Miscellaneous.</toc-entry></toc></subsection></section><section id="H66051AA1A8924690999D40965383D45B"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="HDEEFAD3AB60B499DAC5C225605C63096"><enum>(1)</enum><text>to resolve, fully and finally, all claims to rights to water, including damages claims related to water, in the State, including in the Verde River Watershed and the Colorado River, of—</text><subparagraph id="H7AC411D3167145BE80A10D928807D92E"><enum>(A)</enum><text>the Yavapai-Apache Nation, on behalf of the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees); and</text></subparagraph><subparagraph id="H4E8032C185244BC2988D291AEF29C36A"><enum>(B)</enum><text>the United States, acting as trustee for the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees);</text></subparagraph></paragraph><paragraph id="H8006FACD82A0416EBE95661995A9E6BE"><enum>(2)</enum><text>to authorize, ratify, and confirm the Yavapai-Apache Nation Water Rights Settlement Agreement, to the extent that Agreement is consistent with this Act;</text></paragraph><paragraph id="HF673931801E2458E82C1D96C9806CE2A"><enum>(3)</enum><text>to authorize and direct the Secretary to execute and perform the duties and obligations of the Secretary under the Agreement and this Act;</text></paragraph><paragraph id="H8F31F9FA1D464FC89044DA0CA00632E7"><enum>(4)</enum><text>to authorize the appropriation of funds necessary to carry out the Agreement and this Act; and</text></paragraph><paragraph id="HD7B6C2644B95418EB70DF42DCD9B4325"><enum>(5)</enum><text>to recognize the important cultural, traditional and religious value of the Verde River to the Yavepé (Yavapai) who know the Verde River as Hatayakehela (<quote>Big River</quote>) and to the Dilzhę́’é (Apache) who know the Verde River as Tú ńlį́į́níchoh (<quote>Big Water flowing</quote>) and to protect the existing flows of the Verde River, including flood flows, as described in the Agreement and this Act, on the Yavapai-Apache Reservation, now and in the future.</text></paragraph></section><section id="HC5F490D5AFC0496B9C19CF1AC81FD496"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H8A0A30F1CFD547D486D982A1F84346E1"><enum>(1)</enum><header>AFY</header><text>The term <term>AFY</term> means acre-feet per Year.</text></paragraph><paragraph id="H0531A2A68CF74767B4D66A998D97BC8A"><enum>(2)</enum><header>Agreement</header><text>The term <term>Agreement</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEF4F12B75DAC4AF598CAF72B9AB313D3"><enum>(A)</enum><text display-inline="yes-display-inline">the Yavapai-Apache Nation Water Rights Settlement Agreement, dated June 26, 2024; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF3DFB796E072454F840AF1924DC5E6E1"><enum>(B)</enum><text display-inline="yes-display-inline">any amendment or exhibit (including exhibit amendments) to the Agreement that are—</text><clause commented="no" display-inline="no-display-inline" id="HBC8F284114DA43C0B1EE7B3509574F07"><enum>(i)</enum><text display-inline="yes-display-inline">made in accordance with the Act; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HC3F14B9A14224811BDFD6223C4B9AAE2"><enum>(ii)</enum><text display-inline="yes-display-inline">otherwise approved by the Secretary and the Parties to the Agreement.</text></clause></subparagraph></paragraph><paragraph id="H8442F990F05947B7BF686A8252F66EA2"><enum>(3)</enum><header>Allottee</header><text>The term <term>Allottee</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HAFFD4436DACB4C949DA28F410465839A"><enum>(A)</enum><text display-inline="yes-display-inline">an individual Indian holding an undivided fractional beneficial interest in the Dinah Hood Allotment; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEE0135309ADF4DEDA164764A1E30167F"><enum>(B)</enum><text display-inline="yes-display-inline">an Indian Tribe holding an undivided fractional beneficial interest in the Dinah Hood Allotment.</text></subparagraph></paragraph><paragraph id="H2976103733424617B757D33EC3535F91"><enum>(4)</enum><header>Available cap supply</header><text>The term <term>Available CAP Supply</term>, for any Year, means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCE51EC7DD49C47FF834B3B629E4BD2B6"><enum>(A)</enum><text display-inline="yes-display-inline">all Fourth Priority River Water available for delivery through the CAP;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3D7CA5A6B5E34CE89B31A4B02021391A"><enum>(B)</enum><text display-inline="yes-display-inline">water available from CAP dams and reservoirs other than the Modified Roosevelt Dam; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCB27AB8E2C2B4B738CF246F5A069953E"><enum>(C)</enum><text display-inline="yes-display-inline">return flows captured by the Secretary for CAP use.</text></subparagraph></paragraph><paragraph id="HDDA3116A1D034B719B9B6DB6FF8CEB8D"><enum>(5)</enum><header>CAP; Central Arizona Project</header><text>The term <term>CAP</term> or <term>Central Arizona Project</term> means the reclamation project authorized and constructed by the United States in accordance with title III of the Colorado River Basin Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1521">43 U.S.C. 1521 et seq.</external-xref>).</text></paragraph><paragraph id="H8EC281B89DDB4DDAA70BAB07AB55484A"><enum>(6)</enum><header>CAP contract</header><text>The term <term>CAP Contract</term> means a long-term contract (as defined in the CAP Repayment Stipulation) with the United States for delivery of CAP Water through the CAP System.</text></paragraph><paragraph id="H43EA075348424CCDB9D0ACFD6C1D310A"><enum>(7)</enum><header>CAP fixed om&amp;r charge</header><text>The term <term>CAP Fixed OM&amp;R Charge</term> has the meaning given the term <quote>Fixed OM&amp;R Charge</quote> in the CAP Repayment Stipulation.</text></paragraph><paragraph id="HEEB00E42AD454DD59089EF4AA334A826"><enum>(8)</enum><header>CAP indian priority water</header><text>The term <term>CAP Indian Priority Water</term> means water within the Available CAP Supply having an Indian delivery priority.</text></paragraph><paragraph id="H610C514F6FD84E328E6F4F014E059DA1"><enum>(9)</enum><header>CAP operating agency</header><text>The term <term>CAP Operating Agency</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0B9C41C50DC14BA79DEEA50BC871379C"><enum>(A)</enum><text display-inline="yes-display-inline">the 1 or more entities authorized to assume responsibility for the care, operation, maintenance and replacement of the CAP System; and</text></subparagraph><subparagraph id="H3E50B042789B438C80BDA527C7530696"><enum>(B)</enum><text>as of the date of enactment of this Act, the CAWCD.</text></subparagraph></paragraph><paragraph id="HE36C40A1842443D79F2D55085566D5E2"><enum>(10)</enum><header>CAP pumping energy charge</header><text>The term <term>CAP Pumping Energy Charge</term> has the meaning given the term <quote>Pumping Energy Charge</quote> in the CAP Repayment Stipulation.</text></paragraph><paragraph id="HBAE522396FC1474D823824DD8F9B78D3"><enum>(11)</enum><header>CAP repayment contract</header><text>The term <term>CAP Repayment Contract</term> means—</text><subparagraph id="H2CF39F22D8DB4491ACB2B1C836C36441"><enum>(A)</enum><text>the contract dated December 1, 1988 (Contract No. 14–06–W–245, Amendment No. 1), between the United States and the Central Arizona Water Conservation District for the Delivery of Water and Repayment of Costs of the CAP; and</text></subparagraph><subparagraph id="H6B023B5661104BCABA04C0FDCE98FE0B"><enum>(B)</enum><text>any amendment to, or revision of, that contract.</text></subparagraph></paragraph><paragraph id="HEA9B487AC70541839F8C7CCDAEED0AA6"><enum>(12)</enum><header>CAP repayment stipulation</header><text>The term <term>CAP Repayment Stipulation</term> means the Stipulated Judgment and the Stipulation for Judgment, including any exhibits to those documents, entered on November 21, 2007, in the United States District Court for the District of Arizona in the consolidated civil action Central Arizona Water Conservation District v. United States, et al., numbered CIV 95–625–TUC–WDB–EHC and CIV 95–1720–PHX–EHC.</text></paragraph><paragraph id="H07DB1E07A0AF4B2CA83B505966B1B076"><enum>(13)</enum><header>CAP system</header><text>The term <term>CAP System</term> means—</text><subparagraph id="H50858FB69FE64F2396EB72487E1297ED"><enum>(A)</enum><text>the Mark Wilmer Pumping Plant;</text></subparagraph><subparagraph id="H361E7CF5A6D14343A9FE88E12F49DA0A"><enum>(B)</enum><text>the Hayden-Rhodes Aqueduct;</text></subparagraph><subparagraph id="H91643CA14B134367B79A4DD0471B3F6E"><enum>(C)</enum><text>the Fannin-McFarland Aqueduct;</text></subparagraph><subparagraph id="H973BE6DB956D49C59D24E76D0649BB43"><enum>(D)</enum><text>the Tucson Aqueduct;</text></subparagraph><subparagraph id="HC5EA6B3DB4494036BBB78F71B37140C1"><enum>(E)</enum><text>any pumping plant or appurtenant work of a feature described in subparagraph (A), (B), (C), or (D); and</text></subparagraph><subparagraph id="HDEDCB6B52A1E4FB0BD0B3DDA30D6FF71"><enum>(F)</enum><text>any extension of, addition to, or replacement of a feature described in subparagraph (A), (B), (C), (D), or (E).</text></subparagraph></paragraph><paragraph id="HA95211CC1CD447428AD40E60505E2965"><enum>(14)</enum><header>CAP water</header><text>The term <term>CAP Water</term> has the meaning given the term <quote>Project Water</quote> in the CAP Repayment Stipulation.</text></paragraph><paragraph id="H4B65CAC3716D41D491333F1C814FA8B2"><enum>(15)</enum><header>CAWCD</header><text>The term <term>CAWCD</term> means the political subdivision of the State that is—</text><subparagraph id="H96707FD59A204DBDA67E68C48D768148"><enum>(A)</enum><text>the contractor under the CAP Repayment Contract; and</text></subparagraph><subparagraph id="H1F53F35281E94F7C84D5B2ADDB2AB6BD"><enum>(B)</enum><text>as of the date of enactment of the Act, the CAP Operating Agency.</text></subparagraph></paragraph><paragraph id="H202081204EFF4CD984B7F4BF3464949C"><enum>(16)</enum><header>C.C. cragin dam and reservoir</header><subparagraph id="HFFF983F26EAB47BE823FB44CBEE97C72"><enum>(A)</enum><header>In general</header><text>The term <term>C.C. Cragin Dam and Reservoir</term> means—</text><clause id="H1517646561F843AB9910C329C3E1A550"><enum>(i)</enum><text>the C.C. Cragin Dam and Reservoir located on East Clear Creek in Coconino County, Arizona, owned by the United States and operated by the Salt River Project Agricultural Improvement and Power District;</text></clause><clause id="HE8B36A6921124072901224FE098AA598"><enum>(ii)</enum><text>associated facilities located in Gila and Coconino Counties, Arizona, including pipelines, tunnels, buildings, hydroelectric generating facilities, and other structures of every kind, including transmission, telephone and fiber optic lines and pumps, machinery, tools, and appliances; and</text></clause><clause id="H6F7875F4C71441859A4C10BDA23C848A"><enum>(iii)</enum><text>all real or personal property, appurtenant to or used, or constructed or otherwise acquired to be used, in connection with the dam and reservoir and associated facilities described in clauses (i) and (ii).</text></clause></subparagraph><subparagraph id="H075FC129F63A45AAB8C5248D0F62F6BC"><enum>(B)</enum><header>Exclusion</header><text>The term <term>C.C. Cragin Dam and Reservoir</term> does not include the Cragin-Verde Pipeline Project.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HED5B755E8A0B48DA8CB96E052CA33349"><enum>(17)</enum><header>Colorado River Water</header><subparagraph commented="no" display-inline="no-display-inline" id="H342C9F43E93640CFB774EE88004566D1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>Colorado River Water</term> means the waters of the Colorado River apportioned for Use within the State by—</text><clause commented="no" display-inline="no-display-inline" id="HFA1F78B25BB541B9BF0DBA1AC7373411"><enum>(i)</enum><text display-inline="yes-display-inline">sections 4 and 5 of the Boulder Canyon Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/617c">43 U.S.C. 617c</external-xref>, 617d);</text></clause><clause commented="no" display-inline="no-display-inline" id="HF166C313C25C48238018CB69D1259DEF"><enum>(ii)</enum><text display-inline="yes-display-inline">the Upper Colorado River Basin Compact of 1948, as ratified and reprinted in title 45, chapter 7, article 3 of the Arizona Revised Statutes;</text></clause><clause commented="no" display-inline="no-display-inline" id="H95C9966F4B064A5789FD3D32182618B2"><enum>(iii)</enum><text display-inline="yes-display-inline">the Colorado River Basin Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1501">43 U.S.C. 1501 et seq.</external-xref>);</text></clause><clause commented="no" id="HE687EF576E59443A9E844A8E4C3A19D0"><enum>(iv)</enum><text>the contract for delivery of water between the United States and the State, dated February 9, 1944; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H13E529905D554843BD30D035A58B7E40"><enum>(v)</enum><text>the decree of the Supreme Court of the United States in Arizona v. California, 376 U.S. 340 (1964), the Consolidated Decree entered on March 27, 2006, in that case (547 U.S. 150), and any modifications thereof.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4283D4CC40354CCEBB959A307C9A9181"><enum>(B)</enum><header>Limitations</header><text display-inline="yes-display-inline">The term <term>Colorado River Water</term>—</text><clause commented="no" display-inline="no-display-inline" id="H520515205891482697C65D04CB5A83F7"><enum>(i)</enum><text display-inline="yes-display-inline">shall only be used for purposes of interpreting the Agreement and this Act; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1A559E381FE24037B1B6205ECEF19B51"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be used for any interpretation of existing law, contract, or decree, including any law, contract, or decree described in clauses (i) through (v) of subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="H997E66ABE188491285E447D23BF64137"><enum>(18)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of Reclamation.</text></paragraph><paragraph id="HCA9307C749AA4F5B927F145D913BD7B6"><enum>(19)</enum><header>Cragin capital costs</header><subparagraph commented="no" display-inline="no-display-inline" id="H9AC66DBC7E3E49E9A2A49C6CD9EDC11B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>Cragin Capital Costs</term> means all costs incurred by SRP for the acquisition and improvement of land, facilities, equipment, and inventories related to the C.C. Cragin Dam and Reservoir.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAD8E3BAD305F4FD28EA5F1F862E209A8"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>Cragin Capital Costs</term> includes all costs for labor, overhead, materials, supplies, spare parts, equipment purchase and rental, and transportation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4155338F8DA64A4C950F08147C044E6C"><enum>(C)</enum><header>Clarification</header><text display-inline="yes-display-inline">Prior to May 1, 2009, all expenses incurred by SRP are accrued as Cragin Capital Costs, excluding capital costs of the SRP-Cragin Pumping System.</text></subparagraph></paragraph><paragraph id="HCE993D17C19A46D6B60178A80E22F8F6"><enum>(20)</enum><header>Cragin o&amp;m costs</header><subparagraph commented="no" display-inline="no-display-inline" id="HBE35706B22E3473B94320D132D5D637A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>Cragin O&amp;M Costs</term> means all costs incurred by SRP for the operation and maintenance of all C.C. and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF7A43428638B4C83A23B93CB5D8BD178"><enum>(B)</enum><text display-inline="yes-display-inline">has at least 15 service connections or regularly serves an average of at least 25 persons daily for at least 60 days a year.</text></subparagraph></paragraph><paragraph id="HAA8A8FEE023B403EB8D7087BBF94A1C1"><enum>(47)</enum><header>Replacement well</header><text>The term <term>Replacement Well</term> means a well that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA21103D4AAC9445CB7E0DC4402729D4C"><enum>(A)</enum><text display-inline="yes-display-inline">is constructed to replace a well in existence on the Effective Date;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4CF940C4C8C54DE58C4682DAFCE49790"><enum>(B)</enum><text display-inline="yes-display-inline">is located no more than 660 feet from the well being replaced; Cragin Dam and Reservoir to the Yavapai-Apache Nation and to other beneficiaries in the Verde Valley Watershed; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2DA5C8650D66468DB1B485584CEB3D02"><enum>(B)</enum><text display-inline="yes-display-inline">the YAN Drinking Water System Project, as described in section 6(c), which will treat and distribute the water delivered from the Cragin-Verde Pipeline Project.</text></subparagraph></paragraph><paragraph id="HB3D4231D31434C208AE1568911183A39"><enum>(58)</enum><header>Use</header><text>The term <term>Use</term> means any beneficial use, including instream flows, recharge, underground storage, recovery, or any other use recognized as beneficial under applicable law.</text></paragraph><paragraph id="H9581567D41FE4380AA4E8DA3B4675D1E"><enum>(59)</enum><header>USGS</header><text>The term <term>USGS</term> means the United States Geological Survey.