which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 to establish the Reentry Rental Assistance and Housing Services Grant Program, and for other purposes.</official-title></form><legis-body id="HAC04BD03CE9B464FA7643D7454E1657E" style="OLC"><section id="HBE26CC386D5948EA8124672174AF2D44" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Returning Home Act</short-title></quote>.</text></section><section id="HE0E493E9508449FB9D22431C7CD52E73"><enum>2.</enum><header>Reentry Rental Assistance and Housing Services Grant Program</header><text display-inline="no-display-inline">Section 2976 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10631">34 U.S.C. 10631</external-xref>) is amended—</text><paragraph id="H171007975D144ADCBB3008486760DD1C"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text level="section" style="OLC">offender</header-in-text></quote>;</text></paragraph><paragraph id="HEB80859A5F1D4D49B885D806FEF23105"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>offender</quote>;</text></paragraph><paragraph id="HB344A6D6D77D467FBD6FA0395B09815B"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="H367DC661484141A68622A76EF2425AC4"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Offender</header-in-text></quote>;</text></subparagraph><subparagraph id="H0941B9579C8A410A945A3756CA086182"><enum>(B)</enum><text>by striking <quote>offender</quote>;</text></subparagraph><subparagraph id="HD8307BB3B24444D490D68AA2EEACF374" display-inline="no-display-inline"><enum>(C)</enum><text>in paragraph (1)—</text><clause id="H30BB49DD11F44A7FA8B2E9ED9F2AB1F5"><enum>(i)</enum><text>by striking <quote>offenders</quote> and inserting <quote>individuals</quote>; and</text></subparagraph><subparagraph id="H45F55D6742694B1EBB1093A29FFD9E8A"><enum>(B)</enum><text>in paragraph (5), by striking <quote>offenders</quote> and inserting <quote>individuals</quote>.</text></subparagraph></paragraph></section><section id="HD73E10F4CE2A498D81793381D6403DF2"><enum>3.</enum><header>Rental assistance and housing grant</header><text display-inline="no-display-inline">Part FF of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10631">34 U.S.C. 10631 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H1C771289F4304B91859CC2A1EA029750" display-inline="no-display-inline"><section id="H7485D38617C245B4B12E93271486D0B6"><enum>2978.</enum><header>Reentry Rental Assistance and Housing Services Grant Program</header><subsection id="H0315816D78854E3EBF818224B410C882"><enum>(a)</enum><header>Establishment</header><text>The Attorney General shall, in coordination with the Secretary of Housing and Urban Development, establish a program to be known as the <quote>Reentry Rental Assistance and Housing Services Grant Program</quote> to provide grants as provided under this section.</text></subsection><subsection id="HC692C09E006C4A68A320015143405413"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A grant under this section may be used for—</text><paragraph id="H5492D6C49A8B4C959196FEE809A0E0F4"><enum>(1)</enum><text display-inline="yes-display-inline">providing 24 months of rental assistance to an individual who was incarcerated for purposes of paying housing costs at a permanent residence;</text></paragraph><paragraph id="HAAAE5539DE3C407A82E98A462DC642D9"><enum>(2)</enum><text display-inline="yes-display-inline">providing a stipend to a family member of an individual who was incarcerated if the individual lives in the family member’s household; and</text></paragraph><paragraph id="HFEB920DFA3CA4105B6EB05BD7E36664C"><enum>(3)</enum><text display-inline="yes-display-inline">providing supportive services to individuals who are incarcerated or who were incarcerated, including—</text><subparagraph id="H14A5940BDEDC4E5FB56076652841D434"><enum>(A)</enum><text display-inline="yes-display-inline">pre-release planning;</text></subparagraph><subparagraph id="HD323BFAF0B5947798089F7DC111DD2F9"><enum>(B)</enum><text>document collection support;</text></subparagraph><subparagraph id="H10D5D00182C447A5AACCA21FF46CDE79"><enum>(C)</enum><text>housing counseling and location services;</text></subparagraph><subparagraph id="HFED5DA212CD644D28D4F19ACEC3551EE"><enum>(D)</enum><text>system navigation and linkage support to other services, including mental health therapy, program services for victims of domestic violence, program services for victims of sexual assault, substance abuse treatment, education services, and employment services;</text></subparagraph><subparagraph id="HD99FE0AD152D49A7BB7411979388A655" commented="no"><enum>(E)</enum><text>information about home-based services and community-based