which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><action display="yes"><action-date date="20260409">April 9, 2026</action-date><action-desc>Additional sponsors: <cosponsor name-id="G000605">Mr. Gray</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, and <cosponsor name-id="C001137">Mr. Crank</cosponsor></action-desc></action><action display="yes"><action-date date="20260409">April 9, 2026</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed<pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Clean Air Act to require revisions to regulations governing the review and handling of air quality monitoring data influenced by exceptional events or actions to mitigate wildfire risk.<pagebreak></pagebreak></official-title></form><legis-body id="H44EFD1407A584D6795A586CFDF059689" style="OLC"><section id="H8B0EA59CDA1346809AD67621726C71A9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fire Improvement and Reforming Exceptional Events Act</short-title></quote> or the <quote><short-title>FIRE Act</short-title></quote>.</text></section><section id="H89C6D8D8427147D882AA158A7BBC16C6" commented="no"><enum>2.</enum><header>Air quality monitoring data influenced by exceptional events or actions to mitigate wildfire risk</header><text display-inline="no-display-inline">Section 319(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)</external-xref>) is amended—</text><paragraph id="HB1783AB394334B89A56351954DEC0B5F" commented="no"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">Or actions To mitigate wildfire risk</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Events</header-in-text></quote>;</text></paragraph><paragraph id="HE58664E9D3A444A592382DD44D6DE360" commented="no"><enum>(2)</enum><text>in paragraph (1)—</text><subparagraph id="H91ADB278A9F44D73A9394FAC9046661E" commented="no"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Definition of exceptional event</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Definitions</header-in-text></quote>;</text></subparagraph><subparagraph id="HBE2AA85597524E77BCEEE958AA9D9CB3" commented="no"><enum>(B)</enum><text>in subparagraph (A), by redesignating clauses (i) through (iv), as subclauses (I) through (IV), respectively;</text></subparagraph><subparagraph id="HBD0F4A71F799443C8E8DAC9B44D8E2AD" commented="no"><enum>(C)</enum><text>by striking <quote>(A)</quote> and all that follows through <quote>an event that—</quote> and inserting the following:</text><quoted-block style="OLC" id="H504104F330F74F3F89DCBF86E8B8FFFA" display-inline="no-display-inline"><subparagraph id="H7E8F6110BC684EA8A1027C4052710414" commented="no"><enum>(A)</enum><header>Exceptional event</header><clause id="HFE25030482394120B374EB6B053CECE1" commented="no"><enum>(i)</enum><header>In general</header><text>The term <term>exceptional event</term> means an event that—</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HE437243E35A741E8823DC78850BF009A" commented="no"><enum>(D)</enum><text>by amending subclause (III) of subparagraph (A)(i), as redesignated, to read as follows:</text><quoted-block style="OLC" id="H62E41EE3E79B4C6CAF0CA5B08F730FB5" display-inline="no-display-inline"><subclause id="H71E77EFC4D904007AA492AF1BCDDCC52" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">is an event that is—</text><item id="HB37D58769D5B4A3E83982B34EA31162A" commented="no"><enum>(aa)</enum><text>a natural event;</text></item><item id="H81242EC937824F0BB3C02796A824D815" commented="no"><enum>(bb)</enum><text display-inline="yes-display-inline">caused by a human activity that is intended to mirror the occurrence or reoccurrence of a natural event; or</text></item><item id="H7CBF2F70FB634D9EA2A76DB1C0664B85" commented="no"><enum>(cc)</enum><text>caused by a human activity that is unlikely to recur; and</text></item></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HD5BA61A12B084C2AA46118B2F2E16FCF" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" id="HDE47B62576764F089FDF300C22EACD10" display-inline="no-display-inline"><clause id="H5ABB8E3A75074FF9B0330D5643DF45BF" commented="no"><enum>(ii)</enum><header>Exclusions</header><text>In this subsection, the term <term>exceptional event</term> does not include—</text><subclause id="HC7403E03AB0E491698601E25443EB365" commented="no"><enum>(I)</enum><text>ordinarily occurring stagnation of air masses;</text></subclause><subclause id="HAD616B1531CC40A09FBF6BE2909AAF04" commented="no"><enum>(II)</enum><text>meteorological inversions; or</text></subclause><subclause id="H5365C8E28DDD43C486572467A7922C29" commented="no"><enum>(III)</enum><text>air pollution relating to source noncompliance.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7138F702CC404C3098E26F2C80502A32" commented="no"><enum>(F)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HB4202BFBA5CC45829F7EB5ACD2DC3594" display-inline="no-display-inline"><subparagraph id="H0DB077877B2B4CA790EE6B3DEFEF306F" commented="no"><enum>(B)</enum><header>Action to mitigate wildfire risk</header><text display-inline="yes-display-inline">The term <term>action to mitigate wildfire risk</term> means a prescribed fire or similar measure, undertaken in accordance with State approved practices, to reduce the risk and severity of wildfires.