and</text></subparagraph><subparagraph id="H42EB46FA79624A62836994CF2BDC5E4F"><enum>(B)</enum><text>by inserting <quote>, and the addition or expansion of programs at high-quality charter schools</quote> after <quote>the expansion of high-quality charter schools</quote>;</text></subparagraph></paragraph><paragraph id="H1BF846FA72DC4214807A0DD234F31F94"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H6BFFE0C462AF43B990928383E61D8487"><enum>(A)</enum><text>in paragraph (1), by striking <quote>12.5 percent</quote> and inserting <quote>at least 15 percent</quote>;</text></subparagraph><subparagraph id="H9C329DC3CCE54062A67C2F902EA820D5"><enum>(B)</enum><text>in paragraph (2), by striking <quote>22.5 percent</quote> and inserting <quote>at least 25 percent</quote>; and</text></subparagraph><subparagraph id="HDFEF2E82689640B5BFB8275F648E156B"><enum>(C)</enum><text>in paragraph (3), by striking <quote>use the remaining</quote> and all that follows through <quote>paragraphs (1) and (2)</quote> and inserting <quote>reserve at least 30 percent</quote>; and</text></subparagraph></paragraph><paragraph id="H4CE5FFEFCBBB459CA34D12C506AE477B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H17AC396AC326403E84B729CF712787E5" changed="added" reported-display-style="italic" committee-id="HED00"><subsection id="H13500E8D01034D37BE283C8146B10249"><enum>(d)</enum><header>Remaining amounts</header><text display-inline="yes-display-inline">In the case of a remaining amount after the Secretary makes reservations of the amount made available under section 4311 for a fiscal year in accordance with paragraphs (1), (2), and (3) of subsection (b), the Secretary—</text><paragraph id="HE0EBC3EC5E5D445C869A52EF5858DD85"><enum>(1)</enum><text>shall use all of such remaining amount to support charter school facilities assistance under section 4304, carry out national activities under section 4305, and carry out section 4303, as described in such paragraphs; and</text></paragraph><paragraph id="HD967238342AD4FFA91D1B6263690437A"><enum>(2)</enum><text>may determine how to allocate such remaining amount to support or carry out, as applicable, the programs and activities described in each such section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE2FAF8F70050431FA244D1921D7C8686"><enum>3.</enum><header>Grants to support high-quality charter schools</header><text display-inline="no-display-inline">Section 4303 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221b">20 U.S.C. 7221b</external-xref>) is amended—</text><paragraph id="H3870D525C9C04C3680E8C6477008FCC9"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H634EF85C3FF04299842F049AABBFEF44"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H57E1BC9496EF404B921CC821FDFFEAFD"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>or</quote> at the end;</text></clause><clause id="H150B6AD41FA74BB288B80EC757478219"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>and</quote> at the end and inserting <quote>or</quote>; and</text></clause><clause id="H1C7986E2452B40FAB285FFAB435D7F82"><enum>(iii)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block style="OLC" id="H4EB739DFE8314818A5BAFC028129FB3E" changed="added" reported-display-style="italic" committee-id="HED00"><subparagraph id="HE43951D0923B42D38223C1C33BC2DAA2" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">support the addition or expansion of curricular or other offerings at a high-quality charter school (provided that such addition or expansion is designed and implemented in a manner that will enable additional students to enroll in and benefit from the school), such as through the adoption of—</text><clause id="H574FD5527F5447739EACD4F83ED6CBC0" commented="no"><enum>(i)</enum><text>new academic programs or delivery models;</text></clause><clause id="H3ED479948DBD4D84A5A3BAAF296833E0" commented="no"><enum>(ii)</enum><text>personalized learning; or</text></clause><clause id="H27A9DB0B800F46ECB888D5AE2092D2F4" commented="no"><enum>(iii)</enum><text>a new curricular approach; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HE66E723E53AE48A3AD9700CF6A342053" commented="no"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>, including