<section id="H714A9E56166D45C5913C8513776A56A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Quality U.S. Aquaculture Act</short-title></quote>.</text></section> <section id="H9061A5ABDFAD42A3BEEBFDCE9E6C369F" section-type="subsequent-section"><enum>2.</enum><header>National Aquaculture Act of 1980</header><text display-inline="no-display-inline">The National Aquaculture Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/16/2801">16 U.S.C. 2801 et seq.</external-xref>) is amended—</text> 
<paragraph id="H640CAE7D67984CA4B1257267B5379B28"><enum>(1)</enum><text>in section 4 (<external-xref legal-doc="usc" parsable-cite="usc/16/2803">16 U.S.C. 2803</external-xref>)—</text> <subparagraph id="H20D681B038F04E2E9984280E26A5F4E7"><enum>(A)</enum><text>in subsection (a)(2), by striking <quote>acquaculture</quote> and inserting <quote>aquaculture</quote>;</text></subparagraph> 
<subparagraph id="H389B7EE381A041C2AAC89E1C95D2C1C5"><enum>(B)</enum><text>in subsection (d), in the matter preceding paragraph (1), by inserting <quote>, not less than once every 3 years,</quote> after <quote>periodic reviews</quote>; and</text></subparagraph> <subparagraph id="H11BAC437E2E84A0F932B2B43F29B9920"><enum>(C)</enum><text>in subsection (e)—</text> 
<clause id="H8945821D18EF499D92863868CB201AD7"><enum>(i)</enum><text>in the matter preceding paragraph (1), by inserting <quote>, not less than once every 3 years,</quote> after <quote>undertake a continuing assessment of aquaculture in the United States</quote>;</text></clause> <clause id="H961B55CA659E4EEFA6C9D1A05C94D22E"><enum>(ii)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></clause> 
<clause id="H99EC14B4BE334B17870550FB9C68F1F9"><enum>(iii)</enum><text>in paragraph (6), by striking the period at the end and inserting a semicolon; and</text></clause> <clause id="HAC22EE4C3B1F4A19B8741BAFC3480FDD"><enum>(iv)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H9D7226E97F7E41E8AF346BEED29D9D01" style="OLC"> 
<paragraph id="H3561FDEA67824BD4BAD84CF237119F4F"><enum>(7)</enum><text>a catalog of new and existing capital constraints, as described in the capital requirements plan formulated under section 8(b), that affect the development of the aquaculture industry in the United States; and</text></paragraph> <paragraph id="H198E8950F4B3495FA588277B4C1497FD"><enum>(8)</enum><text>a catalog of new and existing Federal or State regulatory barriers, as described in the regulatory constraints plan formulated under section 9(b), to the initiation and operation of commercial aquaculture ventures.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph> 
<paragraph id="H05E972FCE6FC41C2910FE1E28453DC36"><enum>(2)</enum><text>in section 5 (<external-xref legal-doc="usc" parsable-cite="usc/16/2804">16 U.S.C. 2804</external-xref>), by striking subsection (d) and inserting the following:</text> <quoted-block id="H32C14F606A344998B6EFDB6BE118D078" style="OLC"> <subsection id="H7D35C83B2321418292866F0FD00B717C"><enum>(d)</enum><header>Aquaculture advisory committee</header> <paragraph id="HDC6E0AD5F9544BC09F1930106583AB8E"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this subsection, the Secretary shall establish an advisory committee, to be known as the Aquaculture Advisory Committee (referred to in this subsection as the <quote>Committee</quote>), to advise the Secretary on—</text> 
<subparagraph id="HA07DFEF62F4F44D1A670C5E0327ACC2F"><enum>(A)</enum><text>oversight of programs of the Department and other members of the coordinating group to support development of, and to advance, aquaculture best practices using the best available science, in consultation with farmers and industry partners;</text></subparagraph> <subparagraph id="HE31F9D1C0D1E49F0B3E3FB8567808729"><enum>(B)</enum><text>providing technical assistance to aquaculture farmers and businesses, including technical assistance that pertains to shellfish, algae, and land-based aquaculture systems, using the best available science; and</text></subparagraph> 
