which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><action display="yes"><action-date date="20260318">March 18, 2026</action-date><action-desc>Additional sponsors: <cosponsor name-id="N000026">Mr. Nehls</cosponsor>, <cosponsor name-id="C001115">Mr. Cloud</cosponsor>, <cosponsor name-id="L000596">Mrs. Luna</cosponsor>, and <cosponsor name-id="C001118">Mr. Cline</cosponsor></action-desc></action><action display="yes"><action-date date="20260318">March 18, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on October 8, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the expedited removal of aliens who are criminal gang members, members of foreign terrorist organizations, or have been convicted of certain specified crimes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HJU00" reported-display-style="italic" id="H880390A0469A4DDD81984AAB7B1DB839"><section id="H246DA8C365DB473DA3CF5FF9C52AFFB3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expedited Removal of Criminal Aliens Act</short-title></quote>.</text></section><section id="H5B5DD2E5D84149F3957AABF4442A68E3"><enum>2.</enum><header>Expedited removal</header><text display-inline="no-display-inline">Section 238 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1228">8 U.S.C. 1228</external-xref>) is amended—</text><paragraph id="HEBEE3F110FD447DDB64A57702463B6FA"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text level="section" style="traditional">Expedited removal of aliens convicted of committing aggravated felonies</header-in-text></quote> and inserting <quote><header-in-text level="section" style="traditional">Expedited removal of certain criminal aliens</header-in-text></quote>;</text></paragraph><paragraph id="H04FF13F876FF4C438212F05217DEC2C2"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="H6BE8E664A7644C61BB4ADCAFD8B60997"><enum>(A)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" id="H017127305D8041899B225031D8D00943" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HJU00"><paragraph id="H92BB14FD2D3747D2B7B595081164241F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall provide for the availability of special removal proceedings at certain Federal, State, and local correctional facilities for any incarcerated alien—</text><subparagraph id="H082909BFDB214AC5A3CB627F52A4C3A2"><enum>(A)</enum><text>convicted of any criminal offense covered in section 237(a)(2)(A)(iii), (B), (C), or (D), or any offense covered by section 237(a)(2)(A)(ii) for which both predicate offenses are, without regard to the date of their commission, otherwise covered by section 237(a)(2)(A)(i); or</text></subparagraph><subparagraph id="H8BE1D37B28C54897991A36611DB5CC1A"><enum>(B)</enum><text display-inline="yes-display-inline">who the Secretary of Homeland Security determines—</text><clause id="H7E743740D88741E4A136E29CCD0A371E"><enum>(i)</enum><text>is inadmissible or deportable; and</text></clause><clause id="H7E06ED2C662C418E85E83B48EE1BE630"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF901C34B17314D038EBE84549DD75EB2"><enum>(I)</enum><text display-inline="yes-display-inline">is a member of a criminal gang or a transnational criminal organization (as defined in section 3003(5) of the Act titled <quote>Making emergency supplemental appropriations for the fiscal year ending September 30, 2024, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/21/2341">21 U.S.C. 2341(5)</external-xref>));</text></subclause><subclause id="H88E97B13F5D74E978C4CC1851CFD62B1" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">is a member of an organization designated as a foreign terrorist organization pursuant to section 219(a) or has provided material support to such an organization; or</text></subclause><subclause id="H4B241433594E46EE90147BFB5785EAD8" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">has been convicted of any felony, any misdemeanor with respect to which the underlying conduct was committed against a member of a vulnerable group, any assault of a law enforcement officer, any sexual offense, any crime of domestic violence, any stalking offense, any crime with respect to which the underlying conduct was committed against a child (including sex trafficking of a minor or sexual abuse of a minor), any activity relating to material involving the sexual exploitation of a minor, or any violation of a protection order (as such terms are defined in the jurisdiction of conviction).</text></subclause></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H74CC25593E8448E885F32D7A74B9F56F"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H48ECCDC284DE43A19B0004E434383D18"><enum>(i)</enum><text>by striking <quote>convicted of an aggravated felony</quote> and inserting <quote>described in paragraph (1)</quote>; </text></clause><clause id="H99E86EEECCC94DB9A6E508CDFBF8F9D2"><enum>(ii)</enum><text>by striking <quote>Attorney General</quote> each place it appears and inserting <quote>Secretary of Homeland Security</quote>; and</text></clause><clause id="H5489CE00BEA2446995173CBCD9B34C7B"><enum>(iii)</enum><text>by striking <quote>felon</quote> and inserting <quote>alien</quote>;</text></clause></subparagraph><subparagraph id="HFD382A5C951E41A190CF4ACEAA756A9C"><enum>(C)</enum><text>in