R. 528</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260317">March 17, 2026</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To require the Secretary of the Interior to carry out a program for Post-Disaster Reforestation and Restoration Program, and for other purposes.</official-title></form><legis-body id="H8D6CF7DBF4764C17B86FC861CD842E59" style="OLC"><section id="HD86825FB01684C998BD22BC7D2E3F6DD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Post-Disaster Reforestation and Restoration Act</short-title></quote>. </text></section><section id="H3F84AFF662484182B960E92D08AF8514"><enum>2.</enum><header>Post-Disaster Reforestation and Restoration Program</header><subsection id="H8F9EFF1DD73541ADB1B8D7E597C978FD"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act and annually thereafter, the Secretary, in coordination with the heads of the covered agencies, shall identify covered lands requiring reforestation and restoration following unplanned disturbances that are unlikely to experience natural regeneration without assistance.</text></subsection><subsection id="H8B9D32E0C7D2482B85783ED69B57CCD2"><enum>(b)</enum><header>Priority projects</header><text>In consultation with the heads of covered agencies, the Secretary—</text><paragraph id="HFCF002C49935488D95409A5F39A3AD9D"><enum>(1)</enum><text>shall propose a list of priority projects for reforestation and restoration for each fiscal year;</text></paragraph><paragraph id="H7A41B8EDD01348E18597CA64FAE3D07B"><enum>(2)</enum><text>may carry out priority projects through—</text><subparagraph id="HE2DB3D1D5AB04D9E991F248243B98E0C"><enum>(A)</enum><text>competitively awarded grants;</text></subparagraph><subparagraph id="HB156318713904195B9E18AA702125EA4"><enum>(B)</enum><text>contracts;</text></subparagraph><subparagraph id="H5780311B73324F7D80807CA1633B709F"><enum>(C)</enum><text>contracts established under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H13E9C5B26BA540D581679E73066FD783"><enum>(D)</enum><text>cooperative agreements, to be awarded in accordance with applicable requirements established by the Secretary; and</text></subparagraph></paragraph><paragraph id="H94937790B4644307A18CFE69A3774268"><enum>(3)</enum><text>may support any grant contract or cooperative agreement that may be necessary to ensure adequate and appropriate seed and seedling availability to further the objectives of priority projects.</text></paragraph></subsection><subsection id="HA6A979F2F177420AAAEB39054F401D79"><enum>(c)</enum><header>Outreach</header><text>To fulfill requirements of this section the heads of covered agencies shall conduct outreach to—</text><paragraph id="H6AB6A218E3FC426E8EA60C78DF163B92"><enum>(1)</enum><text>Indian Tribes;</text></paragraph><paragraph id="HA4332FFF9661419191B4644A0BCF5D47"><enum>(2)</enum><text>States;</text></paragraph><paragraph id="H89BF50D854D54562B4C2EA9F8F6BE1D9"><enum>(3)</enum><text>territories;</text></paragraph><paragraph id="HFFDEAFA2D9054C97AA62224643A70B1B"><enum>(4)</enum><text>units of local government;</text></paragraph><paragraph id="H60818647347A408DBE00D4BBED5BED4D"><enum>(5)</enum><text>Alaska Native organizations;</text></paragraph><paragraph id="HE654FB9A5D4642E3B569F46AD91661AE"><enum>(6)</enum><text>Native Hawaiian organizations;</text></paragraph><paragraph id="HFA6922850D814A90A34386846BE23349"><enum>(7)</enum><text>institutions of higher education; </text></paragraph><paragraph id="HE6A1A6E403874322B6EE6000AC6F2536"><enum>(8)</enum><text>Federal agencies with jurisdiction over Federal land adjoining or proximal to priority projects; and</text></paragraph><paragraph id="H7721ECFC9DBB406888B7AA4AB944436E"><enum>(9)</enum><text>other stakeholders as determined by the Secretary.</text></paragraph></subsection><subsection id="H0DB159DA95BA4F508E19931F74CD9696"><enum>(d)</enum><header>Reports and recommendations</header><text>Not later than 2 years after the date of the enactment of this Act, and annually thereafter, the Secretary shall submit to the relevant Congressional Committees a report that includes the following:</text><paragraph id="H72A38269E0604B71A8478F38D3098029"><enum>(1)</enum><text>An accounting of all covered lands requiring reforestation and restoration.</text></paragraph><paragraph id="HDD6F12F7C73B479293154AA98A2F695C"><enum>(2)</enum><text>A list of priority projects and implementation progress to address reforestation and restoration objectives identified.</text></paragraph><paragraph id="HF24793E5F13C4FA7BDC7D8A5897CAE31"><enum>(3)</enum><text>An accounting of grants, contracts, and cooperative agreements established in furtherance of priority projects.</text></paragraph><paragraph id="H9CB3CC25948749E08582181C5F2ED2C4"><enum>(4)</enum><text>Outreach efforts by covered agencies to advance priority projects.