<section section-type="section-one" id="H11A33C693DF24423BE458B2F6A3960EF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AGOA Extension Act</short-title></quote>.</text></section> <section id="H1993B61B94AB4104A697F9AC590506EB"><enum>2.</enum><header>Extension of preferential treatment for certain countries in Africa under African Growth and Opportunity Act; retroactive application</header> <subsection id="H50C4AD9A5F994682AEA984D1C4D1A4C8"><enum>(a)</enum><header>Extension</header> <paragraph id="H64BD4B593DA14DB38F515822DA75473B"><enum>(1)</enum><header>Trade Act of 1974</header><text>Section 506B of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2466b">19 U.S.C. 2466b</external-xref>) is amended by striking <quote>September 30, 2025</quote> and inserting <quote>December 31, 2028</quote>.</text></paragraph>
<paragraph id="H097CE4D99BE1401FABDB7ABED07476AB"><enum>(2)</enum><header>African Growth and Opportunity Act</header>
<subparagraph id="HB1457A94974B47A59E875E49FDB97A16"><enum>(A)</enum><header>In general</header><text>Section 112(g) of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3721">19 U.S.C. 3721(g)</external-xref>) is amended by striking <quote>September 30, 2025</quote> and inserting <quote>December 31, 2028</quote>.</text></subparagraph> <subparagraph id="H5153A10DF53845A6B5245294F866AB58"><enum>(B)</enum><header>Regional apparel article program</header><text>Section 112(b)(3)(A) of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3721">19 U.S.C. 3721(b)(3)(A)</external-xref>) is amended—</text>
<clause id="HD2A2903C505F4A0185799D538E7E7986"><enum>(i)</enum><text>in clause (i), by striking <quote>21 succeeding</quote> and inserting <quote>24 succeeding</quote>; and</text></clause> <clause id="HE45B9AC6CED24E1F93CF3BAE91422550"><enum>(ii)</enum><text>in clause (ii)(II), by striking <quote>September 30, 2025</quote> and inserting <quote>December 31, 2028</quote>.</text></clause></subparagraph>
<subparagraph id="H89146CCDE1A74B8D87858468CDFD92B6"><enum>(C)</enum><header>Third-country fabric program</header><text>Section 112(c)(1) of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3721">19 U.S.C. 3721(c)(1)</external-xref>) is amended—</text> <clause id="HDB702080C151442DAA35A4AA11B38E0B"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">september 30, 2025</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">december 31, 2028</header-in-text></quote>;</text></clause>
<clause id="H02E5ADDF5F414C1EB14E914842E40B2D"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>September 30, 2025</quote> and inserting <quote>December 31, 2028</quote>; and</text></clause> <clause id="HC4735827166F4F9F8D8F4887A97DC0DA"><enum>(iii)</enum><text>in subparagraph (B)(ii), by striking <quote>September 30, 2025</quote> and inserting <quote>December 31, 2028</quote>.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H995D787E9785486A80B8445450B9C5EF"><enum>(b)</enum><header>Retroactive application</header>
<paragraph id="HA05346F3EA7D434985B51F4470F74C8C"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 514 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1514">19 U.S.C. 1514</external-xref>) or any other provision of law, and subject to paragraph (2), any entry of a covered article to which duty-free treatment or other preferential treatment under section 506A of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2466a">19 U.S.C. 2466a</external-xref>) would have applied if the entry had been made on September 30, 2025, that was made—</text> <subparagraph id="H1DD40776052F46E3B0DFE38B27BE0CF8"><enum>(A)</enum><text display-inline="yes-display-inline">after September 30, 2025, and</text></subparagraph>
<subparagraph id="HBB5FF0B2545B48FE88E7673FBF8575B1"><enum>(B)</enum><text>before the date of the enactment of this Act,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall be liquidated or reliquidated as though such entry occurred on the date of the enactment of this Act.</continuation-text></paragraph> <paragraph id="HE992A5E3F8E44E93A9107043EDA9B844"><enum>(2)</enum><header>Requests</header><text>A liquidation or reliquidation may be made under paragraph (1) with respect to an entry only if a request therefor is filed with the Commissioner of U.S. Customs and Border Protection not later than 180 days after the date of the enactment of this Act that contains sufficient information to enable such Commissioner—</text>
<subparagraph id="HDA9F837954234663B17C70D6E3BC5F3F"><enum>(A)</enum><text>to locate the entry; or</text></subparagraph> <subparagraph id="H1020CB0193FE488EB0DECF4B95487ED3"><enum>(B)</enum><text>to reconstruct the entry if it cannot be located.</text></subparagraph></paragraph>
<paragraph id="HAB4D14205418476E88D872A38D495B5C"><enum>(3)</enum><header>Payment of amounts owed</header><text>Any amounts owed by the United States pursuant to the liquidation or reliquidation of an entry of a covered article under paragraph (1) shall be paid, without interest of any kind, not later than 90 days after the date of the liquidation or reliquidation (as the case may be).</text></paragraph> <paragraph id="H73EEA04C3CB940AEB95E47CF21E9C96E"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="H1384987DDCFD4C70B612BA35C8D389A3"><enum>(A)</enum><header>Covered article</header><text display-inline="yes-display-inline">The term <quote>covered article</quote> means an article from a country that is designated by the President as a beneficiary sub-Saharan African country under section 104 of the African Growth and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3703">19 U.S.C. 3703</external-xref>) as of the day before the date of the enactment of this Act.</text></subparagraph> <subparagraph id="H6E94D3D2B4C14854A344D4D8ADCAD990"><enum>(B)</enum><header>Entry</header><text>The term <quote>entry</quote> includes a withdrawal from warehouse for consumption.</text></subparagraph></paragraph></subsection></section>
<section id="HF5911CA163F6423A9EAF7699798940E5"><enum>3.</enum><header>Extension of customs user fees</header>
<subsection id="HFD8FDE4C6455491484E362C9823C9744"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 13031(j)(3) of the Consolidated Omnibus Budget Reconciliation Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/19/58c">19 U.S.C. 58c(j)(3)</external-xref>) is amended—</text> <paragraph id="H5CDB9CF9199343DAB4DA540CD46B5117"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>September 30, 2031</quote> and inserting <quote>December 31, 2031</quote>; and</text></paragraph>
<paragraph id="HC36AF83E49C44A098DC7D0AB9ADA91AA"><enum>(2)</enum><text>in subparagraph (B)(i), by striking <quote>September 30, 2031</quote> and inserting <quote>December 31, 2031</quote>.</text></paragraph></subsection> <subsection id="HEE245F85492841E09DC6FEA5D5423F19"><enum>(b)</enum><header>Rate for merchandise processing fees</header><text display-inline="yes-display-inline">Section 503 of the United States-Korea Free Trade Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3805">19 U.S.C. 3805</external-xref> note) is amended by striking <quote>September 30, 2031</quote> and inserting <quote>December 31, 2031</quote>.</text></subsection></section>
