<subsection id="H7AA387A516B143628639B0B50D276E35"> <enum>(a)</enum> <header>Definitions</header> <text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">Chapter 81</external-xref> of title 38, United States Code, is amended by inserting after subchapter VI the following new subchapter:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H7028394A8D904692A7BC34C1B7A715C5"> <subchapter id="H79D46E2F17794A9988C76002B4285BCD"> <enum>VII</enum> <header>Acquisition organization, cost assessment, and program evaluation</header> <section id="HC47C73ADCBB94E42AEF6938EF3315B9E"> <enum>8181.</enum> <header>Definition of major acquisition program</header> <text display-inline="no-display-inline">In this subchapter, the term <term>major acquisition program</term> means a program of the Department to acquire services, supplies, technology, systems, or a combination thereof, with an estimated total program cost, estimated by the Secretary, that exceeds—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H9B3913E3D0C3416A8B8234C0551A5924"> <enum>(1)</enum> <text display-inline="yes-display-inline">$1,000,000,000 (adjusted pursuant to section 1908 of title 41) for the total life cycle cost of the program; or</text> </paragraph> <paragraph id="HF38AC8D1CA914895BCB96693EA88A3C9"> <enum>(2)</enum> <text>$200,000,000 (adjusted pursuant to section 1908 of title 41) annually.</text> </paragraph> </section> </subchapter> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H18D85C7D2378468C9A53FDBF7146C77B"> <enum>(b)</enum> <header>Assistant Secretary for Acquisition</header> <text>Section 308 of such title is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="HB956B3152B574171851D931158400CA8"> <enum>(1)</enum> <text display-inline="yes-display-inline">in subsection (a)(1), by striking <quote>seven</quote> and inserting <quote>eight</quote>; and</text> </paragraph>

<subsection commented="no" display-inline="no-display-inline" id="HF3841FAF8BA844F59842528480DB74EA"> <enum>(a)</enum> <header>Assistant Secretary for Acquisition; Chief Acquisition Officer</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HCE58B18B706443AC814D56EB738CA21A"> <enum>(1)</enum> <text>The Secretary shall designate one of the Assistant Secretaries specified in subsection (a)(1) of section 308 of this title as the Assistant Secretary of Veterans Affairs for Acquisition, who shall focus solely on the administration of functions specified in subsection (b)(10) of such section.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H11260D583C6F4EEBBF466B7C9A6BA00D" indent="up1"> <enum>(2)</enum> <text display-inline="yes-display-inline">Pursuant to section 1702(a) of title 41, the Secretary shall designate the Assistant Secretary of Veterans Affairs for Acquisition as the Chief Acquisition Officer of the Department.</text> </paragraph> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H0A3CA1FB1C964BC09EBD07D1A1DD2FF4"> <enum>(b)</enum> <header>Office of Acquisition</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H615E6D838009492C9A4839023BA799DA"> <enum>(1)</enum> <text display-inline="yes-display-inline">There is in the Department an Office of Acquisition.</text> </paragraph> <paragraph indent="up1" commented="no" display-inline="no-display-inline" id="H3C58E60CE2324454BB3DE9AF231506DA"> <enum>(2)</enum> <text>The head of the Office of Acquisition shall be the Assistant Secretary of Veterans Affairs for Acquisition designated pursuant to subsection (a).</text> </paragraph> 
<paragraph id="HE21F7A8A6AE744C3B7CF6FD0898789EF" indent="up1">
                                <enum>(3)</enum>
 <text>The Secretary shall take such actions as may be necessary to ensure that major acquisition program offices of the Department align under the Office of Acquisition and report directly to the Assistant Secretary of Veterans Affairs for Acquisition.</text>
                            </paragraph> 
<paragraph id="HDF85A601474E4E2C9E42E2F871AE6559" indent="up1"> <enum>(4)</enum> <text>The budget of the Office of Acquisition, including budgets for major acquisition programs, shall be established in the budget justification materials submitted to Congress in support of the budget of the Department (as submitted with the budget of the President under section 1105(a) of title 31).</text> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="H424B0241DEBA4626907B58131DC302BD"> <enum>(c)</enum> <header>Deputy Assistant Secretary for Logistics</header> <paragraph commented="no" display-inline="yes-display-inline" id="H68744F4C4A8C4FD59B437AE13BF8C95D"> <enum>(1)</enum> <text>Pursuant to section 308(d) of this title, the Secretary shall appoint a Deputy Assistant Secretary of Veterans Affairs for Logistics, who shall report to the Assistant Secretary for Acquisition.</text> </paragraph> 
