improvements to network outage reporting</header><subsection id="H7AF1946B1414438A92724891D2E9FCC1"><enum>(a)</enum><header>Reports after activation of Disaster Information Reporting System</header><paragraph id="H72F5F34039284FE1B9A32A166B4AD4D7"><enum>(1)</enum><header>Public hearings</header><subparagraph id="H34614A9F5D1546A3B6EBB65CDF8BFA31"><enum>(A)</enum><header>Requirement</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Commission shall hold not less than 1 public hearing relating to all events during the preceding 1-year period for which the System was activated for not less than 7 days.</text></subparagraph><subparagraph id="HD300ED8E198443058FC9CDE14F781791"><enum>(B)</enum><header>Inclusion of certain individuals in hearings</header><text>For each public hearing held under subparagraph (A), the Commission shall consider including—</text><clause id="H57521E9B4F7E43B8B4844CBF22B8C2F1"><enum>(i)</enum><text>representatives of State governments, local governments, or Indian tribal governments in areas affected by such events;</text></clause><clause id="H7AB92002470F48EB84649DCDD489E3E3"><enum>(ii)</enum><text>residents of the areas affected by such events, or consumer advocates;</text></clause><clause id="HB4A0A1B205C64E0D961B8DFC74210516"><enum>(iii)</enum><text>providers of communications services affected by such events;</text></clause><clause id="H53EF02A1DB6B4BE1B7898A73063736AE"><enum>(iv)</enum><text>faculty of institutions of higher education;</text></clause><clause id="HEC162629386E493798D026F1268FB9A6"><enum>(v)</enum><text>representatives of other Federal agencies;</text></clause><clause id="H53722D38AD08456998A0FE5ECEDE76DB"><enum>(vi)</enum><text>electric utility providers;</text></clause><clause id="HFA38F24FDBE9484FB5502E616671ABC9"><enum>(vii)</enum><text>communications infrastructure companies; and</text></clause><clause id="H83B6834C659D4EF2A8E7975C595D8F74"><enum>(viii)</enum><text>first responders, emergency managers, or 9–1–1 directors in areas affected by such events.</text></clause></subparagraph></paragraph><paragraph id="HC268FC64252B4F04B7CDFE37A43FD90F"><enum>(2)</enum><header>Reports</header><text>Not later than 120 days after the date on which a public hearing held under paragraph (1) concludes, the Commission shall issue a report that includes, with respect to the events to which such hearing relates and to the extent known without requiring the collection of additional information—</text><subparagraph id="H81C450D949C140DC9B5620C10F2FD278"><enum>(A)</enum><text>the number and duration of any outages of—</text><clause id="H318D2D3339904A5484F2884BA5CC14C9"><enum>(i)</enum><text>broadband internet access service;</text></clause><clause id="HC0DCD234FB1344FFAD912AAC414DCB20"><enum>(ii)</enum><text>interconnected VoIP service;</text></clause><clause id="H722043E5E82044E19B44D44CB77E4B64"><enum>(iii)</enum><text>commercial mobile service; and</text></clause><clause id="HD84158BA74B54E578952644503A2DCF3"><enum>(iv)</enum><text>commercial mobile data service;</text></clause></subparagraph><subparagraph id="H37ABCF47E8CF4E4CB4D1538B131FEDCF"><enum>(B)</enum><text>the approximate number of users and the amount of communications infrastructure potentially affected by an outage described in subparagraph (A);</text></subparagraph><subparagraph id="H3042DD7E21C148D49BD098A45B0E05F1"><enum>(C)</enum><text>the number and duration of any outages that prevent emergency communications centers from receiving caller location or number information or receiving emergency calls and routing such calls to emergency service personnel; and</text></subparagraph><subparagraph id="H4B932B1025A14966A377F41FCA80382E"><enum>(D)</enum><text>any recommendations of the Commission on how to improve the resiliency of affected communications services or networks.</text></subparagraph></paragraph><paragraph id="H9AED045333574BE6A98B10A75D2CD332"><enum>(3)</enum><header>Development of reports</header><text>In developing a report required by paragraph (2), the Commission shall consider information collected by the Commission with respect to the events to which such report relates, including information collected through the System and the relevant public hearing.</text></paragraph><paragraph id="H6098E16C0AE2468BBF2C54644BA52A45" commented="no"><enum>(4)</enum><header>Publication of reports</header><subparagraph id="HE70D842BFB764FD28AD28D0BAF8A0101" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the Commission shall publish each report required by paragraph (2) on the website of the Commission upon the issuance of such report.</text></subparagraph><subparagraph id="H3927383641E64541AE2517B35236B544" commented="no"><enum>(B)</enum><header>Exclusion</header><text>In publishing a report under subparagraph (A), the Commission shall exclude information that is otherwise exempt from public disclosure under the rules of the Commission or that was submitted to the Commission with a proper request for confidential treatment as described in section 0.459 of title 47, Code of Federal Regulations (or any successor regulation).