costs to provide such assistance,</quote> after <quote>provide technical assistance</quote>;</text></subparagraph></paragraph><paragraph id="H96749F3F8A99450AA913FA96911AFD03"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H7CA122D8CD0F4F428D32CFB30B45456C"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>, over the course of the grant period described in subsection (d)(1)(A)</quote> after <quote>shall</quote>; and</text></subparagraph><subparagraph id="H9E0C7624CD8E485E991D9C5209C4AD24"><enum>(B)</enum><text>in paragraph (3), by adding at the end the following:</text><quoted-block style="OLC" id="H35AFC80043914CE4BE712E98530B1800" changed="added" reported-display-style="italic" committee-id="HED00"><subparagraph id="HB53DD2FA492F4A1EB3B93977D48B5C18" commented="no"><enum>(C)</enum><header>Single-sex schools and services</header><text>Nothing in this part shall be construed to prohibit schools from providing educational services to students of a single sex. </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H85C1626046EC4592A0BCE077FC9A4695"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="H1B9642FD4D004EABA926146852E33B62"><enum>(A)</enum><text>in the heading of such subsection, by inserting <quote><header-in-text level="subsection" style="OLC">Advance Payments; </header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Peer Review; </header-in-text></quote>;</text></subparagraph><subparagraph id="H63BC7E01C9824907B559C51269B5F3E3"><enum>(B)</enum><text>in paragraph (1)(B), by striking <quote>of which</quote> and all that follows through <quote>program design</quote> and inserting <quote>of which an eligible applicant may use not more than a period of time determined by the State entity (which may not exceed 2 years) for planning and program design</quote>;</text></subparagraph><subparagraph id="HE2F206C7321D4DB0BCE971FF5C31F401"><enum>(C)</enum><text>in paragraph (2), by striking <quote>The Secretary, and each State entity awarding subgrants under this section, shall</quote> and inserting <quote>The Secretary shall, and each State entity awarding subgrants under this section may,</quote>; and</text></subparagraph><subparagraph id="H929A1F007D334D34A06540BFC5B2A767"><enum>(D)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" id="H075C3AC77B744C1B9A61D1DE5BED1194" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="H3853DDA5643C4D71A8C7A333BC0D80E3"><enum>(3)</enum><header>Advance payments</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary shall take such steps as are necessary to ensure that—</text><subparagraph id="H25E28B1D45564F9FA3F72318145258D3"><enum>(A)</enum><text>an eligible applicant awarded a subgrant by a State entity under this section may request advance payments of subgrant funds for the purposes described in subsection (b)(1), and upon such request, such State entity shall provide advance payments of such funds awarded to the eligible applicant in accordance with section 200.305(b)(1) of title 2, Code of Federal Regulations (or successor regulations);</text></subparagraph><subparagraph id="H6AB98BBF7F3446569C3B775C7BC1144C"><enum>(B)</enum><text display-inline="yes-display-inline">a State entity shall be provided with advance payments of grant funds in accordance with section 200.305(b)(1) of title 2, Code of Federal Regulations (or successor regulations) in an amount sufficient to provide advance payments to an eligible applicant under subparagraph (A); and</text></subparagraph><subparagraph id="H3964F00FB7F0423DB53A4E9BDACD2958" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>mutually agreed upon funding techniques, such as those described in part 205.12 of title 31, Code of Federal Regulations (or successor regulations), are in place with States or State entities, as appropriate, to receive funds under this section in a manner that permits a State entity to receive advance payments of grant funds, and provide to eligible applicants advance payments of subgrant funds, in accordance with subparagraphs (A) and (B).