<paragraph indent="up1" commented="no" display-inline="no-display-inline" id="HC79116D6A41F427E8C6ABFF156ED3E7D"> <enum>(2)</enum> <text>The Deputy Assistant Secretary of Veterans Affairs for Logistics shall be responsible for administration of logistics and supply chain operations of the Department.</text> </paragraph> </subsection> <subsection id="H27AB31B7CAD44613881A34E07AC0BF04"> <enum>(d)</enum> <header>Deputy Assistant Secretary for Procurement</header> <paragraph commented="no" display-inline="yes-display-inline" id="H373F57BAE6C042F8A87FFAA468A37FF5"> <enum>(1)</enum> <text>Pursuant to section 308(d) of this title, the Secretary shall appoint a Deputy Assistant Secretary of Veterans Affairs for Procurement, who shall report to the Assistant Secretary for Acquisition.</text> </paragraph> 
<paragraph id="HA097D514DC5547C1A3C5BC06F2BF275C" indent="up1"> <enum>(2)</enum> <text>The Deputy Assistant Secretary of Veterans Affairs for Procurement shall be responsible for all procurement and contracting organizations of the Department.</text> </paragraph> </subsection> <subsection id="H5AFE2F8D6DD94E52BFD7E1E04ABF5482"> <enum>(e)</enum> <header>Deputy Assistant Secretary for Acquisition, Program Management, and Performance</header> <paragraph commented="no" display-inline="yes-display-inline" id="H17A53248BB6D42E4976BB8D24976DAD9"> <enum>(1)</enum> <text>Pursuant to section 308(d) of this title, the Secretary shall appoint a Deputy Assistant Secretary of Veterans Affairs for Acquisition, Program Management, and Performance, who shall report to the Assistant Secretary for Acquisition.</text> </paragraph> 
<paragraph indent="up1" commented="no" display-inline="no-display-inline" id="H3917B60691D1406EAF688E2724DE4DE6"> <enum>(2)</enum> <text>The Deputy Assistant Secretary for Acquisition, Program Management, and Performance shall be responsible for the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="HBD4605EE6594466D9768D158189E4144"> <enum>(A)</enum> <text display-inline="yes-display-inline">Lifecycle management.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC5DD557681FD4214A28126002A13C591"> <enum>(B)</enum> <text display-inline="yes-display-inline">Requirements planning.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6D6CB10EB81C4F1F9BF45386C40D2B86"> <enum>(C)</enum> <text display-inline="yes-display-inline">Programming and budgeting.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H482A6F2717284142B18769485E4343B1"> <enum>(D)</enum> <text display-inline="yes-display-inline">Policy.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H89E1D546DFBB438D9DFDE744C7CAC918"> <enum>(E)</enum> <text display-inline="yes-display-inline">Performance standards.</text> </subparagraph>

<subsection id="HD871337DB54C47ACA0F9FBF90C2809E3"> <enum>(f)</enum> <header>Program Executive Officers</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H3D2957AF4E6242E59374B8E74DC5EFB7"> <enum>(1)</enum> <text>The Assistant Secretary for Acquisition shall appoint no fewer than four Program Executive Officers, each responsible for overseeing major acquisition programs in one of the following areas:</text> <subparagraph id="H436E3F863BFC4144A7736A7BB37674E3" indent="up1"> <enum>(A)</enum> <text>Medical.</text> </subparagraph> 
<subparagraph id="H3C67D392FA58469796BCF4169D9EE75C" indent="up1"> <enum>(B)</enum> <text>Information technology.</text> </subparagraph> <subparagraph id="HF1FAD5DBEBE1423FAA1C70535AD0929D" indent="up1"> <enum>(C)</enum> <text>Professional services.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE787D0515E3A4657B7D8C712D2198065" indent="up1"> <enum>(D)</enum> <text>Other areas not included in subparagraphs (A) through (C).</text> </subparagraph> </paragraph> <paragraph id="H5A7A42F51153462BB1771C18E794E4AB" indent="up1"> <enum>(2)</enum> <text>Each Program Executive Officer shall report directly to the Assistant Secretary for Acquisition and shall supervise the managers of major acquisition programs within their respective area, as appointed under section 8183 of this title.</text> </paragraph> 
<paragraph id="H686D4B3D6DC247498368CB1340BD7839" indent="up1"> <enum>(3)</enum> <text>Each Program Executive Officer shall be—</text> <subparagraph id="HBDE93CF84EDE47C18AD75AA6E8CF5C06"> <enum>(A)</enum> <text>certified in project management at level three by—</text> 
<clause id="H50988AD52BB648BBBE1BED059DFB59FA"> <enum>(i)</enum> <text>the Department;</text> </clause> <clause id="HAB9882D3DCB7480685FD9650085759B7"> <enum>(ii)</enum> <text>the Federal Acquisition Institute pursuant to section 1201 of title 41; or</text> </clause> 
<clause id="H20C4B92ED46F48E8A74D1310EA16AD47"> <enum>(iii)</enum> <text>the Department of Defense pursuant to section 1701a of title 10; or</text> </clause> </subparagraph> <subparagraph id="HEC49DF8DCDDA497BB145DEA3ED8B5477"> <enum>(B)</enum> <text>hold an equivalent certification by a private sector project management certification organization, as determined appropriate by the Secretary.</text> </subparagraph> </paragraph> </subsection> </section> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> </section> 
