which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><action display="yes"><action-date date="20260430">April 30, 2026</action-date><action-desc>Additional sponsor: <cosponsor name-id="H001086">Mrs. Harshbarger</cosponsor></action-desc></action><action display="yes"><action-date date="20260430">April 30, 2026</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed<pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Infrastructure Investment and Jobs Act to reauthorize the Rural and Municipal Utility Advanced Cybersecurity Grant and Technical Assistance Program, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H9920DB71278B4A4CBDA2717391BCFC5D" style="OLC"><section id="HE3285435C89246AA8DAF7B6607EF6FB7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural and Municipal Utility Cybersecurity Act</short-title></quote>.</text></section><section id="H55A370CDF3E34F67BE7E8BCEB6A036CF"><enum>2.</enum><header>Rural and Municipal Utility Advanced Cybersecurity Grant and Technical Assistance Program</header><text display-inline="no-display-inline">Section 40124 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18723">42 U.S.C. 18723</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H13CA347E8C514E2DB51BD36C80FFE016" display-inline="no-display-inline"><section id="H1E003FA47372416F949F61AE78A43F67"><enum>40124.</enum><header>Rural and Municipal Utility Advanced Cybersecurity Grant and Technical Assistance Program</header><subsection id="H1601EAE5EA234031ABB69D1C192700EF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H80535FB43DE347EA87B253DEC80DE393"><enum>(1)</enum><header>Advanced cybersecurity technology</header><text>The term <term>advanced cybersecurity technology</term> means any technology, operational capability, or service, including computer hardware, software, or a related asset, that enhances the security posture of electric utilities through improvements in the ability to protect against, detect, respond to, or recover from a cybersecurity threat.</text></paragraph><paragraph id="HB5B09EAC731C44CA9727B72350EF8095"><enum>(2)</enum><header>Bulk-power system</header><text>The term <term>bulk-power system</term> has the meaning given the term in section 215(a) of the Federal Power Act.</text></paragraph><paragraph id="H2024BF079C964D7C8F4D71C4DF227102"><enum>(3)</enum><header>Cybersecurity threat</header><text display-inline="yes-display-inline">The term <term>cybersecurity threat</term> has the meaning given the term in section 2200 of the Homeland Security Act of 2002.</text></paragraph><paragraph id="H17F38D59E8884FB8869BC10C9D5FEE75"><enum>(4)</enum><header>Defense critical electric infrastructure</header><text display-inline="yes-display-inline">The term <term>defense critical electric infrastructure</term> has the meaning given the term in section 215A(a) of the Federal Power Act.</text></paragraph><paragraph id="HC502B723E6594861882FC0B127BB5AAB"><enum>(5)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H459A8A30477749C098BDF47B07D15389"><enum>(A)</enum><text>a rural electric cooperative;</text></subparagraph><subparagraph id="H57789B3C363842AEAF9A6677F2B4EA1A"><enum>(B)</enum><text>an electric utility owned by a political subdivision of a State, such as a municipally owned electric utility;</text></subparagraph><subparagraph id="H220FEC355FAA461C8189CB2E122C4731" commented="no"><enum>(C)</enum><text>an electric utility owned by any agency, authority, corporation, or instrumentality of 1 or more political subdivisions of a State;</text></subparagraph><subparagraph id="HD185404DF63D40BB9CCD18B82649A19D"><enum>(D)</enum><text>a not-for-profit entity that is in a partnership with not fewer than 6 entities described in subparagraph (A), (B), or (C); and</text></subparagraph><subparagraph id="H6FBCC1D4312C47E2A2C790452687C9CE"><enum>(E)</enum><text>an investor-owned electric utility that sells less than 4,000,000 megawatt hours of electricity per year.</text></subparagraph></paragraph><paragraph id="H218228D08E0B4B05966976E8013E9F4D" display-inline="no-display-inline"><enum>(6)</enum><header>Program</header><text>The term <term>Program</term> means the Rural and Municipal Utility Advanced Cybersecurity Grant and Technical Assistance Program established under subsection (b).