<section id="HCE167834D7B843D58A25335D3DAA1785" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Unfair Medicaid Recoveries Act</short-title></quote>.</text></section> <section id="HA0045AD8837744829F8264469BF9EEA3"><enum>2.</enum><header>Liens, adjustments, and recoveries for medical assistance</header> <subsection id="H237758271FFD44E38A70958E11B7B298"><enum>(a)</enum><header>Liens</header><text display-inline="yes-display-inline">Section 1917(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396p">42 U.S.C. 1396p(a)</external-xref>) is amended—</text> 
<paragraph id="HAD0F5377A3A44D67BC98C48646E7F45F"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="H460E830EE9314801A0096D66AE73C158"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>plan, except—</quote> and inserting <quote>plan, except, subject to paragraph (4)—</quote>; and</text></subparagraph> 
<subparagraph id="H72E397C8AF7148E691D02F0A42C4BF7D"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>in the case of</quote> and inserting <quote>with respect to liens imposed before the date of the enactment of the Stop Unfair Medicaid Recoveries Act, in the case of</quote>; and</text></subparagraph></paragraph> <paragraph id="H40EBAF8C09F7426CB31A95D3142ED276"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HB9479D9C271E49398B1823324E0DFE91" display-inline="no-display-inline"> 
<paragraph id="H8EA8A9A642C34F7CBF002E55F996C0F2" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Notwithstanding any preceding provision of this subsection, not later than 90 days after the date of the enactment of this paragraph, a State shall—</text> <subparagraph id="HED1B6029665C4BAAAD5D8643569B8F01"><enum>(A)</enum><text>withdraw any lien imposed under paragraph (1)(B) that is in effect as of such date; and</text></subparagraph> 
<subparagraph id="H47F17D8E9DB54C288498591D73120466"><enum>(B)</enum><text display-inline="yes-display-inline">notify each individual (or legal representative of such individual (or of such individual’s estate)) subject to such a lien so withdrawn of the withdrawal of such lien.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HA71C4D4ADC714BC586B820685F40C873"><enum>(b)</enum><header>Adjustments and recoveries</header><text display-inline="yes-display-inline">Section 1917(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396p">42 U.S.C. 1396p(b)</external-xref>) is amended—</text> 
<paragraph id="H190E6CBA7864471E8C1F2906D85D78BB"><enum>(1)</enum><text>in paragraph (1), by striking <quote>except that</quote> and inserting <quote>except that, subject to paragraph (6),</quote>; and</text></paragraph> <paragraph id="H10EAE1EA031449AF9890865309AE5BC3"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HA24E5ED346AF44C68523862E8F154DF0" display-inline="no-display-inline"> 
<paragraph id="H04364FB9B73844B680BD2841DF8C1E5F" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">Notwithstanding any preceding provision of this subsection, no adjustment or recovery of any medical assistance correctly paid on behalf of an individual under the State plan may be initiated, maintained, or collected on or after the date of the enactment of this paragraph. Not later than 90 days after such date, a State shall—</text> <subparagraph id="HAA9B65C81ADE4BC58406E31D4371E848"><enum>(A)</enum><text>withdraw any lien in effect as of such date with respect to such medical assistance correctly paid; and</text></subparagraph> 
<subparagraph id="H7B97524790B04D34A024FD724F1B2CE8"><enum>(B)</enum><text>notify each individual (or legal representative of such individual (or of such individual’s estate)) subject to such a lien so withdrawn of the withdrawal of such lien and the prohibition on adjustment or recovery under this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </legis-body></bill>
