            rehabilitation programs for veterans with service-connected disabilities, to establish a
            new bar to certain benefits under laws administered by the Secretary of Veterans
 Affairs, and for other purposes.</official-title></form><legis-body id="H15045228B5884D199FFF6943716F777D" style="OLC"><section id="H232038EA97EC410D9575E5E29505B3D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Readiness and Employment Improvement and Accountability Act</short-title></quote>.</text></section><section id="HF66CAF7E4D9A453089D705B94DCD080E" commented="no"><enum>2.</enum><header>Bar to certain veterans benefits: conviction of assaulting, resisting, or impeding an officer or employee of the Department of Veterans Affairs</header><subsection id="H0901F58E81EE4B05A7A9A12F08B8F7D0"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 5303(a) of title 38, United States Code, is amended—</text><paragraph id="H1CAEDC7ED5FC4A729434B00EF4D47D1E"><enum>(1)</enum><text>by inserting <quote><header-in-text level="paragraph" style="USC"><enum-in-header>(1)</enum-in-header></header-in-text></quote> before <quote>The discharge</quote>; and</text></paragraph><paragraph id="H9AE56D04ED0B4A5FB26816103BA3440E"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HB7114001BE4645CA9A80EF9688AF091E" display-inline="no-display-inline"><paragraph id="H9FC36FE314E44F8E8F24870F2E2B0BAF" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC73B8D87E5BE49AB9D2C046E908F19DF"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary may bar a person described in subparagraph (B) from benefits under chapter 30, 31, 33, 35, or 36 of this title.</text></subparagraph><subparagraph id="H3F7CACC9F6114230A0C4A0C6248B4170" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A person described in this subparagraph is a person convicted under section 111 of title 18 for an offense against an officer or employee of the Department.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC4DDF8E371B7458590A596F961E922BA"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to a conviction under section 111 of title 18 for an offense against an officer or employee of the Department of Veterans Affairs that occurs on or after the date of the enactment of this Act.</text></subsection></section><section id="HFE9542CA968F4CE9846A2419869A4032"><enum>3.</enum><header>Periods of eligibility: additional vocational rehabilitation programs</header><text display-inline="no-display-inline">Section 3103(c)(2) of title 38, United States Code, is amended—</text><paragraph id="HEBB06ABF45A14F20A321A1A5B5BA88D4"><enum>(1)</enum><text>by striking <quote>, or (B)</quote> and inserting <quote>, (B)</quote>; and</text></paragraph><paragraph id="H4E42F52D6811416998B1E1B3A306AE15" display-inline="no-display-inline"><enum>(2)</enum><text>by striking <quote>; or</quote> and inserting <quote>, or (C) the veteran has not obtained employment (i) in the occupation for which such veteran had been so trained (ii) during the one-year period after the end of such training; or</quote>.</text></paragraph></section><section id="H6FCDB8F02103470A9A00B188E2F285D6"><enum>4.</enum><header>Scope of services and assistance for a rehabilitation program: approval of the Secretary required for certain payments</header><subsection id="H3002AF6D02B44CCBB1CDEA5A214A0FFE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3104(a) of title 38, United States Code, is amended, in paragraph (7), by adding at the end the following new subparagraph:</text><quoted-block style="USC" id="HC7B3998FDF0940BEB5DBA291847AAD64" display-inline="no-display-inline"><subparagraph id="H998A69432E194B8FAF682F57CF53C219" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A payment for equipment under subparagraph (A) that exceeds $5,000 shall require the approval of the Secretary.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCF633D2BC5864E219DD23A21922C8A80"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and annually thereafter for five years, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report of payments approved under subparagraph (C) of such paragraph, as added by this section, during the year preceding the date of such report. In such a report, the Secretary shall identify, with regard to each such payment—</text><paragraph id="HC0519F70517E43BFA29E6BDF9F58B891"><enum>(1)</enum><text>the equipment purchased;</text></paragraph><paragraph id="HCB0561D0C2DA44BAB479BC0145EE654F"><enum>(2)</enum><text>the reason for the purchase; and</text></paragraph><paragraph id="HA842432F6B8741718C06CAE9E7C2DF8B"><enum>(3)</enum><text>the total equipment purchased for the rehabilitation program of the veteran.</text></paragraph></subsection></section><section id="H338B42AE9AD148699D11654268D32535"><enum>5.</enum><header>Maximum amount for a rehabilitation program; automatic adjustment</header><text display-inline="no-display-inline">Section 3104 of title 38, United States Code, is amended, in subsection (b)—</text><paragraph id="H6A557ED86859481DB5619F1D3143C5DA"><enum>(1)</enum><text>by inserting <quote><header-in-text level="paragraph" style="USC"><enum-in-header>(1)</enum-in-header></header-in-text></quote> before <quote>A rehabilitation program</quote>;</text></paragraph><paragraph id="HD3630D6778FC4466BD678146E0634B8B"><enum>(2)</enum><text>by designating the second and third sentences, collectively, as paragraph (2) of such subsection and adjusting the margins accordingly; and</text></paragraph><paragraph id="H6D2A5F5938414395A641F1CC1ED60C5F"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HECD19E1CE9AA4CDE8A308AB8A9483FA6" display-inline="no-display-inline"><paragraph id="HA7263420E7C344EDB7738C1CDB9761FA" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD29D714438634ADDA8E4AD60CDC086EF"><enum>(A)</enum><text>Subject to subparagraph (B), the amount of Federal funds paid for a rehabilitation program may not exceed $250,000.