To amend the United States Housing Act of 1937 to address the payment of tenant-based assistance in cases where a family moves, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
This Act may be cited as the “Housing Choice Voucher Fairness Act of 2025”.
SEC. 2. Transferring housing choice voucher billing.
Section 8(r) of the United States Housing Act of 1937 (42 U.S.C. 1437f(r)) is amended by adding at the end the following:
“(6) If an agency provides tenant-based assistance to a family on or after January 1, 2026 and such family moves to a dwelling unit located in an area outside of the area covered by such agency, such agency shall continue providing tenant-based assistance to such family unless the cost of providing rental assistance for such dwelling unit is greater than 10 percent more than the cost of providing rental assistance for such family when they lived in the area covered by such agency.”.
