<section id="HA65ED0C93203498A888F79B13C78618A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marijuana in Federally Assisted Housing Parity Act of 2025</short-title></quote>.</text></section> <section id="H36BD6307A58640B5903283AA6E09DC80"><enum>2.</enum><header>Amendments to United States Housing Act of 1937</header><text display-inline="no-display-inline">The United States Housing Act of 1937 is amended as follows:</text> 
<paragraph id="H006EB93A3C974B0CA4B085DB690FADF1"><enum>(1)</enum><header>Drug-related criminal activity defined</header><text>In section 3(b)(9) (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)(9)</external-xref>), by inserting before the period at the end the following: <quote>, except that such term shall not include any such manufacture, sale, distribution, use, or possession of marihuana (as such term is defined in such section) that is in compliance with the law of the State in which such manufacture, sale, distribution, use, or possession takes place</quote>.</text></paragraph> <paragraph id="H82AAC1B12220401FBB931B0CBFD65C29"><enum>(2)</enum><header>Currently engaging in the illegal use of a controlled substance and drug-related criminal activity defined</header><text display-inline="yes-display-inline">In section 6 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437d">42 U.S.C. 1437d</external-xref>)—</text> 
<subparagraph id="HBA46A9C6CADA455ABD1AAEC88F2EC247"><enum>(A)</enum><text>in subsection (l), in the last sentence after paragraph (9)—</text> <clause id="H86B165D4430B47C198A80D486E5728C4"><enum>(i)</enum><text>by striking <quote>paragraph (5)</quote> and inserting <quote>paragraph (6)</quote>; and</text></clause> 
<clause id="H541FB5A6096848E583882E3A833691EF"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting before the period at the end the following: <quote>, except that such term shall not include any such manufacture, sale, distribution, use, or possession of marihuana (as such term is defined in such section) that is in compliance with the law of the State in which such manufacture, sale, distribution, use, or possession takes place</quote>; and</text></clause></subparagraph> <subparagraph id="H444B012F2B894FB5938AE390805C49A4"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (t)(7)(C), by inserting before the period at the end the following: <quote>, except that such term shall not include the use of marihuana (as such term is defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)) that is in compliance with the law of the State in which such use takes place</quote>.</text></subparagraph></paragraph> 
<paragraph id="H076FA4AA4CEC468DAE2773DC06D79CAC"><enum>(3)</enum><header>Drug-related criminal activity defined</header><text display-inline="yes-display-inline">In section 8(f)(5) (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(f)(5)</external-xref>), by inserting before the semicolon at the end the following: <quote>, except that such term shall not include any such manufacture, sale, distribution, use, or possession of marihuana (as such term is defined in such section) that is in compliance with the law of the State in which such manufacture, sale, distribution, use, or possession takes place</quote>.</text></paragraph></section> <section id="H6FA5183C580F4589B0CD3AE28A765DD1"><enum>3.</enum><header>Amendments to Quality Housing and Work Responsibility Act of 1998</header><text display-inline="no-display-inline">Subtitle F of title V of the Quality Housing and Work Responsibility Act of 1998 is amended—</text> 
<paragraph id="HFDF432520C774B2BA7EF0DEC2536CF28"><enum>(1)</enum><text>in section 576 (<external-xref legal-doc="usc" parsable-cite="usc/42/13661">42 U.S.C. 13661</external-xref>)—</text> <subparagraph id="HE2AF3099ABDA47A197DD6EB7E5521CAF"><enum>(A)</enum><text>in subsection (b)—</text> 
<clause id="H6E88B871301042EAA8F7A55F2687E054"><enum>(i)</enum><text>in paragraph (1), by striking <quote>Notwithstanding</quote> and inserting <quote>Except as provided in paragraph (3) and notwithstanding</quote>;</text></clause> <clause display-inline="no-display-inline" id="HA26B353DD0BE4C158000E098BE3A50D0"><enum>(ii)</enum><text>in paragraph (2), by inserting <quote>other than the use of marihuana described in paragraph (3),</quote> after <quote>controlled substance</quote> each place such term appears; and</text></clause> 
