<section id="HACF7D7BE023E439FB6CB310295587D5C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Infertility Treatment Affordability Act of 2025</short-title></quote>.</text></section> <section id="H2463286AC246444F9C18AE8081A84A44"><enum>2.</enum><header>Credit for infertility treatments</header> <subsection id="HA6F22B43A93B4112BF49F080A6279075"><enum>(a)</enum><header>In general</header><text>Subpart A of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before section 24 the following new section:</text>

<section id="H568116807F2F43B5A17F811BE565DAAD"><enum>23A.</enum><header>Credit for infertility treatments</header>
<subsection id="H5A416476BFFE40DF82D0195A25F79729"><enum>(a)</enum><header>Allowance of credit</header><text>In the case of an eligible individual, there shall be allowed as a credit against the tax imposed by this chapter for the taxable year an amount equal to 50 percent of the qualified infertility treatment expenses paid or incurred during the taxable year.</text></subsection> <subsection id="HE283604D6A5B4DBC8EC28D5DAC4C7AA9"><enum>(b)</enum><header>Limitations</header> <paragraph id="HDFBBC0E698874FE4A4BADCFDA1AA8E4D"><enum>(1)</enum><header>Dollar limitation</header><text>The amount of the credit under subsection (a) for any taxable year shall not exceed the excess (if any) of—</text>
<subparagraph id="H1229E46C22974B37BB0E6023C6384995"><enum>(A)</enum><text>the dollar amount in effect under section 23(b)(1) for the taxable year, over</text></subparagraph> <subparagraph id="H033C836BC7994A689DC103B7BC44B30F"><enum>(B)</enum><text>the aggregate amount of the credits allowed under subsection (a) for all preceding taxable years.</text></subparagraph></paragraph>
<paragraph id="H8B7AB54133A34A01A64383658B32A738"><enum>(2)</enum><header>Income limitation</header>
<subparagraph id="HA0C4BBDAAD684E32968A762845292D66"><enum>(A)</enum><header>In general</header><text>The amount otherwise allowable as a credit under subsection (a) for any taxable year (determined after the application of paragraph (1) and without regard to this paragraph and subsection (c)) shall be reduced (but not below zero) by an amount which bears the same ratio to the amount so allowable as—</text> <clause id="H4E06EFDEC1C54F6BB1239E881081D786"><enum>(i)</enum><text>the amount (if any) by which the taxpayer’s adjusted gross income exceeds the dollar amount in effect under clause (i) of section 23(b)(2)(A), bears to</text></clause>
<clause id="HC150C669E4E049FABE89874CC88C401B"><enum>(ii)</enum><text>$40,000.</text></clause></subparagraph> <subparagraph id="HECAD54A56F7B4C17AC2FB9BD1B929FDA"><enum>(B)</enum><header>Determination of adjusted gross income</header><text>For purposes of subparagraph (A), adjusted gross income shall be determined without regard to sections 911, 931, and 933.</text></subparagraph></paragraph>
<paragraph id="H082FA69D68B843F1A53EC433ABDB8966"><enum>(3)</enum><header>Portion of credit refundable</header>
<subparagraph id="HE1A3EE4958784CFCB8A8E3BF7622BE86"><enum>(A)</enum><header>In general</header><text>So much of the credit allowed under subsection (a) for any taxable year (determined after the applications of paragraphs (1) and (2)) as does not exceed $5,000 shall be treated as a credit allowed under subpart C and not as a credit allowed under this subpart.</text></subparagraph> <subparagraph id="H969F04A5ACED4AB08383CC6250D55C71" display-inline="no-display-inline"><enum>(B)</enum><header>Adjustments for inflation</header> <clause id="H00C425FD428E47BD89F7807CC8D3BA58"><enum>(i)</enum><header>In general</header><text>In the case of a taxable year beginning after December 31, 2025, the $5,000 amount in subparagraph (A) shall be increased by an amount equal to—</text>
<subclause id="H3E7AE0D37D644125ABBA196B284B4E52"><enum>(I)</enum><text>such dollar amount, multiplied by</text></subclause> <subclause id="HE861FC3403844EC4B7AECCD56FEB9EDE"><enum>(II)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>calendar year 2024</quote> for <quote>calendar year 2016</quote> in subparagraph (A)(ii) thereof.</text></subclause></clause>
<clause id="H408FCC85832A4A3783EE17CFD2E0C4CC"><enum>(ii)</enum><header>Rounding</header><text>If any amount as increased under clause (i) is not a multiple of $10, such amount shall be rounded to the nearest multiple of $10.</text></clause></subparagraph></paragraph> <paragraph id="HE29A272307624DD7856A013E3FBD0663"><enum>(4)</enum><header>Denial of double benefit</header> <subparagraph id="HE465F585AA994F4780D9D3CC04242E1C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any qualified infertility treatment expense taken into account for purposes of any deduction (or any credit other than the credit allowed under this section) shall be reduced by the amount of the credit allowed under subsection (a) with respect to such expense.</text></subparagraph>
<subparagraph id="H7AEA87D693844D67B1C37A2C937A8BCC"><enum>(B)</enum><header>Grants</header><text>No credit shall be allowed under subsection (a) for any expense to the extent that reimbursement or other funds in compensation for such expense are received under any Federal, State, or local program.</text></subparagraph> <subparagraph id="H179C2BE7F5DB4DC3AAA1750ED088B064"><enum>(C)</enum><header>Insurance reimbursement</header><text>No credit shall be allowed under subsection (a) for any expense to the extent that payment for such expense is made, or reimbursement for such expense is received, under any insurance policy.</text></subparagraph></paragraph></subsection>
<subsection id="HC63F9F1BFA5F4952994E2FA3A4DEBD7B"><enum>(c)</enum><header>Carryforwards of unused credit</header>