</text></paragraph><paragraph id="H1C16EBEDB49C46A7A0F9EEFD0B554790"><enum>(5)</enum><text>Assessments of, and recommendations relating to seed, seedling, and implementation gaps to advance priority projects and opportunities to establish dedicated funding necessary to address any backlog of reforestation and restoration needs.</text></paragraph></subsection><subsection id="HE3C4F36E571C4EC4801558C93238FF69"><enum>(e)</enum><header>Sunset</header><text>The authority provided under this section shall terminate on the date that is 7 years after the date of enactment of this Act.</text></subsection><subsection id="HA8A9BC544B8245BF9C1524CF5875664A"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4EFCD031EB214284A5E137A779813CF5"><enum>(1)</enum><header>Covered agency</header><text display-inline="yes-display-inline">The term <term>covered agency</term> means the National Park Service, the United States Fish and Wildlife Service, the Bureau of Land Management, the Bureau of Reclamation, and the Bureau of Indian Affairs.</text></paragraph><paragraph id="H73E462046C5440CABEE3BAC11FF00880"><enum>(2)</enum><header>Covered lands</header><text>The term <term>covered lands</term> means—</text><subparagraph id="H6DD0F59178BE465E92FAFB6DAB462391"><enum>(A)</enum><text>any Federal land or interest in land administered by a covered agency; or</text></subparagraph><subparagraph id="HC5B5B379A8AF4F5B92B9BC9C0D7DB531"><enum>(B)</enum><text>Indian Forest Land or Rangeland. </text></subparagraph></paragraph><paragraph id="H25579C9216294E139E5F0EDE0754F228"><enum>(3)</enum><header>Indian Forest Land or Rangeland</header><text display-inline="yes-display-inline">The term <quote>Indian Forest Land or Rangeland</quote> means land that—</text><subparagraph id="HBCFAA29594B54234BA28B597133A973E"><enum>(A)</enum><text>is held in trust by, or with a restriction against alienation by, the United States for an Indian Tribe or a member of an Indian Tribe; and</text></subparagraph><subparagraph id="HF6BDECD918AC4449839835009508A4C7"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H2C3C62C1C9CC4F30ACBA09C33D6B352E"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H93A5B8600BBF42E8B38951478AA343D9"><enum>(I)</enum><text>is Indian forest land (as defined in section 304 of the National Indian Forest Resources Management Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3103">25 U.S.C. 3103</external-xref>)); or</text></subclause><subclause id="H12DA0BC731E4402587B42F141CF129D8"><enum>(II)</enum><text display-inline="yes-display-inline">has a cover of grasses, brush, or any similar vegetation; or</text></subclause></clause><clause id="H121859B7DAA1425D8E40929B72C91862"><enum>(ii)</enum><text>formerly had a forest cover or vegetative cover that is capable of restoration.</text></clause></subparagraph></paragraph><paragraph id="H519B011664F3436ABCB0E422376557D7"><enum>(4)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> means any Indian or Alaska Native tribe, band, nation, pueblo, village, or community individually identified (including parenthetically) in the list published most recently as of the date of enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="HF260903983114E308D218F77553B2848"><enum>(5)</enum><header>Natural regeneration</header><text>The term <term>natural regeneration</term> has the meaning given the term in section (e)(4) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (U.S.C. 36 1601).</text></paragraph><paragraph id="HB942E788123F42A9ACB82EED4D689568"><enum>(6)</enum><header>Reforestation</header><text>The term <term>reforestation</term> has the meaning given the term in section (e)(4) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (U.S.C. 36 1601).</text></paragraph><paragraph id="HE0DF45063F404EEBBD48C484CA6E0A20"><enum>(7)</enum><header>Restoration</header><text>The term <term>restoration</term> means assisting the recovery of an ecosystem that has been degraded, damaged, or destroyed, including the reestablishment of appropriate plant species composition and community structure.</text></paragraph><paragraph id="HFB9446F197F1438A8AA681615C080DD6"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="HBA13A7A20BEA4F7CBF189F1726FC002D"><enum>(9)</enum><header>Unplanned disturbance</header><text>The term <term>unplanned disturbance</term> means any unplanned disturbance that disrupts ecosystem structure or composition and may include a wildfire, an infestation of insects or disease, or a weather event.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20260316" chamber="House">Passed the House of Representatives March 16, 2026.</attestation-date><attestor display="yes">Kevin F.
