<subsection id="HE072C526C98F4E158182B8F15EECB378"><enum>(b)</enum><header>Restrictions</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/131">Chapter 131</external-xref> of title 5, United States Code, is amended by adding at the end a new subchapter:</text> <quoted-block style="USC" display-inline="no-display-inline" id="HFD5D4BC84BBF49B1AF8BD8E0DC9074E9"> <subchapter id="HE8B0EED21BA44778B484F27A59D404AA"><enum>IV</enum><header>Restrictions on covered investments</header> <section id="HFF91296961D5415992D5E4E9C8288A28"><enum>13151.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text>
<paragraph id="H8B6B911544B04F7EB6269D3ED22ABE91"><enum>(1)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means any of the following:</text> <subparagraph id="H0892AFC884D14E4CA380EF835A2DF090" commented="no"><enum>(A)</enum><text>A Member of Congress, as defined in section 13101.</text></subparagraph>
<subparagraph id="H2031429AD0FB45D7BA79136F4F5864EF" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">A dependent child (as defined in section 13101) or a spouse of a Member of Congress.</text></subparagraph></paragraph> <paragraph id="HB05D6BDF9862479CB00BB0423D902286"><enum>(2)</enum><header>Covered investment</header> <subparagraph id="HC12168395F7F4206B0B732A891C8AD75"><enum>(A)</enum><header>In general</header><text>The term <term>covered investment</term> means a security issued by a publicly traded company or any comparable economic interest acquired through synthetic means, such as the use of a derivative, including an option, warrant, or other similar means.</text></subparagraph>
<subparagraph id="HEAFE4A0F6A0C48588472B5925CDCBACA"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered investment</term> does not include—</text> <clause id="HE9925CFC9DB54BFB9AB3D177B28C11E2"><enum>(i)</enum><text>an excepted investment fund (as described in section 13104(f)(8));</text></clause>
<clause id="H9B7618ACDF7F485589E6CA01986A7236"><enum>(ii)</enum><text display-inline="yes-display-inline">any other fund that would be an excepted investment fund but for the fact that the fund does not meet the diversification requirement solely because the fund is concentrated in—</text> <subclause id="HA258ED18C0B64D44B00FAC78F38AD21D"><enum>(I)</enum><text>the United States; or</text></subclause>
<subclause id="H3DFA7D081C8A4E79859980A14A49086F"><enum>(II)</enum><text>the State, territory, or District of residence of the covered individual who owns the fund;</text></subclause></clause> <clause id="H9BAF3AD3B7FD4B2A92232C8D4EDE7650" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">an interest in a small business concern as defined under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>); or</text></clause>
<clause id="H566B47CE53EF4F8BB45641136FFDFB0A"><enum>(iv)</enum><text display-inline="yes-display-inline">investments held in a trust if no covered individual has any authority over a trustee of the trust, including the authority to appoint, replace, or direct the actions of such a trustee, and the trustee is not the spouse, child, parent, or sibling of a Member of Congress.</text></clause></subparagraph></paragraph> <paragraph id="H106048EBA4084E459132BF74551C51B3"><enum>(3)</enum><header>Publicly traded company</header><text display-inline="yes-display-inline">The term <term>publicly traded company</term> means an issuer that has a class of securities registered under section 12 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78l">15 U.S.C. 78l</external-xref>).</text></paragraph>
<paragraph id="HA70D26AF2EC64A9C9A5CD740021A99C5" display-inline="no-display-inline"><enum>(4)</enum><header>Security</header><text>The term <term>security</term> has the meaning given the term in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>).</text></paragraph> <paragraph id="H6229C5F3C1884189BE122625D8A84962"><enum>(5)</enum><header>Supervising ethics office</header><text>The term <term>supervising ethics office</term> has the meaning given the term in section 13101.</text></paragraph></section>
<section id="H589B7FDBB57D47B99239CB58CEA5B33B"><enum>13152.</enum><header>Restrictions on covered investments</header>