</text></paragraph><paragraph id="H64D359C885194DC9A2F60FBC1B273699"><enum>(60)</enum><header>Verde river decree</header><text>The term <term>Verde River Decree</term> means the decree to be entered by the Gila River Adjudication Court adjudicating all rights to water in the Verde River Watershed.</text></paragraph><paragraph id="H5ED6D89A400B45348DCBEA93D7BACC2A"><enum>(61)</enum><header>Verde river subflow zone</header><text>The term <term>Verde River Subflow Zone</term> means the area in the Verde River Watershed delineated by the Arizona Department of Water Resources as the subflow zone on a map or maps that are approved by the Gila River Adjudication Court.</text></paragraph><paragraph id="H81420BCC05B349049130AA03418E7D91"><enum>(62)</enum><header>Verde river water</header><text>The term <term>Verde River Water</term> means the Water described in paragraph 5.0 of the Agreement, whether Diverted from the stream or pumped from a well.</text></paragraph><paragraph id="HEA32F692348C43439638D3E6F63C0642"><enum>(63)</enum><header>Verde river watershed</header><text>The term <term>Verde River Watershed</term> means all land located within the surface water drainage of the Verde River and its tributaries, depicted on the map attached as Exhibit 2.88 to the Agreement.</text></paragraph><paragraph id="HA53BC8D89C6C4F44A0B16D0A7A6627C8"><enum>(64)</enum><header>Water</header><text>The term <term>Water</term>, when used without a modifying adjective, means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H6BCB9AAF3AE143F8852128B2B3EEA3D1"><enum>(A)</enum><text display-inline="yes-display-inline">Groundwater;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H86AC71F29C0F43E89DF25308456E7D94"><enum>(B)</enum><text display-inline="yes-display-inline">Surface Water;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18190441775E4733B52F4E88E141405C"><enum>(C)</enum><text display-inline="yes-display-inline">Colorado River Water;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD546123C86940BD9356AAD406E92A8E"><enum>(D)</enum><text display-inline="yes-display-inline">Effluent; Cragin Dam and Reservoir, without cost to SRP, and delivered for Use on the Yavapai-Apache Reservation, YAN Trust Land, and YAN After-Acquired Trust Land for beneficial purposes.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB207067D093740C7BE9ABBD75708A1AB"><enum>(70)</enum><header>YAN delivery point</header><text>The term <term>YAN Delivery Point</term> means the point or points located at the end of the Cragin-Verde Pipeline Project where Water may be delivered to the YAN or the United States acting as trustee for the YAN pursuant to the YAN-SRP Water Delivery and Use Agreement.</text></paragraph><paragraph id="HF399E9E19DE34E0F85325568C07332D3"><enum>(71)</enum><header>YAN drinking water system project; Yavapai-Apache Nation Drinking Water System Project</header><text>The terms <term>YAN Drinking Water System Project</term> and <term>Yavapai-Apache Nation Drinking Water System Project</term> mean the water treatment and water distribution system project of the Yavapai-Apache Nation under the Tú ńlį́į́níchoh Water Infrastructure Project, as described in section 6(c), that will treat and distribute water delivered from the C.C. Cragin Dam and Reservoir.</text></paragraph><paragraph id="HCB364A7068894A8BB170818E83EAA358"><enum>(72)</enum><header>YAN fee land</header><text>The term <term>YAN Fee Land</term> means land that, as display-inline="yes-display-inline">located outside the exterior boundaries of the Yavapai-Apache Reservation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H52AA842EF9EE4DCBB5FC457D05B91F25"><enum>(B)</enum><text display-inline="yes-display-inline">owned in fee by the Yavapai-Apache Nation and has not been taken into trust by the United States for the benefit of the Yavapai-Apache Nation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6261A736489F4438AA92A3785B2A8640"><enum>(C)</enum><text display-inline="yes-display-inline">described and shown in Exhibit 2.98 to the Agreement.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE7C5207907541ECBB84C44916655442"><enum>(73)</enum><header>YAN judgment</header><text>The term <term>YAN Judgment</term> means the judgment and decree entered by the Gila River Adjudication Court, as described in the Agreement.</text></paragraph><paragraph id="HCDBDD55D52C54271AFD5B86C3E268FCC"><enum>(74)</enum><header>YAN land</header><text>The term <term>YAN Land</term> means, Verde</quote> gage, located at GPS coordinates 34.6116972, −111.8984306 within the Reservation.</text></paragraph><paragraph id="HEA28A823A17647768B160B6E9B83B0E3"><enum>(76)</enum><header>YAN-SRP exchange agreement</header><text>The term <term>YAN-SRP Exchange Agreement</term> means the agreement between the Nation and SRP, as approved by the United States, in the form substantially similar to that attached as Exhibit 6.5 to the Agreement.</text></paragraph><paragraph id="H186B780D8FB84403A729D4A4D80C11DB"><enum>(77)</enum><header>YAN-SRP water delivery and use agreement</header><text>The term <term>YAN-SRP Water Delivery and Use Agreement</term> means the agreement between the Nation and SRP, as approved by the United States, in the form substantially similar to that attached as organized pursuant to section 16 of the Act of June 18, 1934 (commonly known as the <quote>Indian Reorganization Act</quote>) (48 Stat. 987, chapter 576; <external-xref legal-doc="usc" parsable-cite="usc/25/5123">25 U.S.C. 5123</external-xref>).</text></paragraph><paragraph id="HD143564B463F4981AC0772BE4F0338AD"><enum>(79)</enum><header>YAN trust land</header><text>The term <term>YAN Trust Land</term> means land that, as of the Enforceability Date, is—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD07396B1F87849C89A32298CF539CBED"><enum>(80)</enum><header>Yavapai-apache reservation; yan reservation; reservation</header><text>The terms <term>Yavapai-Apache Reservation</term>, <term>YAN Reservation</term> or <term>Reservation</term> mean the land described in section 13(a).</text></paragraph><paragraph id="H29A88B1A7B374FFE884E92A1FE594817"><enum>(81)</enum><header>Year</header><text>The term <term>Year</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7BC560580642424CBEBAFC22169F28D7"><enum>4.</enum><header>Ratification and execution of the Yavapai-Apache Nation Water Rights Settlement Agreement</header><subsection id="HEA8308B047D94BE0BE89DB6811D14E9C"><enum>(a)</enum><header>Ratification</header><paragraph id="H04E349BF24194A8896D435E5FA8B305E"><enum>(1)</enum><header>In general</header><text>Except as modified by this Act, and to the extent the Yavapai-Apache Nation Water Rights Settlement Agreement does not conflict with this Act, the Agreement is authorized, ratified, and confirmed.</text></paragraph><paragraph id="HF265B06F69304B21AA070A267ECDD027"><enum>(2)</enum><header>Amendments</header><text>If an amendment to the Agreement, including an amendment to any exhibit attached to the Agreement requiring the signature or approval of the Secretary, is executed in accordance with this Act to make the Agreement consistent with this Act, the amendment is authorized, ratified, and confirmed, to the extent the amendment is consistent with this Act.</text></paragraph></subsection><subsection id="H81357C280FD348C183E63449B34A273C"><enum>(b)</enum><header>Execution</header><paragraph id="H0FC470FA0DC646688699FDF6FE303F0B"><enum>(1)</enum><header>In general</header><text>To the extent the Agreement does not conflict with this Act, the Secretary shall execute the Agreement, including all exhibits to, or parts of, the Agreement requiring the signature of the Secretary.</text></paragraph><paragraph id="HB7048321708240B39622D57D960F89B1"><enum>(2)</enum><header>Modifications</header><text>Nothing in this Act prohibits the Secretary from approving any modification to the Agreement, including any Exhibit to the Agreement, that is consistent with this Act, to the extent the modification does not otherwise require congressional approval under section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other applicable Federal law.</text></paragraph></subsection><subsection id="HBDF7167CC6E345969152AA4BBC911CE9"><enum>(c)</enum><header>Environmental compliance</header><paragraph id="H5076749D3DD247CCB8D3E60EA5958705"><enum>(1)</enum><header>In general</header><text>In implementing the Agreement (including all exhibits to the Agreement requiring the signature of the Secretary) and this Act, the Secretary shall comply with all applicable provisions of—</text><subparagraph id="HF315DC93AEAC42BF83E9E1FDBCFE159C"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subparagraph><subparagraph id="H9D1B6503CFFB4F7496C3929F98F6F237"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), including the implementing regulations of that Act; and</text></subparagraph><subparagraph id="HED285DFC106841088BA9CDE21CE8531A"><enum>(C)</enum><text>all other applicable Federal environmental laws and regulations.</text></subparagraph></paragraph><paragraph id="H96F7306BE6EB4BFDBA307B2128CD746D"><enum>(2)</enum><header>Authorizations</header><text>The Secretary shall—</text><subparagraph id="H273E1C3B54424641AF106125536C4459"><enum>(A)</enum><text>independently evaluate the documentation prepared and submitted under paragraph (1); and</text></subparagraph><subparagraph id="HF3F3D0F95F5845F4BA044D16C9EFD45C"><enum>(B)</enum><text>be responsible for the accuracy, scope, and contents of that documentation.</text></subparagraph></paragraph><paragraph id="H55255C4AD0F14AC489F893943ADC41DB"><enum>(3)</enum><header>Effect of execution</header><text>The execution of the Agreement by the Secretary under this section shall not constitute a major Federal action for purposes of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></paragraph><paragraph id="H2D091D8350F246358206F25CA74824EA"><enum>(4)</enum><header>Costs</header><text>Any costs associated with the performance of the compliance and coordination activities under this subsection shall be paid from funds deposited in the Tú ńlį́į́níchoh Water Infrastructure Project Fund established by section 7(a), subject to the condition that any costs associated with the performance of Federal approval or other review of that compliance work or costs associated with inherently Federal functions shall remain the responsibility of the Secretary.</text></paragraph></subsection></section><section id="HB3910E6A60C84964ACE656A76B7D5A10"><enum>5.</enum><header>Water rights</header><subsection id="H2822473FA25C4DBC8A24A07FB33B3159"><enum>(a)</enum><header>Confirmation of water rights</header><paragraph id="H4537319A2B764D3C96A1DCF523E77485"><enum>(1)</enum><header>In general</header><text>The Water Rights of the Yavapai-Apache Nation as described in the Agreement are ratified, confirmed and declared to be valid.</text></paragraph><paragraph id="H78D51030891D406A9530ECB2E2B9EE38"><enum>(2)</enum><header>Use</header><text>Any use of Water pursuant to the Water Rights described in paragraph (1) by the Yavapai-Apache Nation shall be subject to the terms and conditions of the Agreement and this Act.</text></paragraph><paragraph id="H0228345937D449E79ED1DA81AE9D31E6"><enum>(3)</enum><header>Conflict</header><text>In the event of a conflict between the Agreement and this Act, this Act shall control.</text></paragraph></subsection><subsection id="H6ABEBE8C545E4BB08098EB01E81E3CC3"><enum>(b)</enum><header>Water rights To be held in trust for the yavapai-Apache nation</header><text>The United States shall hold the following Water Rights in trust for the benefit of the Yavapai-Apache Nation:</text><paragraph id="HBF2F55713395439789914B9D6329FF7D"><enum>(1)</enum><text>The Water Rights described in paragraphs 5.0, 6.0, 8.0, 9.0 and 11.0 of the Agreement.</text></paragraph><paragraph id="HAC0FBE678D214AB1ABDD9F829602B89E"><enum>(2)</enum><text>Any Water Rights taken into trust pursuant to subsections (f) and (g).</text></paragraph></subsection><subsection id="H0FA65F0086704509A46AC6D00D14A100"><enum>(c)</enum><header>Off-Reservation use</header><text>Except for Effluent as provided in subparagraph 4.15 of the Agreement, YAN CAP Water as provided in subparagraph 6.0 of the Agreement, and Water that is subject to an Exchange in accordance with State law, the rights to Water described in subparagraph 4.1 of the Agreement may not be sold, leased, transferred or used outside the boundaries of the YAN Reservation, YAN Trust Land, or YAN After-Acquired Trust Land.</text></subsection><subsection id="H9E9EA36A956B423F84436F2CDD7066E6"><enum>(d)</enum><header>Forfeiture and abandonment</header><text>None of the water rights described in paragraphs (1) and (2) of subsection (b) shall be subject to loss through non-use, forfeiture, abandonment, or other operation of law.</text></subsection><subsection id="HB9090C613EF1431DA6CF7EB9E9FFFE13"><enum>(e)</enum><header>Yavapai-Apache nation <enum-in-header>CAP</enum-in-header> water</header><text>The Yavapai-Apache Nation shall have the right to divert, use, and store YAN CAP Water in accordance with the Agreement and section 14.</text></subsection><subsection id="HEE354D2F95DA475A8E6B880A7FFBFA09"><enum>(f)</enum><header>Water rights held in trust for <enum-in-header>YAN</enum-in-header> after-Acquired trust land</header><text>As described in subparagraph 4.13.2.1 of the Agreement, and subject to all valid and existing rights, any Water Rights appurtenant to YAN After-Acquired Trust Land at the time the YAN After-Acquired Trust Land is taken into trust by the Secretary shall be held in trust by the United States for the benefit of the Yavapai-Apache Nation.</text></subsection><subsection id="H21116189378D44D3A50E2330AA22F0B1"><enum>(g)</enum><header>Water rights held in trust for future acquisitions of water rights</header><text>As described in subparagraphs 4.14.1 and 4.14.2 of the Agreement, and subject to all valid and existing rights, on the request of the Yavapai-Apache Nation, and in accordance with applicable Federal law, the Secretary shall accept and take into trust for the benefit of the Yavapai-Apache Nation any Water Rights severed and transferred to the Reservation, YAN Trust Land, or YAN After-Acquired Trust Land.</text></subsection></section><section id="H086113F22E7D4B32A7C6CEF7AF951E34"><enum>6.</enum><header>Tú ńlį́į́níchoh Water Infrastructure Project</header><subsection id="H6ADBC3772B0D41F9AD0BA255FF303820"><enum>(a)</enum><header>In general</header><text>The Secretary, acting through the Commissioner, shall plan, design and construct the Tú ńlį́į́níchoh Water Infrastructure Project, which shall consist of—</text><paragraph id="HCF4595274353432D99D7B083C75CC92A"><enum>(1)</enum><text>the Cragin-Verde Pipeline Project as described in subsection (b); and</text></paragraph><paragraph id="H4308FD1E09674DCD827CDDF1B14F26AD"><enum>(2)</enum><text>the Yavapai-Apache Nation Drinking Water System Project as described in subsection (c).</text></paragraph></subsection><subsection id="HDA60AA0F35C24420AA9402734A0D5A0C"><enum>(b)</enum><header>Cragin-Verde pipeline project</header><paragraph id="H15D6BB23226146709504DF28B74C4354"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Commissioner, and without cost to the Salt River Federal Reclamation Project, shall—</text><subparagraph id="H78656DAE864844D1A7AC9E5BF775014E"><enum>(A)</enum><text>plan, design, and construct the Cragin-Verde Pipeline Project as part of the Salt River Federal Reclamation Project; and</text></subparagraph><subparagraph id="HF5A272F52FD740979930402709CC09D9"><enum>(B)</enum><text>obtain any rights-of-way or other interests in land needed to construct the Cragin-Verde Pipeline Project.</text></subparagraph></paragraph><paragraph commented="no" id="H4D2935AB1BD141DFA11FAA495E13529A"><enum>(2)</enum><header>Scope</header><text>The scope of the planning, design, and construction activities for the Cragin-Verde Pipeline Project shall meet the requirements described in paragraph (3).</text></paragraph><paragraph id="H9E00EE35E97545C8B2B10FCB72EFA0F8"><enum>(3)</enum><header>Requirements</header><text>The Cragin-Verde Pipeline Project shall—</text><subparagraph id="H7B2358D0D59444E9973125642F1C3EE9"><enum>(A)</enum><text>be capable of delivering—</text><clause commented="no" display-inline="no-display-inline" id="HF4466DFB387C4D70B17218503905BD6E"><enum>(i)</enum><text display-inline="yes-display-inline">not less than 6,836.92 AFY of water from the C.C. Cragin Dam and Reservoir for Use by the YAN as provided in the Settlement Agreement and this Act; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H3D594F893EA84155B6AF56D5DDA76D06"><enum>(ii)</enum><text display-inline="yes-display-inline">up to an additional 1,912.18 AFY for Use by water users in Yavapai County as provided by the amendments made by section 17(a);</text></clause></subparagraph><subparagraph id="H0DE8767741024C58820CB99F89F3B254"><enum>(B)</enum><text>include all facilities and appurtenant items necessary to divert, store, and deliver water to the YAN Delivery Point on the Yavapai-Apache Reservation; and</text></subparagraph><subparagraph id="H9DD66AE179E64F08B794B64DDCCEB6D2"><enum>(C)</enum><text>to the maximum extent practicable, be designed and constructed to minimize care, operation, and maintenance costs.