<section commented="no" display-inline="no-display-inline" id="H374D942F9A1745168C26A7840D9666D5"> <enum>3.</enum> <header>Department of Veterans Affairs major acquisition program managers</header> <text display-inline="no-display-inline">Subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">chapter 81</external-xref> of title 38, United States Code, as added by section 2, is amended by adding at the end the following new section:</text> <quoted-block style="USC" display-inline="no-display-inline" id="H15F169FE530D40DDA7A2EBA39AEDAD3D"> <section id="H8055135589A34D28804182E40B4F02C3"> <enum>8183.</enum> <header>Major acquisition program managers</header> <subsection id="HBDC53596795D44FBA6D9C5E4B3D05FA2"> <enum>(a)</enum> <header>Appointments</header> <text display-inline="yes-display-inline">Not later than 30 days after any date on which the Secretary approves a major acquisition program to commence, the applicable Program Executive Officer shall appoint a manager to be responsible for administering such program.</text> </subsection> 
<subsection id="H257653D1302346C99B0031E71AD9FD6D"> <enum>(b)</enum> <header>Qualifications</header> <text>Each manager appointed pursuant to subsection (a) shall be—</text> <paragraph id="H67117A0566D949B3ACACABDF944B30B4"> <enum>(1)</enum> <text>certified in project management at level three by—</text> 
<subparagraph id="H60DF6EF055964BBFBD2508D4BEA1DB23"> <enum>(A)</enum> <text>the Department;</text> </subparagraph> <subparagraph id="HF0D31E9F4D4B4A21B5CA87F957F48003"> <enum>(B)</enum> <text>the Federal Acquisition Institute pursuant to section 1201 of title 41; or</text> </subparagraph> 
<subparagraph id="H75879BDF8F364DBD85CBA0CFF5743DAB"> <enum>(C)</enum> <text>the Department of Defense pursuant to section 1701a of title 10; or</text> </subparagraph> </paragraph> <paragraph id="H87236A7A7C7146599FD42EBD85F67684"> <enum>(2)</enum> <text>hold an equivalent certification by a private sector project management certification organization, as determined appropriate by the Secretary.</text> </paragraph> </subsection> 
<subsection id="HB3490FEB55D7429D886FAD0B4DEDCF68">
                        <enum>(c)</enum>
                        <header>Duties</header>
 <text>Each manager appointed pursuant to subsection (a) for a major acquisition program shall—</text>
                        <paragraph commented="no" display-inline="no-display-inline"
                            id="H72F90D856E884B60B2BFEAC90A763A5A">
                            <enum>(1)</enum>
 <text display-inline="yes-display-inline">report to the Assistant Secretary for Acquisition through the Program Executive Officer responsible for the major acquisition program; and</text>
                        </paragraph>
                        <paragraph commented="no" display-inline="no-display-inline"
                            id="H74C7F515B61144CE9A905F54EF17364A">
                            <enum>(2)</enum>
 <text display-inline="yes-display-inline">shall be responsible for, with respect to the major acquisition program—</text>
                            <subparagraph id="H0E92D7FBDC784856AD6E7C031AAD5A4E">
                                <enum>(A)</enum>
 <text>developing, in coordination with the Program Executive Officer, a plan to administer the major acquisition program, which shall be known as the <quote>program baseline</quote> for the major acquisition program, that includes—</text>
                                <clause display-inline="no-display-inline"
                                    id="HB8C74C9347CF47249AC2610291BD9C90">
                                    <enum>(i)</enum>
 <text>a description of each acquisition phase of the major acquisition program;</text>
                                </clause>
                                <clause id="HF6BB0BC02AEB46D5A2DB8433AAF61E98">
                                    <enum>(ii)</enum>
 <text>for each such acquisition phase, requirements for advancing the major acquisition program to a subsequent acquisition phase; and</text>
                                </clause>
                                <clause id="H47DEF7951F5E41598BB4DCE0A81AC45F">
                                    <enum>(iii)</enum>
 <text>estimates of the cost, schedule, and performance of the major acquisition program that account for the entire life cycle of the major acquisition program;</text>
                                </clause>
                            </subparagraph>
                            <subparagraph id="H6AA9AEFB30074823AD6178C67F59AE93">
                                <enum>(B)</enum>