<subsection id="H4A03D7575DBD43CCB1790FE3F4AC691E" display-inline="no-display-inline"><enum>(a)</enum><header>Conduct during federal service</header><text>Except as described in subsection (c), no covered individual may purchase a covered investment.</text></subsection> <subsection id="HC17E56230AB641DCA1E23F6ED88A247B"><enum>(b)</enum><header>Advanced notice requirement</header> <paragraph id="HF0D66608BA764ED987352F32C0538A54"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No covered individual shall sell a covered investment, unless a notice of intent to sell the covered investment is made by the Member of Congress and publicly disclosed at least 7 calendar days, and no more than 14 calendar days, prior to the sale in accordance with the requirements of this subsection.</text></paragraph>
<paragraph id="HC3D748F84815462A83B8E916B02EBA1F"><enum>(2)</enum><header>Contents of notice</header><text>The notice under paragraph (1) shall include the following:</text> <subparagraph id="H77033431735A47FE9F93C91FAB6AB132"><enum>(A)</enum><text>The projected date of sale of a covered investment.</text></subparagraph>
<subparagraph id="H0241B8F361F544E894D7585DFD2D7E02"><enum>(B)</enum><text>A description of such sale.</text></subparagraph> <subparagraph id="HC3D045EEAFBD471B99F91880CC264D24"><enum>(C)</enum><text>The number of shares in such sale.</text></subparagraph></paragraph>
<paragraph id="HF897B0838A8D41E7ACC5137A71E68178" commented="no"><enum>(3)</enum><header>Withdrawal</header><text display-inline="yes-display-inline">The notice under paragraph (1) shall be withdrawn by the Member of Congress who filed it, prior to the close of the expiration of the notice, if the covered individual determines not to sell the covered investment.</text></paragraph> <paragraph id="HA8C85B454B6745E8B06C3A9730F76560"><enum>(4)</enum><header>Filing</header><text display-inline="yes-display-inline">A Member of Congress shall file the notice under paragraph (1) for each intended sale by the Member, or the spouse or dependent child of the Member, with—</text>
<subparagraph id="H7855708FC4F44D5AA405657C71E62939"><enum>(A)</enum><text>the Clerk of the House of Representatives, in the case of a Representative in Congress, a Delegate to Congress, or the Resident Commissioner from Puerto Rico; or</text></subparagraph> <subparagraph id="H4610C43E6E2346FA92789F5B2180400F"><enum>(B)</enum><text>the Secretary of the Senate, in the case of a Senator.</text></subparagraph></paragraph>
<paragraph id="H26D9356821B34008879C33E3498A2BDD"><enum>(5)</enum><header>Publication</header><text display-inline="yes-display-inline">The notice under paragraph (1) and the withdrawal under paragraph (3) shall, upon receipt, be made publicly available on a website controlled by the Clerk of the House of Representatives or the Secretary of the Senate, as applicable.</text></paragraph></subsection> <subsection id="H1F13DC2EF54E4B138A9AC425883CB48A"><enum>(c)</enum><header>Exceptions</header> <paragraph id="H187557C9A55149F5994A8B1F1753F3A6" commented="no"><enum>(1)</enum><header>Occupational exception</header><text display-inline="yes-display-inline">Notwithstanding subsections (a) and (b), a spouse or dependent child of a Member of Congress may trade any covered investment if such covered investment is—</text>
<subparagraph id="H3BDFE76A6854435D88744DCFCA458A8C"><enum>(A)</enum><text>not owned by a covered individual and if such trade is performed as a function of the primary occupation of the spouse or dependent child; or</text></subparagraph> <subparagraph id="H6BE50EFE2BA8452B8F859321AAEA56E3"><enum>(B)</enum><text display-inline="yes-display-inline"> made as a part of compensation from an employer of such individual or in furtherance of any fiduciary or occupational obligations of such individual.</text></subparagraph></paragraph>
<paragraph id="H96756F02BD194B50AD2872ECA13728F0" commented="no"><enum>(2)</enum><header>Dividend reinvestments exception</header><text display-inline="yes-display-inline">The requirements of subsection (a) shall not apply to a covered individual with respect to a transaction for the purpose of reinvesting dividends received from a covered investment into the same covered investment automatically or without delay.</text></paragraph></subsection></section> <section id="HB78B25AFB58C4914A65240EBFCC1BE7E"><enum>13153.</enum><header>Enforcement</header> <subsection id="HDBFA9C43253044BBB7291B58140497AE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any covered individual who violates the restrictions in section 13152 with respect to a covered investment, shall, at the direction of the supervising ethics office—</text>
<paragraph id="H7CF2E7E3C9DB48FD934808671FBA1409"><enum>(1)</enum><text>incur a fee, as calculated in subsection (b), to be paid by the Member of Congress who—</text> <subparagraph id="H33AC09BE460840E3A5FBB60925849FF2"><enum>(A)</enum><text>caused the violation; or</text></subparagraph>