services;</text></subparagraph><subparagraph id="H677EC93D18634BDA81F9D3541334284D"><enum>(F)</enum><text>case management and addressing criminogenic needs;</text></subparagraph><subparagraph id="HA625C5DFD25B422BA6CD1A14931D41AE"><enum>(G)</enum><text>move-in support and assistance;</text></subparagraph><subparagraph id="HF83C2A57F5EF4CAD8169E81A9959EEC9"><enum>(H)</enum><text>support with security deposits and other leasing fees;</text></subparagraph><subparagraph id="HE2B902EA015645CEAEA57496546C66AF"><enum>(I)</enum><text>housing placement support;</text></subparagraph><subparagraph id="HFF5239B9D4C745A39A427158AEEE7DDA"><enum>(J)</enum><text>housing stabilization support for at least 12 months to help retain housing after placement;</text></subparagraph><subparagraph id="HC18D7F978FD54160966250096EE175CE"><enum>(K)</enum><text>financial incentives to landlords, including payment of holding fees, funds to mitigate property damage, and other incentives to accept tenants who are receiving rental assistance; and</text></subparagraph><subparagraph id="H6E3F7384D7144E40935BA339DA4839DB"><enum>(L)</enum><text>other similar supportive services as determined by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="HEB0CDF4BFAE2499387BA74870EAA9AB2"><enum>(c)</enum><header>Allocation for rental assistance</header><text display-inline="yes-display-inline">A grantee shall use—</text><paragraph id="H68699995ABE84AB789CA63FECD93B979"><enum>(1)</enum><text>not less than 60 percent of the grant funding for rental assistance described under subsection (b)(2); and</text></paragraph><paragraph id="HEFACF07B2F1F40328699D46F548F574A"><enum>(2)</enum><text>not more than 15 percent of grant funding for financial incentives to landlords described under subsection (b)(3)(K).</text></paragraph></subsection><subsection id="H3463DD39C3B64A43A5F29D61C2B6D37C"><enum>(d)</enum><header>Application requirements</header><paragraph id="H0BD5AC10751F44E287FAAD3603CD809D"><enum>(1)</enum><header>Application</header><subparagraph id="HEE8425793D63475AB6629486593460E9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible applicant seeking a grant under this section shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General may require.</text></subparagraph><subparagraph id="HE2CEF63A509F4007A776F2DFDE26DED9"><enum>(B)</enum><header>Eligible applicant</header><text display-inline="yes-display-inline">For purposes of this paragraph, an eligible applicant is—</text><clause id="H920B6389DF2F4AC1A324F446332BA346"><enum>(i)</enum><text>an eligible entity;</text></clause><clause id="H346F393A983B49F9ABE0E4AB45C9CF02"><enum>(ii)</enum><text>a nonprofit organization or service provider in partnership with an eligible entity; or</text></clause><clause id="H7077016926394CBFB495E8218BB29E8A"><enum>(iii)</enum><text display-inline="yes-display-inline">a nonprofit organization or service provider in partnership with—</text><subclause id="H1FBEBF9D8AF646C7B0FAB749F8DC2E93"><enum>(I)</enum><text>a collaborative applicant or other entity funded under the Continuum of Care program under subtitle IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11381">42 U.S.C. 11381 et seq.</external-xref>);</text></subclause><subclause id="HEDDA7C2FC7CE4187BA475996F7936B43" commented="no"><enum>(II)</enum><text>a protection and advocacy system (as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>));</text></subclause><subclause id="H5F2865C5303542CA99994A6B14BF3352" commented="no"><enum>(III)</enum><text>a client assistance program (as described in section 112 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/732">29 U.S.C. 732</external-xref>)); or</text></subclause><subclause id="HE986093673464BFAB354BFA9C5FD9E67" commented="no"><enum>(IV)</enum><text>a center for independent living (as defined in section 702 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796a">29 U.S.C. 796a</external-xref>)).</text></subclause></clause></subparagraph></paragraph><paragraph id="HED831E4129EF48E6995D3782828180C9"><enum>(2)</enum><header>Program proposal</header><text display-inline="yes-display-inline">The Attorney General may make a grant under this section to an applicant only if the applicant submits a proposed program that will benefit—</text><subparagraph id="H56D1EEE4B1C44D7DA95A398EC4DA72A6"><enum>(A)</enum><text display-inline="yes-display-inline">individuals who are incarcerated in a prison, jail, juvenile facility, or halfway house who are not more than 365 days from their release date and are at risk of becoming homeless or exiting into housing insecurity;</text></subparagraph><subparagraph id="H84AB4B6C001C48758180A925F396E30B"><enum>(B)</enum><text display-inline="yes-display-inline">individuals experiencing homelessness while under parole or supervised release from a prison, jail, juvenile facility, or halfway house; or</text></subparagraph><subparagraph id="H15CDB9E69C37434E81B98549524DA432"><enum>(C)</enum><text display-inline="yes-display-inline">individuals experiencing homelessness or housing insecurity and who were discharged from a prison, jail, juvenile facility, or halfway house.