following bill; which was referred to the Committee on Appropriations,
and in addition to the Committee on Agriculture, for a period to be
subsequently determined by the Speaker, in each case for consideration
of such provisions as fall within the jurisdiction of the committee
concerned

A BILL
To provide supplemental appropriations to carry out the emergency food
assistance program under the Emergency Food Assistance Act of 1983 in
the event of a lapse in funding for the supplemental nutrition
assistance program under the Food and Nutrition Act of 2008.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Food Bank Emergency Support Act of
2025''.
SEC. 2. APPROPRIATION.
(a) Amount Appropriated.--There is hereby appropriated, out of any
money in the Treasury not otherwise appropriated, $462,500,000 for
expenditure under the authority of section 27 of the Food and Nutrition
Act of 2008 (7 U.S.C. 2036) to be available in accordance with this
section until expended.
(b) Availability of Appropriated Funds.--During any period for
which--
(1) insufficient appropriated funds are available without
regard to the funds appropriated under subsection (a), to carry
out the Food and Nutrition Act of 2008 (7 U.S.C. 2012 et seq.)
without a reduction in benefit amounts otherwise payable under
such Act; or
(2) the Secretary of Agriculture issues a determination,
certification, or notice that available budget authority is
insufficient to provide timely the full amounts of benefit
payments determined under such Act for all eligible households,
funds appropriated under subsection (a) shall be available for
expenditure, including during a lapse in appropriations and after such
lapse, to carry out section 27 of the Food and Nutrition Act of 2008 (7
U.S.C. 2036).
(c) Excepted From Furlough.--Any services of an officer, employee,
or contractor to carry out section 27 of the Food and Nutrition Act of
2008 (7 U.S.C. 2036) (including with respect to executing orders for
the distribution of commodities) shall be deemed, for purposes of
section 1342 of title 31, United States Code, as services for
emergencies involving the safety of human life or the protection of
property.
SEC. 3. EFFECTIVE DATE.
This Act shall take effect as if enacted on September 30, 2025.