<subparagraph id="H83C915C628CC4F418BEDBFEB1D1070C8"><enum>(B)</enum><text>is the spouse or parent of a covered individual who caused the violation; and</text></subparagraph></paragraph> <paragraph id="H57B304662BE94D38AA2E607C1B5C1AC4"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a purchase of a covered investment, be required to sell a covered investment purchased in violation of section 13152(a).</text></paragraph></subsection>
<subsection id="H380E8236DFF641E98D4576263F269918" commented="no"><enum>(b)</enum><header>Calculation of fees</header><text display-inline="yes-display-inline">The fee required under subsection (a) shall be equal to the sum of—</text> <paragraph id="HEFBDE8D57E8B4B0094F3F6E7017569FC"><enum>(1)</enum><text display-inline="yes-display-inline">$2,000 or ten percent of the value of the transaction in the covered investment which violates section 13152, whichever is greater; and</text></paragraph>
<paragraph id="H30A414A536294687B56D3D55019B0204"><enum>(2)</enum><text>the net gain realized, if any, from the covered investment during the period beginning on the most recent date on which the individual became a covered individual and ending on the date of disposition of the covered investment, as determined by the supervising ethics office.</text></paragraph></subsection> <subsection id="H215E6FA18F0742BFAA174FA41A884582"><enum>(c)</enum><header>Payment restrictions</header><text display-inline="yes-display-inline">A Member of Congress may not pay any of the fees under this section by using amounts from the following sources:</text>
<paragraph id="H1153681A7E914C6EA63F2C8F09EDBC58"><enum>(1)</enum><text>The Members’ Representational Allowance.</text></paragraph> <paragraph id="H0F4DD42E216C4E8BB68F0D588A4FFBC4"><enum>(2)</enum><text display-inline="yes-display-inline">The Senators’ Official Personnel and Office Expense Account.</text></paragraph>
<paragraph id="HCEA3012E5FC149D28676D07D058ECAEA"><enum>(3)</enum><text display-inline="yes-display-inline">Any contribution (as defined in section 301(8) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101(8)</external-xref>)) accepted as a candidate, and any other donation received as support for activities of the individual as a holder of Federal office.</text></paragraph></subsection> <subsection id="H58FDA291A5494CAAB66C158D25E3ABDF"><enum>(d)</enum><header>Miscellaneous receipts</header><text display-inline="yes-display-inline">Any amounts collected in fees authorized by this section shall be deposited in the general fund of the Treasury as miscellaneous receipts in accordance with section 3302(b) of title 31.</text></subsection>
<subsection id="HD0D6A2A9C7704C81AAA82529FA82F052"><enum>(e)</enum><header>Referral</header><text display-inline="yes-display-inline">The supervising ethics office has the authority to refer a former Member of Congress to the Department of Justice and section 13106 shall be applied in the same manner and to the same extent as a violation under such section if such former Member resigns or retires before paying the fee under this section.</text></subsection> <subsection id="H0F7AE4889886492585D296A59689808C"><enum>(f)</enum><header>Interpretative guidance</header><text>Each supervising ethics office may issue interpretative guidance on this subchapter and in issuing such guidance, may consider mitigating or aggravating circumstances.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H3AC2EAD14B2345EBBF62B979C54DFB47" display-inline="no-display-inline" commented="no"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section and the amendments made by this section shall take effect on the date that is 180 days after the date of enactment of this Act.</text></subsection></section> <section id="H65F75FB58ADD4C81AF5DE6B13BDBF36E" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Requiring voters to provide photo identification</header> <subsection id="H2736FFCE8A324DFEA53EB54C88568001"><enum>(a)</enum><header>Requirement to provide photo identification as condition of casting ballot</header> <paragraph id="H8EF4D6FD628445D9B8D60CD5F7888059"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081 et seq.</external-xref>) is amended by inserting after section 303 the following new section:</text>

<section id="HECD2B9C003CB4EAA9D6E38B166F8AB14"><enum>303A.</enum><header>Photo identification requirements</header>
<subsection id="H5E421B0D9D2941B3B40CE8776C75ADCA"><enum>(a)</enum><header>Provision of identification required as condition of casting ballot</header>
