<section id="H4CF330D8C93A4C8785DED0ED951512C0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text> <paragraph id="HCBB0D0647BCB4EE6B172153A4841F0F3"><enum>(1)</enum><text display-inline="yes-display-inline">The United States, like a number of other countries, should state an objective to stabilize greenhouse gas concentrations in the atmosphere at a level that would prevent <quote>dangerous anthropogenic interference</quote> with the climate system. The objective should be to reduce its greenhouse gas emissions by 50 to 52 percent below 2005 levels by 2030.</text></paragraph> 
<paragraph id="HA716989986E84B248072E9AF59AB59AF" commented="no">
        <enum>(2)</enum>
 <text>To achieve this objective, the increase in global mean surface temperature should not exceed 2°C (3.6°F) above preindustrial temperature by 2100 consistent with the Paris Agreement that entered into force in 2016.</text>
      </paragraph> 
<paragraph id="H037D4CAAAD1A4E7F9B19A69720C6E83A">
        <enum>(3)</enum>
 <text>The risks associated with a temperature increase above 2°C (3.6°F) are grave, including the disintegration of the Greenland ice sheet, which, if it were to melt completely, would raise global average sea level by approximately 23 feet, devastating many of the world’s coastal areas and population centers.</text>
      </paragraph> 
<paragraph id="H942FDB4259C74CEEB9EA8C5778B6BA38" commented="no">
        <enum>(4)</enum>
 <text display-inline="yes-display-inline">A 2018 report by the Intergovernmental Panel on Climate Change demonstrated that limiting the temperature increase to 1.5°C will result in still harmful, but significantly less severe outcomes than a 2°C increase.</text>
      </paragraph> 
<paragraph id="H6C6E535E5EE4405BADB27EC845C39F3D" commented="no">
        <enum>(5)</enum>
 <text display-inline="yes-display-inline">The Intergovernmental Panel on Climate Change projects that temperatures will rise 1.5°C between 2030 and 2052. In order to limit the temperature increase to 1.5°C, global net anthropogenic carbon dioxide emissions must reach net zero by 2050. The Intergovernmental Panel on Climate Change notes in their 2023 report that the level of reduction in greenhouse gas emissions this decade will largely determine whether warming can be limited to 1.5°C or 2°C.</text>
      </paragraph> 
<paragraph id="HF1BBE08897BF49D9BD182F9BED440198"><enum>(6)</enum><text display-inline="yes-display-inline">A 2023 report by the Intergovernmental Panel on Climate Change highlights that <quote>Deep, rapid, and sustained reductions in greenhouse gas emissions would lead to a discernible slowdown in global warming within around two decades, and also to discernible changes in atmospheric composition within a few years.</quote>.</text></paragraph> <paragraph id="HF9208BB33F294BD68B5C934418A30F94" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">The 2023 National Climate Assessment, authored by more than 300 experts and released by the United States Global Change Research Program, makes clear that the present unprecedented rises in global temperature are primarily due to human activities. The changing climate will devastate all sectors of society and disproportionately harm the most vulnerable communities.</text></paragraph> 
<paragraph id="HEEF553A08884495CA73E983875D9DB83"><enum>(8)</enum><text>Serious global warming impacts have already been observed in the United States and worldwide, including—</text> <subparagraph id="H28694EC5419C4319AD96E41BC3DBDB5D"><enum>(A)</enum><text>increases in heat waves and other extreme weather events;</text></subparagraph> 
<subparagraph id="H6296903A813F489EBC26A2657677F8C5"><enum>(B)</enum><text>rise in sea level, retreat of glaciers and polar ice;</text></subparagraph> <subparagraph id="HE4D2C0F7CFC141E9B5A3365246A498DB"><enum>(C)</enum><text>decline in mountain snowpack, increased drought (including droughts in the West and South United States) resulting in damage to our economy and property;</text></subparagraph> 