 <text>ensuring the major acquisition program is in compliance with such requirements and providing all program documentation, including program baseline documentation, cost, schedule, performance and risk assessments, and other relevant materials, to designated officials and relevant governance boards;</text>
                            </subparagraph>
                            <subparagraph id="H9637D20CBF93495AB054AAB30ED3851B">
                                <enum>(C)</enum>
 <text display-inline="yes-display-inline">developing resource requests and justifications necessary to satisfy such requirements; and</text>
                            </subparagraph>
                            <subparagraph id="HC3CD98BBD8CE4A0195CA45BA30F1394B">
                                <enum>(D)</enum>
 <text display-inline="yes-display-inline">on a continuous basis, assessing and managing risks to satisfying the requirements of such program baseline relating to cost and schedule.</text>
                            </subparagraph>
                        </paragraph>
                    </subsection> 
<subsection id="H3615EE27FE31431197233A09E5D93DFB">
                        <enum>(d)</enum>
                        <header>Program decision authority</header>
 <text>The Secretary shall ensure that—</text> <paragraph id="H717341A1621445BE92428EAF9B53F19D"> <enum>(1)</enum> <text>program decision authority for oversight of a major acquisition program is the Assistant Secretary for Acquisition; and</text>
                        </paragraph>
                        <paragraph id="HCE30BF94E86645DA8B023EB74497AC60">
                            <enum>(2)</enum>
 <text>program management offices for major acquisition programs are independent of the Veterans Benefits Administration, the Veterans Health Administration, the National Cemetery Administration, and staff offices of the Department by reporting directly to the Assistant Secretary for Acquisition.</text>
                        </paragraph>
                    </subsection> 
<subsection id="H481F6B11B9E6437E8CF58527F3E5AABA">
                        <enum>(e)</enum>
                        <header>Program decision authority notification required</header>
 <text>Not later than 30 days after any date on which a major acquisition program concludes an acquisition phase, the manager of such program appointed pursuant to subsection (a) shall notify the program decision authority under subsection (c).</text>

<section commented="no" display-inline="no-display-inline" id="H1F531800C9DD4F5FA7D64D392608BC7B"> <enum>4.</enum> <header>Department of Veterans Affairs acquisition and procurement reorganization matters</header> 
<subsection id="H1EA68989D7654DF3A19099921F5A6815"> <enum>(a)</enum> <header>Organizational consolidation</header> <text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall organizationally consolidate under the Assistant Secretary of Veterans Affairs for Acquisition every activity of the Department of Veterans Affairs, including the Veterans Benefits Administration, the Veterans Health Administration, and the National Cemetery Administration, that relates to—</text> <paragraph id="H2C8C6F70DA01492E8005D77F9ED01FC5" commented="no"> <enum>(1)</enum> <text>acquisition;</text> </paragraph> 
<paragraph id="HECFE1EAE8D254905A0A670059DF4ED83" commented="no"> <enum>(2)</enum> <text>procurement and contracting; or</text> </paragraph> <paragraph id="H834E97DCB5504D6C84BB58360A7BDF7B" commented="no"> <enum>(3)</enum> <text>logistics and supply chain.</text> </paragraph> </subsection> 
<subsection id="HE010951EB8E34EF0A06F80638C0C1BF1"> <enum>(b)</enum> <header>Relocation</header> <text>Subsection (a) shall not be construed to require the physical relocation of employees of the Department.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="H0BEBDB8778AE4154AC648307DD7455C3"> <enum>(c)</enum> <header>Plan and briefing</header> <paragraph commented="no" display-inline="no-display-inline" id="HEAA3DC99B974417DBD356CABB4AE06C5"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">Not later than 90 days after commencing organizational consolidation under subsection (a), the Secretary shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H866FD7B1FD574C08AD0F789ADD7D61DD"> <enum>(A)</enum> <text display-inline="yes-display-inline">submit to the Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a written plan to carry out such organizational consolidation; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H95DFA1DA156E468B8B18226CF388E8B3"> <enum>(B)</enum> <text>provide such committees a briefing on such plan.</text> </subparagraph> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF90701A10FB44DC78405346EF1A1CD8E"> <enum>(2)</enum> <header>Contents</header> <text>The plan submitted pursuant to paragraph (1)(A) shall include the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE32DA87AD0CF4F7386FBEAC5713F1050"> <enum>(A)</enum> <text>A timeline.