<subparagraph id="HEE66513E772046EABE9C8D5D4B20575D"><enum>(C)</enum><text>any other aspects of the implementation of this Act.</text></subparagraph></paragraph> <paragraph id="H53D43ABAF6A641B3B382913BFE1EB497"><enum>(2)</enum><header>Membership</header> <subparagraph id="H26894649B5444240883774F273E43CAC"><enum>(A)</enum><header>In general</header><text>The Committee shall be composed of 14 members, who are not officers or employees of the Federal Government.</text></subparagraph> 
<subparagraph id="H3F8927223BDF44F79285A6B369950DA8"><enum>(B)</enum><header>Initial appointments</header><text>The Secretary shall appoint the members of the Committee not later than 180 days after the date of enactment of this section.</text></subparagraph> <subparagraph id="H9B334E7A5D13404DBA1BA3BE54D7D86A"><enum>(C)</enum><header>Period of initial appointment; vacancies</header> <clause id="HDEA5188EE09A433F959E514900413DA9"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), a member of the Committee shall be appointed for a term of 3 years.</text></clause> 
<clause id="H2671D288EC6644E48E96D5B4912CB085"><enum>(ii)</enum><header>Initial appointments</header><text>Of the members first appointed to the Committee—</text> <subclause id="H4F51D1154A2D426E8B0CA4C1B8C6FD9F"><enum>(I)</enum><text>5 of the members, as determined by the Secretary, shall be appointed for a term of 3 years;</text></subclause> 
<subclause id="H0891D17E53B847F999032861DF97A12F"><enum>(II)</enum><text>5 of the members, as determined by the Secretary, shall be appointed for a term of 2 years; and</text></subclause> <subclause id="H3A5239FE68184D17B957B01A1E1B6CCF"><enum>(III)</enum><text>4 of the members, as determined by the Secretary, shall be appointed for a term of 1 year.</text></subclause></clause> 
<clause id="H8B98AA77B1344F2CBA11C7B7015E3318"><enum>(iii)</enum><header>Vacancies</header><text>Any vacancy in the Committee—</text> <subclause id="H9CBEE2321BD04368A65B42F8A66AFE49"><enum>(I)</enum><text>shall not affect the powers of the Committee; and</text></subclause> 
<subclause id="HBB676CD4150549A59CAA56499811C94E"><enum>(II)</enum><text>shall be filled as soon as practicable in the same manner as the original appointment.</text></subclause></clause></subparagraph> <subparagraph id="H1AFE21B242FC420CAA502879B88DA110"><enum>(D)</enum><header>Consecutive terms</header><text>An initial appointee of the Committee may serve an additional consecutive term if the member is reappointed by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HFFB3184873BC4E1F843067C59C28CB6A"><enum>(3)</enum><header>Meetings</header> 
<subparagraph id="H5267BB77130A4AC6AD64865B7CBFE39D"><enum>(A)</enum><header>Frequency</header><text>The Committee shall meet not fewer than 3 times per year.</text></subparagraph> <subparagraph id="HD8F0238F0F0D4D00BE707939DB259524"><enum>(B)</enum><header>Initial meeting</header><text>Not later than 180 days after the date on which the members are appointed under paragraph (2)(B), the Committee shall hold the first meeting of the Committee.</text></subparagraph></paragraph> 
<paragraph id="H42C89C3A3F524FBFBF069529565196CE"><enum>(4)</enum><header>Duties</header><text>The Committee shall—</text> <subparagraph id="HA721C962E6E443A3A57654005C00FDAD"><enum>(A)</enum><text>develop recommendations and advise the Secretary on aquaculture policies, initiatives, and outreach administered by the Department;</text></subparagraph> 
<subparagraph id="H09B754145EE149B4A232B9E76378BC4F"><enum>(B)</enum><text>evaluate and review ongoing research and extension activities relating to aquaculture practices;</text></subparagraph> <subparagraph id="HA0A5DF4CB8C54EB9A8C23DE53D785D17"><enum>(C)</enum><text>identify new and existing barriers to successful aquaculture practices; and</text></subparagraph> 
<subparagraph id="H607B2E9F83CC4D0E9BA46A8E93356A8C"><enum>(D)</enum><text>provide additional assistance and advice to the Secretary as appropriate.</text></subparagraph></paragraph> <paragraph id="HD1AB1EE683EA4D8084A9E79B1D30EFA8"><enum>(5)</enum><header>Personnel matters</header> <subparagraph id="H80AE87209B064F79BC999E7C7A707FB6"><enum>(A)</enum><header>Compensation</header><text>A member of the Committee shall serve without compensation.</text></subparagraph> 
