph> <paragraph id="H710B6FBB6F9D4CCF87658A2D5927F00E"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text></paragraph></subsection></section> 
<section id="H303EF48CB60C44DD8A23CDA747E85AF2"><enum>3.</enum><header>Requiring the Secretary of Health and Human Services to establish a program to reimburse health care providers for furnishing specified HIV prevention items and services to uninsured individuals</header> 
<subsection id="HDCA6910C3E004257817FFD46FCCF287A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Secretary of Health and Human Services shall establish a program under which—</text> <paragraph id="HE70BFE239C9B4425AA2F1513FB151931"><enum>(1)</enum><text>program-registered providers submit claims to the Secretary with respect to the furnishing of specified HIV prevention items and services to uninsured individuals;</text></paragraph> 
<paragraph id="H6118CF69035A45F292085AAFFD047F41"><enum>(2)</enum><text>the Secretary, subject to the availability of appropriations, pays each such provider for such items and services in an amount established under <internal-xref idref="H40673445910F4C38B3E251C4F3612247" legis-path="__.(b)">subsection (b)</internal-xref>; and</text></paragraph> <paragraph id="H539E509DA7AD4229997ABCC262D26F30" commented="no"><enum>(3)</enum><text>the Secretary provides for the development and distribution of a card (or other technology), to be referred to as a <quote>PrEP Pass</quote>, that may be used by an uninsured individual to assure access to specified HIV prevention items and services from program-registered providers at no cost to such individual.</text> </paragraph></subsection> 
<subsection id="H40673445910F4C38B3E251C4F3612247" commented="no"><enum>(b)</enum><header>Payment amount</header> 
<paragraph id="H2124D479E44940C4A345659339AAC1EB" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to <internal-xref idref="H5B23FEB0BEB74CFD95707C2C306CE216" legis-path="__.(b)(2)">paragraph (2)</internal-xref>, the Secretary shall establish a payment amount for each specified HIV prevention item or service under the program under <internal-xref idref="HDCA6910C3E004257817FFD46FCCF287A" legis-path="__.(a)">subsection (a)</internal-xref>. The Secretary shall review such payment amount not less frequently than once every 2 years.</text></paragraph> <paragraph id="H5B23FEB0BEB74CFD95707C2C306CE216" commented="no"><enum>(2)</enum><header>Laboratory tests</header><text>In the case of a specified HIV prevention item or service that is a clinical diagnostic laboratory test covered under part B of title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>), the payment amount for such test under the program under <internal-xref idref="HDCA6910C3E004257817FFD46FCCF287A" legis-path="__.(a)">subsection (a)</internal-xref> shall be equal to the payment amount determined with respect to such test under section 1834A of such Act.</text></paragraph></subsection> 
<subsection id="H634F3279CFF047558C7890FFB2A29498"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H56C7F82CB17849538FD199EBC31B3813"><enum>(1)</enum><header>Specified HIV prevention items and services</header><text>The term <term>specified HIV prevention items and services</term> means—</text> 
<subparagraph id="H0FB2C5321C904C4EA5D329459A89D7FF"><enum>(A)</enum><text display-inline="yes-display-inline">any drug approved by the Federal Drug Administration for the prevention of HIV, including any such drug approved for use as pre-exposure prophylaxis (commonly referred to as <quote>PrEP</quote>), and administrative fees for such drugs; and</text></subparagraph> <subparagraph id="HEE6199C0EC6B45529B8274788C1826E5"><enum>(B)</enum><text>laboratory and other diagnostic procedures associated with the use of such drugs that are recommended in the most recent clinical practice guidelines of the Centers for Disease Control and Prevention.</text></subparagraph></paragraph> 
<paragraph id="H1910F6A7682F49F8A77D50677B672F6E"><enum>(2)</enum><header>Program-registered provider</header><text>The term <term>program-registered provider</term> means a health care provider that—</text> <subparagraph id="H28C97AD7DDF34A7CB4B95586E8F0FEA2"><enum>(A)</enum><text>is licensed or otherwise authorized to furnish a specified HIV prevention item or service in the State in which such provider furnishes such item or service under the program established under this section; and</text></subparagraph> 
<subparagraph id="H24CD3F058D3947D4B4E33AE2F4A5B7D2"><enum>(B)</enum><text>enters into an agreement with the Secretary under which the provider agrees not to hold an uninsured individual liable for the cost of specified HIV prevention items and services with respect to which a payment is made under <internal-xref idref="H6118CF69035A45F292085AAFFD047F41" legis-path="3.(a)(2)">subsection (a)(2)</internal-xref>.</text></subparagraph></paragraph> <paragraph id="H953E4CDA90C7491194ED0B5AC7F4A36C"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration.</text></paragraph> 
<paragraph id="HC24EE5FEF67F499A8CECE01483975EA2">
          <enum>(4)</enum>
          <header>Uninsured individual</header>
 <text>The term <term>uninsured individual</term> means, with respect to an individual furnishing a specified HIV prevention item or service, an individual who is not enrolled in—</text>
          <subparagraph id="HB8BC5D55CBA84DFEA26D0531C9A7CCDF">
            <enum>(A)</enum>
 <text>a Federal health care program (as defined in section 1128B(f) of the Social Security Act (42 U.S.C. 1320a–7b(f)));</text>
          </subparagraph>
          <subparagraph id="H84DE9F198878414FA98542171A705367">
            <enum>(B)</enum>
 <text>a group health plan or health insurance coverage offered by a health insurance issuer in the group or individual market (as such terms are defined in section 2791 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91</external-xref>)); or</text>
          </subparagraph>
          <subparagraph id="HE0F5FFBA51C44D6F88C06D4D95F0EF0E">
            <enum>(C)</enum>
 <text>a health plan offered under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code.</text> </subparagraph> </paragraph></subsection></section> </legis-body></bill>