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H67647409786C48F591D531F4B312ED08"> <enum>(B)</enum> <text>A plan for communication and training activities for relevant Department personnel.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H2A8275F03D0D404FAE09DA72163AC388"> <enum>(C)</enum> <text>A plan for modification of relevant Department policy and guidance.</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HBCDAFC076FFB4DEE8ED517C4E8B8771B"> <enum>(D)</enum> <text display-inline="yes-display-inline">Such other matters as the Secretary considers relevant and appropriate.</text> </subparagraph> </paragraph> </subsection> </section> <section id="HDD4804374B12489C82522EB7B5BFB21B"> <enum>5.</enum> <header>Independent verification and validation of major acquisition programs of Department of Veterans Affairs</header> <subsection id="HDF76984C5AAD4A7593A43CD0838EC41D"> <enum>(a)</enum> <header>Contracting authority</header> <text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall seek to enter into one or more contracts using competitive procedures with one or more entities to carry out the functions described in subsection (c).</text> </subsection> 
<subsection id="HE588993E1C2D43CB99D3C6C8C983C54D"> <enum>(b)</enum> <header>Eligibility</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H1F018629766344F7968327DBB4F3AFDA"> <enum>(1)</enum> <header>In general</header> <text>An entity is not eligible to be awarded a contract under this section unless the Chief Acquisition Officer of the Department of Veterans Affairs determines, at the time of evaluation of offers submitted under subsection (a), that the entity is currently performing or has performed, during the preceding three-year period, not fewer than three prime contracts from either governmental or commercial health care organizations for—</text> <subparagraph id="H3F31CC2909C4491CB9FD270C1C0C82A3"> <enum>(A)</enum> <text>the independent verification and validation services or equivalent services, including systems engineering and technical advisory (SETA) support of major acquisition programs; or</text> </subparagraph> 
<subparagraph id="HEDFCC40BB635420EA5AD471231E1E486"> <enum>(B)</enum> <text>the independent verification and validation or systems engineering and technical advisory (SETA) support of the development or acquisition of major acquisition programs or defense systems, in accordance with guidance of the Department of Defense relating to such acquisition programs or such business systems.</text> </subparagraph> </paragraph> <paragraph id="HB32D0CB0A2EC4EB6B8B282CA7CF90B69"> <enum>(2)</enum> <header>Past performance</header> <text>For any contract used to demonstrate eligibility under paragraph (1), an entity must have performed the work at a satisfactory or better level as indicated by the past performance information in the Contractor Performance Assessment Reporting System, or successor system.</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE91DFE2B082349BF89D73E8100FBD76A"> <enum>(3)</enum> <header>Demonstration of lack of conflict of interest</header> <text>The Secretary shall revoke the eligibility of an entity under this subsection if an entity does not demonstrate clear and unmitigable evidence that the entity does not have a conflict of interest with respect to the effective performance of functions under subsection (c).</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H099462674CC34237B69AC60EE362CBAF"> <enum>(4)</enum> <header>No mitigation plans acceptable</header> <text>The Secretary may not accept from an entity a plan to mitigate a conflict of interest in order to ameliorate any limitation or prohibition under this subsection.</text> </paragraph> </subsection> 
<subsection id="H36E8C751BA5C428EA4957F1B0E246723"> <enum>(c)</enum> <header>Functions</header> <text>The functions specified in this subsection are the following:</text> <paragraph id="H1FC306310EC8440BBD1E62826A0C7784"> <enum>(1)</enum> <text>The independent verification and validation of each major acquisition program project—</text> 
<subparagraph id="H2AE2024A13D642BC98D4111504C17EDB"> <enum>(A)</enum> <text>when such major acquisition program is initiated, with respect to its design and the development of its requirements and acquisition;</text> </subparagraph> <subparagraph id="H3134CDA173AE48F5AAA1EBA4B6B0868C"> <enum>(B)</enum> <text>at the conclusion of such program; and</text> </subparagraph>
                    <subparagraph id="H0B61531E8D5C4AF69FC82EAE3326FBB7">
                        <enum>(C)</enum>
 <text>at any other intervals during such program selected by the Chief Acquisition Officer of the Department.</text>
                    </subparagraph> </paragraph> 