<subparagraph id="H023502A3E167497890D92B8839FC5C3F"><enum>(B)</enum><header>Travel expenses</header><text>A member of the Committee shall be allowed travel expenses, including per diem in lieu of subsistence, in accordance with section 5703 of title 5, United States Code.</text></subparagraph></paragraph> <paragraph id="H595DAD3290BA4DA693D8A21F8488793F"><enum>(6)</enum><header>Termination</header> <subparagraph id="HBA52D31BB369467E855B44D74848597D"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Committee shall terminate on the date that is 5 years after the date on which the members are appointed under paragraph (2)(B).</text></subparagraph> 
<subparagraph id="H6697358A44FE4275B31C63CB9FB86159"><enum>(B)</enum><header>Extensions</header><text>Before the date on which the Committee terminates, the Secretary may renew the Committee for 1 or more 2-year periods.</text></subparagraph></paragraph></subsection> <subsection id="H8DE29847C5004AA48114114858EA6195"><enum>(e)</enum><header>Annual report</header><text>Not later than 1 year after the date of the enactment of this subsection, and each year thereafter, the Secretary, acting through the coordinating group and in consultation with the Secretary of Commerce and the Secretary of the Interior, shall prepare on an annual basis, and submit to Congress, a report on the status of aquaculture in the United States. Such report shall contain—</text> 
<paragraph id="H304AC62E8C614782BBDFFFD0B37DC5A5"><enum>(1)</enum><text>a description and evaluation of the actions undertaken with respect to the Plan during the reporting period;</text></paragraph> <paragraph id="H652E93A1C87E444DB8C85114AEA6F0E0"><enum>(2)</enum><text>an explanation of any revisions made to the Plan during the reporting period;</text></paragraph> 
<paragraph id="HEC1C75BEA5984B2BA9A1842D82623139"><enum>(3)</enum><text>the results of the continuing assessment established under section 4(e);</text></paragraph> <paragraph id="HC1FF531E77DE4938B1EC13F2F2FA662A"><enum>(4)</enum><text>an evaluation of the role each Federal department or agency has in supporting the aquaculture industry;</text></paragraph> 
<paragraph id="H457403AE5FCF4C3EB45E78FDB974D1A3"><enum>(5)</enum><text>the total amount and value of expenditures of Federal departments or agencies on—</text> <subparagraph id="H44B9FE0801284A328D0EA19BBFECE6BE"><enum>(A)</enum><text>aquaculture purchases;</text></subparagraph> 
<subparagraph id="H8C66F737C5464B2B8634D17A1EFF392F"><enum>(B)</enum><text>aquaculture promotion and outreach supporting the aquaculture industry;</text></subparagraph> <subparagraph id="HF072F07E9CDF4A678D6F1BE5DFC59F3B"><enum>(C)</enum><text>grants made to the aquaculture industry; and</text></subparagraph> 
<subparagraph id="H3D018B425DAC4A9F9F53A71316E54811"><enum>(D)</enum><text>grants to facilitate aquaculture research and the subject matter of such research;</text></subparagraph></paragraph> <paragraph id="H3BA07B7E927C431AA4109FD0A4BD8941"><enum>(6)</enum><text>a summary of the activities and recommendations of the Aquaculture Advisory Committee established under subsection (d);</text></paragraph> 
<paragraph id="H53825EB39970451793448DE14083D597"><enum>(7)</enum><text>a summary of the activities and recommendations of the coordinating group; and</text></paragraph> <paragraph id="HB84040A47170447686796BF611B2B59D"><enum>(8)</enum><text>such other comments and recommendations as the Secretary determines appropriate.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H795E8472D5B04B57B7A1884ACD7198D9"><enum>(3)</enum><text>in section 10 (<external-xref legal-doc="usc" parsable-cite="usc/16/2809">16 U.S.C. 2809</external-xref>), by striking <quote>2023</quote> each place it appears in paragraphs (1), (2), and (3) and inserting <quote>2029</quote>.</text></paragraph></section> </legis-body></bill>