</text></subparagraph></paragraph><paragraph id="H8201244D77F245E6B26450920F8979A8"><enum>(4)</enum><header>Title to facilities</header><text>Title to the Cragin-Verde Pipeline Project shall be held by the United States as part of the Salt River Federal Reclamation Project pursuant to the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act (commonly known as the <quote>Reclamation Act of 1902</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371 et seq.</external-xref>).</text></paragraph><paragraph id="H28E5868C3B0D46B6B553DF81FB9EBFB7"><enum>(5)</enum><header>Assumption of and responsibility for care, operation, and maintenance of cragin-verde pipeline project</header><text>On the Date of Substantial Completion, SRP shall assume and be responsible for the care, operation, and maintenance of the Cragin-Verde Pipeline Project pursuant to the contract between the United States and the Salt River Valley Water Users’ Association dated September 6, 1917, as amended.</text></paragraph><paragraph id="HEFFEC7F53FE947E6991AAB3D57196D9A"><enum>(6)</enum><header>Costs of care, operation, and maintenance to be borne by project beneficiaries</header><subparagraph commented="no" display-inline="no-display-inline" id="HA624113AA6CD45E7864B666F6F0F2668"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The costs of the care, operation, and maintenance of the Cragin-Verde Pipeline Project shall not be borne by SRP.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3D4352CD696B4917AD0D7DD11FF293C1"><enum>(B)</enum><header>Costs borne by YAN</header><text display-inline="yes-display-inline">Except as provided in subparagraph 10.10 of the Agreement, the Yavapai-Apache Nation and any other beneficiaries of the Cragin-Verde Pipeline Project shall bear the costs of the care, operation, and maintenance of the Cragin-Verde Pipeline Project on a pro rata basis after the Date of Substantial Completion.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF089B565944F47418F67C06739283293"><enum>(C)</enum><header>Costs borne by Secretary</header><text display-inline="yes-display-inline">Until the Date of Substantial Completion, the costs of care, operation, and maintenance shall be borne by the Secretary.</text></subparagraph></paragraph><paragraph id="HBE1979F16D724A76851CCABC914D4E8A"><enum>(7)</enum><header>Withdrawal and reservation</header><subparagraph id="HEBF7D09F65124938AB28389D4C71AAA1"><enum>(A)</enum><header>Definition of covered land</header><text>In this paragraph, the term <term>covered land</term> means the portion of the National Forest System land determined by the Secretary to be necessary for the construction and operation of the Cragin-Verde Pipeline Project as depicted on the map prepared under subparagraph (D).</text></subparagraph><subparagraph id="HFBFDADE05D7F4DBE964B88A72C376BDD"><enum>(B)</enum><header>Withdrawal of covered land</header><text>The covered land is permanently withdrawn from—</text><clause id="HFCA034A68EDE4744935925F73D7EEA73"><enum>(i)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></clause><clause id="HE373393A46C840F593B4A2F8EC3CBA76"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text></clause><clause id="H25D084C287F34DA5A2213D8FB4B3572A"><enum>(iii)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text></clause></subparagraph><subparagraph id="HC2CE7108657E4E29B6A16051C11FEAD1"><enum>(C)</enum><header>Reservation of covered land</header><text>Subject to valid existing rights, the covered land is reserved to the United States, through the Secretary, for the exclusive right to use the covered land and interests in the covered land for Bureau of Reclamation purposes to construct the Cragin-Verde Pipeline Project as part of the Salt River Federal Reclamation Project and operated by SRP pursuant to the contract between the United States and the Salt River Valley Water Users’ Association dated September 6, 1917, as amended.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDAD484E8327244FCA246DF337CC36C45"><enum>(D)</enum><header>Map of covered land</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall prepare a map depicting the boundary of the covered land, which shall be on file and available for public inspection in the appropriate offices of the Forest Service and the Bureau of Reclamation.</text></subparagraph></paragraph></subsection><subsection id="HE2BD18146224427DAADBBFB20C897DC6"><enum>(c)</enum><header>Yavapai-Apache nation drinking water system project</header><paragraph id="H0F99D7B0A9FD4E2E915DDA6C7690CD6E"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Commissioner, shall—</text><subparagraph id="HFADB90BB331044EF90701F87F5BDD030"><enum>(A)</enum><text>plan, design and construct the YAN Drinking Water System Project;</text></subparagraph><subparagraph id="HC6A2A3979ECF46B8831EFBCA67F9832A"><enum>(B)</enum><text>comply with all requirements of section 4(c)(1); and</text></subparagraph><subparagraph id="H955E20BFED42410A9F6ABBF897C5186F"><enum>(C)</enum><text>obtain any rights-of-way or other interests in land needed to construct the YAN Drinking Water System Project.</text></subparagraph></paragraph><paragraph id="HCDC22EA4885E4780A5D62C2D5C7EF1DA"><enum>(2)</enum><header>Scope</header><text>The scope of the planning, design, and construction activities for the YAN Drinking Water System Project shall be as generally described in the document entitled <quote>Yavapai-Apache Nation Drinking Water Infrastructure Plan</quote> and dated July 2024, subject to the condition that the design of the project may be adjusted by mutual agreement of the Secretary and the Yavapai-Apache Nation if—</text><subparagraph commented="no" display-inline="no-display-inline" id="HDE957E3130C142288417CD29F56949D1"><enum>(A)</enum><text display-inline="yes-display-inline">the requirements of paragraph (3) can be met; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD6E25E60B88E428D89B99E99852DE63E"><enum>(B)</enum><text display-inline="yes-display-inline">the adjustment is not expected to increase the total cost of the YAN Drinking Water System Project.</text></subparagraph></paragraph><paragraph id="H3AABE6C8D6434F08ADCDB37A4D797991"><enum>(3)</enum><header>Requirements</header><text>The YAN Drinking Water System Project shall—</text><subparagraph id="H8D8AAD63ED864DA2B7B54F778CA42343"><enum>(A)</enum><text>include a surface water treatment facility capable of treating up to 2,250,000 gallons of water per day, with a peak of 3,000,000 gallons of water per day, for water delivered to the YAN Delivery Point from the C.C. Cragin Dam and Reservoir via the Cragin-Verde Pipeline Project, except as otherwise provided for in paragraph (4);</text></subparagraph><subparagraph id="H105334F1DB0C40B9AA508EA016C2E1E2"><enum>(B)</enum><text>include pipelines, water storage tanks, pump stations, transmission mains, and other associated infrastructure necessary for the delivery of the treated water from the surface water treatment facility described in subparagraph (A) to the locations described in the Yavapai-Apache Nation Drinking Water Infrastructure Plan dated July 2024, or as otherwise agreed to by the Nation and the Secretary; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H92B8AEDC3B7844FB95261A451B97E594"><enum>(C)</enum><text>to the maximum extent practicable, be designed and constructed to minimize care, operation, and maintenance costs.</text></subparagraph></paragraph><paragraph id="HD30E890E27A340619C476639007D4262"><enum>(4)</enum><header>Increase in capacity and cost share</header><text>For the water described in the amendments made by section 17(a), the Secretary is authorized to increase the capacity of the YAN Drinking Water System Project to treat and deliver up to an additional 2,500,000 gallons of water per day, for such water delivered to the YAN Delivery Point from the C.C. Cragin Dam and Reservoir via the Cragin-Verde Pipeline Project, subject to the conditions that—</text><subparagraph id="H524A978B71904BD6BCA60802676E0F0A"><enum>(A)</enum><text>the Yavapai-Apache Nation and the water user or users described in the amendments made by section 17(a) agree to terms and conditions for the Nation to treat and distribute the water described in that section;</text></subparagraph><subparagraph id="HB1E0C4DFE0244337B6BC740A5E68E27E"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HB08375216A964A558B992C45A91246F7"><enum>(i)</enum><text>the water user or water users located in Yavapai County pay their share of the cost of construction to increase the capacity of the YAN Drinking Water System Project; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HD12860312BF44127BC072DEB28EC0FC0" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">payment for such costs are deposited into the YAN Drinking Water System Project Fund Account described in section 7(c)(2) for use for the purposes described in paragraph (1); and</text></clause></subparagraph><subparagraph id="HB548B8C48C014178B8348DC7DF866C47"><enum>(C)</enum><text>the request to increase the capacity of the YAN Drinking Water System Project and meeting the conditions required under this paragraph will not delay the timely completion of the YAN Drinking Water System Project to accept delivery of water from the Cragin-Verde Pipeline Project to the YAN Delivery Point for the benefit of the Yavapai-Apache Nation.</text></subparagraph></paragraph><paragraph id="H5A433EDD502A499AA25F4A780ABF88DE"><enum>(5)</enum><header>Title to facilities</header><subparagraph commented="no" display-inline="no-display-inline" id="H6561A617D62B4986A39FED913A675301"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The YAN Drinking Water System Project shall be owned by the United States during construction.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H35AE3FB937F84E06A5DA7C20E9C13FD3"><enum>(B)</enum><header>Transfer of title to YAN</header><text display-inline="yes-display-inline">On the Date of Substantial Completion of the Tú ńlį́į́níchoh Water Infrastructure Project, the Secretary shall transfer title to the YAN Drinking Water System Project to the Yavapai-Apache Nation.</text></subparagraph></paragraph><paragraph id="HE9AB4BA669B14CA386F9157563B524E4"><enum>(6)</enum><header>Assumption of and responsibility care, operation and maintenance of the yan drinking water system project</header><subparagraph commented="no" display-inline="no-display-inline" id="H102ED3C2E891416AAEAE9D7387B1EC7E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">On the Date of Substantial Completion of the Tú ńlį́į́níchoh Water Infrastructure Project, the Yavapai-Apache Nation shall assume and be responsible for the care, operation, and maintenance of the YAN Drinking Water System Project.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H38423B230385453B9807EC2C37F9A0EF"><enum>(B)</enum><header>Costs during construction</header><text display-inline="yes-display-inline">Until the Date of Substantial Completion, the costs of care, operation, and maintenance shall be borne by the Secretary.</text></subparagraph></paragraph><paragraph id="H131A6E110FB94D568EE8311BA7E4BD7D"><enum>(7)</enum><header>Applicability of isdeaa</header><text>On receipt of a request of the Yavapai-Apache Nation, and in accordance with the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>), the Secretary shall enter into 1 or more agreements with the Nation to carry out the activities authorized by this subsection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5EEA322C1CD54E4B884DC9BA2FD3C157"><enum>(8)</enum><header>Condition</header><text>As a condition of construction of the YAN Drinking Water System Project authorized by this subsection, the Nation shall authorize, at no cost to the Secretary, the use of all land or interests in land located on the Reservation, YAN Trust Land, and YAN After-Acquired Trust Land that the Secretary identifies as necessary for the planning, design, construction, operation, and maintenance of the YAN Drinking Water System Project until the transfer of title to the YAN Drinking Water System Project to the Nation pursuant to paragraph (5)(B).</text></paragraph></subsection><subsection id="HB718032E7B09429ABAA2EFB0C4A05F32"><enum>(d)</enum><header>Date of substantial completion</header><text>The Tú ńlį́į́níchoh Water Infrastructure Project shall be deemed substantially complete on the date on which written notice is provided to the Parties by the Bureau of Reclamation that the Cragin-Verde Pipeline Project and the YAN Drinking Water System Project are sufficiently complete to place the projects into service for their intended use.</text></subsection></section><section id="HD8CB15E8917E4F0B89ED21E7E45B1468"><enum>7.</enum><header>Tú ńlį́į́níchoh Water Infrastructure Project Fund</header><subsection id="H98A622FC40914CB9A4135C1F9811C925"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a non-trust interest-bearing account, to be known as the Tú ńlį́į́níchoh Water Infrastructure Project Fund (referred to in this section as the <term>Project Fund</term>) and to be managed and distributed by the Secretary to carry out this Act.</text></subsection><subsection id="HA166348AEDA14D99BDB8B429D25C2AED"><enum>(b)</enum><header>Accounts</header><text>The Secretary shall establish within the Project Fund the following accounts (referred to in this section as the <term>Project Fund Accounts</term>):</text><paragraph id="HE7891AD1C15D48F6A2558EE3B5D5F444"><enum>(1)</enum><text>The Cragin-Verde Pipeline Account.</text></paragraph><paragraph id="H43E0A2F37C0D4D559EFD8D095C69583E"><enum>(2)</enum><text>The YAN Drinking Water System Account.</text></paragraph></subsection><subsection id="HD2648BD0D4EC487E9BC53BE349BBE55B"><enum>(c)</enum><header>Deposits</header><text>The Secretary shall deposit—</text><paragraph id="H4CC7087FC8C943B7BAC9D260AF531F30"><enum>(1)</enum><text>in the Cragin-Verde Pipeline Account established under subsection (b)(1), the amounts made available pursuant to section 10(a)(1)(A); and</text></paragraph><paragraph id="HA8C0D838A48B4627B52F7EA39A8D6978"><enum>(2)</enum><text>in the YAN Drinking Water System Account established under subsection (b)(2), the amounts made available pursuant to section 10(a)(1)(B).</text></paragraph></subsection><subsection id="H3DCFEAF3A40D44DFB7FEA5F5EBB50C4E"><enum>(d)</enum><header>Uses</header><paragraph id="H558DACB88F044C1894BF6704244B5131"><enum>(1)</enum><header>Cragin-verde pipeline account</header><text>The Cragin-Verde Pipeline Account established under subsection (b)(1) shall be used by the Secretary—</text><subparagraph id="H55BE020D6E6C4FD5894FDA3D7DE594F2"><enum>(A)</enum><text>to carry out section 6(b), including all required environmental compliance under section 4(c), for the Cragin-Verde Pipeline Project; and</text></subparagraph><subparagraph id="H90AB91EF152343A2AFBF7E2123BF6EAF"><enum>(B)</enum><text>to reimburse SRP for the proportional Cragin Capital Costs and Cragin O&amp;M Costs associated with water delivered to the Yavapai-Apache Nation from the C.C. Cragin Dam and Reservoir under subparagraph 8.6.1 of the Agreement.</text></subparagraph></paragraph><paragraph id="H84B4FA262DE84D7094A5430FE17040F3"><enum>(2)</enum><header>YAN drinking water system account</header><text>The YAN Drinking Water System Account established under subsection (b)(2) shall be used by the Secretary to carry out section 6(c), including all required environmental compliance under section 4(c), for the YAN Drinking Water System Project.</text></paragraph></subsection><subsection id="H88CE4F3F1C5245BD8AE548284414F2FE"><enum>(e)</enum><header>Availability of amounts</header><paragraph id="HB645AD14C19344F9BEEC324C8FDF3117"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), amounts appropriated to and deposited in the Project Fund Accounts under subparagraphs (A) and (B) of section 10(a)(1) shall not be made available for expenditure until the Enforceability Date.</text></paragraph><paragraph id="HC2C048AF34F6427EAC7F7BE416B2AE9E"><enum>(2)</enum><header>Exception</header><text>Of the amounts described in paragraph (1), $13,000,000 shall be made available before the Enforceability Date for the Bureau of Reclamation to carry out environmental compliance and preliminary design of the Tú ńlį́į́níchoh Water Infrastructure Project, subject to the following:</text><subparagraph id="H78AB08F0DA094B53B82D872A39F59C97"><enum>(A)</enum><text>The revision of the Settlement Agreement and exhibits to conform to this Act.</text></subparagraph><subparagraph id="H8551B775C6D64E48A6677F7B357FB934"><enum>(B)</enum><text>Execution by all of the required settlement parties, including the United States, of the conformed Settlement Agreement and exhibits, including the waivers and releases of claims under section 11.</text></subparagraph></paragraph></subsection><subsection id="H8FA41288D45A4F72A6FD7823D26FC823"><enum>(f)</enum><header>Interest</header><text>In addition to the deposits to the Project Fund Accounts under subsection (c), any investment earnings, including interest credited to amounts unexpended, are authorized to be appropriated to be used in accordance with the uses described in paragraphs (1) and (2) of subsection (d).