<section id="H48F4A5D73E4546788B6670A451A6716D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Worker Cooperative Development and Support Act</short-title></quote>.</text></section> <section id="H7DFACFBB9718458D95D837FF837EA291"><enum>2.</enum><header>Promotion of worker-owned cooperative business by certain agencies</header><text display-inline="no-display-inline">The head of each covered agency shall—</text> 
<paragraph id="H721F8B3A60DE42C39B52D6C67EC42D2F"><enum>(1)</enum><text>implement programs and initiatives to support and expand worker-owned cooperative businesses;</text></paragraph> <paragraph id="HDBD310E7A5C84D6C9FD8F02FB32390F9"><enum>(2)</enum><text display-inline="yes-display-inline">periodically review existing regulations and propose revisions to such regulations to remove barriers that impede the formation and expansion of worker-owned cooperative businesses;</text></paragraph> 
<paragraph id="H9C3547A1A05B4AD9A29224D1AF546C2F"><enum>(3)</enum><text display-inline="yes-display-inline">facilitate access to capital for worker-owned cooperative businesses, including—</text> <subparagraph id="HCD1747288BC04F628A9CE1D8835F25FE"><enum>(A)</enum><text>exploring innovative financing options; and</text></subparagraph> 
<subparagraph id="HF5AD379B8D0A45889D8A79CCA060A2B8"><enum>(B)</enum><text>using existing programs to support worker-owned cooperative businesses;</text></subparagraph></paragraph> <paragraph id="H3150FDE2ABC14C4F9841104DBF960BD5"><enum>(4)</enum><text display-inline="yes-display-inline">coordinate with the United States Council on Worker Cooperatives established under section 4;</text></paragraph> 
<paragraph id="HADAD76AFC9B84220AC1E53583668E2B7"><enum>(5)</enum><text display-inline="yes-display-inline">develop, use, and contribute to the Federal strategy described in section 4(d)(1);</text></paragraph> <paragraph id="HCD9C33D35D43403CA67176119D82AEA5"><enum>(6)</enum><text display-inline="yes-display-inline">conduct and support research with respect to—</text> 
<subparagraph id="HC4C21194C4BA4435AFCA45AC7CD02B5A"><enum>(A)</enum><text>the economic impact of worker-owned cooperative businesses;</text></subparagraph> <subparagraph id="H91819BA25D014FBA973531BEF0E21E3F"><enum>(B)</enum><text>barriers to growth for worker-owned cooperative businesses; and</text></subparagraph> 
<subparagraph id="HBBC7BBC0EF1043179D26B565D90C6BC9"><enum>(C)</enum><text>the effectiveness of existing programs that relate to worker-owned cooperative businesses;</text></subparagraph></paragraph> <paragraph id="H9F78C070A74A469D8B0844746731FC6A"><enum>(7)</enum><text display-inline="yes-display-inline">provide education, outreach, and technical assistance to assist existing businesses to transition to worker-owned cooperative businesses;</text></paragraph> 
<paragraph id="H187420E5AECA4A60BE3F79228832DAC1"><enum>(8)</enum><text display-inline="yes-display-inline">engage with businesses, nonprofit organizations, and academic institutions to identify best practices to enhance the use worker-owned cooperative businesses; and</text></paragraph> <paragraph id="H17809F39E8B049A6832F732A4EE3A419"><enum>(9)</enum><text display-inline="yes-display-inline">provide relevant training for Federal workers to integrate worker-owned cooperative businesses into existing systems of Federal Government.</text></paragraph></section> 
<section id="H424F30348C204D19B60E2BADD57639A9"><enum>3.</enum><header>Education and outreach relating to worker-owned cooperative business</header><text display-inline="no-display-inline">The Administrator of the Small Business Administration shall—</text> <paragraph id="H6BE26000AD7E4D11A1A34716136E7764"><enum>(1)</enum><text>develop educational materials relating to worker-owned cooperative businesses that are—</text> 
<subparagraph id="HA1E7732EF20F45F386A6A2B9A53A7FFC"><enum>(A)</enum><text>accessible online and in print; and</text></subparagraph> <subparagraph id="H6D2EF4DD39A94CA4AD2EBBAD6DC75041"><enum>(B)</enum><text>translated into multiple languages; and</text></subparagraph></paragraph> 
<paragraph id="H460DBE8E8AB843A48FBB86354ABEC2C1"><enum>(2)</enum><text>implement an outreach program relating to worker-owned cooperative businesses in communities where English is not the predominant language.</text></paragraph></section> <section id="H8CCC6D6E01D74A5BB008C9273D07C831"><enum>4.</enum><header>Establishment of the United States Council on Worker Cooperatives</header> <subsection id="HD7F66C49AE214523A0E6CAC541C6A0C7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Secretary of Labor shall establish the United States Council on Worker Cooperatives (in this section referred to as the <quote>Council</quote>) to coordinate, across the Federal Government, activities relating to the formation and expansion of worker-owned cooperative businesses.</text></subsection> 
