which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><action display="yes"><action-date date="20260901">September 1, 2026</action-date><action-desc>Additional sponsor: <cosponsor name-id="V000138">Mr. Vindman</cosponsor></action-desc></action><action display="yes"><action-date date="20260901">September 1, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on September 16, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Credit Reporting Act to clarify Federal law with respect to reporting certain full-file consumer credit information to consumer reporting agencies, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HBA00" reported-display-style="italic" id="HC2EE97DC77794611A1697B01364AA5F8"><section section-type="section-one" id="H57F5057B686B45499307B8ED296299D4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Credit Access and Inclusion Act of 2026</short-title></quote>.</text></section><section id="H57CA5CD19DF24116976B68FAA779C07E"><enum>2.</enum><header>Full-file reporting permitted</header><subsection id="HFEF36AA943264C8E905270190E29511D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 623 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H33691E0323DC4BC0915DE755EB1FEA0D" changed="added" reported-display-style="italic" committee-id="HBA00"><subsection id="H265839D773EF4C4EBCFA8BA2211571CD"><enum>(f)</enum><header>Full-File credit reporting</header><paragraph id="HE76420BA8FA94A7A9D7B314BD2868A58"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H3E438BCB9307489281FC7C68DFFD81E7"><enum>(A)</enum><header>Energy utility firm</header><text display-inline="yes-display-inline">The term <term>energy utility firm</term> means an entity that provides gas or electric utility services to the public.</text></subparagraph><subparagraph id="HAB41B6D1193B49998BB736D664F8E69F"><enum>(B)</enum><header>Utility or telecommunication firm</header><text>The term <term>utility or telecommunication firm</term> means an entity that provides utility services to the public through pipe, wire, landline, wireless, cable, or other connected facilities, or radio, electronic, or similar transmission (including the extension of such facilities).</text></subparagraph></paragraph><paragraph id="H7D6B3C8B03BB464DB65BF8D300BBBD9D"><enum>(2)</enum><header>Information relating to lease agreements, utilities, and telecommunications services</header><text display-inline="yes-display-inline">Subject to the limitations in paragraph (3), and notwithstanding any other provision of law, a person or the Secretary of Housing and Urban Development may furnish to a consumer reporting agency information relating to the performance of a consumer in making payments—</text><subparagraph commented="no" display-inline="no-display-inline" id="H04337186698945B8A9FD287EDAF41D1E"><enum>(A)</enum><text display-inline="yes-display-inline">under a lease agreement with respect to a dwelling, including such a lease in which the Department of Housing and Urban Development provides subsidized payments for occupancy in a dwelling; or</text></subparagraph><subparagraph id="H1A4B781EDB464D069E33126D3437BD30"><enum>(B)</enum><text>pursuant to a contract for a utility or telecommunications service.</text></subparagraph></paragraph><paragraph id="HFAC860D813EA42BA8BFB12EB5AC250C6"><enum>(3)</enum><header>Limitation</header><text display-inline="yes-display-inline">Information about the usage by a consumer of any utility service provided by a utility or telecommunication firm may be furnished to a consumer reporting agency only to the extent that the information relates to the payment by the consumer for the service of the utility or telecommunication service or other terms of the provision of the services to the consumer, including any deposit, discount, or conditions for interruption or termination of the service.</text></paragraph><paragraph id="H66569A8279F34660ADBF812FD33D64DD"><enum>(4)</enum><header>Payment plan</header><text display-inline="yes-display-inline">An energy utility firm may not report payment information to a consumer reporting agency with respect to an outstanding balance of a consumer as late if—</text><subparagraph id="HF28A69014B9B4F6FAD718D728596B615"><enum>(A)</enum><text>the energy utility firm and the consumer have entered into a payment plan (including a deferred payment agreement, an arrearage management program, or a debt forgiveness program) with respect to such outstanding balance; and</text></subparagraph><subparagraph id="H80B95C715E6842CABD26DDA7A444CA5E"><enum>(B)</enum><text display-inline="yes-display-inline">the consumer is meeting the obligations of the payment plan, as determined by the energy utility firm.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H78741672CAED40948DFD1A9729AB87B5"><enum>(b)</enum><header>Limitation on liability</header><text display-inline="yes-display-inline">Section 623(c) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2(c)</external-xref>) is amended—</text><paragraph id="H5498CD7FCD2C4801AC7B87EF93A37B57"><enum>(1)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HFACEC412CD184E629F901F886A72B115"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></paragraph><paragraph id="HBAC784B5A09345949587EBDA426D5B7A"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBD881C357C5F4883B76B6DF6BCA9FC13" changed="added" reported-display-style="italic" committee-id="HBA00"><paragraph id="H39929DBE471443DF9E8F71EDA51799C4"><enum>(3)</enum><text display-inline="yes-display-inline">subsection (f) of this section, including any regulations issued thereunder; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H048E956018CB4C969D3E72E48A778635"><enum>(c)</enum><header>GAO study and report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Congress a report—</text><paragraph id="HAAF5ED1151A545EBA3C8AC651F72D441"><enum>(1)</enum><text>on the impact that furnishing information pursuant to subsection (f) of section 623 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2</external-xref>), as added by subsection (a) of this section, has had on consumers; and</text></paragraph><paragraph id="H3CDE28B275974A2698AA204A994E939A" commented="no"><enum>(2)</enum><text>that analyzes the effect on consumer credit scores of reporting consumer cash flow data to consumer credit agencies.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date>September 1, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