</text></subsection><subsection id="H69319B62FA3E4707B78622B2E52682C4"><enum>(g)</enum><header>Project efficiencies</header><paragraph id="H43CCD0DE79E8415BBEE893FF4CC2D352"><enum>(1)</enum><header>In general</header><text>If the total cost of the activities described in subsection (b) or (c) of section 6 are less than the amounts authorized to be appropriated under subparagraphs (A) and (B) of section 10(a)(1) to carry out those activities, the Secretary shall deposit the savings into the other Project Fund Account, if such funds are necessary to complete the construction of any component of the Tú ńlį́į́níchoh Water Infrastructure Project.</text></paragraph><paragraph id="H59691149A4B64BC3A45182CAF785F756"><enum>(2)</enum><header>Remaining funds</header><subparagraph commented="no" display-inline="no-display-inline" id="H6E434DB607F54391932128F59DF63F7A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any funds remaining in the Project Fund on the Date of Substantial Completion shall be deposited in the Yavapai-Apache Nation Water Settlement Trust Fund established by section 8(a) not later than 60 days after that date.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H94E194E861E948B4A872DCF544C57072"><enum>(B)</enum><header>Allocation</header><text display-inline="yes-display-inline">No later than 30 days after the Date of Substantial Completion, the Yavapai-Apache Nation may direct the allocation and amounts for the deposit of such funds to 1 or more of the accounts described in section 8(b), but if no timely direction is provided to the Secretary, the Secretary shall deposit the full amount of such funds to the Yavapai-Apache Water Projects Account described in paragraph (2) of that section.</text></subparagraph></paragraph></subsection></section><section id="H2FE1F3A27BA240C2B2BF518525CEED81"><enum>8.</enum><header>Yavapai-Apache Nation Water Settlement Trust Fund</header><subsection id="H502D43D42C424A7DADB58D87696524A0"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a trust fund for the Yavapai-Apache Nation, to be known as the <quote>Yavapai-Apache Nation Water Settlement Trust Fund</quote> (referred to in this section as the <term>Trust Fund</term>), to be managed, invested, and distributed by the Secretary and to remain available until expended, withdrawn, or reverted to the general fund of the Treasury, consisting of the amounts deposited in the Trust Fund under subsection (c), together with any investment earnings, including interest, earned on those amounts for the purpose of carrying out this Act.</text></subsection><subsection id="HC46C51B8E19E4561BF6FDFCA8659BB5C"><enum>(b)</enum><header>Accounts</header><text>The Secretary shall establish in the Trust Fund the following accounts:</text><paragraph id="H79C8214B897C45E998B4985401996075"><enum>(1)</enum><text>The Yavapai-Apache Water Settlement Implementation Account.</text></paragraph><paragraph id="HE4A760E755E54B488FB4BA69536847E9"><enum>(2)</enum><text>The Yavapai-Apache Water Projects Account.</text></paragraph><paragraph id="HE2213F976A6F449B8F4451FCA90420C2"><enum>(3)</enum><text>The Yavapai-Apache Wastewater Projects Account.</text></paragraph><paragraph id="H7F4447CB4ADE41C4B05C80EE9539CA08"><enum>(4)</enum><text>The Yavapai-Apache OM&amp;R Account.</text></paragraph><paragraph id="H4C69F5A6FD6446E1AEB418E8EBAC2707"><enum>(5)</enum><text>The Yavapai-Apache Watershed Rehabilitation and Restoration Account.</text></paragraph></subsection><subsection id="H7FE8D086BEF444B39AB2139E51255EA4"><enum>(c)</enum><header>Deposits</header><text>The Secretary shall deposit—</text><paragraph id="HCDA7E0F5FE9445888F3FA100F2B1ABAF"><enum>(1)</enum><text>in the Yavapai-Apache Water Settlement Implementation Account established under subsection (b)(1), the amounts made available pursuant to subparagraph (A) of section 10(a)(2);</text></paragraph><paragraph id="H511C6A77F11A414BA9BD554A900BF243"><enum>(2)</enum><text>in the Yavapai-Apache Water Projects Account established under subsection (b)(2), the amounts made available pursuant to subparagraph (B) of that section;</text></paragraph><paragraph id="H0B0133CFBC8A4AF39885B47329023CC2"><enum>(3)</enum><text>in the Yavapai-Apache Wastewater Projects Account established under subsection (b)(3), the amounts made available pursuant to subparagraph (C) of that section;</text></paragraph><paragraph id="H875315BE2F034701AF1EA83758438993"><enum>(4)</enum><text>in the Yavapai-Apache OM&amp;R Account established under subsection (b)(4), the amounts made available pursuant to subparagraph (D) of that section; and</text></paragraph><paragraph id="H4A6D48F6770749E49B9E417F07F33516"><enum>(5)</enum><text>in the Yavapai-Apache Watershed Rehabilitation and Restoration Account established under subsection (b)(5), the amounts made available pursuant to subparagraph (E) of that section.</text></paragraph></subsection><subsection id="HF21F75376FE74644AFF7AEBE4D0E0CAA"><enum>(d)</enum><header>Management and interest</header><paragraph id="H9788F364F2F84F5AA09479F68F0CF854"><enum>(1)</enum><header>Management</header><text>On receipt and deposit of amounts into the Trust Fund pursuant to subsection (c), the Secretary shall manage, invest, and distribute all amounts in the Trust Fund in a manner that is consistent with the investment authority of the Secretary under—</text><subparagraph id="H70FA358BA2E8413A93D3F4EE878686E4"><enum>(A)</enum><text>the first section of the Act of June 24, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>);</text></subparagraph><subparagraph id="H5EB413225C7B42DE9B037C981AB0E05A"><enum>(B)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H93182804EA284EDCA72B0DA5DA143E81"><enum>(C)</enum><text>this subsection.</text></subparagraph></paragraph><paragraph id="HFCD6436C37104907A04D16290EEC9BEF"><enum>(2)</enum><header>Investment earnings</header><text>In addition to the deposits made to the Trust Fund under subsection (c), any investment earnings, including interest, credited to amounts in the Trust Fund are authorized to be used in accordance with subsection (g).</text></paragraph></subsection><subsection id="H276F9ECD0FEA496F8A213BFBF638555A"><enum>(e)</enum><header>Availability of amounts</header><text>Amounts deposited in the Trust Fund (including any investment earnings) shall be made available to the Yavapai-Apache Nation by the Secretary beginning on the Enforceability Date, subject to the requirements of this Act.</text></subsection><subsection id="HE48C2BC4C34549919D14A7F3D192585D"><enum>(f)</enum><header>Withdrawals</header><paragraph id="H4EE2A0C3F8DA4D1B833373275B36ECDB"><enum>(1)</enum><header>Withdrawals under the american indian trust fund management reform act of 1994</header><subparagraph id="H5165EE08C3A140CAAFA0D1172F218219"><enum>(A)</enum><header>In general</header><text>The Yavapai-Apache Nation may withdraw any portion of the amounts in the Trust Fund on approval by the Secretary of a Tribal management plan submitted by the Nation in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>).</text></subparagraph><subparagraph id="HE62322DDB3914DBD814342FE9F17EB36"><enum>(B)</enum><header>Requirements</header><text>In addition to the requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001 et seq.</external-xref>), the Tribal management plan under this subsection shall require that the Yavapai-Apache Nation spend all amounts withdrawn from the Trust Fund and any investment earnings accrued through the investments under the Tribal management plan in accordance with this Act.</text></subparagraph><subparagraph id="H672B6FA00A3E4B5FB92DB8914AD03B8E"><enum>(C)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary—</text><clause id="HCDD085B5CA9B486FBCA8E544F3F001BE"><enum>(i)</enum><text>to enforce a Tribal management plan; and</text></clause><clause id="H63A698AF4CF548109AA30989166D2D70"><enum>(ii)</enum><text>to ensure that amounts withdrawn by the Yavapai-Apache Nation from the Trust Fund under this subsection are used in accordance with this Act.</text></clause></subparagraph></paragraph><paragraph id="H4CD962C8E85240ECA8ACBF4D9DB4BC82"><enum>(2)</enum><header>Expenditure plan</header><subparagraph id="HA0F5478EBF0747E89285D2452F15FC74"><enum>(A)</enum><header>In general</header><text>The Yavapai-Apache Nation may submit to the Secretary a request to withdraw funds from the Trust Fund pursuant to an approved expenditure plan.</text></subparagraph><subparagraph id="H2A86FB13CAB34089947BE7D7FAABD438"><enum>(B)</enum><header>Requirements</header><text>To be eligible to withdraw amounts under an expenditure plan under this paragraph, the Yavapai-Apache Nation shall submit to the Secretary an expenditure plan for any portion of the Trust Fund that the Yavapai-Apache Nation elects to withdraw pursuant to this paragraph, subject to the condition that the amounts shall be used for the purposes described in this Act.</text></subparagraph><subparagraph id="HCDA32E37037A43138A9C6A6D1950FB67"><enum>(C)</enum><header>Inclusions</header><text>An expenditure plan under this paragraph shall include a description of the manner and purpose for which the amounts proposed to be withdrawn from the Trust Fund will be used by the Yavapai-Apache Nation in accordance with this Act.</text></subparagraph><subparagraph id="HF42AFD7D412C413BBEF98DF4A91324F8"><enum>(D)</enum><header>Approval</header><text>The Secretary shall approve an expenditure plan submitted under subparagraph (B) if the Secretary determines that the expenditure plan—</text><clause id="H001F064A01F24E3BA9FCF2DB4CFB7C43"><enum>(i)</enum><text>is reasonable; and</text></clause><clause id="HFE630DEB05BB4A16AA825D554944522A"><enum>(ii)</enum><text>is consistent with, and will be used to carry out, the purposes of this Act.</text></clause></subparagraph><subparagraph id="H29228D3AC4D54C06B5D3BD2F4D5CDBA3"><enum>(E)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary to enforce an expenditure plan to ensure that amounts disbursed under this subsection are used in accordance with this Act.</text></subparagraph></paragraph></subsection><subsection id="H1E40CBD24F3D4B32B220D6851CD10B8F"><enum>(g)</enum><header>Uses</header><text>The amounts from the Trust Fund shall be used by the Yavapai-Apache Nation for the following purposes:</text><paragraph id="H20890D1FC4C54C2880F77D1BF226D1D8"><enum>(1)</enum><header>The yavapai-apache water settlement implementation account</header><text>Amounts in the Yavapai-Apache Water Settlement Implementation Account established under subsection (b)(1) may only be used—</text><subparagraph id="HC13F55341C594592AB65F2B9D5BEA92A"><enum>(A)</enum><text>to pay fees and costs incurred by the Yavapai-Apache Nation for filing and processing any application or obtaining any permit required under paragraph 5.0, 8.0, or 11.0 of the Agreement;</text></subparagraph><subparagraph id="H3947B19F8233455B8DEA085A523F0398"><enum>(B)</enum><text>to pay costs incurred by the Yavapai-Apache Nation to participate in the planning, preliminary design, and environmental compliance activities for the Cragin-Verde Pipeline Project;</text></subparagraph><subparagraph id="HCBB1638833794C7E806BE3CD219D8817"><enum>(C)</enum><text>to engage in water management planning to comply with paragraph 12.0 of the Agreement; and</text></subparagraph><subparagraph id="HE7848D079ABE40898585E27AECC55132"><enum>(D)</enum><text>to pay, reimburse, or retire debt for costs incurred by the Yavapai-Apache Nation after the date of enactment of this Act for work under subparagraph (A), (B), or (C).</text></subparagraph></paragraph><paragraph id="HAA70925147494E5396A6F476761ED301"><enum>(2)</enum><header>The yavapai-apache water projects account</header><text>Amounts in the Yavapai-Apache Water Projects Account established under subsection (b)(2) may only be used—</text><subparagraph id="HF77F1933D0A64983BDBAFB64730DB5B1"><enum>(A)</enum><text>for environmental compliance, permitting, planning, engineering and design, and construction, including acquisition of any necessary rights-of-way or other interests in land, and any other related activities necessary for the completion of construction for—</text><clause id="HCE6E0983FBAE4367975AEB33DA97EBDE"><enum>(i)</enum><text>expansion of the YAN Drinking Water System Project after the Date of Substantial Completion;</text></clause><clause id="HEA704109E72C421B9577B371F2CFD7DF"><enum>(ii)</enum><text>water infrastructure, and water storage and recovery projects, that facilitate the use or management of the water sources identified in subparagraph 4.1 of the Agreement; and</text></clause><clause id="H966ED6D777D74DE69D965940E87F6D04"><enum>(iii)</enum><text>the proportionate share of the Yavapai-Apache Nation for any joint project with communities in the Verde Valley Watershed that facilitate the use or management of the water sources identified in subparagraph 4.1 of the Agreement; and</text></clause></subparagraph><subparagraph id="H107265D33DA444F89B916AA17CA2E28F"><enum>(B)</enum><text>to pay, reimburse, or retire debt for costs incurred by the Yavapai-Apache Nation after the date of enactment of this Act for projects under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H3313967BCF204A75A9C82EB450673FC0"><enum>(3)</enum><header>The yavapai-apache wastewater projects account</header><text>Amounts in the Apache Wastewater Projects Account established under subsection (b)(3) may only be used—</text><subparagraph id="HC99F83A6F68246D9892A87BDF1609C4D"><enum>(A)</enum><text>for environmental compliance, planning, permitting, engineering and design, and construction, including acquisition of any necessary rights-of-way or other interests in land, and any other related activities necessary for the completion of construction for—</text><clause id="HF365FE04F52A433DB3233AAF59C6FA0A"><enum>(i)</enum><text>wastewater infrastructure, and wastewater storage and recovery projects, that facilitate the reuse or management of Effluent; and</text></clause><clause id="HAFE4DF7C4D8D4FCDB2A5F32F095F74E8"><enum>(ii)</enum><text>the proportionate share of the Yavapai-Apache Nation for any joint project or projects with communities in the Verde Valley Watershed that facilitate the reuse or management of Effluent;</text></clause></subparagraph><subparagraph id="HC91A139049FC4D5385D8793C18117267"><enum>(B)</enum><text>to pay, reimburse, or retire debt for costs incurred by the Yavapai-Apache Nation after the date of enactment of this Act for projects under subparagraph (A); and</text></subparagraph><subparagraph id="H2B3881F6B3804C98BC609F58C858B2FD"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H1B68859CAF364200B38E70C089041CED"><enum>(i)</enum><text>to pay the outstanding debt on the loan of the Yavapai-Apache Nation with the Water Infrastructure and Finance Authority of Arizona for the construction of the Middle Verde Water Reclamation Facility; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H416CCF6F5A3546E4A2C3E4636B79B840" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">to reimburse the Yavapai-Apache Nation up to $8,000,000 in additional construction costs related to construction of the Middle Verde Water Reclamation Facility.</text></clause></subparagraph></paragraph><paragraph id="H6F3F4C328BFC4A29A42BA3A9478AC4C2"><enum>(4)</enum><header>The yavapai-apache om&amp;r account</header><text>Amounts in the Yavapai-Apache OM&amp;R Account established under subsection (b)(4) may only be used to pay—</text><subparagraph id="HFAA5568301EF4695AE839FB0EFC9F6D4"><enum>(A)</enum><text>OM&amp;R and energy costs for the Tú ńlį́į́níchoh Water Infrastructure Project, including the Cragin-Verde Pipeline Project and the YAN Drinking Water System Project;</text></subparagraph><subparagraph id="HFF68058444C6479B85EDC90B77CFAFE1"><enum>(B)</enum><text>OM&amp;R, energy costs, and any other charges assessed to the Yavapai-Apache Nation pursuant to the YAN-SRP Water Delivery and Use Agreement, the YAN-SRP Exchange Agreement, and the YAN Amended CAP Water Delivery Contract;</text></subparagraph><subparagraph id="HAF190E9FC52D42D3A69870EB11B6A3AD"><enum>(C)</enum><text>OM&amp;R for Yavapai-Apache Nation projects described in paragraphs (2), (3), and (5); and</text></subparagraph><subparagraph id="H12C12B4F758D496EAECE7D9A1AFAE57D"><enum>(D)</enum><text>OM&amp;R, energy costs, and other charges incurred by the Nation for the storage, transportation and recovery of water or Effluent.</text></subparagraph></paragraph><paragraph id="H4BA3991A031643C38BAFD8BC113D0ACB"><enum>(5)</enum><header>Yavapai-apache watershed rehabilitation and restoration account</header><text>Amounts in the Yavapai-Apache Watershed Rehabilitation and Restoration Account established under subsection (b)(5) may only be used for the purpose of environmental compliance, permitting, planning, engineering and design activities, and construction of projects for the protection and restoration of the Verde River Watershed, and any other related activities necessary for the completion of such projects.</text></paragraph></subsection><subsection id="HDFDC8C63FEE54C7ABB32FCDA12AD94DD"><enum>(h)</enum><header>Liability</header><text>The Secretary and the Secretary of the Treasury shall not be liable for the expenditure or investment of any amounts withdrawn from the Trust Fund by the Yavapai-Apache Nation under subsection (f).