<paragraph id="H738332DCFC884FF7A4454FD93D593E27"> <enum>(2)</enum> <text>The independent verification and validation of other programs or projects of the Department selected by the Chief Acquisition Officer of the Department, at intervals selected by the Chief Acquisition Officer.</text> </paragraph> </subsection> <subsection id="H2EAB1728BC0E429883B3EDF29914CEA8"> <enum>(d)</enum> <header>Funding</header> <text>The Chief Financial Officer of the Department shall ensure that each organizational subdivision of the Department that enters into a contract under subsection (a) proportionally contributes amounts to fund each such contract.</text> </subsection> 
<subsection id="H4295FE68378A42A18E4D10CA69C4FF26"> <enum>(e)</enum> <header>Definitions</header> <text>In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H916E147014C247CEB6251A822DFB09C5"> <enum>(1)</enum> <header>Covered contract</header> <text display-inline="yes-display-inline">The term <term>covered contract</term> means any prime or subcontract with the Department, including—</text> 
<subparagraph id="H174DF1A9B35F478D960692B8EB3FCC18"> <enum>(A)</enum> <text>information technology support or software or system design, development, sustainment, or maintenance services;</text> </subparagraph> <subparagraph id="H16FC2D9FAF67464695C73344FE74A52A"> <enum>(B)</enum> <text>professional or management consulting services; or</text> </subparagraph> 
<subparagraph id="H67E69B81E3C842C68E2BEF86D5E3333E"> <enum>(C)</enum> <text>advisory and assistance services.</text> </subparagraph> </paragraph> <paragraph id="HAC3DEC02085847E18922880F1A10F263"> <enum>(2)</enum> <header>Independent verification and validation</header> <text>The term <term>independent verification and validation</term> means a comprehensive inspection, a review, analysis, and testing, or an assessment of systems, software, or hardware, as applicable, performed by an entity awarded a contract under subsection (a)—</text>
                    <subparagraph id="H28C65D2ACB2D49AB8E57A94153F8755B">
                        <enum>(A)</enum>
 <text>to verify that the requirements of a program, project or system, or a development phase of such a program or project, are correctly defined; and</text>
                    </subparagraph>
                    <subparagraph id="H4F896FE5088F4551B8A91D1CA8235839">
                        <enum>(B)</enum>
 <text>to validate cost, schedule, and performance baselines of current programs and measure program effectiveness.</text>
                    </subparagraph>
                </paragraph> </subsection> </section> 
<section commented="no" display-inline="no-display-inline" id="H76E8BDCF99DC438CA4FE2CA05735C503"> <enum>6.</enum> <header>Department of Veterans Affairs cost assessment and program evaluation</header> 
<subsection commented="no" display-inline="no-display-inline" id="H3CBEB19CBD0D4B7B860F5EF3BA8D80AD"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">Subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">chapter 81</external-xref> of title 38, United States Code, as added by section 2 and amended by section 3, is further amended by adding at the end the following new section:</text> <quoted-block style="USC" display-inline="no-display-inline" id="HEFBD5F87696F4F9E8649D51B85F8E4E6"> <section id="H4F7B83EEAF764EDEBAEF22AFB93C9E96"> <enum>8184.</enum> <header>Cost assessment and program evaluation</header> <subsection id="H792478ED4456412481A93C857B117D91"> <enum>(a)</enum> <header>Director of Cost Assessment and Program Evaluation</header> <text>There is in the Department a Director of Cost Assessment and Program Evaluation, who shall report directly to the Secretary.</text> </subsection> 
<subsection id="HB9BAB9F2658C4CA6956E0DE88FB3724E"> <enum>(b)</enum> <header>Responsibilities</header> <text>The responsibilities of the Director are as follows:</text> <paragraph id="HAD3178C16CD3440B8A105D08C15DFBC6"> <enum>(1)</enum> <text>To develop policies and procedures for cost estimation and analysis of major acquisition programs of the Department.</text> </paragraph> 
<paragraph id="HCFAEC246ECF640AB8AC2AFCCCEE70BD1">
                                <enum>(2)</enum>
 <text>To conduct independent cost estimates and analyses for major acquisition programs to support acquisition decisions, or any other acquisitions as directed by the Secretary.</text>
                            </paragraph> 
<paragraph id="H64302B817621414A9A8704F32F338201" commented="no"> <enum>(3)</enum> <text>To provide an independent cost estimate to the Assistant Secretary for Acquisition in advance of a decision to proceed with full-scale acquisition for a major acquisition program or any other program as directed by the Director.</text> </paragraph> <paragraph id="H5E6A75E9A0DC4962A628E17B3D2BA24A"> <enum>(4)</enum> <text>To evaluate the effectiveness of major acquisition programs in meeting Department objectives.</text> </paragraph> 