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB01C6049B96E445D8A2F2BDDDD6C99D0" commented="no"><enum>(3)</enum><text>in paragraph (2)—</text><subparagraph id="H21CBA9343D1B4BED8F72BDA8A575091D" commented="no"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="H2F19FC89DBDA46C5BBB42ACB7BC464AE" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>March 1, 2006</quote> and inserting <quote>18 months after the date of enactment of the <short-title>FIRE Act</short-title></quote>;</text></clause><clause id="H88F2A7EAE37F40CB81101620B864F321" commented="no"><enum>(ii)</enum><text>by inserting <quote>revisions to</quote> before <quote>regulations</quote>; and</text></clause><clause id="H5F14CA9E85134DEABF6256B148AE3287" commented="no"><enum>(iii)</enum><text>by adding <quote>or actions to mitigate wildfire risk</quote> before the period at the end;</text></clause></subparagraph><subparagraph id="H8876FF9240DB41C1804650E08000DC16" commented="no"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="HE0FCA5E80CE94546861C3569933D8181" commented="no"><enum>(i)</enum><text>by inserting <quote>including proposed revisions to regulations,</quote> after <quote>subparagraph (A),</quote>;</text></clause><clause id="H0BADE2A6774341F4B32F56FDB1363A01"><enum>(ii)</enum><text>by inserting <quote>or action to mitigate wildfire risk</quote> after <quote>an exceptional event</quote>; and</text></clause><clause id="H2E238D0C40634583B31FAE99A87DA55C" commented="no"><enum>(iii)</enum><text>by striking <quote>paragraph (3)</quote> and inserting <quote>this section</quote>; and</text></clause></subparagraph><subparagraph id="H8A70F365FF7C4545B0FD0A171C678959" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HE9C6BC25BEF1422994ADA82A6B087991" display-inline="no-display-inline"><subparagraph id="HDEB6CF2879A346658D88E168C10151DE" commented="no"><enum>(C)</enum><header>Regional analysis</header><text display-inline="yes-display-inline">When more than one State notifies the Administrator of its intent to submit a petition pursuant to this section for an exceptional event or an action to mitigate wildfire risk for the same air quality event, or, if the Administrator determines such a multistate air quality event has occurred, the Administrator shall conduct regional modeling and analysis sufficient to satisfy the demonstration required for an exceptional event or an action to mitigate wildfire risk petition for such air quality event. </text></subparagraph><subparagraph id="H3A66FD8231084525B19D46A798D4F6C7" commented="no"><enum>(D)</enum><header>Transparency</header><text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of the <short-title>FIRE Act</short-title>, the Administrator shall establish, and thereafter update monthly, a public website describing the status of all petitions submitted pursuant to this section for exceptional events and actions to mitigate wildfire risk. </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H91383B3D3AD448AC961589425EF034D3" commented="no"><enum>(4)</enum><text>in paragraph (3)(A)—</text><subparagraph id="H5B4DE541B4BF41239BAD20E9B77B7F6A" commented="no"><enum>(A)</enum><text>by redesignating clauses (ii) through (v) as clauses (iii) through (vi), respectively; and</text></subparagraph><subparagraph id="H2320FFED66DC4741B05AFABBFF0C8506" commented="no"><enum>(B)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" id="HDA3E66DA2B8548BAB368A4812736C935" display-inline="no-display-inline"><clause id="HBC95148FCFB14EEDA47273F0807FB721" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the principle that actions to mitigate wildfire risk can play an important role in reducing the magnitude and frequency of wildfires;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H75D3DDEE3FB149909FCCEACF502D81E1" commented="no"><enum>(5)</enum><text>in paragraph (3)(B)—</text><subparagraph id="HAF99D7A072054D8399425F1FF37EEFB2" commented="no"><enum>(A)</enum><text>in clause (i), by inserting <quote>or action to mitigate wildfire risk</quote> before <quote>must be</quote>;</text></subparagraph><subparagraph id="HEDFE6446ADAB416CAF1A0126D1AA899A" commented="no"><enum>(B)</enum><text>by amending clause (ii) to read as follows:</text><quoted-block style="OLC" id="HFBD750AEE4054436920F6DFF6BCEF470" display-inline="no-display-inline"><clause id="H7C39C140FFB54AF1954D22DC2015B62C" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a clear causal relationship must exist, or be reasonably expected to exist, between the measured exceedances of a national ambient air quality standard and the exceptional event or action to mitigate wildfire risk to demonstrate that the exceptional event or action to mitigate wildfire risk caused a specific air pollution concentration at a particular air quality monitoring location;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HBF857F94DB4E4D1BA5E9AF886161744F" commented="no"><enum>(C)</enum><text>by amending clause (iv) to read as follows:</text><quoted-block style="OLC" id="HE4A0D8230A2A4BC8AF021A2900510438" display-inline="no-display-inline"><clause id="HEE2E6789751F415DB0D20F064BFBE8F8" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">there are criteria and procedures for the Governor of a State to petition the Administrator to exclude air quality monitoring data that is directly due to exceptional events or actions to mitigate wildfire risk from use in determinations by the Administrator with respect to—</text><subclause id="H1CAB1BF6F94546B3B44968ADD28F2F68" commented="no"><enum>(I)</enum><text>area or source exceedances or violations of the national ambient air quality standards;</text></subclause><subclause id="H54F0EC31461748DBB231C1683171F7DD" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">the designation, redesignation, classification, or reclassification of an area;</text></subclause><subclause id="HBD34FCAA4D8F42329B96DDB67C51437B" commented="no"><enum>(III)</enum><text>the demonstration by a State of attainment of a national ambient air quality standard;</text></subclause><subclause id="H8E2C2C04B3384E899E55FDD1DBDC531A" commented="no"><enum>(IV)</enum><text>attainment determinations;</text></subclause><subclause id="H5D79EC4ACE5B4C009303D6B9B718C724" commented="no"><enum>(V)</enum><text>attainment date extensions;</text></subclause><subclause id="HE68A8089684349DBA14488A99842A240" commented="no"><enum>(VI)</enum><text>finding a State implementation plan to be inadequate; or</text></subclause><subclause id="H8693C06693CD4966AAB0CB7384303460" commented="no"><enum>(VII)</enum><text>preconstruction demonstrations under section 165(a)(3).</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H11CCE1DFD2AA4BB7AF858B1D0510BEC3" commented="no"><enum>(6)</enum><text>by striking paragraph (4).</text></paragraph></section></legis-body><endorsement display="yes"><action-date>April 9, 2026</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