</text></subsection><subsection id="H0905D2EEB338425CA49745B0485173E6"><enum>(i)</enum><header>Title to infrastructure</header><text>Title to, control over, and operation of any project constructed using funds from the Trust Fund shall remain in the Yavapai-Apache Nation.</text></subsection><subsection id="H6A4E1136DCCB40619AEB6B39E14B62F6"><enum>(j)</enum><header>No per capita distributions</header><text>No portion of the Trust Fund shall be distributed on a per capita basis to any Member of the Yavapai-Apache Nation.</text></subsection><subsection id="H4139439E13584D208C6BAF96D98BA947"><enum>(k)</enum><header>Expenditure reports</header><text>The Yavapai-Apache Nation shall annually submit to the Secretary an expenditure report describing accomplishments and amounts spent from use of withdrawals under a Tribal management plan under subsection (f)(1) or an expenditure plan under subsection (f)(2).</text></subsection><subsection id="H2970154488F3493A958D6AFEA709419D"><enum>(l)</enum><header>Effect</header><text>Nothing in this section gives the Yavapai-Apache Nation the right to judicial review of a determination of the Secretary relating to whether to approve a Tribal management plan under subsection (f)(1) or an expenditure plan under subsection (f)(2) except under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></subsection></section><section id="H28052D6256234196BD5F04D4E7CF5850"><enum>9.</enum><header>Gaging station</header><text display-inline="no-display-inline">The Secretary, acting through the Director of the USGS, shall continue to maintain and operate the existing USGS gaging station at the YAN Point of Compliance, identified as <quote>Verde River Above Camp Verde - 09504950</quote> in Exhibit 11.1B to the Agreement, within the Yavapai-Apache Reservation, for the purpose of monitoring the instream flow right of the Yavapai-Apache Nation to the Verde River as described in paragraph 11.0 of the Agreement.</text></section><section id="H8B0283EC2AD74988B482706219942DD7"><enum>10.</enum><header>Funding</header><subsection id="HCC370C776E9946F589E55DFC7E8C9839"><enum>(a)</enum><header>Mandatory appropriations</header><text>Out of any money in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary, to remain available to the Secretary until expended, withdrawn, or reverted to the general fund of the Treasury, the following amounts:</text><paragraph id="H59E78D1DB3374154A4D31856385C16D0"><enum>(1)</enum><header>Tú ńlį́į́níchoh water infrastructure project fund</header><text>For deposit in the following accounts of the Tú ńlį́į́níchoh Water Infrastructure Project Fund established under section 7(a):</text><subparagraph id="H54A25D28EFEE4895B9385B3BE064108D"><enum>(A)</enum><text>$731,059,000 in the Cragin-Verde Pipeline Account established under section 7(b)(1).</text></subparagraph><subparagraph id="H4EC3903E08114D009891E535708808A1"><enum>(B)</enum><text>$152,490,000 in the YAN Drinking Water System Account established under section 7(b)(2).</text></subparagraph></paragraph><paragraph id="HB5953DD20CE84F7189A71942463776B0"><enum>(2)</enum><header>Yavapai-apache nation water settlement trust fund</header><text>For deposit in the following accounts of the Yavapai-Apache Nation Water Settlement Trust Fund established under section 8(a):</text><subparagraph id="HDE4AB24CCA1C43BEA570F681F280387D"><enum>(A)</enum><text>$300,000 in the Yavapai-Apache Water Settlement Implementation Account established under section 8(b)(1).</text></subparagraph><subparagraph id="HA2595D6D5CB14335BF1C53ECC555E3B3"><enum>(B)</enum><text>$58,000,000 in the Yavapai-Apache Water Projects Account established under section 8(b)(2).</text></subparagraph><subparagraph id="H3F1669DE02954790B0AB8F393AA30765"><enum>(C)</enum><text>$31,000,000 in the Yavapai-Apache Wastewater Projects Account established under section 8(b)(3).</text></subparagraph><subparagraph id="H7710A837F21344D9B2E62422AB2FECDB"><enum>(D)</enum><text>$66,000,000 in the Yavapai-Apache OM&amp;R Account established under section 8(b)(4).</text></subparagraph><subparagraph id="H2D3D7566CBDB42F3897845851685F886"><enum>(E)</enum><text>$700,000 in the Yavapai-Apache Watershed Rehabilitation and Restoration Account established under section 8(b)(5).</text></subparagraph></paragraph></subsection><subsection id="H44C922C4B0FE4EB7A0147BDAC859C5BA"><enum>(b)</enum><header>Fluctuation in costs</header><paragraph id="HC00ECD1663AD4F9B996EB6DB82468777"><enum>(1)</enum><header>Project fund</header><text>The amounts appropriated under subsection (a)(1) shall be—</text><subparagraph id="HABB0E6CE6FE44ECEA874109E40A08B29"><enum>(A)</enum><text>increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs occurring after January 1, 2024, as indicated by the Bureau of Reclamation Construction Cost Index applicable to the types of construction involved; and</text></subparagraph><subparagraph id="H762A5C4FD3F140C6AD2EBFC8A1C0439F"><enum>(B)</enum><text>adjusted to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices as determined by the Secretary, including repricing applicable to the means of construction and current industry standards involved.</text></subparagraph></paragraph><paragraph id="HE72088ABB2FE489AA878C5EC4119F23B"><enum>(2)</enum><header>Trust fund</header><text>The amounts appropriated under subsection (a)(2) shall be—</text><subparagraph id="HDA722E87142E47EA94334E721B1DED37"><enum>(A)</enum><text>increased or decreased, as appropriate, by such amounts as may be justified by reason of ordinary fluctuations in costs occurring after January 1, 2024, as indicated by the Bureau of Reclamation Construction Cost Index—Composite Trend; and</text></subparagraph><subparagraph id="HF140847E76FE4E24AB89712240B042CD"><enum>(B)</enum><text>adjusted to address construction cost changes necessary to account for unforeseen market volatility that may not otherwise be captured by engineering cost indices as determined by the Secretary, including repricing applicable to the means of construction and current industry standards involved.</text></subparagraph></paragraph><paragraph id="HF5D8AEBBFE294747936295589C59D4F1"><enum>(3)</enum><header>Repetition</header><text>The adjustment process under this subsection shall be repeated for each subsequent amount appropriated until the amount authorized, as adjusted, has been appropriated.</text></paragraph><paragraph id="HA4FD073A688A4B7BACEB77349F565809"><enum>(4)</enum><header>Requirements for adjustment process</header><text>The adjustment process under this subsection shall be repeated for each subsequent amount appropriated for deposit in the Tú ńlį́į́níchoh Water Infrastructure Project Fund under subsection (a)(1) and the Yavapai-Apache Nation Water Settlement Trust Fund under subsection (a)(2), until the amount authorized to be appropriated, as so adjusted, has been appropriated.</text></paragraph><paragraph id="H9571A69E711C4F50B1EFEDA24B30E020"><enum>(5)</enum><header>Period of indexing</header><subparagraph id="HB0DEB6F1296A4F31854C89A1BDB2E710"><enum>(A)</enum><header>Project fund</header><text>With respect to the Tú ńlį́į́níchoh Water Infrastructure Project Fund, the period of indexing adjustment for any increment of funding shall be annual until the Tú ńlį́į́níchoh Water Infrastructure Project is completed.</text></subparagraph><subparagraph id="H4BB306EF41B244EBA045CC2FAFF03CB9"><enum>(B)</enum><header>Trust fund</header><text>With respect to the Yavapai-Apache Nation Water Settlement Trust Fund, the period of indexing adjustment for any increment of funding shall end on the date on which funds are deposited into the Yavapai-Apache Nation Water Settlement Trust Fund.</text></subparagraph></paragraph></subsection><subsection id="HE9DE7083F59A4CFCBA3CDD5C245B7D3A"><enum>(c)</enum><header>Commencement of environmental compliance</header><text>Subject to the requirements of subparagraphs (A) and (B) of section 7(e)(2), effective beginning on the date of deposit of funds in the Tú ńlį́į́níchoh Water Infrastructure Project Fund under subsection (a)(1), the Secretary shall commence any planning, design, environmental, cultural, and historical compliance activities necessary to implement the Agreement and this Act, including activities necessary to comply with section 4(c)(1).</text></subsection></section><section id="HB74F9CF0F7364465B45F91CD81E9BB6D"><enum>11.</enum><header>Waivers, releases, and retentions of claims</header><subsection id="H8380F3D1F6A444B9B4ABFEDBE940AFD0"><enum>(a)</enum><header>Waiver, release, and retention of claims for water rights and injury to water rights by the yavapai-Apache nation, on behalf of the yavapai-Apache nation and the members of the yavapai-Apache nation (but not members in the capacity of the members as allottees), and the united states, acting as trustee for the yavapai-Apache nation (but not members in the capacity of the members as allottees)</header><paragraph id="H26BC5B99933B408B81ADE7D9F39C74EC"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), the Yavapai-Apache Nation, on behalf of the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees), and the United States, acting as trustee for the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees), as part of the performance of the respective obligations of the Yavapai-Apache Nation and the United States under the Agreement and this Act, shall execute a waiver and release of any claims against the State (or any agency or political subdivision of the State), and any other individual, entity, corporation, or municipal corporation under Federal, State, or other law for all—</text><subparagraph id="H4F9DD495DD9D43F39A4A2D15F7C6B291"><enum>(A)</enum><text>past, present, and future claims for Water Rights, including rights to Colorado River Water, for YAN Land, arising from time immemorial and, thereafter, forever;</text></subparagraph><subparagraph id="H0D304AE570D2487291853213D7AC576C"><enum>(B)</enum><text>past, present, and future claims for Water Rights, including rights to Colorado River Water, arising from time immemorial and, thereafter, forever, that are based on the aboriginal occupancy of land by the Yavapai-Apache Nation, the predecessors of the Yavapai-Apache Nation, the Members of the Yavapai-Apache Nation, or the predecessors of the Members of the Yavapai-Apache Nation;</text></subparagraph><subparagraph id="H24BA422E58164313B3BCF567D9B1D7A4"><enum>(C)</enum><text>past and present claims for Injury to Water Rights, including rights to Colorado River Water, for YAN Land, arising from time immemorial through the Enforceability Date;</text></subparagraph><subparagraph id="H08AED6DC971C4165878D169364A6A978"><enum>(D)</enum><text>past, present, and future claims for Injury to Water Rights, including rights to Colorado River Water, arising from time immemorial and, thereafter, forever, that are based on the aboriginal occupancy of land by the Yavapai-Apache Nation, the predecessors of the Yavapai-Apache Nation, the Members of the Yavapai-Apache Nation, or the predecessors of the Members of the Yavapai-Apache Nation;</text></subparagraph><subparagraph id="HE0885525640B4035B0432347A40ED41A"><enum>(E)</enum><text>claims for Injury to Water Rights, including rights to Colorado River Water, arising after the Enforceability Date, for YAN Land, resulting from the off-Reservation Diversion or Use of Water in a manner not in violation of the Agreement or State law; and</text></subparagraph><subparagraph id="H01DD81195284493DA4C3700C1B295542"><enum>(F)</enum><text>past, present, and future claims arising out of, or relating in any manner to, the negotiation, execution, or adoption of the Agreement, any judgment or decree approving or incorporating the Agreement, or this Act.</text></subparagraph></paragraph><paragraph id="H22EC4113C43741A1AC9C5F4069351714"><enum>(2)</enum><header>Form; effect</header><text>The waiver and release of claims described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H45E4EDFEAFCE48D597E90A8008656679"><enum>(A)</enum><text display-inline="yes-display-inline">shall be in the form described in Exhibit 13.1 to the Agreement; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB2ED7621E9724D1A89A50A428DE4D1F7"><enum>(B)</enum><text display-inline="yes-display-inline">shall take effect on the Enforceability Date.</text></subparagraph></paragraph><paragraph id="H64DDD98219C04452B7BAD69C350797D8"><enum>(3)</enum><header>Retention of claims</header><text>Notwithstanding the waiver and release of claims described in paragraph (1) and Exhibit 13.1 to the Agreement, the Yavapai-Apache Nation, on behalf of the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation, and the United States, acting as trustee for the YAN and the Members of the YAN (but not Members in the capacity of the Members as Allottees), shall retain any right—</text><subparagraph id="HA1286DF9032646D897CB322F5C88E45F"><enum>(A)</enum><text>subject to subparagraph 17.9 of the Agreement, to assert claims for injuries to, and seek enforcement of, their rights under the Agreement or this Act in any Federal or State court of competent jurisdiction;</text></subparagraph><subparagraph id="H0906DCDBBAC14DF68A313E227567DF2C"><enum>(B)</enum><text>to assert claims for injuries to, and seek enforcement of, their rights under any judgment or decree entered by the Gila River Adjudication Court, including the Verde River Decree;</text></subparagraph><subparagraph id="HC33D1E3A0C0E4E96A8682C5BC8BF45CD"><enum>(C)</enum><text>to assert claims for Water Rights or Injury to Water Rights acquired before the Enforceability Date pursuant to subparagraph 4.14.1 of the Agreement;</text></subparagraph><subparagraph id="H11BD569646DA4ED0BF57DEB6A7C35810"><enum>(D)</enum><text>to challenge or object to any claims for Water Rights or Injury to Water Rights by or for any Indian Tribe, or the United States acting on behalf of any Indian Tribe;</text></subparagraph><subparagraph id="H00E31BE05ACD4CBBA0C290BF8C5171D2"><enum>(E)</enum><text>to assert past, present, or future claims for Injury to Water Rights against any Indian Tribe, or the United States, acting on behalf of any Indian Tribe;</text></subparagraph><subparagraph id="H418712099BB145ADAC424B5F5BD6FC31"><enum>(F)</enum><text>to assert claims for Injury to Water Rights arising after the Enforceability Date for YAN Land resulting from any off-Reservation Diversion of Surface Water within the Verde River Watershed, other than from a well, if the Diversion or Use of Surface Water was first initiated after the Effective Date and was not the subject of a permit to appropriate Surface Water issued by the Arizona Department of Water Resources before the Effective Date; and</text></subparagraph><subparagraph id="H184C2C0D88504CDEADC62C329B0350C9"><enum>(G)</enum><text>to assert claims for Injury to Water Rights arising after the Enforceability Date for YAN Land resulting from any off-Reservation Diversion or Use of Water from a well, if—</text><clause id="H75CC1C3C252348458C9596657E5F58A0"><enum>(i)</enum><text>the Water is determined by the Gila River Adjudication Court to be Surface Water;</text></clause><clause id="H930E92099C2E44388AD8B5BF1358D297"><enum>(ii)</enum><text>the well is located within the Verde River Watershed above USGS Gage No. 09506000 identified as <quote>Verde River near Camp Verde, AZ</quote>;</text></clause><clause id="H944013B491574228A7CBE394E4B58C38"><enum>(iii)</enum><text>the well was constructed after the Effective Date; and</text></clause><clause id="H9CC54C1C923F49C0977F9289AD10E94B"><enum>(iv)</enum><text>the well is not—</text><subclause id="H515AA928CB7F4576ABEB36BBEE05941D"><enum>(I)</enum><text>a Replacement Well;</text></subclause><subclause id="H5C402FEB5E974AC4959A13EFA63019E7"><enum>(II)</enum><text>a new point of Diversion for a Surface Water Use predating the Effective Date;</text></subclause><subclause id="H3C47903C22F6475B99FCAD87532EEF51"><enum>(III)</enum><text>operated by a Municipal Water Provider pursuant to an agreement with the Yavapai-Apache Nation under subparagraph 16.1.2 of the Agreement;</text></subclause><subclause id="HD308820B5B5244C99F64BB5A90D3B0EF"><enum>(IV)</enum><text>constructed for Domestic Use or Stock Watering Use;</text></subclause><subclause id="H50392ED449824528AB47D26FDB92ABC8"><enum>(V)</enum><text>constructed to supply a Stockpond with a capacity not to exceed 4 acre-feet;</text></subclause><subclause id="HC3D55AF4B32245569B477CA5D28AD112"><enum>(VI)</enum><text>used by a city or town in the Prescott active management area—</text><item id="H44DEEF0A443347AE9344DC5067211ED8"><enum>(aa)</enum><text>to withdraw Underground Water from land located in the Big Chino sub-basin of the Verde River groundwater basin that has historically irrigated acres for transportation to an adjacent initial active management area under the criteria described in sections 45–555(A), 45–555(B), 45–555(C), and 45–555(D) of the Arizona Revised Statutes, as those sections exist as of the Effective Date, a copy of which is attached as Exhibit 13.1.3 to the Agreement;</text></item><item id="H615848AEF1944EB8B6B3EBB4C85CF4EA"><enum>(bb)</enum><text>to withdraw and transport 8,068 AFY of Underground Water from the Big Chino sub-basin of the Verde River groundwater basin to the Prescott active management area pursuant to the criteria described in sections 45–555(E) and 45–555(G) of the Arizona Revised Statutes, as