<subparagraph id="HFC447B5E2AA5430EBDC0C1F0A705E4E2"><enum>(D)</enum><text>extreme weather conditions resulting in wildfires, stronger hurricanes, and polar vortex occurrences resulting in further damage to property and our economy;</text></subparagraph> <subparagraph id="H289C829AE86A4DBDA853929FF0D78E90"><enum>(E)</enum><text>damage to our environment such as ocean acidification, extensive coral bleaching, migrations, and shifts in the yearly cycles of plants and animals; and</text></subparagraph> 
<subparagraph id="H21FFC157B25E4F9FAA7D65231BE8A833"><enum>(F)</enum><text>effects on human population, including population displacement and adverse health effects such as the spread of infectious diseases and climate-related conditions such as asthma.</text></subparagraph></paragraph> <paragraph id="HB79F5EF2A5C24AD9B9453EC8868CE0BC"><enum>(9)</enum><text>Scientists project that under a midrange estimate of global warming, by 2050, roughly one-third of animal and plant species will be committed to extinction.</text></paragraph> 
<paragraph id="H9FEC1425F1344F23A89805FAE2B829CF" commented="no"><enum>(10)</enum><text display-inline="yes-display-inline">The Energy Information Administration’s International Energy Outlook report estimates an increase of 20 percent in global carbon dioxide emissions between 2021 and 2050.</text></paragraph> <paragraph id="H8DD51F0EC13844FE874C72B294BCD391"><enum>(11)</enum><text>Decisive action is needed to minimize the many dangers posed by global warming.</text></paragraph> 
<paragraph id="HDBA1D7776EEF4E7BB1CF8A834EAEDA46"><enum>(12)</enum><text>The timing of such action is critical, given that greenhouse gases can persist in the atmosphere for more than a century.</text></paragraph> <paragraph id="HD44D30355DBD4D858EAD51E3E7A69D78" commented="no"><enum>(13)</enum><text>With less than 5 percent of the world population, the United States emits approximately 11.5 percent of the world’s total greenhouse gas emissions and must be a leader in addressing global warming.</text></paragraph> 
<paragraph id="H9041C804641B4CCEAC8620AAF6D88E27" commented="no"><enum>(14)</enum><text>The State of California, the 5th largest economy in the world, has shown that renewable energy standards and greenhouse gas emissions regulation can reduce greenhouse gas emissions while fostering significant economic growth.</text></paragraph> <paragraph id="HB7018CB35E2D4B9A8640C797C47CAA3E"><enum>(15)</enum><text>Existing energy efficiency and clean, renewable energy technologies can reduce global warming pollution, while saving consumers money, reducing our dependence on oil, enhancing national security, cleaning the air, and protecting pristine places from drilling and mining.</text></paragraph></section> 
<title id="H4310104F047F4AF9BDFBBAAFF0B51B65"><enum>I</enum><header>Renewable energy</header> 
<section id="H98EE644D5BBB45B0A55F6E2AC6BDD902"><enum>101.</enum><header>National renewable energy standard</header><text display-inline="no-display-inline">Title VI of the Public Utility Regulatory Policies Act of 1978 is amended by adding at the end the following:</text> <quoted-block id="H1718E4B3E4D04AC68375FF776FAC2F5D" style="OLC"> <section id="H9806061664D74495AE5114743A9170DE"><enum>610.</enum><header>National renewable energy standard</header> <subsection id="HCAC4929F36E04BA8AAEE8AC3C7C612F6"><enum>(a)</enum><header>In general</header><text>The Secretary shall promulgate regulations requiring that—</text> 
<paragraph id="HD5AD2C9C7AB34172AA40B2B41C6FAD3F"><enum>(1)</enum><text>beginning in calendar year 2026, the percentage of electric energy generated from renewable sources that is sold at the retail level in the United States shall increase each year; and</text></paragraph> <paragraph id="HE6320C2F2B18471EA3333CA2684C0B91" commented="no"><enum>(2)</enum><text>in calendar year 2035 and each subsequent calendar year, such percentage shall not be less than 100 percent of the total electric energy sold at the retail level in the United States.</text></paragraph></subsection> 
