<section id="H8CDDD98F698A423DB58CC76EE3C4258A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affordable Housing Over Mandating Efficiency Standards Act</short-title></quote> or the <quote><short-title>Affordable HOMES Act</short-title></quote>.</text></section> <section id="H87E7DAB567FE4D1F99BE27F44B979EDF"><enum>2.</enum><header>Recommendations for revisions to standards for manufactured housing</header> <subsection id="H8BF57AE4B90446D2A043F9E87B137540"><enum>(a)</enum><header>Recommendations</header><text>Section 413 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17071">42 U.S.C. 17071</external-xref>) is amended—</text>
<paragraph id="H92FC7FFA4E0B48098118305B90796B88"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text> <quoted-block style="OLC" id="H50FF9AC4DAAA4D839D1371EEC2294282" display-inline="no-display-inline"> <subsection id="HA086B5D8E4094EE5BD048CA5A1D1EC92"><enum>(a)</enum><header>Recommendations for revisions to standards</header><text display-inline="yes-display-inline">The Secretary may transmit to the Secretary of Housing and Urban Development recommendations for revisions to the preemptive energy conservation standards established under section 604(g) of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5403">42 U.S.C. 5403(g)</external-xref>).</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph>
<paragraph id="H9F9B551BD0ED408C9530D79FCC911612"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text> <quoted-block id="HC8686CB9BFA9401DAF6742EE4D50ECF4" style="OLC"> <subsection id="HEC4DC4C1A203425EB0E814CEEA91EA42"><enum>(b)</enum><header>Criteria for recommendations</header><text display-inline="yes-display-inline">Any recommendations for revisions to a preemptive energy conservation standard transmitted under this section shall—</text>
<paragraph id="HCE521A881BDE422D90B10C1649D9C744"><enum>(1)</enum><text>be based on a determination of the cost-effectiveness of such standard as proposed to be revised, taking into consideration life cycle construction and operating costs; </text></paragraph> <paragraph id="H0244E562B4724476A97ABF837AF60229"><enum>(2)</enum><text>include estimates of the impact of such standard as proposed to be revised on the initial purchase price of manufactured homes; and</text></paragraph>
<paragraph id="HD930F52AC0314AFC8FD575725CB5C065"><enum>(3)</enum><text>be developed taking into consideration—</text> <subparagraph id="HE8296CFCF85A4D6387F463B376F49DF1"><enum>(A)</enum><text>factory construction techniques and limitations unique to manufactured homes;</text></subparagraph>
<subparagraph id="HB310C72FC393484CB5AC39E7AB87919A"><enum>(B)</enum><text>climate zones established by the Secretary of Housing and Urban Development;</text></subparagraph> <subparagraph id="H66219AD6334743DC9172B19C0A54805A"><enum>(C)</enum><text>alternative methods that achieve equivalent or improved energy performance as compared to such standard as proposed to be revised; and</text></subparagraph>
<subparagraph id="H43EB0DE2FE3E4A8EB8BE05689380794E"><enum>(D)</enum><text>estimated payback periods for any added costs arising from such standard as proposed to be revised.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H83CF2BAC74A042F4BA07DF68FA0CA550"><enum>(3)</enum><text>by striking subsection (c).</text></paragraph></subsection>
<subsection id="H0F45FD7315974C27A902D0504CBEB015"><enum>(b)</enum><header>No force or effect</header><text>The final rule titled <quote>Energy Conservation Program: Energy Conservation Standards for Manufactured Housing</quote> published by the Department of Energy in the Federal Register on May 31, 2022 (87 Fed. Reg. 32728), shall have no force or effect.</text></subsection></section> </legis-body><attestation><attestation-group><attestation-date date="20260109" chamber="House">Passed the House of Representatives January 9, 2026.</attestation-date><attestor display="no">Kevin F.
