<section id="HFE4B22D49C1C46AB869980A74C895EFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Thomas M. Conway Veterans Access to Resources in the Workplace Act</short-title></quote>.</text></section> <section id="H19DC0A85A00A44EB91CDF8D45809A3D4"><enum>2.</enum><header>Display of veterans benefits notice</header> <subsection id="H7EAE0DD93E1D4E6D9C5ED68B64333531"><enum>(a)</enum><header>Display requirement</header><text>Each employer shall post and keep posted, in conspicuous places on the premises of the employer where notices to employees and applicants for employment are customarily posted, the notice developed under subsection (b) for the State in which such premises is located.</text></subsection>
<subsection id="H761D80689E6749E1B3D17C4871C63DC4"><enum>(b)</enum><header>Notice</header>
<paragraph id="HF9481BBB326E4EDA9FBF9570B507FD59"><enum>(1)</enum><header>In general</header>
<subparagraph id="H7254CD2B90F44BF8B393E2D1CE83838B"><enum>(A)</enum><header>Development; publication</header>
<clause commented="no" display-inline="no-display-inline" id="H816E89CDBFC2456890EDC507421B0EE9"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Secretary of Labor (acting through the Veterans' Employment and Training Service), in coordination with the Secretary of Veterans Affairs (in consultation with the Veterans Experience Office), shall develop and publish a notice for each State detailing benefits for veterans under the laws administered by such Secretaries.</text></clause> <clause commented="no" display-inline="no-display-inline" id="HEA19A43694EE48B68FAD9A2B82FD3974"><enum>(ii)</enum><header>Benefits under State law</header><text display-inline="yes-display-inline">The Secretary of Labor shall ensure that each State is given a 45-day period to provide information on benefits for veterans under State law to be included in the notice for such State.</text></clause></subparagraph>
<subparagraph id="H09715B25EBEC48A2B677A9410DF2A4F4"><enum>(B)</enum><header>Review</header>
<clause commented="no" display-inline="no-display-inline" id="H59CD85F788D34C3E89B58F42954C61C2"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not less frequently than twice each year, the Secretary of Labor, in coordination with the Secretary of Veterans Affairs, shall review, and update as necessary, each notice developed under this paragraph.</text></clause> <clause commented="no" display-inline="no-display-inline" id="H3CCF763E8669470E90DF3D0AFDCD1457"><enum>(ii)</enum><header>State updates</header><text display-inline="yes-display-inline">In carrying out clause (i), the Secretary of Labor shall ensure that each State is given the opportunity to update the information included in the notice for such State.</text></clause></subparagraph></paragraph>
<paragraph id="H26267172EAEF48FCAC32E9666DD7ACB0"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each notice developed under paragraph (1) shall at a minimum include information on the following:</text> <subparagraph id="HF4570E39F5364AFB9E60F169808BCC3D"><enum>(A)</enum><text>The Veterans Crisis Line.</text></subparagraph>
<subparagraph id="H23B9F402B2E548C9ADD059C0549832BD"><enum>(B)</enum><text>How to apply for the benefits described in paragraph (1)(A).</text></subparagraph> <subparagraph id="H0A475EA124954F7191A6592960CF136F"><enum>(C)</enum><text display-inline="yes-display-inline">Information on benefits for veterans under the law of the applicable State, if the State provides such information as described in paragraph (1).</text></subparagraph></paragraph>
<paragraph id="HD6DF90B7203640699D4205A1738EB322"><enum>(3)</enum><header>Publication; design</header><text display-inline="yes-display-inline">Each notice developed under paragraph (1) shall be—</text> <subparagraph id="HD09D3AAF7C1B41E8B6F037315DEADB1E"><enum>(A)</enum><text>made publicly available on the websites of the Department of Labor and the Department of Veterans Affairs; and</text></subparagraph>