</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB0504925608F45EABA95CD1BC22C301E"><enum>(4)</enum><text>in subsection (e)(1), by striking <quote>is currently using</quote> and inserting <quote>has not obligated all funds received pursuant to</quote>;</text></paragraph><paragraph id="HD0F46E7EE32145D787FC5710601B051F"><enum>(5)</enum><text>in subsection (f)—</text><subparagraph id="HEC55B588A3D64C4FB8679F5F4C319E5B"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H43547DBEA5AB4CA784C7163932B49ACA"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="H001CE2BD79C544EEBB0723A67FA71317"><enum>(I)</enum><text>by amending clause (i) to read as follows:</text><quoted-block style="OLC" id="H9943CD3CB80348B69585F59B2112EDA5" changed="added" reported-display-style="italic" committee-id="HED00"><clause id="H1C247432E5B24E58A80E0A5F7F1E2136" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">support the opening, expansion, and strengthening of charter schools through the startup of new charter schools, the replication of high-quality charter schools, the expansion of high-quality charter schools, and the addition of programs in high-quality schools, which shall include an initial projection (which may not be used to determine a State entity’s allocation of subgrant funds if the State entity determines that an alternative allocation would better meet the purposes of this program) of—</text><subclause id="H983D3520D69748F4BD191AB3C5D4781E" commented="no"><enum>(I)</enum><text>the number of charter schools to be opened through the startup of new charter schools under the program;</text></subclause><subclause id="H2214E377D4F94A6D962E8B285AB4844F"><enum>(II)</enum><text>the number of charter schools to be opened as a result of the replication of a high-quality charter school under the program; or</text></subclause><subclause id="HFADD644FDFC948B7A311BB9BF19372A6" commented="no"><enum>(III)</enum><text>the number of high-quality charter schools to be expanded under the program;</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause><subclause id="H73B67C7C4FE941FDAA0047AE04F3F9CB"><enum>(II)</enum><text display-inline="yes-display-inline">in subclause (II) of clause (vi), by striking <quote>in a manner consistent with the eligible applicant’s application for such subgrant</quote>;</text></subclause><subclause id="H7E89E5A496D54CDC9AFE3A52526B644B"><enum>(III)</enum><text>in clause (xi), by inserting <quote>in the case of a State entity described in subsection (a)(1) or (a)(3),</quote> before <quote>support</quote>; and</text></subclause><subclause id="HB057D8064DC640E9A0B4CD855A527236"><enum>(IV)</enum><text>in clause (xii)—</text><item id="H19EBDFE715094E2CB4E69840FBF90964"><enum>(aa)</enum><text>in subclause (I)—</text><subitem id="HF5AEDD8A5BCC47D6A35AE04579E5700E"><enum>(AA)</enum><text>by striking <quote><header-in-text level="subclause" style="OLC"><enum-in-header>(I)</enum-in-header></header-in-text></quote>; and</text></subitem><subitem id="HA823BA26EC134B319AB84F62A9432C12"><enum>(BB)</enum><text>by striking <quote>not described in subclause (II)</quote> and inserting <quote>described in paragraphs (1), (2), or (3) of subsection (a)</quote>; and</text></subitem></item><item id="H35BA97EE896545A98E055C7CBF4A396D"><enum>(bb)</enum><text>by striking subclause (II);</text></item></subclause></clause><clause id="H641CD2510F7B461EB2598D31006129CC"><enum>(ii)</enum><text>in subparagraph (B)(iii), by striking <quote>to develop or strengthen a cohesive strategy</quote>;</text></clause><clause id="HE1B748DF2AFA4ECF8332778D6217EBF3"><enum>(iii)</enum><text>in subparagraph (C)—</text><subclause id="H78BD21B79ABD4EC48B0D024699A97F22"><enum>(I)</enum><text>in clause (i)(VI), by striking <quote>and</quote> at the end;</text></subclause><subclause id="HF3DBD89507CE4281A7DBC8A6AA009869"><enum>(II)</enum><text>in clause (ii), by inserting <quote>and</quote> at the end; and</text></subclause><subclause id="H17DFCC07C1CA439AB15A77E71EBE5095"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H29F8E80004AB4A54B0B084EB72DC7CF1" changed="added" reported-display-style="italic" committee-id="HED00"><clause id="H4597A7E81B9D463E8A6B6FDDD9515178" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">a description of whether and how, in lieu of requiring