<official-title display="yes">To extend duty-free treatment provided with respect to imports from Haiti under the Caribbean Basin Economic Recovery Act, and for other purposes.</official-title>

<section id="HC32D263EC72D4A6089A0CCC4A5674ECC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Haiti Economic Lift Program Extension Act</short-title></quote>.</text></section> <section id="H05AD1DF18533431487374AA4C852A0EF"><enum>2.</enum><header>Extension of special rules for Haiti under Caribbean Basin Economic Recovery Act</header><text display-inline="no-display-inline">Section 213A of the Caribbean Basin Economic Recovery Act (<external-xref legal-doc="usc" parsable-cite="usc/19/2703a">19 U.S.C. 2703a</external-xref>) is amended—</text>
<paragraph id="HE207D47CE8C543C3AC834FE1EF3D259F"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="H247B21EBB2E345718C97A25AFA372CA4"><enum>(A)</enum><text>in paragraph (1)—</text>
<clause id="HB743591D5E8048C5966737C009D70075"><enum>(i)</enum><text>by amending subparagraph (B)(v)(I) to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HF0170D5C314F4A2A8ED3F7A92D802D49"> <subclause id="H1235AE98050442F8A4A9DE31A616888C"><enum>(I)</enum><header>Applicable percentage</header><text>The term <term>applicable percentage</term> means 60 percent or more on and after December 20, 2017.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="HA1DACF99AF81479DAD8E3235910F4826"><enum>(ii)</enum><text>by amending subparagraph (C) to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H9FD3CCBF06B8461F8718EE7816485CFE"> <subparagraph commented="no" display-inline="no-display-inline" id="H7C9AF7E2160643E0B1E31811A975D1C9"><enum>(C)</enum><header display-inline="yes-display-inline">Quantitative limitations</header><text display-inline="yes-display-inline">The preferential treatment described in subparagraph (A) shall be extended, during each period after the initial applicable 1-year period, to not more than 1.25 percent of the aggregate square meter equivalents of all apparel articles imported into the United States in the most recent 12-month period for which data are available.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="H484160800A044986B552E90FB6C0C1B0"><enum>(B)</enum><text>in paragraph (2), by striking <quote>in each of the 16 succeeding 1-year periods</quote> each place it appears and inserting <quote>in any of the succeeding 1-year periods</quote>; and</text></subparagraph></paragraph> <paragraph id="HCDE860E7C81347AE8436F2053E737975"><enum>(2)</enum><text>by amending subsection (h) to read as follows:</text>

<subsection commented="no" display-inline="no-display-inline" id="H8282318CF19F4C31A6D305591A15AE84"><enum>(h)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">The duty-free treatment provided under this section shall remain in effect until December 31, 2028.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HC7B3EDC78CF046C89422F24AF9B6E9D5"><enum>3.</enum><header>Restoration of eligibility of certain articles for preferential treatment</header> <subsection commented="no" display-inline="no-display-inline" id="H86428B734E814F3FA64AB4DAD25A5949"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The President shall proclaim such modifications to the Harmonized Tariff Schedule of the United States as may be necessary to restore the eligibility of articles described in subsection (b) for preferential treatment under section 213A of the Caribbean Basin Economic Recovery Act (<external-xref legal-doc="usc" parsable-cite="usc/19/2703a">19 U.S.C. 2703a</external-xref>).</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H5F256D3F785C4FA8AE8EEA89960BD551"><enum>(b)</enum><header display-inline="yes-display-inline">Articles described</header><text display-inline="yes-display-inline">An article described in this subsection is an article that—</text> <paragraph commented="no" display-inline="no-display-inline" id="H8F10C23059624B6EAD455CE93125EFDE"><enum>(1)</enum><text display-inline="yes-display-inline">was eligible for preferential treatment under section 213A of the Caribbean Basin Economic Recovery Act (<external-xref legal-doc="usc" parsable-cite="usc/19/2703a">19 U.S.C. 2703a</external-xref>) on December 20, 2006; and </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF75D6115EF81405797052704F1DEED27"><enum>(2)</enum><text display-inline="yes-display-inline">became ineligible for such treatment after that date and before the date of the enactment of this Act as a result of revisions to the Harmonized Tariff Schedule.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HE99D8B216D214F52B110837C0EE82966"><enum>(c)</enum><header>Effective date of proclamation</header><text>A proclamation under subsection (a) shall take effect not earlier than 2 business days after the President submits to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives a report on the proclamation and the reasons for the modifications to the Harmonized Tariff Schedule under the proclamation.</text></subsection></section>
<section id="H2B61B5F7BB604600B3A9CDEAE8D61E0B"><enum>4.</enum><header>Retroactive application</header>
<subsection id="HCEF928528DD5487F9065147A32C721ED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 514 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1514">19 U.S.C. 1514</external-xref>) or any other provision of law, and subject to paragraph (2), any entry of a covered article to which duty-free treatment or other preferential treatment under the Caribbean Basin Economic Recovery Act (<external-xref legal-doc="usc" parsable-cite="usc/19/2701">19 U.S.C. 2701 et seq.</external-xref>) would have applied if the entry had been made before September 30, 2025, that was made—</text> <paragraph id="HFB13A1EC28F341EDB3C55FFF0E3DE042"><enum>(1)</enum><text display-inline="yes-display-inline">on or after September 30, 2025, and</text></paragraph>
<paragraph id="H5A7671BFDEEE45B7829EB3502E408170"><enum>(2)</enum><text>before the date of the enactment of this Act,</text></paragraph><continuation-text continuation-text-level="subsection">shall be liquidated or reliquidated as though such entry occurred on the date of the enactment of this Act.</continuation-text></subsection> <subsection id="H3EBB406ACCEB4529BA6AC3C8783B96F7"><enum>(b)</enum><header>Requests</header><text>A liquidation or reliquidation may be made under paragraph (1) with respect to an entry only if a request therefor is filed with the Commissioner of U.S. Customs and Border Protection not later than 180 days after the date of the enactment of this Act that contains sufficient information to enable such Commissioner—</text>
<paragraph id="HAA472F42B3A04D818972F370ABAB1BF0"><enum>(1)</enum><text>to locate the entry; or</text></paragraph> <paragraph id="H6A7DB06836F14CB4ACB7E94F7D4340D3"><enum>(2)</enum><text>to reconstruct the entry if it cannot be located.</text></paragraph></subsection>
<subsection id="H318F07D0973C475493A51AA01FA33B65"><enum>(c)</enum><header>Payment of amounts owed</header><text>Any amounts owed by the United States pursuant to the liquidation or reliquidation of an entry of a covered article under paragraph (1) shall be paid, without interest of any kind, not later than 90 days after the date of the liquidation or reliquidation (as the case may be).</text></subsection> <subsection id="HD177B4C2B31541A7AC73E3DB9289351D"><enum>(d)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HCFB6EE9120DF4DDC9D8B8C3404194578"><enum>(1)</enum><header>Covered article</header><text display-inline="yes-display-inline">The term <quote>covered article</quote> means an article from Haiti.</text></paragraph> <paragraph id="H4275F02C9E1B438A9AAB2B9013475724"><enum>(2)</enum><header>Entry</header><text>The term <quote>entry</quote> includes a withdrawal from warehouse for consumption.</text></paragraph></subsection></section>