<paragraph id="H31C70CE2E42C4BC08695ACABE271D950"><enum>(1)</enum><header>Individuals voting in person</header>
<subparagraph id="HC1C9B6783E5F495BB5B954586772A740"><enum>(A)</enum><header>Requirement to provide identification</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and except as provided in subparagraph (B), the appropriate State or local election official may not provide a ballot for an election for Federal office to an individual who desires to vote in person unless the individual presents to the official a valid physical photo identification.</text></subparagraph> <subparagraph id="H53BB8D24BC03412FA9EEB2EDE073214C"><enum>(B)</enum><header>Availability of provisional ballot</header> <clause id="HF0B3745631F64890BC7038FF43C4994F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If an individual does not present the identification required under subparagraph (A), the individual shall be permitted to cast a provisional ballot with respect to the election under section 302(a), except that the appropriate State or local election official may not make a determination under section 302(a)(4) that the individual is eligible under State law to vote in the election unless, not later than 3 days after casting the provisional ballot, the individual presents to the official—</text>
<subclause id="H1B76258CE13F49138F297D6D141A4C87"><enum>(I)</enum><text>the identification required under subparagraph (A); or</text></subclause> <subclause id="H33B67A8DB587428C831169520A999215"><enum>(II)</enum><text>an affidavit developed and made available to the individual by the State attesting that the individual does not possess the identification required under subparagraph (A) because the individual has a religious objection to being photographed.</text></subclause></clause>
<clause id="H2C92F0AE89104103961D8A0A4ACDCE3E"><enum>(ii)</enum><header>No effect on other provisional balloting rules</header><text>Nothing in clause (i) may be construed to apply to the casting of a provisional ballot pursuant to section 302(a) or any State law for reasons other than the failure to present the identification required under subparagraph (A).</text></clause></subparagraph></paragraph> <paragraph id="H8D6CAF760DB44FE8B5F64C8532EE78BE"><enum>(2)</enum><header>Individuals voting other than in person</header> <subparagraph id="H8BBC423C527B4C478A30948F964FC188"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and except as provided in subparagraph (B), the appropriate State or local election official may not accept any ballot for an election for Federal office provided by an individual who votes other than in person unless the individual—</text>
<clause id="H7BEC01A31F864C4FA37A1366FF6AF2B8"><enum>(i)</enum><text>submits with the ballot a copy of a valid photo identification; </text></clause> <clause id="HF00E97F6B75E4977A8195BE1C1F44D65"><enum>(ii)</enum><text display-inline="yes-display-inline">submits with the ballot the last four digits of the individual’s Social Security number and an affidavit developed and made available to the individual by the State attesting that the individual is unable to obtain a copy of a valid photo identification after making reasonable efforts to obtain such a copy; or</text></clause>
<clause id="H2130E0571A2F4DA2A7908ABF13761F3D"><enum>(iii)</enum><text display-inline="yes-display-inline">includes a notarization by a notary public attesting that the individual has personally marked the ballot.</text></clause></subparagraph> <subparagraph id="HF374D21B119F4F55BBAE2AF8A76FAA96" display-inline="no-display-inline"><enum>(B)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subparagraph (A) does not apply with respect to a ballot provided by—</text>
<clause id="HE4720524F8D94DAAAD82FE07789D513E"><enum>(i)</enum><text display-inline="yes-display-inline">an absent uniformed services voter, as defined in section 107(1) of the Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20310">52 U.S.C. 20310(1)</external-xref>); or</text></clause> <clause id="H262A81E59CBB4059BF43D632783BA96C"><enum>(ii)</enum><text>an individual provided the right to vote otherwise than in person under section 3(b)(2)(B)(ii) of the Voting Accessibility for the Elderly and Handicapped Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20102">52 U.S.C. 20102(b)(2)(B)(ii)</external-xref>).</text></clause></subparagraph></paragraph></subsection>