paragraph (3)—</text><clause id="H3F6ADAA9709642D1BD647FE4CB30CC8F"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>Attorney General</quote> each place it appears and inserting <quote>Secretary of Homeland Security</quote> ;</text></clause><clause id="H448E37302D764AE3B7B9C3EADF236866"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>convicted of an aggravated felony</quote> and inserting <quote>described in paragraph (1)</quote>; and</text></clause><clause id="H2377346923CB4C0289445EECA97651BD"><enum>(iii)</enum><text>by striking <quote>for the underlying aggravated felony</quote>;</text></clause></subparagraph><subparagraph id="H67D6AB1AC3C245F293F3F7DCEE0AE46C"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>Attorney General</quote> each place it appears and inserting <quote>Secretary of Homeland Security</quote>; and </text></subparagraph><subparagraph id="HA97A39B68C4D4A988C47DD4D0B5B615F"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HB012CA775DD842198910F82832D424C0" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HJU00"><paragraph id="HEF7BAB15614B4EA0BF603765C5B71E95"><enum>(5)</enum><header>Manner of proceedings</header><text display-inline="yes-display-inline">Special removal proceedings described in this section shall be conducted in conformity with section 240 (except as otherwise provided in this section), and in a manner which eliminates the need for additional detention at any processing center of the Department of Homeland Security and in a manner which assures expeditious removal following the end of the alien's incarceration for the underlying sentence. Nothing in this section shall be construed to create any substantive or procedural right or benefit that is legally enforceable by any party against the United States or its agencies or officers or any other person.</text></paragraph><paragraph id="HBD6CE79A1A3141AF8371D3ADFCFBC382"><enum>(6)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="H4975FE945B7A43C780515D6D459DE6F7"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>member of a vulnerable group</quote> means—</text><clause id="H406B1B1D98CA4C1798172814289ECCCC"><enum>(i)</enum><text display-inline="yes-display-inline">an individual who is younger than 16 years of age;</text></clause><clause id="HC7C4A1648554435A8587CBA2E489586D"><enum>(ii)</enum><text display-inline="yes-display-inline">a pregnant woman;</text></clause><clause id="H7D23B7D67EE3452D9D1984F853486D26"><enum>(iii)</enum><text display-inline="yes-display-inline">an individual with a severe physical or mental disability; or</text></clause><clause id="H1176013B82314FCF9CECE1D765DC2EA9"><enum>(iv)</enum><text display-inline="yes-display-inline">an individual who is older than 65 years of age.</text></clause></subparagraph><subparagraph id="H755DD238158A4AEAB9FC39103D463701"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>criminal gang</quote> means an ongoing group, club, organization, or association of 5 or more persons that has as 1 of its primary purposes the commission of 1 or more of the offenses described in this subparagraph and the members of which engage, or have engaged within the past 5 years, in a continuing series of such offenses. The offenses described, whether committed, in whole or in part, within or outside of the United States and regardless of whether the offenses occurred before, on, or after the date of the enactment of this paragraph, are the following:</text><clause id="HF483442353B145B896EFC7017E140902"><enum>(i)</enum><text>A Federal, State, local, or Tribal offense that is punishable by imprisonment for more than 1 year and relates to a controlled substance (as so classified under the relevant Federal, State, local, or Tribal law), regardless of whether the substance is classified as a controlled substance under section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></clause><clause id="HF9D3C6BBE51A4DB2ADF8B0C8CC7E0073"><enum>(ii)</enum><text>A foreign offense that is punishable by imprisonment for more than 1 year and relates to a controlled substance as defined under section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></clause><clause id="H13E34C4A84AA4211A42C281CAA4B2B25"><enum>(iii)</enum><text>An offense that is punishable by imprisonment for more than 1 year and involves firearms or explosives (as defined under the relevant Federal, State, local, Tribal, or foreign law) or in violation of section 931 of title 18, United States Code (relating to purchase, ownership, or possession of body armor by violent felons).</text></clause><clause id="HE8E68553A62C47E9B33D9A5FC479FAF7"><enum>(iv)</enum><text>An offense under section 274 (relating to bringing in and harboring certain aliens), section 277 (relating to aiding or assisting certain aliens to enter the United States), or section 278 (relating to importation of alien for immoral purpose).</text></clause><clause id="H8DB7A2535FA1455AB2181FC242574157"><enum>(v)</enum><text display-inline="yes-display-inline">A crime of violence (as defined in section 16(a) of title 18, United States Code).