those sections exist as of the Effective Date, a copy of which is attached as Exhibit 13.1.3 to the Agreement; or</text></item><item id="HD012A917A5B74144881CDDBBBF6B3429"><enum>(cc)</enum><text>to withdraw and transport Underground Water from land located in the Big Chino sub-basin of the Verde River groundwater basin to the Prescott active management area to meet the additional needs of an Indian Tribe in the Prescott active management area pursuant to a federally approved Indian water rights settlement under sections 45–555(G) and 45–555(F), as those sections exist as of the Effective Date, a copy of which is attached as Exhibit 13.1.3 to the Agreement; and</text></item></subclause><subclause id="HC5A2682ABA1544C987231679805879A2"><enum>(VII)</enum><text>providing a source of supply for an M&amp;I Use for a Municipal Water Provider or a Public Water System (that does not have an agreement with the YAN pursuant to subparagraph 16.1.2 of the Agreement) that meets certain conditions, including that—</text><item id="H323D3D58B58D473F8A2DA0B81848E246"><enum>(aa)</enum><text>the well is located outside the lateral limits of the Verde River Subflow Zone;</text></item><item id="H18B3C4B719F74719A910A80AFA511C88"><enum>(bb)</enum><text>all buildings constructed after the well is drilled that are served by the Municipal Water Provider or Public Water System have WaterSense Labeled Fixtures, or fixtures that are equivalent to or exceed WaterSense specifications for water efficiency and performance as described in Exhibit 2.90 to the Agreement;</text></item><item id="H3029CF7688E440ACB0622A0DD63EF00B"><enum>(cc)</enum><text>the Municipal Water Provider or Public Water System uses its best efforts to ensure that all outdoor landscaping installed after the well is drilled that is served by the Municipal Water Provider or Public Water System uses only native or drought tolerant plants, except as provided for in item (dd);</text></item><item id="HEF5FFD2104FF42C6B8C9FC8CA9E249C9"><enum>(dd)</enum><text>all turf or other landscape areas not using native or drought tolerant plants, including for schools, parks, cemeteries, golf courses, or common areas, installed after the well is drilled are, to the extent permitted by State law, prohibited by the Municipal Water Provider or Public Water System unless the plants are 100 percent served with Effluent, greywater, harvested rainwater, or some combination thereof; and</text></item><item id="H60CB57E503A746A6BCEE801567A7E1D7"><enum>(ee)</enum><text>ornamental water features (except swimming pools), ponds, and lakes constructed after the well is drilled are, to the extent permitted by State law, prohibited by the Municipal Water Provider or Public Water System unless the features, ponds, and lakes are 100 percent served with Effluent, greywater, harvested rainwater, or some combination thereof.</text></item></subclause></clause></subparagraph></paragraph></subsection><subsection id="H7B6E7F77A9D940EF8BC0345E6A91C5EE"><enum>(b)</enum><header>Waiver, release, and retention of claims for water rights and injury to water rights by the yavapai-Apache nation, on behalf of the yavapai-Apache nation and the members of the yavapai-Apache nation (but not members in the capacity of the members as allottees), against the united states</header><paragraph id="H6B7E4F9F1FF7474DA1E6B96D3AA53F0A"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), the Yavapai-Apache Nation, on behalf of the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees), as part of the performance of the obligations of the Yavapai-Apache Nation under the Agreement and this Act, shall execute a waiver and release of all claims against the United States, including agencies, officials, and employees of the United States, under Federal, State, or other law for all—</text><subparagraph id="HE28252FC328C4821B685780657DD0501"><enum>(A)</enum><text>past, present, and future claims for Water Rights, including rights to Colorado River Water, for YAN Land, arising from time immemorial and, thereafter, forever;</text></subparagraph><subparagraph id="HAEBF5C40477E400E906FAAC879867538"><enum>(B)</enum><text>past, present, and future claims for Water Rights, including rights to Colorado River Water, arising from time immemorial and, thereafter, forever, that are based on the aboriginal occupancy of land by the Yavapai-Apache Nation, the predecessors of the Yavapai-Apache Nation, the Members of the Yavapai-Apache Nation, or the predecessors of the members of the Yavapai-Apache Nation;</text></subparagraph><subparagraph id="HBD15C590E1FC4656AD4E752D98D5C4DE"><enum>(C)</enum><text>past and present claims relating in any manner to damage, losses, or injury to land or other resources due to loss of Water or Water Rights (including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights due to loss of Water or Water Rights, claims relating to interference with, Diversion, or taking of Water, or claims relating to the failure to protect, acquire, or develop Water, Water Rights, or Water infrastructure) within the State that first accrued at any time prior to the Enforceability Date;</text></subparagraph><subparagraph id="H0ED1F58CC99B4C92963EEDFC13EA4BBF"><enum>(D)</enum><text>past and present claims for Injury to Water Rights, including rights to Colorado River Water, for YAN Land, arising from time immemorial through the Enforceability Date;</text></subparagraph><subparagraph id="H36A6592C35F34A519E99AFAAEEFAE63D"><enum>(E)</enum><text>past, present, and future claims for Injury to Water Rights, including rights to Colorado River Water, arising from time immemorial and, thereafter, forever, that are based on the aboriginal occupancy of land by the Yavapai-Apache Nation, the predecessors of the Yavapai-Apache Nation, the Members of the Yavapai-Apache Nation, or the predecessors of the members of the Yavapai-Apache Nation;</text></subparagraph><subparagraph id="HB6F9C1F4C99A464B8D9C5DD5C2AC1E51"><enum>(F)</enum><text>claims for Injury to Water Rights, including rights to Colorado River Water, arising after the Enforceability Date for YAN Land, resulting from the off-Reservation Diversion or Use of Water in a manner not in violation of the Agreement or State law; and</text></subparagraph><subparagraph id="HF6DF75C06679485CB62C682519351F12"><enum>(G)</enum><text>past, present, and future claims arising out of, or relating in any manner to, the negotiation, execution, or adoption of the Agreement, any judgment or decree approving or incorporating the Agreement, or this Act.</text></subparagraph></paragraph><paragraph id="H5BB76AD63453497AA0874B9689AB45F8"><enum>(2)</enum><header>Form; effect</header><text>The waiver and release of claims described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H49560EEC68044036A1A236565AE5DEAB"><enum>(A)</enum><text display-inline="yes-display-inline">shall be in the form described in Exhibit 13.2 to the Agreement; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC856B312974940C4A79AC00654577220"><enum>(B)</enum><text display-inline="yes-display-inline">shall take effect on the Enforceability Date.</text></subparagraph></paragraph><paragraph id="H4EB5BBE91CAA4C9AACDCB789373F23F1"><enum>(3)</enum><header>Retention of claims</header><text>Notwithstanding the waiver and release of claims described in paragraph (1) and Exhibit 13.2 to the Agreement, the Yavapai-Apache Nation, on behalf of the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees) shall retain any right—</text><subparagraph id="HB5C587A4E8374FABA51DB285F83EC4FD"><enum>(A)</enum><text>subject to subparagraph 17.9 of the Agreement, to assert claims for injuries to, and seek enforcement of, their rights under the Agreement or this Act in any Federal or State court of competent jurisdiction;</text></subparagraph><subparagraph id="HD0A5D3CB29F147BDA7AA520A9272CD94"><enum>(B)</enum><text>to assert claims for injuries to, and seek enforcement of, rights under any judgment or decree entered by the Gila River Adjudication Court, including the Verde River Decree;</text></subparagraph><subparagraph id="HDC6CDC2EBE7A4DD59D011876F4E6440B"><enum>(C)</enum><text>to assert claims for Water Rights or Injury to Water Rights acquired before the Enforceability Date pursuant to subparagraph 4.14.1 of the Agreement;</text></subparagraph><subparagraph id="HCCA9034BE0F142CCAB21A80FE01D5654"><enum>(D)</enum><text>to challenge or object to any claims for Water Rights or Injury to Water Rights by or for any Indian Tribe or the United States acting on behalf of any Indian Tribe;</text></subparagraph><subparagraph id="H77D6C5AE64844608BF7173FB3403A27B"><enum>(E)</enum><text>to assert past, present, or future claims for Injury to Water Rights against any Indian Tribe or the United States acting on behalf of any Indian Tribe;</text></subparagraph><subparagraph id="HBDE8FEC5112947CD95D896A7F1D922CD"><enum>(F)</enum><text>to assert claims for Injury to Water Rights arising after the Enforceability Date for YAN Land resulting from any off-Reservation Diversion of Surface Water within the Verde River Watershed, other than from a well, if the Diversion or Use of Surface Water was first initiated after the Effective Date and was not the subject of a permit to appropriate Surface Water issued by the Arizona Department of Water Resources before the Effective Date; and</text></subparagraph><subparagraph id="H9F9EA1519F6C4155A22156D2CBE527D2"><enum>(G)</enum><text>to assert claims for Injury to Water Rights arising after the Enforceability Date for YAN Land resulting from any off-Reservation Diversion or Use of Water from a well, if—</text><clause id="HCBD1AD17A6B441A58713F5057F60C62B"><enum>(i)</enum><text>the Water is determined by the Gila River Adjudication Court to be Surface Water;</text></clause><clause id="HC788D3803B274366B16FA15F3F17CD9F"><enum>(ii)</enum><text>the well is located within the Verde River Watershed above Gage No. 09506000, Verde River near Camp Verde, AZ;</text></clause><clause id="HF76637E6254C49E78A1EDD3495F04A9C"><enum>(iii)</enum><text>the well was constructed after the Effective Date; and</text></clause><clause id="HDE790F9CAA75473E8BEC903AAD2AF75E"><enum>(iv)</enum><text>the well is not—</text><subclause id="HF1840E4078A54E6286B8A651E87968EB"><enum>(I)</enum><text>a Replacement Well;</text></subclause><subclause id="H9F17C38A06BD47E3BB86C2753BA5E752"><enum>(II)</enum><text>a new point of Diversion for a Surface Water Use predating the Effective Date;</text></subclause><subclause id="HE480F448B2454F6A9AD3D994038E48B4"><enum>(III)</enum><text>operated by a Municipal Water Provider pursuant to an agreement with the Yavapai-Apache Nation under subparagraph 16.1.2 of the Agreement;</text></subclause><subclause id="HF56EEC27355948C3B952F1C9BB4B7F6E"><enum>(IV)</enum><text>constructed for Domestic Use or Stock Watering Use; or</text></subclause><subclause id="H2EDB45D0282B4F1D86CEFB103166E925"><enum>(V)</enum><text>constructed to supply a Stockpond with a capacity not to exceed 4 acre-feet.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H2CA5C0DEB43841A8A73B1A7855C167E0"><enum>(c)</enum><header>Waiver, release and retention of claims by the united states in all capacities (Except as trustee for an indian tribe other than the yavapai-Apache nation) against the yavapai-Apache nation and the members of the yavapai-Apache nation</header><paragraph id="H7C8F4E2EC3C340438E561C8C652927D1"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), the United States, in all capacities (except as trustee for an Indian Tribe other than the Yavapai-Apache Nation), as part of the performance of the obligations of the United States under the Agreement and this Act, shall execute a waiver and release of all claims against the Yavapai-Apache Nation, the Members of the Yavapai-Apache Nation, or any agency, official, or employee of the Yavapai-Apache Nation, under Federal, State, or any other law for all—</text><subparagraph id="H003A92FFAA8240D2837A1D777424006E"><enum>(A)</enum><text>past and present claims for Injury to Water Rights, including rights to Colorado River Water, resulting from the Diversion or Use of Water on YAN Land arising from time immemorial through the Enforceability Date;</text></subparagraph><subparagraph id="H46FA6704DD4F49D0AD960C0DDEAD4F56"><enum>(B)</enum><text>claims for Injury to Water Rights, including rights to Colorado River Water, arising after the Enforceability Date, resulting from the Diversion or Use of Water on YAN Land in a manner that is not in violation of the Agreement or State law; and</text></subparagraph><subparagraph id="HB4AB5362886245BDA305CBA78B222C96"><enum>(C)</enum><text>past, present, and future claims arising out of, or related in any manner to, the negotiation, execution, or adoption of the Agreement, any judgment or decree approving or incorporating the Agreement, or this Act.</text></subparagraph></paragraph><paragraph id="HB58B0666146741ED8D9BC2D6443369AA"><enum>(2)</enum><header>Form; effect</header><text>The waiver and release of claims described in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H65FC87102FDB4E9991487DBB1A8D8E9B"><enum>(A)</enum><text display-inline="yes-display-inline">shall be in the form described in Exhibit 13.3 to the Agreement; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0F499F20D18241E692BD40A4DD331A76"><enum>(B)</enum><text display-inline="yes-display-inline">shall take effect on the Enforceability Date.</text></subparagraph></paragraph><paragraph id="H13124F84E1304A93A459EFF170175543"><enum>(3)</enum><header>Retention of claims</header><text>Notwithstanding the waiver and release of claims described in paragraph (1) and Exhibit 13.3 to the Agreement, the United States shall retain any right to assert any claim not expressly waived in accordance with that paragraph and that exhibit.</text></paragraph></subsection><subsection id="H1E0ED1679DBD4BB380FE17A393696539"><enum>(d)</enum><header>No effect on actions relating to health, safety or environment</header><text>Nothing in the Agreement or this Act affects any right of the United States or the Yavapai-Apache Nation on behalf of the Yavapai-Apache Nation, or on behalf of the Members of the Yavapai-Apache Nation, to take any action authorized by law relating to health, safety, or the environment, including—</text><paragraph id="H1ACB57A35AA449FE93E1FD3FE5390368"><enum>(1)</enum><text>the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></paragraph><paragraph id="H587FCBE0A132409F96CCA6CF3BA7B79C"><enum>(2)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>);</text></paragraph><paragraph id="H41CB2B2E9B7B4AE4A839376A4D697CE3"><enum>(3)</enum><text>the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H515370D03AD541D89660881BFDA4058F"><enum>(4)</enum><text>any regulations implementing the Acts described in paragraphs (1) through (3).</text></paragraph></subsection></section><section id="H5A11E979471D4B00A5B2FD10F5F6B4AB"><enum>12.</enum><header>Satisfaction of water rights and other benefits; effect on members of the Yavapai-Apache Nation and Dinah Hood Allotment</header><subsection id="H86D7B0BAF6BC42DCB1C6F4EF76A32CBD"><enum>(a)</enum><header>In general</header><text>The benefits provided under the Agreement and this Act shall be in complete replacement of, in complete substitution for, and in full satisfaction of any claim of the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees) against the parties to the Agreement, including the United States, that is waived and released by the Yavapai-Apache Nation acting on behalf of the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees) pursuant to—</text><paragraph commented="no" display-inline="no-display-inline" id="H13B06BE050E2404B925DFBC997C27F74"><enum>(1)</enum><text display-inline="yes-display-inline">subsections (a) and (b) of section 11; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEB363726DD3944E0A7461890EE59DB2D"><enum>(2)</enum><text display-inline="yes-display-inline">subparagraphs 13.1 and 13.2 of the Agreement.</text></paragraph></subsection><subsection id="HCF451C91109548A49DACEA56C8A3EE5F"><enum>(b)</enum><header>Entitlements</header><text>Any entitlement to Water of the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees), or the United States as trustee for the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees), for YAN Land shall be satisfied out of the water resources and other benefits granted, confirmed, quantified, or recognized, by the Agreement or this Act to or for—</text><paragraph commented="no" display-inline="no-display-inline" id="HDEAB21A18BFB4BD2BBB626A21B49D6E1"><enum>(1)</enum><text display-inline="yes-display-inline">the Yavapai-Apache Nation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE963A5B9171D4860AC4317037B156206"><enum>(2)</enum><text display-inline="yes-display-inline">the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9EBFB830019344FAAB5C5DF578B8164A"><enum>(3)</enum><text display-inline="yes-display-inline">the United States as trustee for the Yavapai-Apache Nation and the Members of the Yavapai-Apache Nation (but not Members in the capacity of the Members as Allottees).