</text></paragraph></subsection><subsection id="HD54E90088E1B49BB8B5D2CB9953EB8AA" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall maintain a program, to be known as the Rural and Municipal Utility Advanced Cybersecurity Grant and Technical Assistance Program, to provide technical assistance and award funding, including grants, cooperative agreements, and prizes, to eligible entities to protect against, detect, respond to, and recover from cybersecurity threats.</text></subsection><subsection id="H4CD4956E2D414ABC9F2CB4644E5F5CEA"><enum>(c)</enum><header>Objectives</header><text>The objectives of the Program shall be—</text><paragraph id="H7C4C6FE395FA47228B5FFA4881018FE9"><enum>(1)</enum><text>to deploy advanced cybersecurity technologies for electric utility systems; and</text></paragraph><paragraph id="HC1E6D4D5AE6F4BA7BDE222966015C273"><enum>(2)</enum><text>to increase the participation of eligible entities in cybersecurity threat information sharing programs.</text></paragraph></subsection><subsection id="HC221D008E585421E8818D6891D98F239"><enum>(d)</enum><header>Awards</header><paragraph id="HD149FDBB75AC4A378707E5FB8C929EAA" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the Program, the Secretary—</text><subparagraph id="HB0AFC4923F444A46844EDA8B2792BD41" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">shall, subject to the availability of appropriations, provide technical assistance, and award funding, including grants, cooperative agreements, and prizes, to eligible entities on a competitive or noncompetitive basis;</text></subparagraph><subparagraph id="HD017378C8012434B8ABC492E0643FE55" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">shall develop criteria for providing such technical assistance and awarding such funding;</text></subparagraph><subparagraph id="HC229373848A3437298BC8A2897773100" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">may enter into agreements that can facilitate the objectives described in subsection (c) with eligible entities to provide technical assistance or award funding, including grants, cooperative agreements, and prizes; and</text></subparagraph><subparagraph id="HE867FA36C2CE4C47A681ECECCD9454E2" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">shall establish a process to ensure, to the extent practicable, that all eligible entities are informed about opportunities to receive technical assistance or funding, including grants, cooperative agreements, and prizes.</text></subparagraph></paragraph><paragraph id="H3BB07069B7F1425B97BEBE57557F4785" commented="no"><enum>(2)</enum><header>Priority for funding and technical assistance</header><text display-inline="yes-display-inline">In providing technical assistance and awarding funding, including grants, cooperative agreements, and prizes, under the Program, the Secretary shall give priority to an eligible entity that, as determined by the Secretary—</text><subparagraph id="HC471CAAE2768423D97FF39F8AB28AF12" commented="no"><enum>(A)</enum><text>has limited cybersecurity resources;</text></subparagraph><subparagraph id="H1E4097367CC9401EB1FDE27C35A08A68" commented="no"><enum>(B)</enum><text>owns assets critical to the reliability of the bulk-power system; or</text></subparagraph><subparagraph id="HEFA83BE259D8454B948F2FA9981C2128" commented="no"><enum>(C)</enum><text>owns or operates defense critical electric infrastructure.</text></subparagraph></paragraph></subsection><subsection id="H66641FE7F0CA4E4AADE9E439F4A38667" commented="no"><enum>(e)</enum><header>Protection of information</header><text display-inline="yes-display-inline">Information shared by or with the Federal Government or a State, Tribal, or local government under the Program shall be deemed voluntarily shared information and exempt from disclosure under section 552 of title 5, United States Code (commonly known as the Freedom of Information Act), or any provision of any State, Tribal, or local freedom of information law, open government law, open meetings law, open records law, sunshine law, or similar law requiring the disclosure of information or records.</text></subsection><subsection id="H6742FCD0B4834CBCABFEF00929DAD1A2" commented="no"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $250,000,000 for the period of fiscal years 2026 through 2030.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement display="yes"><action-date>April 30, 2026</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
