which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><action display="yes"><action-date date="20260914">September 14, 2026</action-date><action-desc>Additional sponsors: <cosponsor name-id="H001098">Mr. Hamadeh of Arizona</cosponsor>, <cosponsor name-id="C001120">Mr. Crenshaw</cosponsor>, <cosponsor name-id="S001229">Mr. Shreve</cosponsor>, and <cosponsor name-id="W000804">Mr. Wittman</cosponsor></action-desc></action><action display="yes"><action-date date="20260914">September 14, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on December 11, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a best-available transmission conductor standard for certain transmission projects under the Federal Power Act and to provide for presumptions regarding cost recovery for such conductors.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HIF00" reported-display-style="italic" id="HAC36802138224D86BC23DFC89B19E187"><section id="HAB9C15142024410EAEFD4019D15ED6F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>High-Capacity Grid Act</short-title></quote>.</text></section><section id="H284CB99F828F4680A3F4DE8AE9D96CC0"><enum>2.</enum><header>Best-available transmission conductor class</header><text display-inline="no-display-inline">The Federal Power Act is amended by inserting after section 223 (<external-xref legal-doc="usc" parsable-cite="usc/16/824w">16 U.S.C. 824w</external-xref>) the following:</text><quoted-block style="OLC" id="HF829008BCDC54E3792CF149294E614AA" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><section id="H79D8CC10D29F4AB4A549DC2939B70A4E"><enum>224.</enum><header>Use of best-available transmission conductors</header><subsection id="H62B0B3414C864EBCBDC3FFC5BA4BF85B" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Use of best-available transmission conductors</header><text display-inline="yes-display-inline">In exercising its authority under sections 205 and 206, the Commission shall require that public utilities use transmission conductors that are designated as part of the best-available transmission conductor class when carrying out covered projects.</text></subsection><subsection id="HB155E553947B4078B77C4B375838C9C6"><enum>(b)</enum><header>Regulations</header><paragraph id="H5F23F7DC7D144430A9536348FD2F26E3"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, the Commission shall issue regulations to carry out this section.</text></paragraph><paragraph id="HB4DE59A494674C608C76CA2B944A9808"><enum>(2)</enum><header>Inclusions</header><text>In issuing regulations under paragraph (1), the Commission shall—</text><subparagraph id="HE31EAD7C36B644AA9FB551978F9AF30E"><enum>(A)</enum><text display-inline="yes-display-inline">establish, in consultation with the Secretary of Energy, a methodology to designate, as part of the best-available transmission conductors class, transmission conductors that—</text><clause id="HA001B2162C53498FA04ED27A5CE9306B" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text>provide the greatest feasible and commercially available energy-carrying capacity at a given voltage level;</text></clause><clause id="HACF165A3B81F4A89BBC0358CE38962F4" commented="no"><enum>(ii)</enum><text>provide the highest feasible and commercially available electrical efficiency at that voltage level; and</text></clause><clause id="HFBCD4B57079B4126B25997FEC885B19C" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">provide the greatest feasible and commercially available level of mechanical performance, taking into account relevant factors, including reliability, safety, and affordability;</text></clause></subparagraph><subparagraph id="HDD73206EA1F348808EA583D4650C87F7"><enum>(B)</enum><text>using such methodology, designate transmission conductors as part of the best-available transmission conductor class;</text></subparagraph><subparagraph id="HEA2614582251427B8E9E63F9C1A3E4B6" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">establish filing requirements for public utilities to demonstrate compliance with the regulations, including (as applicable) such information and data the Commission determines necessary to demonstrate project-specific impacts described in subparagraph (D); and</text></subparagraph><subparagraph id="HFB6F2284EAE04D569CCB9B3742988312"><enum>(D)</enum><text display-inline="yes-display-inline">provide that the requirement to use transmission conductors that are designated as part of the best-available transmission conductor class not apply—</text><clause id="H82C7B94CC2D041AB96FF7C302F6EE458"><enum>(i)</enum><text display-inline="yes-display-inline">to carrying out any covered project for which a public utility, prior to the date of enactment of this section, has—</text><subclause id="HA53AC2491920446B998B4B2DCB785DE2" commented="no"><enum>(I)</enum><text>filed for any State or Federal permit required to carry out the covered project; or</text></subclause><subclause id="HC857494E56BD405ABD5C8E06BDD82FAB"><enum>(II)</enum><text>procured any transmission conductors;</text></subclause></clause><clause id="HBD641069B3AC46C5AEE85DFC7DC22633" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">to the emergency replacement or repair of transmission facilities necessary to restore service following a natural disaster, act of terrorism, or other event designated as an emergency by a relevant Federal or State authority;</text></clause><clause id="H5746C010F3014C8B9BDAE91A13636ACF"><enum>(iii)</enum><text display-inline="yes-display-inline">if such use would negatively impact safety or violate a reliability standard; or</text></clause><clause id="H780F990A2FC54555B4067C96F4A4794D" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">if the public utility carrying out the covered project demonstrates such use would significantly increase the cost per kilowatt-hour of electricity without providing a material and commensurate increase to capacity, efficiency, or mechanical performance. </text></clause></subparagraph></paragraph></subsection><subsection id="HECD81E97648D47CEB88AB553EC1C5C5C"><enum>(c)</enum><header>Periodic review and updates</header><text display-inline="yes-display-inline">The Commission may, to reflect improvements in technology, periodically review and update—</text><paragraph id="HF3C568BB7300428D834682527101B3D1"><enum>(1)</enum><text>the methodology for designating transmission conductors as part of the best-available transmission conductor class; and</text></paragraph><paragraph id="HEF8D72097EB9424BAEE86B03BC3D4F37"><enum>(2)</enum><text>the designation of transmission conductors as part of the best-available transmission conductor class.</text></paragraph></subsection><subsection id="H63F27D3EF83E4446B3539AC2BDF7A033"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3E3934B39D044F989FE49250DADE8247" commented="no"><enum>(1)</enum><header>Best-available transmission conductor class</header><text>The term <term>best-available transmission conductor class</term> means a class of transmission conductors that are designated as part of the class pursuant to this section.</text></paragraph><paragraph id="HE65AC3AD62EC4B8DA8D2261CDD0F13F0" commented="no"><enum>(2)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph id="H69CE6CCC9D254875A0E1AD698D068182"><enum>(3)</enum><header>Covered project</header><text>The term <term>covered project</term> means—</text><subparagraph id="H1FDFA7DB0662480596DF7E44136B82E7"><enum>(A)</enum><text display-inline="yes-display-inline">the construction of a new transmission facility subject to the jurisdiction of the Commission under section 201(b) that includes a transmission conductor; or</text></subparagraph><subparagraph id="H1DF42B67A2094299916E7CDE79B8AA65" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">any major (as determined by the Commission) modification, upgrade, replacement, or reconductoring of an existing transmission conductor subject to such jurisdiction.</text></subparagraph></paragraph><paragraph id="HD874E4EFDD85436B9C03F2B3CDF64C55" commented="no"><enum>(4)</enum><header>Reliability standard</header><text>The term <term>reliability standard</term> has the meaning given such term in section 215.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement display="yes"><action-date date="20260914">September 14, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