</text></subparagraph></paragraph><paragraph id="H904C1FCB80514260A233BD13F9775528"><enum>(3)</enum><header>Priority considerations</header><text display-inline="yes-display-inline">The Attorney General shall prioritize grants—</text><subparagraph id="H621E15FE6D4E4B72865FA000D64750AE"><enum>(B)</enum><text>to an applicant that implements a housing first approach which includes low-barrier screening criteria for determining which individuals receive assistance under the program; and</text></subparagraph><subparagraph id="H39A05A243DD24C2C9D022891476C0FE8"><enum>(C)</enum><text display-inline="yes-display-inline">to an applicant that implements a program to serve a population that, when compared to the general population, is at a disproportionate risk of incarceration and that experiences a disproportionate rate of homelessness.</text></subparagraph></paragraph><paragraph id="H1660DB86E8EF41DBB78C977DE3248D1D"><enum>(4)</enum><header>Prohibition on grants to law enforcement</header><text display-inline="yes-display-inline">The Attorney General may not provide a grant under this section to a law enforcement entity, including an entity that employs probation officers.</text></paragraph></subsection><subsection id="H25A67B58BC074489B2F5BD95E201C96B"><enum>(e)</enum><header>Denial notification requirements</header><paragraph id="H406AF7947533401D954BEE44DDD1173E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A grantee under this section shall notify individuals who apply for and are denied support from programs funded with such grants about—</text><subparagraph id="HABFED742959942A193A49659DA7579C8"><enum>(A)</enum><text>the denial;</text></subparagraph><subparagraph id="HDEF73A38F1A74837AC60EAD7930B81C3"><enum>(B)</enum><text>the reason for the denial; and</text></subparagraph><subparagraph id="H230F93AC6F2C4FCB8F223128797095F4"><enum>(C)</enum><text display-inline="yes-display-inline">supportive services (including housing counseling) and free legal resources.</text></subparagraph></paragraph><paragraph id="H0E2E9047AE7F42E18DBC46DEAFCCB3D4"><enum>(2)</enum><header>Timing</header><text>Such notifications shall be sent to the individual within 15 days after denial.</text></paragraph></subsection><subsection id="HBF1AFFC720EB4316B18DB643C2577993" commented="no"><enum>(f)</enum><header>Accessibility requirements</header><text>A grantee under this section shall ensure that information regarding the programs and support services that the grantee offers and that are funded with such grants is made available—</text><paragraph id="HB72F6BDE80014101B5D065E429897142" commented="no"><enum>(1)</enum><text>in a manner that uses simple, plain language and is reader friendly; and</text></paragraph><paragraph id="H83AF94E13C26488F8C71551C92303AB5" commented="no"><enum>(2)</enum><text>in a form that is accessible to individuals with disabilities.</text></paragraph></subsection><subsection id="H6EC692C040454751BA7E5EF3A9B589D2"><enum>(g)</enum><header>Evaluation</header><text>Not later than 2 years after the date of enactment of this section, the Attorney General shall evaluate the efficacy of the grant awarded under this section in improving outcomes for previously incarcerated individuals.</text></subsection><subsection id="HB59C403F47724D50AEBBDD74454702D7"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated $100,000,000 for each fiscal year to carry out this section.</text></subsection><subsection id="H2B4F48BAE8C54618BA2C0DB388383EF8"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HB40727D604944A74B7189278C0ED0FE3" commented="no"><enum>(1)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given to such term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph><paragraph id="H639A9C3F1A994FFDA2CCAB73FDACA67B"><enum>(2)</enum><header>Housing costs</header><text>The term <term>housing costs</term> includes rent, utilities, security deposits, application fees, and other similar expenses as determined by the Attorney General, in consultation with the Secretary.</text></paragraph><paragraph id="H847AA7420B29447183E32ACE79564E7B"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