<paragraph id="H96F26094DBB74C74A778D8F2CF144F11"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the portion of the credit allowable under subsection (a) which is allowed under this subpart exceeds the limitation imposed by section 26(a) for such taxable year reduced by the sum of the credits allowable under this subpart (other than this section and section 25D), such excess shall be carried to the succeeding taxable year and added to the credit allowable under subsection (a) for such succeeding taxable year.</text></paragraph> <paragraph id="H00757EBDB5B64D908F51F4476D4752BB"><enum>(2)</enum><header>Limitation</header><text>No credit may be carried forward under this subsection to any taxable year after the 5th taxable year after the taxable year in which the credit arose. For purposes of the preceding sentence, credits shall be treated as used on a first-in, first-out basis.</text></paragraph></subsection>
<subsection id="HE452E669453D44278A2295E158113FFC"><enum>(d)</enum><header>Qualified infertility treatment expenses</header><text>For purposes of this section—</text> <paragraph id="H19CB35AD74B14E7BA1C9592D6005D9C2"><enum>(1)</enum><header>In general</header><text>The term <term>qualified infertility treatment expenses</term> means amounts paid or incurred for the treatment of infertility if such treatment is provided—</text>
<subparagraph id="H5C8918113555471A965761E7DFC4BE95"><enum>(A)</enum><text display-inline="yes-display-inline">by a physician, or other medical practitioner, licensed in the United States, and</text></subparagraph> <subparagraph id="H0B192956783C49FAAC01444599431155"><enum>(B)</enum><text>pursuant to a diagnosis of infertility by a physician licensed in the United States.</text></subparagraph></paragraph>
<paragraph id="HC08776E3D60748DEA24D99738D00A97A"><enum>(2)</enum><header>Treatments in advance of infertility arising from medical treatments</header><text>For purposes of this section:</text> <subparagraph id="H985DB1BAEAA0464881CBB24EE03DF728"><enum>(A)</enum><header>In general</header><text>In the case of expenses incurred in advance of a diagnosis of infertility for fertility preservation procedures which are conducted prior to medical procedures that, as determined by a physician licensed in the United States, may cause involuntary infertility or sterilization, such expenses shall be treated as qualified infertility treatment expenses—</text>
<clause id="H2B1A7D6FE1F9450499908CF8659CEF34"><enum>(i)</enum><text>notwithstanding paragraph (1)(B), and</text></clause> <clause id="H0A87918CAA1F4D8F94544C82B0A93340"><enum>(ii)</enum><text>without regard to whether a diagnosis of infertility subsequently results.</text></clause></subparagraph>
<subparagraph id="H89AD67042E7E4D079F972DC5F8349E64"><enum>(B)</enum><header>Exception for procedures designed to result in infertility</header><text display-inline="yes-display-inline">Expenses for fertility preservation procedures in advance of a procedure designed to result in infertility or sterilization shall not be treated as qualified infertility treatment expenses.</text></subparagraph></paragraph> <paragraph id="H505B0F1C7E68469BA48C45224AFED42B"><enum>(3)</enum><header>Infertility</header><text>The term <term>infertility</term>—</text>
<subparagraph id="H21D4EB547BBD42969B76C0172F59CAF3"><enum>(A)</enum><text>means the inability to conceive or to carry a pregnancy to live birth,</text></subparagraph> <subparagraph id="HB815E3C8A0F24C42989DF56E42F6F4A8"><enum>(B)</enum><text>includes iatrogenic infertility resulting from medical treatments such as chemotherapy, radiation, or surgery, and</text></subparagraph>
<subparagraph id="H28A5C003CB764A13A7A9A8AABA32A04E"><enum>(C)</enum><text>does not include infertility or sterilization resulting from a procedure designed for such purpose.</text></subparagraph></paragraph></subsection> <subsection id="H4B4BFED3ECEC44CE9945B6EF381ECCEB"><enum>(e)</enum><header>Eligible individual</header><text>For purposes of this section, the term <term>eligible individual</term> means an individual—</text>
<paragraph id="HEA8E6508B3334BD699B1B47F90DEA372"><enum>(1)</enum><text>who has been diagnosed with infertility by a physician licensed in the United States, or</text></paragraph> <paragraph id="HB6266447D9F045DC84A95AEF9425A56B"><enum>(2)</enum><text>with respect to whom a physician licensed in the United States has made the determination described in subsection (d)(2)(A).</text></paragraph></subsection>
<subsection id="H8EE117581CF94DE2B7B12726E4AD1196"><enum>(f)</enum><header>Married couples must file joint returns</header><text>Rules similar to the rules of paragraphs (2), (3), and (4) of section 21(e) shall apply for purposes of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2AD072592A024F8CA3F1F7C80A1A1AAA"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="HAFEE7FAF2082438F84EBE5FC6DE1B51C"><enum>(1)</enum><text>The table of sections for subpart A of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before the item relating to section 24 the following new item:</text>

<paragraph id="HD3E4D80C896C486F85BB4AE090BE7B42"><enum>(2)</enum><text>Section 23(c)(1) of such Code is amended by striking <quote>section 25D</quote> and inserting <quote>sections 23A and 25D</quote>.</text></paragraph> <paragraph id="H6A239099EDE841FAA25D63DC155AD220"><enum>(3)</enum><text>Section 25(e)(1)(C) of such Code is amended by inserting <quote>, 23A,</quote> after <quote>23</quote>.</text></paragraph></subsection>
<subsection id="HD3AAF37260604AF98F931B962AF6D4E0"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2024.</text></subsection></section> </legis-body></bill>
