R. 7366</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260204">February 4, 2026</action-date><action-desc><sponsor name-id="L000600">Mr. Langworthy</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to clarify and affirm the preemptive authority of the Food and Drug Administration over dietary supplement regulation, and for other purposes.</official-title></form><legis-body id="HDDAFAFE1F4CE4BCD8B041A9A5BEEDF53" style="OLC"><section id="H702132C018B4458BA4C7F7C6AED00BFE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dietary Supplement Regulatory Uniformity Act</short-title></quote>.</text></section><section id="HE01B1A93357F464881B3FE5D8C59143C"><enum>2.</enum><header>Clarification of Federal preemption with respect to dietary supplement regulation</header><text display-inline="no-display-inline">Section 403A of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343-1">21 U.S.C. 343–1</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H10A45337BDF849F28CC74F4123C61FDE" display-inline="no-display-inline"><subsection id="H97A94F1EEFB44642977DBE03A439DE13"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H9EF760F8A8E54AB58030599B275CCE65"><enum>(1)</enum><text display-inline="yes-display-inline">No State (or political subdivision thereof) may establish or continue in effect any requirement concerning a dietary supplement which is different from, or in addition to, or that is not otherwise identical with, a requirement applicable to a dietary supplement under this Act.</text></paragraph><paragraph id="HA783ED4537EB4BE88008B1CC1CD64E7A" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Upon application of a State or a political subdivision thereof, the Secretary may, by regulation and after notice and opportunity for a hearing, exempt from paragraph (1), under such conditions as may be prescribed in such regulation, a requirement of such State or political subdivision applicable to a dietary supplement if—</text><subparagraph id="H7CA19FE3F57849B781B2589B5A6A52B3"><enum>(A)</enum><text>such requirement is more stringent than the applicable requirement under Federal law; or</text></subparagraph><subparagraph id="HFAB8FA53C65E4C0B8478CBF928984BD3"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H0E6D962FF2A344119E91DC662F8311BE"><enum>(i)</enum><text>such requirement addresses a compelling local condition; and</text></clause><clause id="H624505EDD8864DBDBB4A1B1C08149364" indent="up1"><enum>(ii)</enum><text>compliance with such requirement does not render the dietary supplement out of compliance with Federal law.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