<subsection id="HA2BCC8D32663433EB4A97E6693926BD9"><enum>(b)</enum><header>Consultation</header><text>The Secretary shall carry out this section in consultation with the Administrator of the Environmental Protection Agency.</text></subsection> <subsection id="HA35FC83561E640FEA46494673DFE5BC5"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to preempt or limit State actions to enhance renewable energy generation or energy efficiency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title> 
<title id="H0B5CD2D224124B73AD720BAA03588E2D"><enum>II</enum><header>Energy efficiency</header> 
<section id="H5DCF7F88ECC04129B3CF3F4624716C2B"><enum>201.</enum><header>National energy efficiency standard</header> 
<subsection id="HE9C30DF1D3314F19AEC2B34F01ED4F1C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VI of the Public Utility Regulatory Policies Act of 1978, as amended by section 101 of this Act, is further amended by adding at the end the following:</text> <quoted-block id="HA35BDC4E174946ACB0434EB4981B49F0" style="OLC"> <section id="H989C252319CB4268BAFD9C057E045061"><enum>611.</enum><header>National energy efficiency standard</header> <subsection id="HBD74813EE6D64429AEE7123518144A02"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall promulgate regulations in accordance with this section setting end-user—</text> 
<paragraph id="H16E83C8EDB7040C78A9EBA77954DE82A"><enum>(1)</enum><text>electricity savings targets for retail electric energy suppliers; and</text></paragraph> <paragraph id="H2CBA14B85D644244B33A3696A5E93E4E"><enum>(2)</enum><text>natural gas savings targets for retail natural gas suppliers.</text></paragraph></subsection> 
<subsection id="H8CFF2AF06DBA4EFC980E992E6A6D3C8F"><enum>(b)</enum><header>Consultation</header><text>The Secretary shall carry out this section in consultation with the Administrator of the Environmental Protection Agency.</text></subsection> <subsection id="HFE879081C5EE461BBF8AA0A8459A0FB3"><enum>(c)</enum><header>Requirements</header><text>With respect to targets under subsection (a):</text> 
<paragraph id="HE46DF3D736244737B0760A3E9B224BE4"><enum>(1)</enum><text display-inline="yes-display-inline">The targets shall require each retail electric energy supplier to secure annual electricity savings, and each retail natural gas supplier to secure annual natural gas savings, of a set percentage of the quantity of electricity or natural gas sold in the most recent year to retail customers.</text></paragraph> <paragraph id="HA1A48990CC974352A367F35E8B060C48"><enum>(2)</enum><text display-inline="yes-display-inline">The electricity savings and natural gas savings shall be achieved through end-use efficiency improvements at customer facilities.</text></paragraph> 
<paragraph id="H00E1F906025243AD8B372DF0E46B984B"><enum>(3)</enum><text display-inline="yes-display-inline">The targets are cumulative. Each year’s electricity savings or natural gas savings shall be achieved in addition to the previous years’ savings.</text></paragraph> <paragraph id="H0578B811A6CE42D1AC4E1392F5179E8F"><enum>(4)</enum><text>For each of calendar years 2026 through 2032, the targets are as follows:</text>

<subsection id="H86DF01D0F0D14957BD21B7C94EF6D946"><enum>(d)</enum><header>Required percentages after 2032</header><text display-inline="yes-display-inline">The Secretary may, upon petition or upon the Secretary’s own initiative, increase the required percentage of end-user electricity savings or natural gas savings for years after 2032.</text></subsection> <subsection id="H410FDD4BD7024801B8E46A05FBE38207"><enum>(e)</enum><header>Market-Based Trading System</header><text>The Secretary shall allow suppliers to achieve the required percentage of end-user electricity savings or natural gas savings under this section through a market-based trading system.</text></subsection> 