<subsection id="HE973D5483484483491B20739B0345543"><enum>(b)</enum><header>Chair</header><text>The Secretary of Labor shall—</text> <paragraph id="H6970E693CA57480CBE5B2FEBABFCDAF2"><enum>(1)</enum><text>serve as the chair of the Council; or</text></paragraph> 
<paragraph id="H214F8A043FC24CD3962DCC4E3FC34353"><enum>(2)</enum><text>appoint a designee to serve as the chair of the Council.</text></paragraph></subsection> <subsection id="HAA4418B45CA644E6BED0578784CA2ACD"><enum>(c)</enum><header>Members</header><text>The Council shall be comprised of the following members:</text> 
<paragraph id="H4DEAA8A679DB4EC18A6AB63F10431943"><enum>(1)</enum><text>The Administrator of the Small Business Administration.</text></paragraph> <paragraph id="H3798213301164A1CA86A8C3412D59CC3"><enum>(2)</enum><text>The Commissioner of Internal Revenue.</text></paragraph> 
<paragraph id="HE794F94EEA9B430E9AFE831D65FC6463"><enum>(3)</enum><text>The Secretary of the Treasury.</text></paragraph> <paragraph id="H0300E0BA6D8F43E38DE3D1F5FE011399"><enum>(4)</enum><text>The Secretary of Commerce.</text></paragraph> 
<paragraph id="HD09BD39F552646ABB1AEFFCDB25F173F" commented="no"><enum>(5)</enum><text>A representative from the National Economic Council.</text></paragraph> <paragraph id="HC337C986423B4684984524DBDBCD04B5"><enum>(6)</enum><text>The Director of the Domestic Policy Council.</text></paragraph> 
<paragraph id="H2608040C11994FF8A6ED0EC8209D4159"><enum>(7)</enum><text display-inline="yes-display-inline">A representative chosen by the Secretary of Agriculture to represent the Interagency Working Group on Cooperative Development of the Department of Agriculture, as established under section 310B(e)(12) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932(e)(12)</external-xref>).</text></paragraph> <paragraph id="H3E870C0DB3584AD78702736D1D62A342"><enum>(8)</enum><text>Any other members as determined by the Secretary of Labor.</text></paragraph></subsection> 
<subsection id="HB4BBD0C3DDDD43AF83AE70B526463671"><enum>(d)</enum><header>Responsibilities</header><text>The Council shall—</text> <paragraph id="HAF73DC54612E41E292528A4D6E075323"><enum>(1)</enum><text display-inline="yes-display-inline">develop a Federal strategy to incorporate worker-owned cooperative businesses as a tool for national economic development;</text></paragraph> 
<paragraph id="HB2C8DE42973B4906BBB865D522D2DF9D"><enum>(2)</enum><text display-inline="yes-display-inline">identify regulatory barriers within the Federal Government to the formation and expansion of worker-owned cooperative businesses;</text></paragraph> <paragraph id="HF9ABC907136541689EEBD6FFA822B9CD"><enum>(3)</enum><text display-inline="yes-display-inline">propose solutions to the barriers identified in paragraph (2) to form and expand worker-owned cooperative businesses in the United States; and</text></paragraph> 
<paragraph id="H95D8AE2DB51C4DE195ABF5E23DA21E10" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">coordinate—</text> <subparagraph id="HBF0028F08648408CBC191F559E68B45C" commented="no"><enum>(A)</enum><text>the availability of data and research relating to—</text> 
<clause id="H47EBC0EDCFEC45318168C94FD32D2369"><enum>(i)</enum><text>barriers to entry for the creation of worker-owned cooperative businesses; and</text></clause> <clause id="H0C4D49B9BA0D4FBC9062F8DCF1F75FBF"><enum>(ii)</enum><text>benefits of worker-owned cooperative businesses;</text></clause></subparagraph> 
<subparagraph id="HC51C3FE9FD5448D1BF310A8D81D18814" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">educational initiatives across Federal agencies to increase awareness and understanding of the worker-owned cooperative business model; and</text></subparagraph> <subparagraph id="H94F17515BC944DBF8757E41BD7BEF2BA" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">between existing and future initiatives relating to worker-owned cooperative businesses to avoid duplication or conflicting objectives.</text></subparagraph></paragraph></subsection> 
<subsection id="HD699CCC40F3649D891DBDAE715453D60"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, and each year thereafter, the Council shall submit to the Congress and publish on a public website a report that includes a description of—</text> <paragraph id="HF3F1B686CC7943478846118998D32C64"><enum>(1)</enum><text>any progress made by the Council with respect to the responsibilities described in subsection (d);</text></paragraph> 
<paragraph id="HAFA652B39F0A405B894AF4102828160C"><enum>(2)</enum><text>policy recommendations relating to the promotion of the formation and expansion of worker-owned cooperative businesses; and</text></paragraph> <paragraph id="HBF9B3F89015646FA90E7A0D6D267CB63"><enum>(3)</enum><text display-inline="yes-display-inline">the successes, best practices, and challenges that Federal agencies have in the promotion of the formation and expansion of worker-owned cooperative businesses and initiatives.</text></paragraph></subsection> 
