R. 6618</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260325">March 25, 2026</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To require the Administrator of the Federal Aviation Administration to conduct a study on drone incursions on wildfire suppression, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="HB9A10F267D5342ADBEA6A14120681292"><section id="H53828909D6CB4557B001AE75DB4055F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Aerial Response Safety Act</short-title></quote>.</text></section><section id="HD33446212989485DA164D1E0C457DFB3"><enum>2.</enum><header>Study on drone incursions on wildfire suppression</header><subsection id="HFF9607A10F18448B9A90313C182B18AE"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H7DDB133E770C49E18A02ACBF51879458"><enum>(1)</enum><header>Counter-UASsystem; Unmanned aircraft system</header><text display-inline="yes-display-inline">The terms <quote>counter-UAS system</quote> and <term>unmanned aircraft system</term> have the meanings given such terms in section 44801 of title 49, United States Code.</text></paragraph><paragraph id="H567ABD94B1D242D684C7ECF65F88DB3B"><enum>(2)</enum><header>Unmanned aircraft system incursion</header><text display-inline="yes-display-inline">The term <term>unmanned aircraft system incursion</term> means the operation of an unmanned aircraft system within any airspace for which the Administrator of the Federal Aviation Administration has issued a temporary flight restriction because of a wildfire.</text></paragraph></subsection><subsection id="H03CD5F2D8A76486F921493858F6AC7A4"><enum>(b)</enum><header>Study required</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration, in consultation with the Secretary of the Interior and the Secretary of Agriculture, acting through the Chief of the Forest Service, shall conduct a study on the effects of unmanned aircraft system incursions on wildfire suppression with respect to land managed by the Department of the Interior or the Department of Agriculture.</text></subsection><subsection id="H2A9266CAFFAA4AC2900A6FBF29CAC57A"><enum>(c)</enum><header>Study contents</header><text>In conducting the study required under subsection (b), the Administrator shall—</text><paragraph id="HBD1CBF4EDBD14BAB868A8911D3F09316"><enum>(1)</enum><text>determine, for each of the 5 most recent calendar years—</text><subparagraph id="H5F48767912D34F1C825FB2A73AD176CC"><enum>(A)</enum><text>the number of occurrences in which a unmanned aircraft system incursion has interfered with wildfire suppression; and</text></subparagraph><subparagraph id="H0966B1AE78074E9D948175A7A435BF45"><enum>(B)</enum><text>the estimated effect of each occurrence described in subparagraph (A) on—</text><clause id="H9E995ACB7F874E4184F699E1EEE23B41"><enum>(i)</enum><text>the length of time required to achieve complete suppression;</text></clause><clause id="H2926B323238846C9938093E5B6DE2419"><enum>(ii)</enum><text>any associated delay in the fielding of aerial firefighting response units; and</text></clause><clause id="H7B43508DD1194086BF36B39E8E8804C5"><enum>(iii)</enum><text>the amounts expended by the Federal Government; and</text></clause></subparagraph></paragraph><paragraph id="H87A1B50E54EF49ACAFA3E38F81E038C2"><enum>(2)</enum><text>evaluate the feasibility and effectiveness of—</text><subparagraph id="HAC561A243FDB4996A6F22B999F621E32"><enum>(A)</enum><text display-inline="yes-display-inline">the dissemination of educational materials relating to the effects of unmanned aircraft system incursions on wildfire suppression operations; and</text></subparagraph><subparagraph id="H7ECD15F8EF004E3BB7A4AAB4C48172C3"><enum>(B)</enum><text>the deployment of approved counter-UAS systems by authorized entities as a means to detect, mitigate, and prevent unmanned aircraft system incursions during such operations.</text></subparagraph></paragraph></subsection><subsection id="H9666551780954932AFE7B1EE17065F39"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Administrator shall submit to the Committee on Energy and Natural Resources, the Committee on Appropriations, and the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources, the Committee on Appropriations, and the Committee on Transportation and Infrastructure of the House of Representatives a report describing—</text><paragraph id="H640D5CC0CA4A4C389878EB6C5E207193"><enum>(1)</enum><text>the findings of the study required under subsection (b); and</text></paragraph><paragraph id="H5A4F19EA71A6402DB48621CDD68D7604"><enum>(2)</enum><text>any recommendations relating to those findings.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20260324" chamber="House">Passed the House of Representatives March 24, 2026.</attestation-date><attestor display="yes">Kevin F.
