Reg. 19775; relating to certain actions under section 303 of the Defense Production Act of 1950) to create, maintain, protect, expand, or restore sustainable and responsible domestic production capabilities for strategic and critical materials through—</text><paragraph id="HB0E563BF79944755B24400626BD7A07E"><enum>(1)</enum><text>supporting feasibility studies for mature mining, beneficiation, and value-added processing projects;</text></paragraph><paragraph id="H3C13592A57534524998911512D823D2B"><enum>(2)</enum><text>by-product and co-product production at existing mining, mine waste reclamation, and other industrial facilities;</text></paragraph><paragraph id="H6EDF1508C2B34D41B0EDDC3318079194"><enum>(3)</enum><text>modernization of mining, beneficiation, and value-added processing to increase productivity, environmental sustainability, and workforce safety; or</text></paragraph><paragraph id="HA17B399FBAAB4B9DAD78D909A5BD4816"><enum>(4)</enum><text>any other activity authorized under section 303(a)(1) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4533">50 U.S.C. 4533(a)(1)</external-xref>).</text></paragraph></subsection><subsection id="HF2C621D7DF5046AC83A1D81FCF9C616C"><enum>(c)</enum><header>Exception</header><text>An action described in subsection (b) may not be treated as a covered project or be included in the Permitting Dashboard under subsection (a) if the project sponsor (as defined in section 41001(18) of the Fixing America’s Surface Transportation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m(18)</external-xref>)) requests that the action not be treated as a covered project.</text></subsection></section></legis-body><endorsement display="yes"><action-date>June 9, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