<subsection id="H0C1BA3A950074F328BDCB9CBF0CCDD21"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to preempt or limit State actions to enhance renewable energy generation or energy efficiency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H9E415035130C457AA34A3FED2B26F8CB"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of contents for the Public Utility Regulatory Policies Act of 1978 is amended by inserting after the item relating to section 608 the following:</text>

<title id="H4C0C55896BA449EEA9864A1F6B5F23D3"><enum>III</enum><header>Science-Based Reductions</header> 
<section id="HE8AF4864DB5B495E9C4815B69032A54F"><enum>301.</enum><header>Net emissions reduction targets</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency (in this title referred to as the <quote>Administrator</quote>) shall promulgate annual net emissions reduction targets for each of calendar years 2030 through 2050, so as to ensure that the quantity of United States net greenhouse gas emissions—</text> <paragraph id="H06560395619B4F4D9361358780BE7183"><enum>(1)</enum><text>in 2035, is at least 52 percent below the quantity of such emissions in 2005; and</text></paragraph> 
<paragraph id="H73B765775FBA4B429D30818F97CC4AC2"><enum>(2)</enum><text>in 2050, is zero.</text></paragraph></section> <section id="H9880ABE05F034AD7B61819D033BE09BF"><enum>302.</enum><header>National Academies review</header><text display-inline="no-display-inline">Not later than 5 years after the date of the enactment of this Act, and every 5 years thereafter, the Administrator shall enter into an arrangement with the National Academies (or, if the National Academies decline to enter into such arrangement, another appropriate entity) under which the National Academies, acting through the National Academy of Sciences and the National Research Council, will submit a report to the Administrator and the Congress on the prospects for avoiding dangerous anthropogenic interference with the climate system and the progress made to date. Each such report shall—</text> 
<paragraph id="H3B02D04A0BAB471D96EEFBD97502ADBB"><enum>(1)</enum><text>evaluate whether the net emissions reduction targets promulgated pursuant to section 301 and the other policies to reduce United States net greenhouse gas emissions under this Act, the amendments made by this Act, and other provisions of law, including the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>), are likely to be sufficient to avoid dangerous anthropogenic interference with the climate system, taking into account the actions of other nations; and</text></paragraph> <paragraph id="H76A75F12B840415A883B397A2A5291A5"><enum>(2)</enum><text display-inline="yes-display-inline">if the National Academies concludes that such targets and policies are not likely to be sufficient to avoid dangerous anthropogenic interference with the climate system—</text> 
<subparagraph id="HAB26400C557E4716B8FDB4737AE3AD28"><enum>(A)</enum><text>identify the needed amount of further reductions in atmospheric greenhouse gas concentrations; and</text></subparagraph> <subparagraph id="H7C039344BD0341C5AE7296086A6A7456"><enum>(B)</enum><text>recommend additional United States and international actions to further reduce atmospheric greenhouse gas concentrations.</text></subparagraph></paragraph></section> 
<section id="H0EC7FAF24BD6468FA2D75F4DDF0A48C5"><enum>303.</enum><header>Regulations</header> 
<subsection id="H5E8A7CE16E104D309F596E0F86E1BA7B"><enum>(a)</enum><header>In general</header><text>The Administrator shall—</text> <paragraph id="H811A582B8B494691B2E10E27C1DE370E"><enum>(1)</enum><text>not later than 7 years after the date of enactment of this Act, promulgate final regulations to implement the net emissions reduction targets under section 301; and</text></paragraph> 
<paragraph id="H11A8D70770DB419388CE8B992402700F"><enum>(2)</enum><text>not less than every 5 years thereafter—</text> <subparagraph id="H7BE51BAB9C414320BCE1C7A820F4D9A0"><enum>(A)</enum><text>review such regulations, taking into account the reports under section 302; and</text></subparagraph> 
