                introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and
 Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the President’s Council on Sports, Fitness, and Nutrition, and for other purposes.</official-title></form><legis-body id="HFD745C9649B84A6285C2673B2E73FF26" style="OLC"><section id="H6FF4903D27B54AE2B3F8B24B38BC698E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Presidential Fitness Test Act of 2025</short-title></quote>.</text></section><section id="HC253CF77B5B24CFDAB7BF189D3ED5FFE"><enum>2.</enum><header>President’s Council on Sports, Fitness, and Nutrition</header><subsection id="HF2BC2A1085F845AA8192971716F271C8"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the President’s Council on Sports, Fitness, and Nutrition (referred to in this section as the <quote>Council</quote>).</text></subsection><subsection id="H090074B20B00494D9AA1EA5684B65D05"><enum>(b)</enum><header>Membership</header><paragraph id="H570334B358F74B749E53B19D96A393C1"><enum>(1)</enum><header>Appointments</header><text>The Council shall consist of up to 30 members to be appointed by the President.</text></paragraph><paragraph id="H38729139BAB240569970B3AB7942866A"><enum>(2)</enum><header>Membership</header><text>The members of the Council may include representatives of relevant stakeholders.</text></paragraph><paragraph id="H655566EA53DD4F989CB4B0F061E66915"><enum>(3)</enum><header>Terms</header><text>A member of the Council—</text><subparagraph id="H5ADB420C779E4F25A354460FD02F4174"><enum>(A)</enum><text>shall serve for a term of 2 years;</text></subparagraph><subparagraph id="HFAF9306F13B041E39284AFE7E031D3E4"><enum>(B)</enum><text>shall be eligible for reappointment; and</text></subparagraph><subparagraph id="H58CC517428D34CA787C6ADC8487D0BDB"><enum>(C)</enum><text>may continue to serve after the expiration of their term until the appointment of a successor.</text></subparagraph></paragraph><paragraph id="HC6E111EA3FEB47AD9AEB0AA1AB92110D"><enum>(4)</enum><header>Chair; Vice Chair</header><text>The President may designate one or more of the members of the Council to serve as the Chair or Vice Chair of the Council.</text></paragraph></subsection><subsection id="H6C34DD8A3145403FA6C4BE8BD93C3100"><enum>(c)</enum><header>Functions of the Council</header><paragraph id="HDD65FB17E2CD4173BCCD4AACDF6032A4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Council shall—</text><subparagraph id="H97896E1CDB13471AA2CD5ACA4E530DDE"><enum>(A)</enum><text>advise the President concerning progress made in carrying out the provisions of this section; and</text></subparagraph><subparagraph id="H9ACAC08E1A3B4D0F89CB54D51026D56E"><enum>(B)</enum><text>recommend to the President actions to accelerate such progress.</text></subparagraph></paragraph><paragraph id="H64E5F1317BE54343BEB1B3F023DACD43"><enum>(2)</enum><header>Recommendations</header><text display-inline="yes-display-inline">In carrying out this section, the Council shall recommend—</text><subparagraph id="H0C7E5B4D962D448EB1B402586384CD9A"><enum>(A)</enum><text display-inline="yes-display-inline">strategies for reestablishing the Presidential Fitness Test, with any appropriate improvements, as the main assessment tool for a Presidential Fitness Award;</text></subparagraph><subparagraph id="H7EF6AE32E53A4D8092D4E08B495F78D8"><enum>(B)</enum><text>strategies for the development and promotion of Presidential challenges and school-based programs that reward excellence in physical education;</text></subparagraph><subparagraph id="H945A6DB0804A4FECB62FC4C2CAC4BA88"><enum>(C)</enum><text>actions to expand opportunities at the global, national, State, and local levels for participation in sports and engagement in physical fitness;</text></subparagraph><subparagraph id="H4C4F9720FB9B4478954B660E636E9DE1"><enum>(D)</enum><text>bold and innovative fitness goals for American youth with the aim of fostering a new generation of healthy, active citizens;</text></subparagraph><subparagraph id="H93DA72BFA8C04DA9A4EDA8CB49D554EA"><enum>(E)</enum><text>campaigns and events that elevate American sports, military readiness, and health traditions;</text></subparagraph><subparagraph id="HC71A8AA24E184CC1BAF1909859CE951B"><enum>(F)</enum><text>opportunities at the global, national, State, and local levels that expand participation in sports and emphasize the importance of an active lifestyle and good nutrition, including partnerships with professional athletes, sports organizations, player’s associations, influential figures, nonprofit organizations, and community groups to inspire all Americans, among other initiatives; and</text></subparagraph><subparagraph id="H528A34E4319A4D80A74208AF0569457A"><enum>(G)</enum><text>strategies to address the growing national security threat posed by the increasing rates of childhood obesity, chronic diseases, and sedentary lifestyles, which threaten the future readiness of the United States workforce and military.