an application in accordance with clause (i), the State entity will opt to use an eligible applicant’s approved charter authorization application, provided that such charter authorization application was approved in accordance with relevant State law during the year preceding the date on which the State entity first accepts applications for such subgrants;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="H284863889876477DBAFD9E1BDFD02178"><enum>(iv)</enum><text>by striking subparagraph (E); and</text></clause><clause id="H9DB756B0728E414F9991C2747C419FC7"><enum>(v)</enum><text>by redesignating subparagraphs (F) and (G) as subparagraphs (E) and (F), respectively; and</text></clause></subparagraph><subparagraph id="H21AAE0EE4E014AFA921E79E0EC61F035"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H765E7C92C7A8429EB6BEDE601ADC7AEF"><enum>(i)</enum><text>in subparagraph (F), by striking <quote>and</quote> at the end;</text></clause><clause id="HFA0BBC5876F947FDB29FBFC4124DBF6D"><enum>(ii)</enum><text>in subparagraph (G)(v), by striking the period at the end and inserting <quote>; and</text></subparagraph><subparagraph id="HE24D6FBC900E4D50AC96FFE922FF73B2"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>meet those objectives and</quote>;</text></subparagraph></paragraph><paragraph id="H8B46FA85D3504490A0C9A0BF9D3DCA1B"><enum>(7)</enum><text>in subsection (h)—</text><subparagraph id="H24E28AB7ADCA477288ECADF936001866"><enum>(A)</enum><text>by amending paragraph (1)(B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEE1F665A09A444F780C08B6F46C409F6" changed="added" reported-display-style="italic" committee-id="HED00"><subparagraph id="HBCD32D8D081E4C28992E5A78DDF3B754"><enum>(B)</enum><text display-inline="yes-display-inline">hiring and compensating teachers, school leaders, or specialized instructional support personnel.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HA9022B3E90264A5C95136D4CC71A8151"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H32A67C1B7F9249E9AFDDA51116E60D4D"><enum>(i)</enum><text>by inserting <quote>academic subscriptions (including digital and online subscriptions),</quote> after <quote>training,</quote>; and</text></clause><clause id="H00C52ED1528F4034985A73BA3EA0472F"><enum>(ii)</enum><text>by inserting <quote>curricular support,</quote> after <quote>(including technology),</quote>;</text></clause></subparagraph><subparagraph id="H11FCBA25649A482EA405F5375E6A34CE"><enum>(C)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" id="H9D4DED06688B4673A5A253057FAE12E6" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="H566A504A491049828E26E4AB9F496410" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">In order to ensure that a school building complies with applicable statutes and regulations, carrying out necessary renovations, upgrades, or facilities repairs, or acquiring portable classrooms.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HC77165E54ECA44AA81C9B9F006EC48EC"><enum>(D)</enum><text>in paragraph (4), by striking <quote>one-time, startup</quote>;</text></subparagraph><subparagraph id="H04897BC2E1DE41C28FCBB84949EFE13B"><enum>(E)</enum><text>in paragraph (6), by striking <quote>appropriate, non-sustained</quote>; and</text></subparagraph><subparagraph id="HC33044005FC24FB6B371EFFA4C10A562"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H95EA7A2E73CE434497CA5077B38083B6" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="HC2DA132201F446A4AC97F8F86422FD55"><enum>(7)</enum><text>Providing costs associated with operations and management of the charter school facility.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5BAEF6496666449B8519A5BFF69100A4"><enum>(8)</enum><text>in subsection (i)—</text><subparagraph id="HABCF280A9B544533A04785209D16F45F"><enum>(A)</enum><text>by striking <quote>of the third year</quote>; and</text></subparagraph><subparagraph id="HFEA820A1EA9F4D0398031414C7B4B2C8"><enum>(B)</enum><text>by striking <quote>(or at the end of the second year of the grant period if the grant is less than 5 years), and at the end of such grant period</quote>.</text></subparagraph></paragraph></section><section id="HDB9CFD7F36024D018CB0D36A592260CA"><enum>4.