committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>For text of introduced bill, see copy of bill as introduced on Septemeber 17, 2025</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of the Interior and the Secretary of Agriculture to develop a plan for ensuring timely review of communications use authorizations, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HII00" reported-display-style="italic" id="H3C16C1201D4D46E5B932E7C775B60CE4"><section id="H08A1351CED734C5280D459710A6EDABD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Administrative Reviews for Broadband Deployment Act</short-title></quote>.</text></section><section id="HF9F9E58EB3F04A7BA83BA7BC63143673"><enum>2.</enum><header>Ensuring timely review of broadband land use authorizations</header><subsection id="HD54B9276569E45E4AD98DE8F7BC23C8C"><enum>(a)</enum><header>Study and report</header><paragraph id="HD703192D89C54B31BCCD51ADA786CB45"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretaries concerned shall each conduct, with respect to the relevant covered department, a study to determine—</text><subparagraph id="H3B6F2C8D58BB473BA7E5DF3CB24366A3"><enum>(A)</enum><text display-inline="yes-display-inline">if there are programmatic or administrative barriers to the timely review of requests for broadband land use authorizations;</text></subparagraph><subparagraph id="H46234E907678485693BAD0BA215D192B"><enum>(B)</enum><text display-inline="yes-display-inline">if there are revisions to rules or regulations that could be implemented to improve efficiency with respect to reviewing requests for broadband land use authorizations; and</text></subparagraph><subparagraph id="HF635E78184604ADDAD3E3B8D62C0A572"><enum>(C)</enum><text display-inline="yes-display-inline">if there are processes for prioritizing the review of requests for broadband land use authorizations.</text></subparagraph></paragraph><paragraph id="HB0D08CED523345B9908BBC5225ACACD5"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretaries concerned shall jointly submit to the appropriate congressional committees a report that—</text><subparagraph id="HAD4A935A5E444893813B5E09DEE20593"><enum>(A)</enum><text>describes the results of the studies conducted under paragraph (1), including any barriers, revisions, or processes identified under subparagraphs (A) through (C) of such paragraph; and</text></subparagraph><subparagraph id="HA0E01CE8455C422EA09C8A5D9D392527"><enum>(B)</enum><text display-inline="yes-display-inline">includes a plan for providing, with respect to the organizational units of the relevant covered departments, the staffing necessary to ensure timely review of broadband land use authorizations.</text></subparagraph></paragraph></subsection><subsection id="H1A0851D94C09405EB8D0A30823D5CAEF"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H17FA0795DA364EC9B019D655D76779D1"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the—</text><subparagraph id="HE6736B5C3541480F87F2C320FBDC1BC6"><enum>(A)</enum><text>Committees on Natural Resources, Agriculture, and Energy and Commerce of the House of Representatives; and</text></subparagraph><subparagraph id="H4B9A9F21F8EA485E86CC23220B12861C"><enum>(B)</enum><text>Committees on Commerce, Science, and Transportation and Environment and Public Works of the Senate. </text></subparagraph></paragraph><paragraph id="HB75DB36EFC654C52851017423304F556"><enum>(2)</enum><header>Broadband land use authorization</header><text display-inline="yes-display-inline">The term <term>broadband land use authorization</term> means an easement, right-of-way, lease, license, or other authorization—</text><subparagraph id="H276D98C37CDD490A886990A8AE62063A"><enum>(A)</enum><text>provided by the Secretary of the Interior or the Secretary of Agriculture;</text></subparagraph><subparagraph id="H5900C66615B14CD78B3E22EB49D4E728"><enum>(B)</enum><text>to locate or modify a communications facility on covered land; and</text></subparagraph><subparagraph id="HC4B504C5BFE04066B979790E51CD1EDC"><enum>(C)</enum><text>for the primary purpose of authorizing the occupancy and use of such covered land for communications use.</text></subparagraph></paragraph><paragraph id="H052963ED9BE24043BB4997919085CCB4"><enum>(3)</enum><header>Communications facility</header><text display-inline="yes-display-inline">The term <term>communications facility</term> has the meaning given the term <term>communications facility installation</term> in section 6409(d) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(d)</external-xref>).</text></paragraph><paragraph id="H8E7CF551CDAD45EA9DA383CAA8AECC56"><enum>(4)</enum><header>Communications use</header><text>The term <term>communications use</term> means the placement and operation of a communications facility.</text></paragraph><paragraph id="H8ACEC54D83D04C20B89EF609139163C0"><enum>(5)</enum><header>Covered land</header><text>The term <term>covered land</term> means—</text><subparagraph id="H81A39BFC8CC6498C9010554DAD1D6FF0"><enum>(A)</enum><text>public lands; and</text></subparagraph><subparagraph id="H31BA2DA96CA34B9EAC50E0D0FB5C3015"><enum>(B)</enum><text>National Forest System land.</text></subparagraph></paragraph><paragraph id="H4D372F6E816E4BD98A6C94FD17026ED5"><enum>(6)</enum><header>National Forest System</header><text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="HF82A1C3BECAE4257BA95FEA43B2D74AF" commented="no"><enum>(7)</enum><header>Organizational unit</header><text>The term <term>organizational unit</term> means—</text><subparagraph id="HCBCFFBC17C964DA9A6267E2009C2DF74" commented="no"><enum>(A)</enum><text>with respect to the Department of the Interior—</text><clause id="H2A2D8136C0FF4ED195D04AB2387CEFDB" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">a State office of the Bureau of Land Management;</text></clause><clause id="H3D8F42BFAB3640988BB04FC0C29D17C3" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a district office of the Bureau of Land Management; or</text></clause><clause id="HB140B9A06FEA4486A96F948EABE122BB" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">a field office of the Bureau of Land Management; and</text></clause></subparagraph><subparagraph id="HF335F8A66D4D47EC84E932B15240A082" commented="no"><enum>(B)</enum><text>with respect to the Department of Agriculture—</text><clause id="H7B5A08D3C6C44397A960FE5199C0FB27" commented="no"><enum>(i)</enum><text>a regional office of the Forest Service;</text></clause><clause id="HF29043720C0945EA96C892C6DD72A795" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a management unit of the Forest Service; or</text></clause><clause id="H6385F643929A43BD966E1D616D25E6BE" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">a ranger district office of the Forest Service.</text></clause></subparagraph></paragraph><paragraph id="HF2C0F35769984183809025CB37AE4005"><enum>(8)</enum><header>Public lands</header><text>The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph><paragraph id="H1D41DF8C068A488B95179EB7C3340CC7"><enum>(9)</enum><header>Relevant covered department</header><text>The term <term>relevant covered department</term> means—</text><subparagraph id="H8ECD15F299F44C959E71458C4BA13BD6"><enum>(A)</enum><text>with respect to the Secretary of the Interior, the Department of the Interior; and</text></subparagraph><subparagraph id="H570BFB98A5664E24A8735728B52467A4"><enum>(B)</enum><text>with respect to the Secretary of Agriculture, the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="H75B7E51CCCA54A619B13F8070CBD21DD"><enum>(10)</enum><header>Secretaries concerned</header><text>The term <term>Secretaries concerned</term> means—</text><subparagraph id="H3395F721B273479898D878F93F594227"><enum>(A)</enum><text>the Secretary of the Interior;