<subparagraph id="H746D8A96693641D3BBD263187A891FB0"><enum>(B)</enum><text display-inline="yes-display-inline">designed to be published on an 8.5 inch by 11 inch sheet of paper.</text></subparagraph></paragraph></subsection> <subsection id="H5570194AA1D941268EB16E160D6A23EB"><enum>(c)</enum><header>Information campaign</header><text>During the 180-day period beginning on the date of the enactment of this Act, the Secretary of Labor, in coordination with the Secretary of Veterans Affairs, shall conduct an information campaign to inform employers of—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HAEFE963834A34CA5867DA60BA7C322AA"><enum>(1)</enum><text display-inline="yes-display-inline">the notices developed under subsection (b); and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB4D6DC1E1DE549BD9E9409E2FE12D96A"><enum>(2)</enum><text display-inline="yes-display-inline">the requirement to display the notice under subsection (a).</text></paragraph></subsection>
<subsection id="HFC82CEF756EA43B18F056ADA107FD8E6" commented="no"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="H7A410717180C4DE2B77ACA2A33170012"><enum>(1)</enum><header>Employee; person</header><text display-inline="yes-display-inline">The terms <term>employee</term> and <term>person</term> have the meanings given those terms in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text></paragraph>
<paragraph id="HB522344E08514000B20A9A482EA03EA7"><enum>(2)</enum><header>Employer</header>
<subparagraph id="HD3B09F6B83CB4A66840B9DFF1705F409"><enum>(A)</enum><header>In general</header><text>The term <term>employer</term>—</text> <clause id="H8D5BFBA21E4A43D4B7AED478DCDC2551"><enum>(i)</enum><text>means any person engaged in commerce or in any industry or activity affecting commerce who employs 50 or more employees for each working day during each of 20 or more calendar workweeks in the current or preceding calendar year; and</text></clause>
<clause id="H0F3FFEB131754DB884085871251221FE"><enum>(ii)</enum><text>includes—</text> <subclause id="H31010330B1E24008A7A285B277C8AE37"><enum>(I)</enum><text>any person who acts, directly or indirectly, in the interest of an employer to any of the employees of such employer;</text></subclause>
<subclause id="HC3DF1DF2D27A468596F556E4D386999D"><enum>(II)</enum><text>any successor in interest of an employer;</text></subclause> <subclause id="H7B0B60987E7242D2BDB288593C4470F5"><enum>(III)</enum><text>any public agency (as defined in section 3(x) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(x)</external-xref>));</text></subclause>
<subclause id="HC389A5D1DF874D39A983B7BDD84B36AF"><enum>(IV)</enum><text>the Government Accountability Office; and</text></subclause> <subclause commented="no" display-inline="no-display-inline" id="H3003516E797B44D39117D2770E4C23A9"><enum>(V)</enum><text display-inline="yes-display-inline">the Library of Congress.</text></subclause></clause></subparagraph>
<subparagraph id="H10E1F2E0846E40B0806E2F3FCEC4048C"><enum>(B)</enum><header>Public agency</header><text>For purposes of subparagraph (A)(ii)(III), a public agency shall be considered to be a person engaged in commerce or in an industry or activity affecting commerce.</text></subparagraph></paragraph> <paragraph id="H01D63A4794EE4A1D93F5FA41C2DC588B"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> includes each of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands.</text></paragraph></subsection>
<subsection id="HBD493D1CF2D345348DA09FF7EF37BA38"><enum>(e)</enum><header>Effective dates</header>
<paragraph id="HA692DECFB4EA4A07B8A690C5F328A3DB"><enum>(1)</enum><header>In general</header><text>Except as specified in paragraph (2), the provisions of this Act shall take effect on the date of the enactment of this Act.</text></paragraph> <paragraph id="HC6B0F0BC387A417C8B5C2A11509F0B87"><enum>(2)</enum><header>Effective date for display requirement</header><text display-inline="yes-display-inline">Subsection (a) shall take effect on the date that is one year after the date of the enactment of this Act.</text></paragraph></subsection></section>
