committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc><action-instruction>For text of introduced bill, see copy of bill as introduced on July 23, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Energy Conservation and Production Act to repeal certain Federal building energy efficiency performance standards, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HIF00" reported-display-style="italic" id="H02773CFC60954C2DB5B99DE4A1524012"><section id="HB046E843BF66443AABE06C9BCE8800C6" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reliable Federal Infrastructure Act</short-title></quote>.</text></section><section id="H732749B9597943909010467FB50C5331"><enum>2.</enum><header>Revised Federal building energy efficiency performance standards</header><subsection id="H4BB51AA8F50C4DA88B9F6C0758091B82" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 305(a)(3)(D)(i) of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6834">42 U.S.C. 6834(a)(3)(D)(i)</external-xref>) is amended—</text><paragraph id="H641560BD7476491FAD6BEE281329479B" commented="no"><enum>(1)</enum><text>by striking subclauses (I) and (II); and</text></paragraph><paragraph id="H8CC2FF30F37B4F7E88201B4BBC92C4AF" commented="no"><enum>(2)</enum><text>in subclause (III), by inserting after the third sentence the following: <quote>The certification system and level may not prohibit a building from obtaining a certification as a green building or high-performance green building solely based on direct or indirect consumption of fossil fuels.</quote>.</text></paragraph></subsection><subsection id="HEDDF21908DDE4A488D724A3DCAA907B6" commented="no"><enum>(b)</enum><header>Standards</header><paragraph id="H645CF05CAA32411D8EFD5BCE6F22DE75" commented="no"><enum>(1)</enum><header>Repeal of certain standards</header><text>Subpart B of part 435, and subpart B of part 433, of title 10, Code of Federal Regulations, as in effect on the day before the date of enactment of this Act, shall have no force or effect.</text></paragraph><paragraph id="HCDC608220F24440D8D163B13B4B7BD98" commented="no"><enum>(2)</enum><header>Transition</header><text display-inline="yes-display-inline">Until such time as the Secretary of Energy issues new or revised regulations pursuant to subsection (d) relating to the revised Federal building energy efficiency performance standards under section 305(a)(3)(D) of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6834">42 U.S.C. 6834(a)(3)(D)</external-xref>) to carry out the amendments made by subsection (a)(1) of this section, such section 305(a)(3)(D) shall be implemented as though the requirements of subclauses (I) and (II) of clause (i) of such section 305(a)(3)(D) (as in effect on the day before the date of enactment of this Act) had never taken effect.</text></paragraph></subsection><subsection id="H73B00B1178F54E67B457BEFC7214CC4D"><enum>(c)</enum><header>Conforming amendment</header><text>Section 436(h) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17092">42 U.S.C. 17092(h)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H1D9B3A33ADE0449B91A373B98298A417" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H4BE258D18DB7451B842527A91CB92EE8"><enum>(3)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The system identified under paragraph (1) may not prohibit a building from obtaining a certification as a green building or high-performance green building solely based on direct or indirect consumption of fossil fuels.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="HA8226DA0801845C086782D0B10263811" commented="no"><enum>(d)</enum><header>Revision of regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Energy shall issue such new or revised regulations as the Secretary determines necessary to carry out the amendments made by this Act.</text></subsection></section></legis-body><endorsement display="yes"><action-date>February 4, 2026</action-date><action-desc>Reported from the <committee-name added-display-style="italic" committee-id="HIF00" deleted-display-style="strikethrough">Committee on Energy and Commerce</committee-name> with an amendment</action-desc><action-date>February 4, 2026</action-date><action-desc>Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name> discharged;