<paragraph id="H2BFAC70C55AA43E1A691EED8A0CA2C44"> <enum>(5)</enum> <text>Not less frequently than once each year, to submit to the Secretary and the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives an annual report on cost estimation and program evaluation activities, including recommendations to improve acquisition efficiency. Such report shall include a list of all acquisitions where the independent cost estimate for a major acquisition program exceeded the budget request for the program by more than 5 percent.</text> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="H60E0016871384BDB864C3D6DEFEAE98E"> <enum>(c)</enum> <header>Support and resources</header> <text display-inline="yes-display-inline">The Chief Financial Officer of the Department shall provide to the Secretary such support and resources as may be necessary for the Secretary to ensure the effective establishment and functioning of the Director of Cost Assessment and Program Evaluation.</text> </subsection> </section> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> 
<subsection id="HC3A4737F89C74AC689E29FA8985A2163"> <enum>(b)</enum> <header>Report on monitoring of operating and support costs for major acquisition programs</header> 
<paragraph id="H7934562BDED34714B4146138487E5EC7"> <enum>(1)</enum> <header>Report to Secretary of Veterans Affairs</header> <text>Not later than one year after the date of the enactment of this Act, and not less frequently than once each year thereafter until December 31, 2028, the Director of Cost Assessment and Program Evaluation of the Department of Veterans Affairs shall submit to the Secretary of Veterans Affairs a report on systems and methods for tracking and assessing operating and support costs of major acquisition programs (as defined in section 8181 of title 38, United States Code, as added by section 2), including recommendations for establishing cost baselines.</text> </paragraph> <paragraph id="H4C0AAD0E82D54463BACC980E5AD7C394"> <enum>(2)</enum> <header>Transmittal to Congress</header> <text>Not later than 30 days after receiving a report pursuant to paragraph (1), the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives the report received by the Secretary.</text> </paragraph> </subsection> </section> 
<section id="H68246CF7F003406CB9209126B3C788A6"> <enum>7.</enum> <header>Improvements to hiring of entry-level acquisition positions in the Department of Veterans Affairs</header> 
<subsection id="H8B9EA9952CB04E1287DB91B75D6A9700">
                <enum>(a)</enum>
                <header>Priority use of internship programs for hiring into entry-Level positions in
                    acquisitions</header>
 <text>The Secretary of Veterans Affairs shall prioritize the use of acquisition internship programs to hire employees to entry-level positions relating to acquisition in the Department of Veterans Affairs.</text>
            </subsection> 
<subsection id="H3DB9B01BF7494538AE92CA3729839BB8"> <enum>(b)</enum> <header>Annual number of participants in acquisition internship programs</header> 
<paragraph id="HDD99DFE2B35D447594C3C2E96477DBF9"> <enum>(1)</enum> <header>In general</header> <text>Not later than September 30 of the first fiscal year beginning after the date of the enactment of this Act, the Secretary shall take such actions as may be necessary to ensure that the annual number of participants in acquisition internship programs of the Department is—</text> <subparagraph id="HFECB533C64F1465BA744C07177F03A33"> <enum>(A)</enum> <text>not fewer than twice the number of participants in such programs during fiscal year 2025; and</text> </subparagraph> 
<subparagraph id="H42B72852E99449DB8FAA21890B115D89"> <enum>(B)</enum> <text>not more than 4 times the number of participants in such programs during such fiscal year.</text> </subparagraph> </paragraph> <paragraph id="HD8C2C51606714A0E95CAA1C99EC3FE98"> <enum>(2)</enum> <header>Termination</header> <text>The requirements of paragraph (1) shall terminate on the date on which the Secretary certifies to the appropriate committees of Congress that the projected number of graduates of acquisition internship programs is sufficient to satisfy the human capital needs of the Department with respect to acquisition, taking into account the rate of attrition and projected retirements of personnel.</text> </paragraph> 