<subparagraph id="HECAEF4D46645439C97C2F003BE2F2CC8"><enum>(B)</enum><text>revise such regulations as necessary to implement such net emissions reduction targets.</text></subparagraph></paragraph></subsection> <subsection id="H75A84F8693974B7B9A993B46A65F8D5D"><enum>(b)</enum><header>Rulemaking on recommendations of national academies</header><text>If any report under section 302 includes a recommendation under section 302(2)(B) for regulatory action by a Federal department or agency, and such regulatory action is within the authority of such department or agency (under law other than this subsection), the head of such department or agency shall, not later than 2 years after the submission of such report, finalize a rulemaking—</text> 
<paragraph id="HA6A83A1303E240D88AEB0C1F38CE3E93"><enum>(1)</enum><text>to carry out such regulatory action; or</text></paragraph> <paragraph id="H11AEA5FEAE9646BE9EFE3A1B52AADF38"><enum>(2)</enum><text>to explain the reasons for declining to act.</text></paragraph></subsection> 
<subsection id="H9BC440E8D7714361806E97C77B053C39"><enum>(c)</enum><header>Additional regulations</header><text>The regulations promulgated under subsection (a) may include additional requirements to reduce United States net greenhouse gas emissions from any source or sector. Any such regulations that address sources whose greenhouse gas emissions are regulated pursuant to section 111(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7411">42 U.S.C. 7411(d)</external-xref>) shall account for the compliance schedule promulgated pursuant to such section 111(d). Regulations under this section may include market-based measures, emissions performance standards, efficiency performance standards, best management practices, technology-based requirements, and other forms of requirements.</text></subsection> <subsection id="H9CC86D105572400EBB624F9B312594DE"><enum>(d)</enum><header>Relation to other authority</header><text>The authority vested by this title is in addition to the authority to regulate greenhouse gas emissions pursuant to other provisions of law.</text></subsection></section> 
<section id="HB39C62C619A64368A56CFCF31D762ED1"><enum>304.</enum><header>Savings clause</header><text display-inline="no-display-inline">Nothing in this title shall be interpreted to preempt or limit State actions to address climate change.</text></section> <section id="H6FCF5965B5DF42358341F7FC919172D4"><enum>305.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="HC4DD055172E8441AA83D2278106A0778"><enum>(1)</enum><header>Greenhouse gas</header><text>The term <term>greenhouse gas</term> means—</text> <subparagraph id="H87ED32423569437F8159AF59FEC5A3EB"><enum>(A)</enum><text>carbon dioxide;</text></subparagraph> 
<subparagraph id="H541CCCBEC703426AB6D032354EC119A3"><enum>(B)</enum><text>methane;</text></subparagraph> <subparagraph id="H017E907834BE429DBCAB81906BE03326"><enum>(C)</enum><text>nitrous oxide;</text></subparagraph> 
<subparagraph id="H58A22A76FD5E48A7B77235AFB6ED8263"><enum>(D)</enum><text>hydrofluorocarbons;</text></subparagraph> <subparagraph id="H4D1C945BF6154EE28985460C21D456F6"><enum>(E)</enum><text>perfluorocarbons;</text></subparagraph> 
<subparagraph id="HA82D9894D6794FBD8CBD56C4CD96E1A8"><enum>(F)</enum><text>sulfur hexafluoride; or</text></subparagraph> <subparagraph id="H38F3290378824B2F8EFB4A029A63807C"><enum>(G)</enum><text>any other anthropogenically emitted gas that is determined by the Administrator, after notice and comment, to contribute to global warming to a non-negligible degree.</text></subparagraph></paragraph> 
<paragraph id="H54863DB5C6E04708AE6FA9E64296D587"><enum>(2)</enum><header>United States net greenhouse gas emissions</header><text display-inline="yes-display-inline">The term <term>United States net greenhouse gas emissions</term> means net greenhouse gas emissions, as calculated by the Administrator on an annual basis and reported to the United Nations Framework Convention on Climate Change Secretariat.</text></paragraph></section></title> </legis-body></bill>
