R. 7122</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260115">January 15, 2026</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> (for himself, <cosponsor name-id="S001200">Mr. Soto</cosponsor>, and <cosponsor name-id="D000032">Mr. Donalds</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to specify that a food shall be considered misbranded if the value of nutrients on its labeling deviates by more than 5 percent of the value specified on such labeling, and for other purposes.</official-title></form><legis-body id="H5B2AB8CF779948AC9093C637DAC1625A" style="OLC"><section id="H0B9EB0FC91D244DA9B3E37B99D7203B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Consistency in Nutrition Labels Act</short-title></quote>.</text></section><section id="H4BAF56D14FDE402D9D7D3933397CD405"><enum>2.</enum><header>Misbranding of food in case of 5 percent deviation of nutrient value</header><subsection id="H009E24D46C024497856EF94432EA186E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 403(q)(2) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343(q)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="traditional" id="H89B4ED85F8D74B76A943125B2F573386" display-inline="no-display-inline"><subparagraph id="H7980F563906245F69D7F244F441A3BC7" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">If the Secretary determines that, with respect to the value for nutrients required by subparagraph (1)(C), (1)(D), or (1)(E) to appear in the label or labeling of food subject to subparagraph (1), the nutrient content of the composite is greater than 5 percent in excess of the value for that nutrient declared on the label, such food shall be treated as misbranded under this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H922DBB7DEBDF4CD3BB26ED0B6384B6E1"><enum>(b)</enum><header>Regulations</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall revise regulations under section 101.9 of title 21, Code of Federal Regulations (as in effect on January 1, 2026), to reflect the amendment made by subsection (a) of this section.</text></subsection></section></legis-body></bill>
