which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require that an individual elected to fill a vacancy in the House of Representatives pursuant to a special election shall be provided an opportunity to have the oath of office administered and seated as a member of that body not later than five legislative days after the day that the results of the special election are certified, and for other purposes.</official-title></form><legis-body id="H7832536AFBC94AB0A7FF013D4C530F2D" style="OLC"><section id="HBB2BB6D5EDE64453A41398E69A6A9163" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Delay in Representation Act</short-title></quote>.</text></section><section id="HC6DD1948F3C24A1D9266982CD675D242"><enum>2.</enum><header>Requirements with respect to oath of office for individuals elected to the House of Representatives pursuant to special elections</header><subsection id="HCA74BBF36E9C4EF098D73AC218B20BDB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law or rule of the House of Representatives, an individual elected to fill a vacancy in the House of Representatives pursuant to a special election shall be provided an opportunity to have the oath of office administered and be seated as a sworn Member of the House not later than five legislative days after the day that the results of such special election are certified.</text></subsection><subsection id="H1AD028876910430ABACC2B06FAAA8571"><enum>(b)</enum><header>Administration of oath of office pursuant to joint agreement</header><text>In the case that an individual described in <internal-xref idref="HCA74BBF36E9C4EF098D73AC218B20BDB" legis-path="2.(a)">subsection (a)</internal-xref> declines to have the oath of office administered during the period described in such subsection, the Speaker of the House of Representatives shall administer the oath of office to such individual on such date as the individual and the Speaker jointly agree.</text></subsection><subsection id="H4020DE59495E4E07B0BB04FE4D692CD0"><enum>(c)</enum><header>Legislative day defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>legislative day</term> means any day on which the House of Representatives is in session, including any day during which the House convenes in a pro forma session.</text></subsection><subsection id="HC1A7B961CBBF44E29CEF14AD69ACEE81"><enum>(d)</enum><header>Effective date</header><text>This section shall take effect on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
