which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><action display="yes"><action-date date="20260827">August 27, 2026</action-date><action-desc>Reported with amendments, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on November 12, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Migratory Bird Treaty Act to clarify the treatment of authentic Alaska Native articles of handicraft containing nonedible migratory bird parts, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HII00" reported-display-style="italic" id="H65C066555E174FBC9DA7051A3E6AB329"><section section-type="section-one" id="H304219B3E03D464581D59666E09145B3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Archie Cavanaugh Migratory Bird Treaty Clarification Act</short-title></quote>.</text></section><section id="H5F203E717E614928A7DA8195093BDED8" display-inline="no-display-inline"><enum>2.</enum><header>Purpose</header><subsection commented="no" display-inline="no-display-inline" id="H6D3B4432FAE2493194BE850589825087"><enum/><text>The purpose of this Act is to clarify the treatment of authentic Alaska Native articles of handicraft offered for sale under the Convention between the United States and Japan for the Protection of Migratory Birds and Birds in Danger of Extinction and Their Environment, signed at Tokyo March 4, 1974 (TIAS 7990).</text></subsection></section><section id="H366FB0CDC50647419CE2A36E0EF134FA" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Clarification for authentic Alaska Native articles of handicraft containing migratory bird parts</header><subsection id="HA23061F1AAC54D5C85C879A7FA64EA99"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act—</text><paragraph id="HAA015123385F4D538293F712665FA6FF"><enum>(1)</enum><text>the Secretary of State shall work with the Secretary of the Interior to enter into appropriate bilateral procedures, as necessary, with the foreign country that is party to the treaty described in section 2 to clarify the treatment of authentic Alaska Native articles of handicraft to be offered for sale containing nonedible migratory bird parts from the species of migratory birds listed in the treaty; and</text></paragraph><paragraph id="HFCE2C103C4574A25A7518406BC74D579"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of the Interior may modify any regulations implementing the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>), as appropriate, consistent with the treaty described in section 2, in consultation with the foreign country that is party to the treaty, the Alaska Migratory Bird Co-Management Council, and the Pacific Flyway Council, and in coordination with the Law Enforcement Office of the United States Fish and Wildlife Service, to implement any necessary clarifications resulting from the procedures described in paragraph (1), including conditions for consignment and re-sale, certification of authenticity, and provisions pertaining to species of conservation concern.</text></paragraph></subsection><subsection id="HD039788FF0B94293B3693DB146B53B28"><enum>(b)</enum><header>Modification of regulations</header><text display-inline="yes-display-inline">If the Secretary of the Interior determines that any of the species used under this section show significant population declines or is determined to be a Bird of Conservation Concern pursuant to section 13 of the Fish and Wildlife Conservation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/16/2912">16 U.S.C. 2912</external-xref>), the Secretary may modify regulations to remove the species from application under this section.</text></subsection><subsection id="HCEED6FD42EBB412499E98C837250DA93"><enum>(c)</enum><header>Outreach</header><text display-inline="yes-display-inline">The Secretary of the Interior shall work in collaboration with the Alaska Migratory Bird Co-Management Council and other appropriate stakeholders to develop outreach and communication resources and means to communicate rules pertaining to the sale of authentic Alaska Native articles of handicraft including parts of migratory birds.</text></subsection><subsection id="H4CB0C5881E8547B6A29737A2A762D51D"><enum>(d)</enum><header>Technical amendment</header><text>Section 2(a) of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref>) is amended by inserting a comma after <quote>March 4, 1972</quote>.</text></subsection><subsection id="HB7BD5A7203954BD38B2B3DF00439B9CE"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H317749AA9F6C4768B3E3DC8122EB5EF6"><enum>(1)</enum><header>Alaska Native</header><text display-inline="yes-display-inline">The term <term>Alaska Native</term> means a member of any Indian Tribe that is based in the State of Alaska, as verified through issuance of—</text><subparagraph id="HFE6DF488BE824C309A31B054B37386F8"><enum>(A)</enum><text>a Tribal enrollment card;</text></subparagraph><subparagraph id="H2AD2E8BCB73545A593862F21C0D520C5"><enum>(B)</enum><text>a Certificate of Degree of Indian Blood (commonly known as a <quote>CDIB</quote>) by the Bureau of Indian Affairs; or</text></subparagraph><subparagraph id="HC75B84FEC6C24689B41B12789C0FF880"><enum>(C)</enum><text>a permit under the Silver Hand program of the Alaska State Council on the Arts.</text></subparagraph></paragraph><paragraph id="H833BFFA9C4864E51AAEBE8D6FD5DD60F"><enum>(2)</enum><header>Authentic Alaska Native article of handicraft</header><text display-inline="yes-display-inline">The term <term>authentic Alaska Native article of handicraft</term>—</text><subparagraph id="HB7888C911C7A48C4B4E0160DF134DE77"><enum>(A)</enum><text>means any item that is—</text><clause id="H75F559286C4148F68181AC10AF952914"><enum>(i)</enum><text display-inline="yes-display-inline">composed, wholly or in a significant respect, of natural materials that were found, foraged, or gifted; and</text></clause><clause id="H75BCBCBB585D4DE7A7EE3420CEF446EE"><enum>(ii)</enum><text>produced, decorated, or fashioned in significant part—</text><subclause id="HE249CB2819454BD0A0FE8D824D772409"><enum>(I)</enum><text>by an Alaska Native;</text></subclause><subclause id="HEB0EBC25158F45AC8EF941D2F851BCB0"><enum>(II)</enum><text>in the exercise of traditional Alaska Native handicrafts; and</text></subclause><subclause id="H5548E07C279A43A8B9969D1B076D1A2F"><enum>(III)</enum><text>without the use of any mass copying device;</text></subclause></clause></subparagraph><subparagraph id="H6F0C4C4E619541AFA0B5B8E22049424D"><enum>(B)</enum><text>includes—</text><clause id="HFD84ECF5587344EA9C6C82B9AC783AB8"><enum>(i)</enum><text display-inline="yes-display-inline">any weaving, carving, stitching, sewing, lacing, beading, drawing, or painting that meets the criteria described in clause (i); and</text></clause><clause id="H3A5CB19AA1BF4EB0AFD117CC6FF86465"><enum>(ii)</enum><text display-inline="yes-display-inline">any item, including clothing, described in subclause (I) that combines the techniques described in that subclause; and</text></clause></subparagraph><subparagraph id="HF86E3657E0594EF2ABAC360327AF4998"><enum>(C)</enum><text display-inline="yes-display-inline">does not include any item that contains a part of a migratory bird that was taken in a wasteful or illegal manner.</text></subparagraph></paragraph><paragraph id="H2364E4E8E25F4541B24FC2488BD137B3"><enum>(3)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <quote>Indian Tribe</quote> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></subsection></section></legis-body><official-title-amendment>Amend the title so as to read: <quote>A bill to clarify the treatment of authentic Alaska Native articles of handicraft containing nonedible migratory bird parts under the Migratory Bird Treaty Act, and for other purposes.</quote>.</official-title-amendment><endorsement display="yes"><action-date>August 27, 2026</action-date><action-desc>Reported with amendments, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