</enum><header>National activities; grants to charter management organizations</header><text display-inline="no-display-inline">Section 4305 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221d">20 U.S.C. 7221d</external-xref>) is amended—</text><paragraph id="H3BC5224041054CFFA8C7C8D0A90201AA"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text><quoted-block style="OLC" id="H91E4866890F74CFDB084E69DC275D913" changed="added" reported-display-style="italic" committee-id="HED00"><subsection id="H41CF9E41B6944E3B8896886A76E60BAF" commented="no"><enum>(a)</enum><header>In general</header><text>From the amount reserved under section 4302(b)(2), the Secretary shall—</text><paragraph id="HEACB30E0489847BDB9D2EE05B0922721" commented="no"><enum>(1)</enum><text>use not more than 10 percent of such funds to—</text><subparagraph id="HE1B6901C02FF4042ACA52C0C169001E4" commented="no"><enum>(A)</enum><text>provide support and technical assistance to—</text><clause id="H85B4A1F996464D80BC43FD1801373150" commented="no"><enum>(i)</enum><text>State entities in awarding subgrants under section 4303(b)(1); and</text></clause><clause id="HD999B905375343698C0FF14E710C5E69" commented="no"><enum>(ii)</enum><text>eligible entities and States receiving grants under section 4304;</text></clause></subparagraph><subparagraph id="H0739E3F18EFC4D5BA21B9E7694AC61B4" commented="no"><enum>(B)</enum><text>disseminate best practices regarding charter schools;</text></subparagraph><subparagraph id="H27209DA133814C1A978DC710CC765A70" commented="no"><enum>(C)</enum><text>increase access to facilities (including funding and financing for facilities) for charter schools;</text></subparagraph><subparagraph id="H1F4B5CDD85B04F5C86D7281CF7A9B0C9" commented="no"><enum>(D)</enum><text>increase the number of available seats in charter schools through early-stage charter school planning;</text></subparagraph><subparagraph id="H18C00728270D42C3BC20283B6D2987EB"><enum>(E)</enum><text>increase the number of available seats in charter schools that—</text><clause id="H0DC2670BF8404221BE55FDA97DB47E77" commented="no"><enum>(i)</enum><text>are located in States that have enacted legislation within a period of 5 years prior to the award of a grant under this section for such purpose; </text></clause><clause id="H706A69B91CE640B994BFDEDE4773D50C" commented="no"><enum>(ii)</enum><text>serve rural students; and</text></clause><clause id="H9418AEB9EFFC415FB3176733A14C9146" commented="no"><enum>(iii)</enum><text>serve students with disabilities; and </text></clause></subparagraph><subparagraph id="H6C5DB6A234CD4E86BAC75576E40F7ABB" commented="no"><enum>(F)</enum><text>evaluate the impact of the charter school program carried out under this part, including with respect to student achievement;</text></subparagraph></paragraph><paragraph id="H8C41CDC93529437E8DF7FA7CF50FBDBC"><enum>(2)</enum><text display-inline="yes-display-inline">use not more than 15 percent of such funds to award grants, on a competitive basis, to eligible applicants for the purpose of carrying out the activities described in section 4303(h) in a State that did not receive a grant under section 4303; and</text></paragraph><paragraph id="HE3B866A0529F4B77BED53F6FFED511E6" commented="no"><enum>(3)</enum><text>after the uses described in paragraphs (1) and (2), use the remainder of such funds to award grants in accordance with subsection (b); and</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H1E8E52D029934DF599953992DC3484E8"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HF27E83C046264DC399CD777D5B773C91"><enum>(A)</enum><text>in paragraph (3)(B)—</text><clause id="HE6A73C8A15424ACFAB1EBAA2E7516FA6"><enum>(i)</enum><text>in clause (ii)—</text><subclause id="HD2FDEE251B364274ABF327D5489587AC"><enum>(I)</enum><text>in subclause (I), by inserting <quote>and</quote> at the end;</text></subclause><subclause id="HA9A6041A18444881ACB387F9BCF7E77E"><enum>(II)</enum><text display-inline="yes-display-inline">in subclause (II), by striking <quote>and</quote> and the end; and</text></subclause><subclause id="H7279382FE7544F7F87C4A41E1EB8B371"><enum>(III)</enum><text>by striking