</text></paragraph></subsection><subsection id="HDE850427C2A94AD684CEDBD93BEA2580"><enum>(c)</enum><header>Savings provision</header><text>Notwithstanding subsections (a) and (b), nothing in the Agreement or this Act—</text><paragraph id="HC548CD97408A45A68F3F2207B73A920E"><enum>(1)</enum><text>recognizes or establishes any right of a Member of the Yavapai-Apache Nation to Water on YAN Land; or</text></paragraph><paragraph id="HE031AAFA811B4BD7BCAE7828EA071F19"><enum>(2)</enum><text>prohibits the Yavapai-Apache Nation from acquiring additional Water Rights by purchase or donation of land, credits, or Water Rights.</text></paragraph></subsection><subsection id="H20FF8B253EAA447BBF454726B0F8B4A1"><enum>(d)</enum><header>Effect on members of the Yavapai-Apache Nation</header><text>Except as provided in subsections (a) and (b), and sections 11(a) and 11(b), the Agreement and this Act shall not affect any rights of any Member of the Yavapai-Apache Nation to Water for land outside of YAN Land.</text></subsection><subsection id="HC221150794504EF5AFC2CC27969146F4"><enum>(e)</enum><header>Effect on Dinah Hood Allotment</header><paragraph id="HC8E58BB6761D4D9EA6A806CB66262A15"><enum>(1)</enum><header>In general</header><text>Nothing in the Agreement or this Act—</text><subparagraph id="HF888BA102212441D8C980EB1A05F80AE"><enum>(A)</enum><text>quantifies or diminishes any Water Right, or any claim or entitlement to Water, for the Dinah Hood Allotment; or</text></subparagraph><subparagraph id="H31C8141BE8344CF687942F74D720FE47"><enum>(B)</enum><text>precludes beneficial owners of the Dinah Hood Allotment, or the United States acting in its capacity as trustee for beneficial owners of the Dinah Hood allotment, from making claims for Water Rights in the State.</text></subparagraph></paragraph><paragraph commented="no" applicable law, beneficial owners of the Dinah Hood Allotment or the United States acting in its capacity as trustee for beneficial owners of the Dinah Hood allotment may make claims to, and may be adjudicated, individual Water Rights in the State.</text></paragraph><paragraph id="H5B2D6A580E5E4C6EBE2243FAF2F0F4DF"><enum>(3)</enum><header>Exception</header><text>Notwithstanding paragraph (1), the Yavapai-Apache Nation, in the capacity of the Yavapai-Apache Nation as a holder of a beneficial real property interest in the Dinah Hood Allotment, shall not object to, challenge, or dispute the claims of water users to Water from the Verde River Watershed in—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0982B568EE2345569CC37C1BB135407D"><enum>(A)</enum><text display-inline="yes-display-inline">the Gila River Adjudication Proceedings; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5049D027EB6D4BA1BF78F37D4FFC2E69"><enum>(B)</enum><text display-inline="yes-display-inline">any other judicial or administrative proceeding.</text></subparagraph></paragraph></subsection></section><section id="HC65B359C21954639B8CFE38F7A6FFF01"><enum>13.</enum><header>Trust land</header><subsection id="H37AC2AC882204CE08E4EF2AB68187705"><enum>(a)</enum><header>Yavapai-Apache Reservation</header><text>The Yavapai-Apache Reservation includes—</text><paragraph id="H170C40BF53A94819BFC23F86F5C662C2"><enum>(1)</enum><text>the land located within the exterior boundaries of the Yavapai-Apache Reservation, as described and depicted in Exhibits 2.96A through 2.96E and 2.102 to the Agreement, as documented by the Land Titles and Records Office of the Department of the Interior;</text></paragraph><paragraph id="H6566EABAC613470A9388DFA982D396A6"><enum>(2)</enum><text>the land added to the Reservation pursuant to subsection (b);</text></paragraph><paragraph id="HEDBE4EC25AC44BAEAF79BD9C86DC362E"><enum>(3)</enum><text>the trust lands identified in Exhibit 2.98A to the Agreement as—</text><subparagraph law.</text></paragraph></subsection><subsection id="H7C83A24C390C4C47B2E317C5B21C18E3"><enum>(b)</enum><header>Land To be taken into trust</header><paragraph id="HF3BAC848CF93490597B64817404B46FD"><enum>(1)</enum><header>In general</header><text>By the date that is not later than 30 days after the date of enactment of this Act, the Secretary is authorized and directed to accept the transfer of title to the land shown on the maps in Exhibits 2.98A and 2.98B to the Agreement, as identified in subparagraphs (A) through (G) of paragraph (2), and to hold that land in trust for the benefit of the Yavapai-Apache Nation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" Recorder.</text></clause></subparagraph></paragraph><paragraph id="HAF67BBCA6A5C483CAA3C6E2BD8846753"><enum>(3)</enum><header>Valid existing rights</header><text>The land taken into trust under paragraph (1) shall be subject to valid existing rights, including easements, rights-of-way, contracts, and managements agreements.</text></paragraph><paragraph id="H59313921F38F4EFAB6C7F6DF63E41BF9"><enum>(4)</enum><header>Limitations</header><text>Nothing in this subsection affects any right or claim of the Yavapai-Apache Nation to any land or interest in land in existence before the date of enactment of this Act.</text></paragraph><paragraph id="H37CDF80BB4D24B2BBA30BEA5E656C991"><enum>(5)</enum><header>Land descriptions</header><text>The Secretary may correct, by mutual agreement with the Yavapai-Apache Nation, any errors in the land descriptions of the land conveyed to the Secretary pursuant to this subsection.</text></paragraph><paragraph id="HB08F1F771E3E435E8AC80B5927F360E6"><enum>(6)</enum><header>Conflict</header><text>In the case of a conflict between a map and a description of land in this Act, the map shall control unless the Secretary and the Yavapai-Apache Nation mutually agree otherwise.</text></paragraph></subsection></section><section id="H3B26843DB0204CB1824CA51749577A15"><enum>14.</enum><header>Yavapai-Apache Nation CAP Water</header><subsection id="HA269F2C035044C538CE9E394D64278D0"><enum>(a)</enum><header>Yavapai-Apache nation amended <enum-in-header>CAP</enum-in-header> water delivery contract</header><paragraph id="HEB48B840EA7E4D6FB63535BDC4A0A99E"><enum>(1)</enum><header>In general</header><text>In accordance with the Yavapai-Apache Nation Water Rights Settlement Agreement and the requirements described in paragraph (2), the Secretary shall enter into the YAN Amended CAP Water Delivery Contract.</text></paragraph><paragraph id="H42FC108373154C1C8AB7C22C93B8CA0E"><enum>(2)</enum><header>Requirements</header><text>The requirements referred to in paragraph (1) are the following:</text><subparagraph id="HF6988C15BE9B4C2FAE6B0FE1EADE003E"><enum>(A)</enum><header>In general</header><text>The YAN Amended CAP Water Delivery Contract shall—</text><clause id="H11856AEAA9944146ACE34B0A475F809C"><enum>(i)</enum><text>be for permanent service (as that term is used in section 5 of the Boulder Canyon Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/617d">43 U.S.C. 617d</external-xref>));</text></clause><clause id="HF1DD7DD8090545888D353CEFDACE4CA5"><enum>(ii)</enum><text>take effect on the Enforceability Date; and</text></clause><clause id="H5E8563CE06504879B34444B95E911100"><enum>(iii)</enum><text>be without limit as to term.</text></clause></subparagraph><subparagraph id="H597681938F1B41A5AD77AEBDD15BFCB0"><enum>(B)</enum><header>YAN cap water</header><clause id="H4660569C0FA04AFF9D8BE43273D46E82"><enum>(i)</enum><header>In general</header><text>The YAN CAP water may be delivered for use in the State through—</text><subclause id="H1419126B803E4D428C32C877B41CCF25"><enum>(I)</enum><text>any project authorized under this Act; or</text></subclause><subclause id="H10FF7093EEAE48DC9B12E152CBF59577"><enum>(II)</enum><text>the CAP System.</text></subclause></clause></subparagraph><subparagraph id="H12FEBC50226A4B7C8240BD5A246B496E"><enum>(C)</enum><header>Contractual delivery</header><text>The Secretary shall deliver the YAN CAP water to Yavapai-Apache Nation in accordance with the terms and conditions of the YAN Amended CAP Water Delivery Contract.</text></subparagraph><subparagraph id="H79CE8D2E46CB464981EA8086E70CC28A"><enum>(D)</enum><header>Delivery of cap indian priority water</header><clause id="HE93A39FF59BA42D19C7EE118EC8109E3"><enum>(i)</enum><header>In general</header><text>If a time of shortage (as that term is described in the YAN Amended CAP Water Delivery Contract) exists, the amount of CAP Indian Priority Water available to the YAN in the applicable Year shall be computed in accordance with the YAN Amended CAP Repayment Contract.</text></clause></subparagraph><subparagraph id="HE672680F3BB14E39986882D9B20DBAE3"><enum>(E)</enum><header>Leases and exchanges of yavapai-apache nation cap water</header><text>On or after the date on which the YAN Amended CAP Water Delivery Contract becomes effective, the Yavapai-Apache Nation may, with the approval of the Secretary, enter into contracts or options to lease or to exchange YAN CAP Water in Coconino, Gila, Maricopa, Pinal, Pima, and Yavapai counties, Arizona, providing for the temporary delivery to any individual or entity of any portion of the YAN CAP Water.</text></subparagraph><subparagraph id="HD05739F26E374D5CAF7368C5C2677300"><enum>(F)</enum><header>Terms of leases and exchanges</header><clause id="H40B0DCA4B71B4FABBDC6237713CCF74A"><enum>(i)</enum><header>Leasing</header><text>Contracts or options to lease under subparagraph (E) shall be for a term of not more than 100 years.</text></clause><clause id="H4746BE4BF683472B86F2F9362AD801AC"><enum>(ii)</enum><header>Exchanges</header><text>Contracts or options to exchange under subparagraph (E) shall be for the term provided for in the contract or option, as applicable.</text></clause><clause id="H12BD627CCD354C45BEBD128AED8F52D3"><enum>(iii)</enum><header>Renegotiation</header><text>The YAN may, with the approval of the Secretary, renegotiate any lease described in subparagraph (E), at any time during the term of the lease, subject to the condition that the term of the renegotiated lease does not exceed 100 years.</text></clause></subparagraph><subparagraph id="H888A13690D084B1A9E95F27E21C82F1D"><enum>(G)</enum><header>Prohibition on permanent alienation</header><text>No YAN CAP Water may be permanently alienated.</text></subparagraph><subparagraph id="H2954E06611754F8EADCAE17D5A2F4C81"><enum>(H)</enum><header>Entitlement to lease and exchange funds; obligations of the united states</header><clause id="HC1EF737B000B483590338C6AB9FEB12B"><enum>(i)</enum><header>Entitlement</header><subclause id="H1A3216A3AB4E45BCAFD8E8724D7D1C9A"><enum>(I)</enum><header>In general</header><text>The Yavapai-Apache Nation shall be entitled to all consideration due to the Yavapai-Apache Nation under any contract to lease, option to lease, contract to exchange, or option to exchange the YAN CAP Water entered into by the Yavapai-Apache Nation.</text></subclause><subclause id="HF6FEF3D74233486E84E913EC60F2130F"><enum>(II)</enum><header>Exclusion</header><text>The United States shall not, in any capacity, be entitled to the consideration described in subclause (I).</text></subclause></clause><clause id="H829E114C402F4681944EA5EE2805CAA2"><enum>(ii)</enum><header>Obligations of the united states</header><text>The United States shall not, in any capacity, have any trust or other obligation to monitor, administer, or account for, in any manner, any funds received by the Yavapai-Apache Nation as consideration under any contract to lease, option to lease, contract to exchange, or option to exchange the YAN CAP Water entered into by Yavapai-Apache Nation, except in a case in which the Yavapai-Apache Nation deposits the proceeds of any lease, option to lease, contract to exchange, or option to exchange into an account held in trust for the Yavapai-Apache Nation by the United States.</text></clause></subparagraph><subparagraph id="HBE6E679E7AD048CEA270E4DD80CC4909"><enum>(I)</enum><header>Water use and storage</header><clause id="H2DD3EA3FFEB8437792EC983C7FE8E4F3"><enum>(i)</enum><header>In general</header><text>The Yavapai-Apache Nation may use YAN CAP Water on or off the YAN Reservation.</text></clause><clause id="HC9D74CFF13EB4B11AABFBA1BF33A248E"><enum>(ii)</enum><header>Storage</header><text>The Yavapai-Apache Nation, in accordance with State law, may store YAN CAP Water at 1 or more underground storage facilities or groundwater savings facilities.</text></clause><clause id="H49A750409CDF4FF297049845FC019C04"><enum>(iii)</enum><header>Assignment</header><text>The Yavapai-Apache Nation may, without the approval of the Secretary, sell, transfer, or assign any long-term storage credits accrued as a result of storage described in clause (ii).</text></clause></subparagraph><subparagraph id="HDEEE9757EBC94E4D95453D6848FB26C6"><enum>(J)</enum><header>Use outside state</header><text>The Yavapai-Apache Nation may not use, lease, exchange, forbear, or otherwise transfer any YAN CAP Water for use directly or indirectly outside the State.</text></subparagraph><subparagraph id="H38AA71D694A0453B90D0AE734085B61D"><enum>(K)</enum><header>CAP fixed OM&amp;R charges</header><clause id="H403627E600BF4BCF8617CA85F483EF9D"><enum>(i)</enum><header>In general</header><text>The CAP Operating Agency shall be paid the CAP Fixed OM&amp;R charges associated with the delivery of all YAN CAP Water.</text></clause><clause id="HC6A426400C174D6CB7695C071944D913"><enum>(ii)</enum><header>Payment of charges</header><text>Except as provided in subparagraph (N), all CAP Fixed OM&amp;R charges associated with the delivery of YAN CAP Water to the Yavapai-Apache Nation shall be paid by—</text><subclause id="H8C6E2ED94BB94F709955A0B946703687"><enum>(I)</enum><text>the Secretary, pursuant to section 403(f)(2)(A) of the Colorado River Basin Project Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1543">43 U.S.C. 1543(f)(2)(A)</external-xref>), subject to the condition that funds for that payment are available in the Lower Colorado River Basin Development Fund; and</text></subclause><subclause id="H98189B75FA824B34A6E9803CCD3D24B5"><enum>(II)</enum><text>if the funds described in subclause (I) become unavailable, the Yavapai-Apache Nation.</text></subclause></clause></subparagraph><subparagraph id="HA743B0F5157146C4805AEA3D66E87921"><enum>(L)</enum><header>CAP pumping energy charges</header><clause id="HE5673BB869EF47FDA99E20B0BF6FC12E"><enum>(i)</enum><header>In general</header><text>The CAP Operating Agency shall be paid the CAP Pumping Energy Charge associated with the delivery of YAN CAP Water only in cases in which the CAP System is used for the delivery of that YAN CAP Water.</text></clause><clause id="H3D5F06BA78D94724A7EEB25229E82D63"><enum>(ii)</enum><header>Payment of charges</header><text>Any applicable CAP Pumping Energy Charge associated with the delivery of the YAN CAP Water shall be paid by the Yavapai-Apache Nation, except for—</text><subclause commented="no" display-inline="no-display-inline" id="H6B20867E82AE4AA8932FC03EAD5587BF"><enum>(I)</enum><text display-inline="yes-display-inline">CAP Water not delivered through the CAP System, which does not incur a CAP Pumping Energy Charge; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA828B67485384E19876695D037FB0231"><enum>(II)</enum><text display-inline="yes-display-inline">water delivered to other persons, as described in subparagraph (N).</text></subclause></clause></subparagraph><subparagraph id="H9BE9786D535C4DE2A04F9656263A375B"><enum>(M)</enum><header>Waiver of property tax equivalency payments</header><text>No property tax or in-lieu property tax equivalency shall be due or payable by the Yavapai-Apache Nation for the delivery of CAP Water or for the storage of CAP Water in an underground storage facility or groundwater savings facility.</text></subparagraph><subparagraph id="HB191FAF53B8043D09E69A2F606863088"><enum>(N)</enum><header>Lessee responsibility for charges</header><clause id="H79F3B22F8BE9482D91ABD4CDA03BAB45"><enum>(i)</enum><header>In general</header><text>Any lease or option to lease providing for the temporary delivery to other persons of any YAN CAP Water shall require the lessee to pay to the CAP Operating Agency the CAP Fixed OM&amp;R Charge and the CAP Pumping Energy Charge associated with the delivery of the leased YAN CAP Water.</text></clause><clause id="HABE50B76DA704B62B60226CF36EA43C6"><enum>(ii)</enum><header>No responsibility for payment</header><text>Neither the Yavapai-Apache Nation nor the United States in any capacity shall be responsible for the payment of any charges associated with the delivery of the YAN CAP Water leased to other persons.</text></clause></subparagraph><subparagraph id="H2639A6E238C247529C24D724DD3D7B45"><enum>(O)</enum><header>Advance payment</header><text>No YAN CAP Water shall be delivered unless the CAP Fixed OM&amp;R Charge and any applicable CAP Pumping Energy Charge associated with the delivery of that YAN CAP Water has been paid in advance.</text></subparagraph><subparagraph id="H4923C3E955FB4842A096FEBECCA828DF"><enum>(P)</enum><header>Calculation</header><text>The charges for delivery of YAN CAP Water pursuant to the Yavapai-Apache Nation Amended CAP Water Delivery Contract shall be calculated in accordance with the CAP Repayment Stipulation.