<section id="H317F10F2C3F94F899793049929C0E9BC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Skills-Based Federal Contracting Act of 2025</short-title></quote>.</text></section> <section id="HAC765367422F46B08E8D0B9397FE8AA4"><enum>2.</enum><header>Use of requirements regarding education of contractor personnel</header> <subsection id="HBF534DAFCEBB48DE93AF157D055F731B"><enum>(a)</enum><header>Flexibility in contractor education requirements</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">Chapter 33</external-xref> of title 41, United States Code, is amended by adding at the end the following new section:</text>

<section id="H6D9F1F50FBD54ACBB8AFABA9A84032B7"><enum>3313.</enum><header>Flexibility in contractor education requirements</header> 
<subsection id="H013936C1937F4AACAE4277DDB304998E"><enum>(a)</enum><header>Prohibition</header><text>A solicitation may not set forth any minimum education requirement for proposed contractor personnel in order for a bidder to be eligible for award of a contract unless the contracting officer includes in the solicitation a written justification that explains why the needs of the executive agency cannot be met without any such requirement and clarifies how the requirement ensures the needs are met.</text></subsection> <subsection id="H90B0331312EF4E949012D20649EF89D6"><enum>(b)</enum><header>Executive agency defined</header><text>In this section, the term <term>executive agency</term> has the meaning given that term in section 133 of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF68215616C4B4BC99970A8F0A45DC218"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">chapter 33</external-xref> of title 41, United States Code, is amended by adding at the end the following new item:</text> <quoted-block style="USC" id="H56F54D774169414C8F910D4CD03DB29E" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">3313. Flexibility in contractor education requirements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HDB7214B75C874E1EAEBC367DAC3E7A2F"><enum>(c)</enum><header>OMB guidance</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall issue guidance to the heads of executive agencies for implementing the amendment made by subsection (a) that includes the following:</text> 
<paragraph id="H0DDB92D268764415B7AEB459D0C0E7F9"><enum>(1)</enum><text>Instructions for contracting officers for the justifications under section 3313(a) of title 41, United States Code, as added by subsection (a), including a requirement that each use of an education requirement be determined, justified, and reviewed.</text></paragraph> <paragraph id="HD40C42640B24444DA032F1F7BCCFC4B0"><enum>(2)</enum><text>Instructions for contracting officers that encourages the use of alternatives to education requirements.</text></paragraph></subsection> 
<subsection id="H791F83611EDF4BD398E8B741FCD5CBCC"><enum>(d)</enum><header>Applicability</header><text>The amendments made by this section shall apply with respect to solicitations issued on or after the date that is 15 months after the date of the enactment of this Act.</text></subsection> <subsection id="H141FD966F8B84D1C97B09EB0A303C69D"><enum>(e)</enum><header>Repeal</header><text>Section 813 of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/398">Public Law 106–398</external-xref>; 114 Stat. 1654A–214), as implemented in subpart 39.104 of the Federal Acquisition Regulation, as in effect on January 3, 2025, is repealed as of the date that the guidance required by subsection (c) becomes effective.</text></subsection> 
<subsection id="H78ABC1B07BB24C37B6FA08BEDB066BB1"><enum>(f)</enum><header>GAO report</header><text>Not later than 3 years after the date of the enactment of this Act, the Comptroller General shall submit to Congress an evaluation of executive agency compliance with section 3313 of title 41, United States Code, as added by subsection (a).</text></subsection> <subsection id="H78A51655268549E790E9D1D75FECD33F"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HD0AA3DB7184548F9ACAF4AC91FDEDE64"><enum>(1)</enum><header>Education</header><text display-inline="yes-display-inline">The term <term>education</term> means an associate, baccalaureate, graduate, or professional degree, specified coursework, or other form of educational attainment awarded by a junior or community college, college, or university that is accredited as a collegiate institution by a recognized accrediting agency or approved by the appropriate State education authority under State law (or the appropriate education authority of the District of Columbia) to grant associate or higher degrees.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0F16BC34EE6644F2A9927B8EC3AD3EA5"><enum>(2)</enum><header display-inline="yes-display-inline">Education requirement</header><text>The term <quote>education requirement</quote> includes a requirement that can be met either through—</text> 
<subparagraph id="H5FA58853AF964E2CA7E257053FDECB23"><enum>(A)</enum><text>education alone;</text></subparagraph> <subparagraph id="H9EAFF6239CA846FAA89F2DCDE3F225E0"><enum>(B)</enum><text>education or experience; or</text></subparagraph> 
<subparagraph id="H08F394F2F3614CA7A7D6AC864FB0D3E4"><enum>(C)</enum><text>a combination of education and experience.</text></subparagraph></paragraph> <paragraph id="H8B396359E30C41618907674E49036BAF"><enum>(3)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given that term in section 133 of title 41, United States Code.</text></paragraph></subsection></section>