subclause (III); and</text></subclause></clause><clause id="HBC3D9B0A994D4DB7A60EFFCE0522D667"><enum>(ii)</enum><text>in clause (iii), by striking <quote>, which shall include a multi-year financial and operating model for the eligible entity</quote>; and</text></clause></subparagraph><subparagraph id="HAB8E36C1A3FE41AB89E137BC4E2206A5"><enum>(B)</enum><text>in paragraph (5)—</text><clause id="H32A1B9BEB5F94A6F949FE142DA731531"><enum>(i)</enum><text>in subparagraph (C)(ii), by striking <quote>or</quote> at the end;</text></clause><clause id="H1117544301CB4C0E93AAD187C2867A62"><enum>(ii)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; or</quote>; and</text></clause><clause id="H82077AEDE2744E5DB3CD0044C8510BFE"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H4D9914017D044B12A7C09B3B7A61D49D" changed="added" reported-display-style="italic" committee-id="HED00"><subparagraph id="H89A5B373B6FA4D1892EAAB2E94FF27C3"><enum>(E)</enum><text>plan to operate or manage high-quality charter schools in—</text><clause id="H1EB469921F48417D8E96899167B25D14"><enum>(i)</enum><text>States in which, as of the date on which the eligible entity submits an application under paragraph (3), the eligible entity does not operate or manage a charter school; or</text></clause><clause id="H674EF1324B824DC19539CF368A09397F"><enum>(ii)</enum><text>States with limited charter school options.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section><section id="H3B884BC5784C40E3BE691ECF11756A48"><enum>5.</enum><header>Solicitation of input from charter school operators</header><text display-inline="no-display-inline">Section 4307 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221f">20 U.S.C. 7221f</external-xref>) is amended—</text><paragraph id="H949F6CC51EB94D788C590799652953BB"><enum>(1)</enum><text>by striking <quote>To the extent practicable, the Secretary</quote> and inserting <quote>The Secretary</quote>;</text></paragraph><paragraph id="H2788D1ABD16A45F0A236B63C7CC8C81F"><enum>(2)</enum><text>by inserting <quote>, prior to the issuance of a notice of proposed rulemaking,</quote> after <quote>are consulted</quote>; and</text></paragraph><paragraph id="H4365BCFEB2CD4D6A8783FDCC6AE4FD47"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H8D1F5972BBAD427A92BEC10FD7310003" changed="added" reported-display-style="italic" committee-id="HED00"><subsection id="H5AA6F88B37E14B758D08ED75DA858002" commented="no"><enum>(b)</enum><header>Regulation</header><text>In meeting the requirement under subsection (a), the Secretary shall promulgate only such regulations as are necessary for the administration of this part and shall not impose additional nonstatutory requirements on those entities subject to the regulations.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HC3648C0BA8944DB8972061AA51B00A31"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 4310(2)(D) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221i">20 U.S.C. 7221i(2)(D)</external-xref>) is amended by inserting <quote>(which may include other educational programs, pursuant to State law)</quote> after <quote>education</quote>.</text></section><section id="H5B207F068E3147EA9BE29F02C4B4F914"><enum>8.</enum><header>Applicability</header><subsection id="H03F463FFFE1241B3899A8CC2A28A1F90"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">This Act and the amendments made by this Act shall apply with respect to grants awarded under sections 4303 and 4305 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7221b">20 U.S.C. 7221b</external-xref>; 7221d) on or after the date of the enactment of this Act.</text></subsection><subsection id="HC603DAC5DBAA4A7AAC561ACCC02D4D1C"><enum>(b)</enum><header>Exception</header><text>An entity that received a grant under a section described in subsection (a) prior to the date of the enactment of this Act for which the applicable grant period has not expired may elect to, for the remainder of such grant period, carry out such grant in accordance with this Act and the amendments made by this Act.</text></subsection></section></legis-body><endorsement display="yes"><action-date>May 13, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