<subsection id="HEFAC77C2DF3F4C5298BCEEC57B25FF03"><enum>(f)</enum><header>Sunset</header><text>The Council shall terminate on the date that is 10 years after the date of enactment of this section.</text></subsection></section> <section id="H666ED71B68CA43B5876C3F6CD6ACD811"><enum>5.</enum><header>Small business intermediary lending pilot program for worker-owned cooperative business</header><text display-inline="no-display-inline">Section 7(l) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(l)</external-xref>) is amended—</text> 
<paragraph id="HE2C8D0AE31A14C79943FA8401B38E3AE"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking subparagraph (A) and inserting the following:</text> <quoted-block style="OLC" id="HCC33864EDB194B9498DEEF34EA5453F2" display-inline="no-display-inline"> <subparagraph id="H3494C72BC1414E41A83E18EE3319356B"><enum>(A)</enum><text display-inline="yes-display-inline">the term ‘eligible intermediary’ means a cooperative (as defined in subsection (a)(35)); and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H343820070DE3475C8D63547FD0C3C19C"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (4)(G)—</text> <subparagraph id="HE51BE279D0934C09A91C7829B8D6001E"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>2011, 2012, and 2013</quote> and inserting <quote>2026 through 2036</quote>; and</text></subparagraph> 
<subparagraph id="H02E8334A5D664549A349D3AD97182A25"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>$20,000,000</quote> and inserting <quote>$60,000,000</quote>.</text></subparagraph></paragraph></section> <section id="H77E93CDF5A8841E284D06AEE073D0610"><enum>6.</enum><header>CDFI education and guidance about the value of worker-owned cooperative business</header><text display-inline="no-display-inline">Section 108(b)(1) of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4707">12 U.S.C. 4707(b)(1)</external-xref>) is amended—</text> 
<paragraph id="H2C012A38C1384D61A27471110F11F655"><enum>(1)</enum><text>in subparagraph (E)(ii)(II), by striking <quote>and</quote> at the end; </text></paragraph> <paragraph id="H73D3E33D832E4986BC658364D10B4B6F"><enum>(2)</enum><text>by redesignating subparagraph (F) as subparagraph (G); and</text></paragraph> 
<paragraph id="HA1B8D88078B042FB9A194870258F2877"><enum>(3)</enum><text>by inserting after subparagraph (E) the following:</text> <quoted-block style="OLC" id="H1147FB1D41604DFAAF70AAA4A9EA8099" display-inline="no-display-inline"> <subparagraph id="HECFA83F2322743E8A5C4BA739FF3C04C"><enum>(F)</enum><text display-inline="yes-display-inline">the provision of education and facilitation of services to assist in the establishment and management of worker-owned cooperative businesses; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H42F39DB17B694E669DC872CDBD7CDF11"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HEB818BC228D042B4B3C6D9A1FB360A73"><enum>(1)</enum><header>Covered agency</header><text>The term <term>covered agency</term> means the following:</text> 
<subparagraph id="HA25F61C4AA3C47CEAD4D5164F661D4A2"><enum>(A)</enum><text>The Small Business Administration.</text></subparagraph> <subparagraph id="H12F9D95343D545A28F92EB2BEC90FB95"><enum>(B)</enum><text>The Internal Revenue Service.</text></subparagraph> 
<subparagraph id="HE0FBA29AB1144C5F93446F7D1D34B386"><enum>(C)</enum><text>The Department of the Treasury.</text></subparagraph> <subparagraph id="HA677BD7128144FD8BA3B70E8B61AC1D7"><enum>(D)</enum><text>The Department of Commerce.</text></subparagraph> 
<subparagraph id="H0CB1A92AD79A4ED7BAB23DBBA881F81A"><enum>(E)</enum><text>The Department of Agriculture.</text></subparagraph> <subparagraph id="H637307624CFD416A9AB408665DDE35E8"><enum>(F)</enum><text>The Department of Labor.</text></subparagraph></paragraph> 
<paragraph id="H8DCDC6D2FA724A4DA87CCCA1281BCB05"><enum>(2)</enum><header>Worker-owned cooperative business</header><text>The term <term>worker-owned cooperative business</term> means—</text> <subparagraph id="H8B050ADB9FCB4FF4BBBEAEB1FA5B4238" commented="no"><enum>(A)</enum><text>any entity that is—</text> 
<clause id="HBDB15E8F159A4D27B60D53B25BF0849F" commented="no"><enum>(i)</enum><text>organized under a State law relating to worker cooperatives; and</text></clause> <clause id="H39B950CB4C1C444D91B7859687A5D31C" commented="no"><enum>(ii)</enum><text>majority owned or controlled by employees of such entity; or</text></clause></subparagraph> 
<subparagraph id="HE376327BCF9C425C97DBA1E3082029D6"><enum>(B)</enum><text>an <quote>eligible worker-owned cooperative</quote>, as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/26/1042">section 1042(c)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph></section> </legis-body></bill>