</text></subparagraph></paragraph></subsection><subsection id="HE88699735C99413D830AE84CE9963A38"><enum>(b)</enum><header>Improvements to network outage reporting</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall conduct an investigation and publish on the website of the Commission a report on—</text><paragraph id="HDF56C11D43194760822FF13FB542CF9D"><enum>(1)</enum><text>the value to public safety agencies of originating service providers including visual information to improve situational awareness about outages in the notifications provided to emergency communications centers, as required by the rules of the Commission;</text></paragraph><paragraph id="HE043666D02DC495DB4F9DF1BC9F2F6FA"><enum>(2)</enum><text display-inline="yes-display-inline">the volume and nature of 9–1–1 outages that may go unreported under the outage notification thresholds of the Commission;</text></paragraph><paragraph id="H729A0DA6E6DC47ACB8566EE3D0D44807"><enum>(3)</enum><text>the balance between the value described in paragraph (1) to public safety agencies and the burden and practicality for originating service providers of including visual information in outage notifications as described in such paragraph; and</text></paragraph><paragraph id="H65DCD3D3D6184402A291BA489C7C6DA4"><enum>(4)</enum><text>recommended changes to the rules of the Commission to address the matters reported under paragraphs (1) and (2).</text></paragraph></subsection><subsection id="H08079F84DB084A519C381E89B66949C1" commented="no"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to provide the Commission or any other person authority over any provider of broadband internet access service beyond what is specifically authorized under this section.</text></subsection><subsection id="H123E0BDBCD58471B90771CA77B2923F9"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H9FE1984540C84F26853FBAFE49FCF6E3"><enum>(1)</enum><header>Broadband internet access service</header><text>The term <quote>broadband internet access service</quote> has the meaning given such term in section 8.1(b) of title 47, Code of Federal Regulations (or any successor regulation).</text></paragraph><paragraph id="HCA0F61872CDE429BBC28F7DE1D7061D2"><enum>(2)</enum><header>Commercial mobile data service</header><text>The term <quote>commercial mobile data service</quote> has the meaning given such term in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>).</text></paragraph><paragraph id="H9D1A2C57A5014B0BA36CD61D7A18540A"><enum>(3)</enum><header>Commercial mobile service</header><text>The term <quote>commercial mobile service</quote> has the meaning given such term in section 332(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>).</text></paragraph><paragraph id="HDBA9B63A65034926A4FEB66F476A1587"><enum>(4)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Communications Commission.</text></paragraph><paragraph id="HEB8567EE1C2C4D7480C864F83B712BC2"><enum>(5)</enum><header>Emergency communications center</header><subparagraph id="HE5095E2A823A40DC922EDC35DF97D82A"><enum>(A)</enum><header>In general</header><text>The term <quote>emergency communications center</quote> means—</text><clause id="H051DD4DBD4E8497A9C4291AC2CA68831"><enum>(i)</enum><text>a facility that—</text><subclause id="HE4D9A11044064888B053300A5526A60A"><enum>(I)</enum><text>is designated to receive a 9–1–1 request for emergency assistance; and</text></subclause><subclause id="HDAAEB7335C6F4851A47B93F89209C190"><enum>(II)</enum><text>performs 1 or more of the functions described in subparagraph (B); or</text></subclause></clause><clause id="H1AB41C7941294E8F952F93E2CD705E7C"><enum>(ii)</enum><text>a public safety answering point (as defined in section 222 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>)).</text></clause></subparagraph><subparagraph id="H7CFD7A67304743D1A92BA896B6C5EA4B"><enum>(B)</enum><header>Functions described</header><text>The functions described in this subparagraph are the following:</text><clause id="H9042D2C287064779917021B8A4626475"><enum>(i)</enum><text>Processing and analyzing 9–1–1 requests for emergency assistance and information and data related to such requests.</text></clause><clause id="H4623E8DEDB014212B567293B6E0EB8D8"><enum>(ii)</enum><text>Dispatching appropriate emergency response providers.</text></clause><clause id="HCDF4ED56CC6148D084307E2670F4A0B3"><enum>(iii)</enum><text>Transferring or exchanging 9–1–1 requests for emergency assistance and information and data related to such requests with 1 or more other emergency communications centers and emergency response providers.</text></clause><clause id="H504C7FFE1D9F4059A3718921F71F4B7A"><enum>(iv)</enum><text>Analyzing any communications received from emergency response providers.</text></clause><clause id="HFA42FBB9E9D64E9ABDF17574AC1ACAB5"><enum>(v)</enum><text>Supporting incident command functions.</text></clause></subparagraph></paragraph><paragraph id="HD701F195441F4A5FBD814D193BA2983A"><enum>(6)</enum><header>Indian tribal government; local government</header><text>The terms <quote>Indian tribal government</quote> and <quote>local government</quote> have the meanings given such terms in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></paragraph><paragraph id="HA158375655AE4E10A8B1ED302A6694CB"><enum>(7)</enum><header>Interconnected VoIP service; State</header><text>The terms <quote>interconnected VoIP service</quote> and <quote>State</quote> have the meanings given such terms in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph><paragraph id="H35117B96F3074958B9D8DEB2E011B475"><enum>(8)</enum><header>Outage</header><text>The term <quote>outage</quote> has the meaning given such term in section 4.5 of title 47, Code of Federal Regulations (or any successor regulation).</text></paragraph><paragraph id="H2D89EACC6B184B08BBAE827BA66AE6A6"><enum>(9)</enum><header>System</header><text>The term <quote>System</quote> means the Disaster Information Reporting System of the Commission.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date>April 9, 2026</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