<clause display-inline="no-display-inline" id="HEBF425B25CDF46D7A7F5C168D0122ECE"><enum>(iii)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H840CD43807014404B07A9836ED2F5943" style="OLC"> <paragraph id="H63B2AEF50BFA41898E0E2C33183FFF71"><enum>(3)</enum><header>State law exception</header><text display-inline="yes-display-inline">A public housing agency or an owner of federally assisted housing may not establish standards prohibiting admission to the program or federally assisted housing to any household with a member who engages in the use, distribution, possession, sale, or manufacture of marihuana (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)) in compliance with the law of the State in which such use, distribution, possession, sale, or manufacture takes place.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H22421934384A4375BAF81E5285B7E0D9"><enum>(B)</enum><text>in subsection (c), by adding after and below paragraph (2) the following flush matter:</text> <quoted-block display-inline="no-display-inline" id="H08074D8F6EC943C4B340F04AF9BAA8D3" style="OLC"> <quoted-block-continuation-text quoted-block-continuation-text-level="subsection">For the purposes of this subsection, the term <quote>criminal activity</quote> shall not include the use, distribution, possession, sale, or manufacture of marihuana (as such term is defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)) that is in compliance with the law of the State in which such use, distribution, possession, sale, or manufacture takes place.</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="HC7324491209F4B82862831E838C9259A"><enum>(2)</enum><text display-inline="yes-display-inline">in section 577 (<external-xref legal-doc="usc" parsable-cite="usc/42/13662">42 U.S.C. 13662</external-xref>), by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="HEC38CFFEB624432E9C3986CF7374B051" style="OLC"> 
<subsection id="H072CF2CC99BA48C0B5AB14F5E20DE3D1"><enum>(c)</enum><header>State law exception</header><text display-inline="yes-display-inline">For the purposes of this section, the term <quote>illegal use of a controlled substance</quote> shall not include the use, distribution, possession, sale, or manufacture of marihuana (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)) that is in compliance with the law of the State in which such use, distribution, possession, sale, or manufacture takes place.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H02061BC6BD0745B999EA203DADA15E01"><enum>(3)</enum><text>in section 579, by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="HC071597E6FBB485FAF6B7DD8410A8B3D" style="OLC"> 
<paragraph id="H7277D594F3F44745A47EB0729D0953E8"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means a State of the United States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H3B60236CD8FE41ACBF894940FDDAA7FB"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting the following new section after section 579:</text> 
<quoted-block display-inline="no-display-inline" id="H9E005065A0214E4D85CA7BDC214A0DE8" style="OLC"> 
<section id="HA7CB0310405245E69ED5D25EB93B3292"><enum>580.</enum><header>Enforcement; smoke-free zones</header> 
<subsection id="H6FC600639EF04460A96198FEBDF54947"><enum>(a)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The Secretary may not prohibit or otherwise discourage any activity involving the use, distribution, possession, sale, or manufacture of marihuana in federally assisted housing that is in compliance with the law of the State in which such activity takes place.</text></subsection> <subsection id="H292D3FC2EACC4EBF8E153F983941DB21"><enum>(b)</enum><header>HUD smoke-Free zones</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>Marijuana in Federally Assisted Housing Parity Act of 2025</short-title>, the Secretary shall issue regulations that restrict smoking marihuana in federally assisted housing in the same manner and same locations as the Secretary restricts smoking tobacco in public housing under subpart G of title 24, Code of Federal Regulations (or any successor regulation).</text></subsection> 
<subsection id="HDE4A75AFE21C444A8F94058EB0DED8FD"><enum>(c)</enum><header>Marihuana defined</header><text display-inline="yes-display-inline">In this section, the term <quote>marihuana</quote> has the meaning given such term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
