R. 6472</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260309">March 9, 2026</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to provide for in-state tuition rates for certain residents of Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, and the United States Virgin Islands, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="HF97C3305DC6C4FB8872D6F94262D6037"><section id="H3635F628FE8947628FF2627787ABA532" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Territorial Student Access to Higher Education Act</short-title></quote>.</text></section><section id="H5E1A85CA91CD4131A0CB1E160AD44B90" section-type="subsequent-section"><enum>2.</enum><header>In-State tuition for certain residents of Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, and the United States Virgin Islands</header><subsection id="HF9ED2DDA6A634837A0AEC194175A80D9"><enum>(a)</enum><header>In-State tuition rates</header><text display-inline="yes-display-inline">Part C of title I of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1015">20 U.S.C. 1015 et seq.</external-xref>) is amended by inserting after section 135 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H46C5DFF3F5384C88B0471A5785C7AC27"><section id="H67A143521C7346D4B4F15971973560DD"><enum>135A.</enum><header>In-State tuition rates for certain residents of Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, and the United States Virgin Islands</header><subsection id="H92D5CD572A17450086517A33A842A3D1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A public institution of higher education that receives assistance under this Act shall not charge a covered individual tuition or fees for attendance at such institution at a rate that is greater than the rate charged for residents of the State in which such institution is located.</text></subsection><subsection id="HE52FD8DE141E4C058AF9E61FE4BE846A"><enum>(b)</enum><header>Covered individual</header><text>In this section, the term <term>covered individual</term> means an individual who—</text><paragraph id="H88A603C62E5048109D9A53BC9610F479"><enum>(1)</enum><text display-inline="yes-display-inline">is a resident of Guam, the Commonwealth of the Northern Mariana Islands, American Samoa, or the United States Virgin Islands; and</text></paragraph><paragraph id="H7B65D49F231240F2892C0EC56479740C"><enum>(2)</enum><text display-inline="yes-display-inline">is a national of the United States (as such term is defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD4C845E4093248E8BD6A1C20ACB6C3BB"><enum>(b)</enum><header>Program participation agreement</header><text>Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H709F921B24F744CA96001370F663CF18"><paragraph id="H694603DEEEAD4089942DEC7FFE9612A4"><enum>(30)</enum><text display-inline="yes-display-inline">The institution will comply with the requirements of section 135A, as applicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20260304" chamber="House">Passed the House of Representatives March 4, 2026.</attestation-date><attestor display="yes">Kevin F.