</text></subparagraph><subparagraph id="H1B2680FF11B743EC83C46211F7890EAC"><enum>(Q)</enum><header>CAP repayment</header><text>For purposes of determining the allocation and repayment of costs of any stages of the CAP System constructed after November 21, 2007, the costs associated with the delivery of YAN CAP Water, whether the YAN CAP Water is delivered for use by the Yavapai-Apache Nation or in accordance with any assignment, exchange, lease, option to lease, or other agreement for the temporary disposition of YAN CAP Water entered into by the YAN, shall be—</text><clause id="H0BB39A16745247C2BAF1E706543679A8"><enum>(i)</enum><text>nonreimbursable; and</text></clause><clause id="HAF5028468CC34186A828849B3002B26B"><enum>(ii)</enum><text>excluded from the repayment obligation of the Central Arizona Water Conservation District.</text></clause></subparagraph><subparagraph id="H0417D7FA5C1F4D009015C930068FC958"><enum>(R)</enum><header>Nonreimbursable cap construction costs</header><clause id="HEA709C49EA224A9E8D2E3941D329B33A"><enum>(i)</enum><header>In general</header><text>With respect to the costs associated with the construction of the CAP System allocable to the Yavapai-Apache Nation—</text><subclause id="H82F9F1FF1D074B849AB6E5DB8066E23F"><enum>(I)</enum><text>the costs shall be nonreimbursable; and</text></subclause><subclause id="HB2355B1C6648444FB9790512B0EC81E5"><enum>(II)</enum><text>the Yavapai-Apache Nation shall have no repayment obligation for the costs.</text></subclause></clause><clause id="HFC54A0D79E3D4A759FA909039F414363"><enum>(ii)</enum><header>Capital charges</header><text>No CAP Water service capital charges shall be due or payable for the YAN CAP Water, regardless of whether the YAN CAP Water is delivered—</text><subclause id="H90DF6DCBBB4E4C8D868FA82988F50E74"><enum>(I)</enum><text>for use by the Yavapai-Apache Nation; or</text></subclause><subclause id="HF0EE80A40B6041E2AD5311A5E0F1E5C8"><enum>(II)</enum><text>under any lease, option to lease, exchange, or option to exchange entered into by the Yavapai-Apache Nation.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="HA886E1D845DD4057BF2E90EDDC3C722F"><enum>15.</enum><header>Enforceability Date</header><subsection id="H6D0F545724BB44DDB47F55D226FE8CE2"><enum>(a)</enum><header>In general</header><text>The Agreement, including the waivers and releases of claims described in section 11, shall take effect and be fully enforceable on the date on which the Secretary publishes in the Federal Register a statement of findings that—</text><paragraph id="HB595BDD7AF8E45AABDFA5E1D1AC6CCEE"><enum>(1)</enum><text>to the extent the Agreement conflicts with this Act—</text><subparagraph id="HCFD3A6528AB740F68A1AD238FB09D872"><enum>(A)</enum><text>the Agreement has been revised through an amendment to eliminate the conflict; and</text></subparagraph><subparagraph id="HFB22D68EDB7846388B535DA725C13A48"><enum>(B)</enum><text>the revised Agreement, including any exhibits requiring amendment or execution by any party to the Agreement, has been executed by all required parties;</text></subparagraph></paragraph><paragraph id="H0B242226ABE54D41A095266B6D1D55EA"><enum>(2)</enum><text>the waivers, releases, and retentions of claims described in section 11 and in Paragraph 13.0 of the Agreement have been executed by—</text><subparagraph commented="no" display-inline="no-display-inline" id="H24DEDD813A5B4F619F59364C02875B88"><enum>(A)</enum><text display-inline="yes-display-inline">the Yavapai-Apache Nation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H78CF357A999741A490121E7718920A94"><enum>(B)</enum><text display-inline="yes-display-inline">the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD017DF9BE7A74B1DBD5909A6C94F9900"><enum>(C)</enum><text display-inline="yes-display-inline">the other parties to the Agreement;</text></subparagraph></paragraph><paragraph id="H5DB74167F4234E1C8264B0BB6EF39682"><enum>(3)</enum><text>the full amount described in subsection (a)(1)(A) of section 10, as adjusted by subsection (c)(1) of that section, has been deposited into the Cragin-Verde Pipeline Account of the Tú ńlį́į́níchoh Water Infrastructure Project Fund;</text></paragraph><paragraph id="H6FCE73CCD962486D8FA51CF3DD6E611F"><enum>(4)</enum><text>the full amount described in subsection (a)(1)(B) of section 10, as adjusted by subsection (c)(1) of that section, has been deposited into the YAN Drinking Water System Account of the Tú ńlį́į́níchoh Water Infrastructure Project Fund;</text></paragraph><paragraph id="H5C54F36F2BD545A9976529C76866919C"><enum>(5)</enum><text>the full amounts described in subparagraphs (A), (B), (C), (D) and (E) of subsection (a)(2) of section 10, as adjusted by subsection (c)(2) of that section, have been deposited into the Trust Fund;</text></paragraph><paragraph id="H0E6C80E4C68146D0865771A11059A19E"><enum>(6)</enum><text>the Arizona Department of Water Resources has—</text><subparagraph commented="no" display-inline="no-display-inline" id="H22DBAD71A6EE4D5899A7014FEB4B11C7"><enum>(A)</enum><text display-inline="yes-display-inline">conditionally approved the severance and transfer of the right of SRP to the diversion and beneficial use of water under Arizona Department of Water Rights Certificate of Water Right No. 3696.0002, as described in Paragraph 8.0 of the Agreement, in an amount not to exceed an average of 3,410.26 AFY, up to a maximum of 3,977.92 acre-feet in any given Year, to the Nation and the United States in its capacity as trustee for the Nation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAA5626B833154E47880E8A56B5988174"><enum>(B)</enum><text display-inline="yes-display-inline">issued a conditional certificate of water right to the Nation and the United States in its capacity as trustee for the Nation, to become effective on the Enforceability Date;</text></subparagraph></paragraph><paragraph id="H076D11C822944DA19A4FF532928BB5F9"><enum>(7)</enum><text>the changes in places of use and points of diversion for the surface water rights to the Verde River as described in subparagraph 5.4 of the Agreement have been conditionally approved, to become effective on the Enforceability Date, provided that the YAN, in its sole discretion, may waive this condition;</text></paragraph><paragraph id="H6EC8537BFE674828AFD884375BC02385"><enum>(8)</enum><text>the Gila River Adjudication Court has included the water right for instream flow for the Nation and the United States as trustee for the Nation, as described in the YAN Judgment, which substantially conforms to the attributes described in Exhibit 11.1B to the Agreement, provided that the Nation, in its sole discretion, may waive this condition;</text></paragraph><paragraph id="HCC9C6E82A398430CB168775DC1CF39D4"><enum>(9)</enum><text>except as otherwise provided in paragraphs (7) and (8), the Gila River Adjudication Court has approved the YAN Judgment in substantially the same form attached as Exhibit 13.9 to the Agreement, as amended to ensure consistency with this Act;</text></paragraph><paragraph id="H35C1ED93D5554848950FE1E3427A4070"><enum>(10)</enum><text>the Secretary has issued a final record of decision approving the construction of the Tú ńlį́į́níchoh Water Infrastructure Project as described in section 6;</text></paragraph><paragraph id="H0D14EE71BEF046BC8BA3958BF98462FC"><enum>(11)</enum><text>the Nation and the Town of Clarkdale have executed the Water and Sewer Service Agreement described in Exhibit 16.1.2.3 to the Agreement, provided that, the Nation, in its sole discretion, may waive this condition;</text></paragraph><paragraph id="H22DEE03E53D0450888B4075CB8CC4A99"><enum>(12)</enum><text>the Nation and the Town of Camp Verde have executed the Interconnection and Exchange Agreement described in Exhibit 16.1.2.2 to the Agreement, provided that the Nation, in its sole discretion, may waive this condition; and</text></paragraph><paragraph id="HD77D1882E5594FCE96308F7A1B3FD2FD"><enum>(13)</enum><text>the tribal council of the Yavapai-Apache Nation has adopted a resolution, as described in section 16(a), consenting to the limited waiver of sovereign immunity from suit in the circumstances described in paragraph (3) of that section.</text></paragraph></subsection><subsection id="H24EED724C4B643A9A2DA7AC414D86916"><enum>(b)</enum><header>Failure To satisfy conditions</header><paragraph id="H0CD3A805232248ACB32272F6CDDE6116"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), if the Secretary fails to publish in the Federal Register a statement of findings under subsection (a) by June 30, 2035, or such alternative later date as may be agreed to by the Yavapai-Apache Nation, the Secretary, and the State—</text><subparagraph id="H669AB416C7D043C9A37DBA6AEB9E7F7E"><enum>(A)</enum><text>this Act is repealed, except as described in paragraph (2);</text></subparagraph><subparagraph id="H43EF74CED9F643CDB6473205F7EF8815"><enum>(B)</enum><text>any action taken by the Secretary and any contract or agreement entered into pursuant to this Act shall be void;</text></subparagraph><subparagraph id="H69169E0315C745C0B96FBB3D2AFC7B89"><enum>(C)</enum><text>the United States shall be entitled to offset any Federal amounts made available under section 10(a) that were used under that section against any claims asserted by the Yavapai-Apache Nation against the United States; and</text></subparagraph><subparagraph id="HF27ADC4C4242410FB450BF82073E6168"><enum>(D)</enum><text>any amounts appropriated under section 10, together with any investment earnings on those amounts, less any amounts expended under section 7(e)(2), shall revert immediately to the general fund of the Treasury.</text></subparagraph></paragraph><paragraph id="H79D2A68E8F7148F18DE25D25EFC8A3E6"><enum>(2)</enum><header>Exception</header><text>Notwithstanding paragraph (1)(A), if the Secretary fails to publish in the Federal Register a statement of findings under subsection (a) by June 30, 2035, or such alternative later date as may be agreed to by the Yavapai-Apache Nation, the Secretary, and the State, section 13 shall remain in effect.</text></paragraph></subsection></section><section id="HB3BEA8707ADA45D3AD5B589953F11769"><enum>16.</enum><header>Administration</header><subsection id="H8AB163B0F087485FA4737CA0D0664FE2"><enum>(a)</enum><header>Limited waiver of sovereign immunity by the Yavapai-Apache Nation and the United States acting as trustee for the Yavapai-Apache Nation</header><paragraph id="HC755D886762047B18473D28C884F357E"><enum>(1)</enum><header>In general</header><text>The Yavapai-Apache Nation, and the United States acting as trustee for the Yavapai-Apache Nation, may be joined in any action brought in any circumstance described in paragraph (3), and any claim by the Yavapai-Apache Nation and the United States to sovereign immunity from any such action is waived.</text></paragraph><paragraph commented="no" id="HC2EEC9F069BA4C7081A9EE9C6B4F24F0"><enum>(2)</enum><header>Consent of Yavapai-Apache Nation</header><text>By resolution dated June 26, 2024, the Yavapai-Apache Nation Council has affirmatively consented to the limited waiver of sovereign immunity from suit in any circumstance described in paragraph (3) notwithstanding any provision of the Yavapai-Apache Nation Code or any other Yavapai-Apache Nation law.</text></paragraph><paragraph id="H0F4ECCFF7D9047F796EC22EB80923813"><enum>(3)</enum><header>Circumstances described</header><text>A circumstance referred to in paragraphs (1) and (2) includes any of the following:</text><subparagraph id="H59E69AB1CFE24CD98C4BE72DE19C8389"><enum>(A)</enum><header>Parties to the Agreement</header><text>Any party to the Agreement—</text><clause id="HFB3FF5ECB2C944C98FBED51A7CBD741B"><enum>(i)</enum><text>brings an action in any court of competent jurisdiction relating only and directly to the interpretation or enforcement of—</text><subclause id="HA30762E152E74F7C97F526E8EB75E798"><enum>(I)</enum><text>this Act; or</text></subclause><subclause id="HEBA6C35A472D4ABD9E8D8445E9254487"><enum>(II)</enum><text>the Agreement and exhibits to the Agreement;</text></subclause></clause><clause id="HD2BBC0B993D548B6BD7BE358068D113E"><enum>(ii)</enum><text>names the Yavapai-Apache Nation, or the United States acting as trustee for the Yavapai-Apache Nation, as a party in that action; and</text></clause><clause id="H770EB4809F3C436ABCA650B371FE7487"><enum>(iii)</enum><text>does not include any request for award against the Yavapai-Apache Nation, or the United States acting as trustee for the Yavapai-Apache Nation, for monetary damages, court costs, or attorney fees, except for claims brought by a party pursuant to the YAN-SRP Water Delivery and Use Agreement and YAN-SRP Exchange Agreement.</text></clause></subparagraph><subparagraph id="HCEE467A9612D4C8594E3690E4D28CF5C"><enum>(B)</enum><header>Landowner or water user</header><text>Any landowner or water user in the Gila River Watershed—</text><clause id="HCB8F92045EC84EBCB6953D1DFEC545EF"><enum>(i)</enum><text>brings an action in any court of competent jurisdiction relating only and directly to the interpretation or enforcement of—</text><subclause id="H4D4FFDDE77C34C49A51665AFC0AE0A14"><enum>(I)</enum><text>paragraph 13.0 of the Agreement;</text></subclause><subclause id="H0F1BE114EAB44E6BA811F808B63FEED2"><enum>(II)</enum><text>the Gila River Adjudication Decree; or</text></subclause><subclause id="HE6DC34F508354253838C06EAC081C699"><enum>(III)</enum><text>section 11;</text></subclause></clause><clause id="H710BB7FF8C1B46C4B80107D624B86682"><enum>(ii)</enum><text>names the Yavapai-Apache Nation, or the United States acting as trustee for the Yavapai-Apache Nation, as a party in that action; and</text></clause><clause id="HF72C8C6EF6E1407D833564A381877418"><enum>(iii)</enum><text>does not include any request for award against the Yavapai-Apache Nation, or the United States acting as trustee for the Yavapai-Apache Nation, for monetary damages, court costs, or attorney fees.</text></clause></subparagraph></paragraph></subsection><subsection id="HDA7630474DE548ECA6099CD6377F03FF"><enum>(b)</enum><header>Antideficiency</header><text>Notwithstanding any authorization of appropriations to carry out this Act, the United States shall not be liable for any failure of the United States to carry out any obligation or activity authorized by this Act (including all agreements or exhibits ratified or confirmed by this Act) if adequate appropriations are not provided expressly by Congress to carry out the purposes of this Act.</text></subsection><subsection id="H90B3C3D2D0BD46C4BDED9AC676379F5C"><enum>(c)</enum><header>Applicability of reclamation reform act</header><text>The Reclamation Reform Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/43/390aa">43 U.S.C. 390aa et seq.</external-xref>) and any other acreage limitation or full-cost pricing provision under Federal law shall not apply to any individual, entity, or land solely on the basis of—</text><paragraph id="H713982FC616E41FAABBE3C2E3D66E3A4"><enum>(1)</enum><text>receipt of any benefit under this Act;</text></paragraph><paragraph id="HE7FE544952F14555A69CE0C73923FCFB"><enum>(2)</enum><text>the execution or performance of the Agreement; or</text></paragraph><paragraph id="H9B54C6BF8BF04F5F9CB6BAC28C52696E"><enum>(3)</enum><text>the use, storage, delivery, lease, or exchange of CAP water.</text></paragraph></subsection></section><section id="HD560A0AA136043078B0E927F92460D9E"><enum>17.</enum><header>Miscellaneous</header><subsection id="HE9F78FAF0AD34A01B686C7C594C5EF48"><enum>(a)</enum><header>C.c. Cragin Dam and Reservoir</header><text>Section 213(i)(3) of the Gila River Indian Community Water Rights Settlement Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/451">Public Law 108–451</external-xref>; 118 Stat. 3533) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H909BBA508D614998BB45A0E3BB07E416"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>Blue Ridge Reservoir</quote> and inserting <quote>C.C. Cragin Dam and Reservoir</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H00707E7858954E1F8AB555B4035AB3C8"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H198340FBDED440A1BFB457211A3A58C2"><subparagraph commented="no" id="H0E15E212B53748269E88F07F8A7FF6A7"><enum>(C)</enum><header>Additional availability</header><text>Up to 1,639.74 acre-feet of water per year may be made available from the C.C. Cragin Reservoir for municipal and domestic uses in Yavapai County, Arizona, without cost to the Salt River Federal Reclamation Project, provided that, on or before December 31, 2029, water users in Yavapai County have contracted with the Salt River Federal Reclamation Project for the use of the water described in this subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HCAB9D2980E864D898CC0EBA1FCE45006"><enum>(b)</enum><header>Effect of Act</header><text>Nothing in this Act quantifies or otherwise affects any water right or claim or entitlement to water of any Indian Tribe, band, or community other than the Yavapai-Apache Nation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H7B06B54619444A2D8C32518F0DD30F5C"><enum>(c)</enum><header>Town of Camp Verde and Forest Service</header><text>Pursuant to existing authorities, the Forest Service shall work expeditiously with the Town of Camp Verde to transfer title to the Town of Camp Verde of up to 40 acres of Forest Service land located at the intersection of Interstate 17 and General Crook Trail within the municipal boundaries of the Town of Camp Verde for public safety and other municipal purposes.</text></subsection></section></legis-body></bill>
