R. 7069</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20260114">January 14, 2026</action-date><action-desc><sponsor name-id="M001237">Ms. McDonald Rivet</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to expand benefits to households eligible for Federal and State energy assistance programs, and for other purposes.</official-title></form><legis-body id="HA47EB8554D0049AE9B3D1DFACF5034C2" style="OLC"><section id="HA109E9A9C4254EB9A26EC1F71ED6FA0B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affordable Food and Energy Act of 2026</short-title></quote>.</text></section><section id="H7E274E60E4734418A0ECA2CD91A4D7D4"><enum>2.</enum><header>Household assistance</header><text display-inline="no-display-inline">Section 5 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014</external-xref>) is amended—</text><paragraph id="HE795B373B0744B6AA93F7C4878B690C8"><enum>(1)</enum><text>by amending subsection (e)(6)(C)(iv)(I) to read as follows:</text><quoted-block id="HF132DC24669C4D7CA7576545A1EF1F65" style="OLC"><subclause id="HC878F806A6B9481DB97EE9BA1D1623A1"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), if a State agency elects to use a standard utility allowance that reflects heating and cooling costs, the standard utility allowance shall be made available to households that received a payment, or on behalf of which a payment was made, under the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8621">42 U.S.C. 8621 et seq.</external-xref>) or other similar energy assistance program, if in the current month or in the immediately preceding 12 months, the household either received such a payment, or such a payment was made on behalf of the household, that was greater than $20 annually, as determined by the Secretary.</text></subclause><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph><paragraph id="H2B4B80B0C5B245CDADA0AC4976CB513E"><enum>(2)</enum><text>by amending subsection (k)(4) to read as follows:</text><quoted-block id="H2F378DB05EFC4FC8A474279FFD28AA4D" style="OLC"><paragraph id="H9AC7E89545204262A823B923C809CAD0"><enum>(4)</enum><header>Third party energy assistance payments</header><subparagraph id="H933CB383936641348498B4CFF1BD161B"><enum>(A)</enum><header>Energy assistance payments</header><text>For purposes of subsection (d)(1), a payment made under a State law (other than a law referred to in paragraph (2)(G)) to provide energy assistance to a household shall be considered money payable directly to the household.</text></subparagraph><subparagraph id="H94177776782F4D82B5902F195CA94F40"><enum>(B)</enum><header>Energy assistance expenses</header><text>For purposes of subsection (e)(6), an expense paid on behalf of a household under a State law to provide energy assistance shall be considered an out-of-pocket expense incurred and paid by the household.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H9DD86487727E4AD1B667ADDFD667A63E"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect July 4, 2025.</text></section></legis-body></bill>