</text></clause><clause id="HF782917A82734D5DB3D501B51CEBBE9B"><enum>(vi)</enum><text>A crime involving obstruction of justice, tampering with or retaliating against a witness, victim, or informant, or burglary (as such terms are defined under the relevant Federal, State, local, Tribal, or foreign law).</text></clause><clause id="H9253CBA287C54A63B74E9733CE6B33E1"><enum>(vii)</enum><text>Any conduct punishable under—</text><subclause id="H5289C157A5514E1FAE50065ED765FBBE"><enum>(I)</enum><text>sections 1028, 1028A, and 1029 of title 18, United States Code (relating to fraud, aggravated identity theft or fraud and related activity in connection with identification documents or access devices);</text></subclause><subclause id="H1F1A9C9197D947D6B1D8BC891DE40082"><enum>(II)</enum><text>sections 1581 through 1594 of such title (relating to peonage, slavery, and trafficking in persons);</text></subclause><subclause id="H0D5A2B869A4A4933B995233A6D72F3AF"><enum>(III)</enum><text>section 1951 of such title (relating to interference with commerce by threats or violence);</text></subclause><subclause id="H93DB316C4967486983E796D3FFB4B471"><enum>(IV)</enum><text>section 1952 of such title (relating to interstate and foreign travel or transportation in aid of racketeering enterprises);</text></subclause><subclause id="HCA3BCD6176084AE1A7148C350703D3D5"><enum>(V)</enum><text>section 1956 of such title (relating to the laundering of monetary instruments);</text></subclause><subclause id="H7D075EA144014420ACD679B8D2486C18"><enum>(VI)</enum><text>section 1957 of such title (relating to engaging in monetary transactions in property derived from specified unlawful activity); or</text></subclause><subclause id="H1BF344E3416F439AADD7C56ADC0BA8B2"><enum>(VII)</enum><text>sections 2312 through 2315 of such title (relating to interstate transportation of stolen motor vehicles or stolen property).</text></subclause></clause><clause id="H2B1D4B5CEEDA470E918B9277444D1695"><enum>(viii)</enum><text>A conspiracy to commit an offense described in subclauses (I) through (VII) of clause (vii).</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7A11142470014F8691E29840C34FA3C1"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="HFB2042DA56C24D3DAD26C6882ADBB517"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H61B5027E13884D8490A522BC5A27CEC8"><enum>(i)</enum><text>by striking <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland Security</quote>; </text></clause><clause id="H54B1FF6D62F34316AA627681EBFCCC79"><enum>(ii)</enum><text>by inserting <quote>inadmissibility or</quote> before <quote>deportability</quote>; </text></clause><clause id="H203D90F9EB2C4F499A284F72AF136EE3"><enum>(iii)</enum><text>by striking <quote>under section 237(a)(2)(A)(iii) (relating to conviction of an aggravated felony)</quote>; and </text></clause><clause id="H2D8A29AF881F45C39D8855C433E19D59"><enum>(iv)</enum><text>by inserting before <quote>section 240</quote> the following <quote>issue a notice to appear under section 239 to initiate removal proceedings under</quote>; </text></clause></subparagraph><subparagraph id="H49F3F4CDA980471992A7F3E8EDCD32F6"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="H753A3426BD0D4E5883054FC92D046EE9" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HJU00"><paragraph id="HDFC91A489D7A40E197FB8158ABD89319"><enum>(2)</enum><header>Alien described</header><text display-inline="yes-display-inline">An alien is described in this paragraph if the alien—</text><subparagraph id="HD43BC97B77B245D29C8AD345A46BDC19" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">has been convicted of any criminal offense described in subparagraph (A) or is described in subparagraph (B) of section 238(a)(1), regardless of whether such alien is incarcerated; and</text></subparagraph><subparagraph id="H61D6FD1D97E147079854B448E786713F"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HBA93324BC14B4CA296EB86A539101359"><enum>(i)</enum><text display-inline="yes-display-inline">was not lawfully admitted for permanent residence at the time at which proceedings under this section commenced; or</text></clause><clause id="H3200351FD91B438EB865C97A552F9F50" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">had permanent resident status on a conditional basis (as described in section 216 of this title) at the time that proceedings under this section commenced. </text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7BA1B04F7FDA4AFFBAEFB98DF454A31E"><enum>(C)</enum><text>in paragraph (3), by striking <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland Security</quote>;</text></subparagraph><subparagraph id="H691E805F0CA34615B29EB64391A7FF0A"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>Attorney General</quote> each place it appears and inserting <quote>Secretary of Homeland Security</quote> ; and</text></subparagraph><subparagraph id="H6BA4C260265246FF8E8AB3C29A2DBAC1"><enum>(E)</enum><text>in paragraph (5)—</text><clause id="H8CC54B0CB59D43E6A8D4E73111706294"><enum>(i)</enum><text>by inserting <quote>or Secretary of Homeland Security</quote> after <quote>Attorney General</quote>; </text></clause><clause id="HDF12EDFC5F704161AD7AFCE8359EEE9A"><enum>(ii)</enum><text>by inserting <quote>or Secretary’s</quote> after <quote>Attorney General’s</quote>; and</text></clause><clause id="HF97A81AD287B492B917B504A3315CCA9"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting <quote>, regardless of whether the alien is in proceedings under this section</quote> after <quote>discretion</quote>; and</text></clause></subparagraph></paragraph><paragraph id="H2D5A35117EAA450EA2F75D5F87355306"><enum>(4)</enum><text>by redesignating the second subsection (c) as subsection (d).