</text></subparagraph><subparagraph id="H9FABF0907CFC4FD7A5848384FC3AF323" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Effective October 1, 2026, and each year thereafter, the Secretary shall increase the dollar amount in effect under paragraph (A), by a percentage equal to the most recent percentage increase under section 3015(h) of this title.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="HDDC993CED03541D5BF56DF92E76D765C"><enum>6.</enum><header>Vocational rehabilitation specialist: authority to redevelop individualized vocational rehabilitation plan; definition</header><subsection id="H4FA2C5A7DB4843F286B9F56B8363CCB3"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 3106(f) of such title is amended by inserting <quote>(who may be a vocational rehabilitation specialist)</quote> after <quote>employee</quote>.</text></subsection><subsection id="H861C5A7B991543F4A749AEE0B5078EEE"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 3101 of title 38, United States Code, is amended by adding at the end the following new paragraph:</text><quoted-block style="USC" id="H525ADE10C96C43C8811F755FD34A9E22" display-inline="no-display-inline"><paragraph id="H6A6CD7C52EEC4D70BC64C799CF84D9C7"><enum>(11)</enum><text display-inline="yes-display-inline">The term <quote>vocational rehabilitation specialist</quote> means—</text><subparagraph id="H4722848A9ED34C9A90B6C53BBB955487"><enum>(A)</enum><text>a vocational rehabilitation specialist in the Veteran Readiness and Employment division of the Veterans Benefits Administration; or</text></subparagraph><subparagraph id="HB584A64C083B4633935DEAD3D0787272"><enum>(B)</enum><text>a counseling psychologist of the Department performing the duties of a vocational rehabilitation specialist.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H9C6A6479EA604253AE6F695E6CFB566C"><enum>7.</enum><header>Subsistence allowance for a veteran entitled to a rehabilitation program and Post-9/11 educational assistance: basis of location</header><text display-inline="no-display-inline">Section 3108(b)(4) of title 38, United States Code, is amended—</text><paragraph id="H353D1DA0D6B340958B73A891990C9AB7"><enum>(1)</enum><text>by striking <quote>the institution providing the rehabilitation program concerned.</quote> and inserting an em dash; and</text></paragraph><paragraph id="H02B0C2DC041A40049D03F6F16289E176"><enum>(2)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block style="USC" id="HB9717DC472FD408AB72270B6634329FB" display-inline="no-display-inline"><subparagraph id="H85F5EA04F3C147A2A506BED69B0C6297" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the institution providing the rehabilitation program concerned; or</text></subparagraph><subparagraph id="H8A0BE1E0ED104AA0A2F4A50AEF07188F" indent="up1"><enum>(B)</enum><text>the residence of the veteran if such residence is more than 25 miles from such institution.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H602B10126A5B4B8E9A3C32BC8076ECEF"><enum>8.</enum><header>Employment counselors</header><text display-inline="no-display-inline">Section 3117 of title 38, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="HE50B0EF0154A4693B1858BE9BAB35BB5" display-inline="no-display-inline"><subsection id="H8C1545F20B9A41E48C359EA20EF7297F"><enum>(c)</enum><text display-inline="yes-display-inline">To carry out this section, the Secretary shall, to the extent practicable, employ an employment counselor at each regional office of the Department.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H087B5BB1089B40B1B6FCBC19C5749C0B"><enum>9.</enum><header>Ineligibility of a veteran in a vocational rehabilitation program for disability compensation on the basis of a disability rated as total on the basis of individual unemployability</header><subsection id="H8F490E6E89D44D3CA2D283C6846FB2F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/31">Chapter 31</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H057F923C804F44BAB035353B155C7ED8" display-inline="no-display-inline"><section id="H3D5811A3CA1B4DD5AFEE2C78737A16C0"><enum>3123.</enum><header>Ineligibility of a veteran in a vocational rehabilitation program for compensation for a disability rated as total on the basis of individual unemployability</header><text display-inline="no-display-inline">A veteran participating in a vocational rehabilitation program may not receive disability compensation under chapter 11 of this title for a disability rated as total on the basis of individual unemployability.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF107834F8CC3457BBBC4E83954AB4461"><enum>(b)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text><quoted-block style="USC" id="H2CC6ADC7B4B84E77907FF9CB0A1015EE" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">3123. Ineligibility of a veteran in a vocational rehabilitation program for compensation for a disability rated as total on the basis of individual unemployability.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HC10F13914AB249B6B633DCDC16315DD4"><enum>10.</enum><header>Technical corrections</header><subsection id="HA028CFBED311479785CEE6106CBB6BE8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3101 of title 38, United States Code, is amended by redesignating the paragraph (10) relating to the term <quote>emergency situation</quote> as paragraph (1).</text></subsection><subsection id="H4526AA3C89BF482E8336C9C49ABB684F"><enum>(b)</enum><header>Periods of eligibility</header><text display-inline="yes-display-inline">Section 3103 of title 38, United States Code, is amended—</text><paragraph id="H93BDBB3FE32A4849B0C35014B8217233"><enum>(1)</enum><text display-inline="yes-display-inline">in the second subsection (h), by inserting <quote>in</quote> after <quote>participating</quote>;</text></paragraph><paragraph id="HA92BED1B709147F0BE3FA156347EB1F8"><enum>(2)</enum><text>by redesignating such second subsection (h), as amended, as subsection (i); and</text></paragraph><paragraph id="H540C9E1B06EF4925A053C92A0E7DD182"><enum>(3)</enum><text>in subsection (a), by striking <quote>or (h)</quote> and inserting <quote>(h) or (i)</quote>.</text></paragraph></subsection></section></legis-body></bill>