<subsection id="H3B4E1AEA3B8E4E158C7B51C360A39032"><enum>(b)</enum><header>Providing public access to digital imaging devices</header><text display-inline="yes-display-inline">With respect to each State, the appropriate State or local government official of the State shall ensure, to the extent practicable, public access to a digital imaging device, which shall include a printer, copier, image scanner, or multifunction machine, at State and local government buildings in the State, including courts, libraries, and police stations, for the purpose of allowing individuals to use such a device at no cost to the individual to make a copy of a valid photo identification. </text></subsection> <subsection id="H1344F31347B94AF1ADDF1897B9B388D8"><enum>(c)</enum><header>Notification of identification requirement to applicants for voter registration</header> <paragraph id="H6FF7E1D83F2B4411B00A7644304C2016"><enum>(1)</enum><header>In general</header><text>Each State shall ensure that, at the time an individual applies to register to vote in elections for Federal office in the State, the appropriate State or local election official notifies the individual of the photo identification requirements of this section.</text></paragraph>
<paragraph id="H9D43A5D63D4F4FC7A4518BF45ED6A4BA"><enum>(2)</enum><header>Special rule for individuals applying to register to vote online</header><text>Each State shall ensure that, in the case of an individual who applies to register to vote in elections for Federal office in the State online, the online voter registration system notifies the individual of the photo identification requirements of this section before the individual completes the online registration process.</text></paragraph></subsection> <subsection id="HF789DFBC900F4E1CA45C92E9A748F4F4"><enum>(d)</enum><header>Valid photo identification defined</header><text display-inline="yes-display-inline">For purposes of this section, a <quote>valid photo identification</quote> means, with respect to an individual who seeks to vote in an election for Federal office, any of the following:</text>
<paragraph id="HB6001C83D85544E1BF622459BC349D12"><enum>(1)</enum><text display-inline="yes-display-inline">A valid State-issued motor vehicle driver’s license that includes a photo of the individual and an expiration date.</text></paragraph> <paragraph id="HC2FCF1D5A79B46D392CF1FA791F25780"><enum>(2)</enum><text>A valid State-issued identification card that includes a photo of the individual and an expiration date issued by a State motor vehicle authority.</text></paragraph>
<paragraph id="H5E4DA83BE9E542FBAA82EB922A3B38DD"><enum>(3)</enum><text>A valid United States passport for the individual.</text></paragraph> <paragraph id="H9D74EF2F719248D3B27D7AE55D58F3F6"><enum>(4)</enum><text display-inline="yes-display-inline">A valid photo identification card for the individual issued by the Department of Defense or the Department of Veterans Affairs.</text></paragraph>
<paragraph id="HF6BEA6FD9D47423EA11A6AE2CA2A5797"><enum>(5)</enum><text display-inline="yes-display-inline">A valid identification document issued by a Tribal government that includes a photo of the individual and an expiration date. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HAEC97893175C4A27B52AC52170051200"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 303 the following new item:</text>

<subsection id="HFF47364C2B8E4AB78678ACDAEFB8D307"><enum>(b)</enum><header>Conforming amendment relating to voluntary guidance by Election Assistance Commission</header><text>Section 311(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21101">52 U.S.C. 21101(b)</external-xref>) is amended—</text> <paragraph id="H7D2D36F8A2524A17925F06E737BF3FAF"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (2);</text></paragraph>
<paragraph id="H0053EEC0E68642FBB729905A824BD28C"><enum>(2)</enum><text>by striking the period at the end of paragraph (3) and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="HB441A75296D34CE988ECF8321964485D"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HB4538F88761240D1B005B449F64C91E5" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of the recommendations with respect to section 303A, the date that is 90 days after the date of the enactment of this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6E52EDBEA6824F4BB1281053D53A026F"><enum>(c)</enum><header>Conforming amendment relating to enforcement</header><text display-inline="yes-display-inline">Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>) is amended by striking <quote>sections 301, 302, 303, and 304</quote> and inserting <quote>subtitle A of title III</quote>.</text></subsection>