</text></subparagraph></paragraph></subsection><subsection id="H4E72690966964A97846B67F1B9D84790"><enum>(d)</enum><header>Administration</header><paragraph id="H56A705C5C9454E45ABBE0988FD74845D"><enum>(1)</enum><header>Executive director</header><text display-inline="yes-display-inline">The President shall designate an Executive Director of the Council who shall—</text><subparagraph id="HEBE33225672A4330978ACF9126EAC874"><enum>(A)</enum><text>manage day-to-day operations;</text></subparagraph><subparagraph id="HC43B3C0081634BD7B4C8859DE7D08C01"><enum>(B)</enum><text>serve as a liaison to the President on matters and activities pertaining to the Council; and</text></subparagraph><subparagraph id="HDEB1A0402BAC46A69D25DCD9683B2548"><enum>(C)</enum><text>oversee engagement with executive departments and agencies, athletic institutions, and community partners.</text></subparagraph></paragraph><paragraph id="HDDCE4FE69EE445488EB7EA49E7C3F082"><enum>(2)</enum><header>Information to be furnished by departments and agencies</header><text display-inline="yes-display-inline">Each executive department and agency shall, to the extent permitted by law and subject to the availability of funds, furnish such information and assistance to the Council as the Council may request.</text></paragraph><paragraph id="HA11E1EFEDADE477B9FAA31155303E363"><enum>(3)</enum><header>Compensation</header><text display-inline="yes-display-inline">Members of the Council shall serve without compensation but may receive travel reimbursement, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, subject to the availability of funds.</text></paragraph><paragraph id="H35DB586D63D34C87BAC883EBD73BA5A0"><enum>(4)</enum><header>Funding; administrative and technical support</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall provide such funding and administrative and technical support as the Council may require, subject to appropriations Acts.</text></paragraph><paragraph id="H72CEC094A4ED4C61AB28F984A5A44E07"><enum>(5)</enum><header>Subcommittees</header><text display-inline="yes-display-inline">The Council may, with the approval of the President, establish subcommittees as appropriate to aid in the work of the Council.</text></paragraph><paragraph id="H3A70CF41CE8A41F48675C0AAA2B987D0"><enum>(6)</enum><header>Seal</header><text display-inline="yes-display-inline">The Council shall modify the seal of the <quote>President’s Council on Physical Fitness and Sports</quote> to reflect the name of the Council as established by subsection (a).</text></paragraph><paragraph id="H9B5E752222D9450F9E8E5E10F00C67BB"><enum>(7)</enum><header>Federal Advisory Committee Act</header><text display-inline="yes-display-inline">To the extent that <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">chapter 10</external-xref> of title 5, United States Code (known as the <quote>Federal Advisory Committee Act</quote>), may apply to the administration of this section, any functions of the President under such chapter, except that of reporting to the Congress, shall be performed by the Secretary of Health and Human Services in accordance with the guidelines and procedures issued by the Administrator of General Services.</text></paragraph></subsection><subsection id="HE8A660E5DDC2449D994936E6A6EA99B8"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The Council shall terminate 2 years after the date of enactment of this Act, unless extended by the President.</text></subsection><subsection id="H55CE83FC998246A09134FF117AD9F8F9"><enum>(f)</enum><header>Availability of amounts</header><text display-inline="yes-display-inline">Amounts appropriated after the date of enactment of this Act to carry out the Presidential Youth Fitness Program may be used to establish the Presidential Fitness Test in schools in the United States.</text></subsection></section></legis-body></bill>