<paragraph id="H0C7F9FCA05F24F12BBD11F67A78063DB"> <enum>(3)</enum> <header>Appropriate committees of Congress defined</header> <text>In this subsection, the term <term>appropriate committees of Congress</term> means the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives.</text> </paragraph> </subsection> </section> <section id="HECFF7E63B3C640E48CE30270B3C45464"> <enum>8.</enum> <header>Independent analysis of acquisition process of Department of Veterans Affairs</header> <subsection commented="no" display-inline="no-display-inline" id="H505A00E726CE475B82083F685B7933D0"> <enum>(a)</enum> <header>Systems engineering analysis</header> <text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Veterans' Affairs shall enter into a memorandum of understanding with the Executive Director of the Acquisition Research Center of the Department of Defense to conduct a systems engineering analysis of the acquisition process of the Department of Veterans Affairs.</text> </subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H8A633845CD4B4D37A4B806AF8CDE44CC"> <enum>(b)</enum> <header>Report</header> <text display-inline="yes-display-inline">Not later than one year after the date in which the Secretary enters into the memorandum of understanding required by subsection (a), the Secretary shall submit to Committee on Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report on the findings of the Executive Director with respect to the analysis conducted under such subsection.</text> </subsection> </section> <section id="H8706F8D193BE4DD5BBAE42A3CDC4FA65"> <enum>9.</enum> <header>Requirements development process</header> <subsection commented="no" display-inline="no-display-inline" id="H3F5B230F37F347A0A5F639F3A122B059"> <enum>(a)</enum> <header>In general</header> <text display-inline="yes-display-inline">Subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">chapter 81</external-xref> of title 38, United States Code, as added by section 2 and amended by sections 3 and 6, is further amended by adding at the end the following new section:</text>

<subsection commented="no" display-inline="no-display-inline" id="H393DEE95F44B498287CFF342DFBE0220"> <enum>(a)</enum> <header display-inline="yes-display-inline">Establishment of process</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H699DE849AD0B4A15B99E2E4084257D24"> <enum>(1)</enum> <text>The Secretary shall establish a standardized requirements development process for major acquisition programs.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H762A6AB7C39C4106BDEE055ED0BEB00A" indent="up1"> <enum>(2)</enum> <text display-inline="yes-display-inline">The process established pursuant to paragraph (1) shall—</text> 
<subparagraph id="HF34CC9AFDD794565AB89524CB674B081"> <enum>(A)</enum> <text>define and validate mission-driven requirements for major acquisition programs exceeding $200,000,000 annually or $1,000,000,000 in lifecycle costs, in coordination with the Assistant Secretary for Acquisition;</text> </subparagraph> <subparagraph id="HCF56C3DB61E44898997F0F1CC76B73E3"> <enum>(B)</enum> <text>incorporate data-driven needs assessments, stakeholder input from relevant administrations, staff offices, and other elements of the Department and veterans service organizations, and alignment with statutory mandates, such as section 8121 of this title; and</text> </subparagraph> 
<subparagraph id="H069AC047280E4D8AB787FB1BDE6267FC"> <enum>(C)</enum> <text>ensure iterative validation of requirements through independent verification and validation, as described in section 8185 of this title, to confirm cost, schedule, and performance baselines.</text> </subparagraph> </paragraph> </subsection> <subsection commented="no" display-inline="no-display-inline" id="HAED08D4527BD43C0BA2A6D5A71DD7860"> <enum>(b)</enum> <header>Limitation on personnel</header> <text>The Secretary shall implement the process established pursuant to subsection (a) using staff within the Office of Acquisition and other relevant offices of the Department, as established under section 8182 of this title, without creating new positions, unless a subsequent cost-benefit analysis, validated by the Director of Cost Assessment and Program Evaluation, justifies additional resources.</text> </subsection> </section> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> 
<subsection id="HC69F673A1846430C8BDAFC540F011762"> <enum>(b)</enum> <header>Report</header> <text>Not later than 180 days after the enactment of this Act, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans' Affairs of the House of Representatives a report detailing the requirements process established pursuant to section 8187 of such title, as added by subsection (a) and a plan for implementation of such process, including timelines for integration with major acquisition program baselines.</text> </subsection> </section> <section commented="no" display-inline="no-display-inline" id="H2BD036789F7941F2ABBDFF290A78CADD"> <enum>10.</enum> <header display-inline="yes-display-inline">Conforming amendments</header> <text display-inline="no-display-inline">Subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">chapter 81</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="HE514DAF82D6B41669588EDB56EDADDD9"> <enum>(1)</enum> <text>in section 8171, by striking paragraphs (5) and (6); and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H79902E7C32374623AA3BDC53487E42D5"> <enum>(2)</enum> <text>by striking section 8172.</text> </paragraph> </section>