</text></paragraph></section><section id="HC81A62C6E4DE41CE8890422C18F3FA24"><enum>3.</enum><header>Detention of criminal aliens</header><text display-inline="no-display-inline">Section 236(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)</external-xref>) is amended—</text><paragraph id="H9D10A00368B44BA2AECB1BDFEE324061"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H7A0D989857C04CBA9DDC54B6C3036C04"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H9B911F3F5FD04FCB82B48B909851D542"><enum>(B)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></subparagraph><subparagraph id="HD839B387C03D49E78C3774304030EEA1"><enum>(C)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" id="HD57670CDD9504950906D5DF8527E5BA0" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HJU00"><subparagraph id="H0F9AD9385A604FB58417811D79BD043D"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="H1FF47114B9944C8C9E6E22FF082B8101"><enum>(i)</enum><text display-inline="yes-display-inline">is inadmissible under section 212 or deportable under section 237; and</text></clause><clause id="H6049E8F62E6D44A8847025FA471E815D" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H1C652BBDA428472A99378F09BC2DCE20"><enum>(I)</enum><text display-inline="yes-display-inline">is a member of a criminal gang (as defined in section 238(a)(6)(B)) or transnational criminal organization (as defined in section 3003(5) of the Act titled <quote>Making emergency supplemental appropriations for the fiscal year ending September 30, 2024, and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/21/2341">21 U.S.C. 2341(5)</external-xref>)); or </text></subclause><subclause id="HE11C2B1475F748E59DFEE434B95EE01F" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">has been convicted of any felony, any misdemeanor with respect to which the underlying conduct was committed against a member of a vulnerable group (as defined in section 238(a)(3)(A)), any assault of a law enforcement officer, any sexual offense, any crime of domestic violence, any stalking offense, any crime with respect to which the underlying conduct was committed against a child (including sex trafficking of a minor or sexual abuse of a minor), any activity relating to material involving the sexual exploitation of a minor, or any violation of a protection order, or</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H932667EF4CE548A193F31FF74F01EA36"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="HEB66CB35E56042529956BF6E86881095"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Definition</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Definitions</header-in-text></quote>; or</quote>; and</text></paragraph><paragraph id="HF184EDF2559A492D8A9862A0B11C99D1"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HE42BBD0E234543888C581BEB418F6353" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HJU00"><clause id="H3A4CB99CDB4E48C89903A0F6C638CACB"><enum>(vii)</enum><text display-inline="yes-display-inline">the alien has been convicted of any criminal offense described in subparagraph (A) or is described in subparagraph (B) of section 238(a)(1), regardless of whether such alien is incarcerated or is in proceedings under section 238. </text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H595644E5BED341C288AAAC3EBE9953C6"><enum>6.</enum><header>Ineligibility for other immigration relief</header><text display-inline="no-display-inline">An alien who has been convicted of any criminal offense described in subparagraph (A) or who is described in subparagraph (B) of section 238(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1128">8 U.S.C. 1128(a)(1)</external-xref>), regardless of whether such alien is incarcerated or is in proceedings under such section 238, shall be ineligible for any other relief under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)), including under section 2242 of the Omnibus Consolidated and Emergency Supplemental Appropriations Act, 1999 (and any regulations issued pursuant to such section).</text></section><section id="H82D742F6BE6D46739733D79AAA08FC4A"><enum>7.</enum><header>Construction; severability</header><text display-inline="no-display-inline">Any provision of this Act or an amendment made by this Act held to be invalid or unenforceable by its terms, or as applied to any person or circumstance, shall be construed so as to give it the maximum effect permitted by law, unless such holding shall be utterly invalid or unenforceable, in which event such provision shall be deemed severable from this Act and shall not affect the remainder of this Act, or the application of such provision to other persons not similarly situated or to other, dissimilar circumstances.</text></section></legis-body><endorsement display="yes"><action-date>March 18, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
