<official-title display="yes">To amend title 5, United States Code, to enhance the authority under which Federal agencies may pay cash awards to employees for making cost saving and improper payment disclosures, and for other purposes.</official-title>

<section id="H30B17F3D150C46FA9535726A64B3D341" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bonuses for Cost-Cutters and Fraud Preventers Act of 2026</short-title></quote>.</text></section> <section id="H998893ACD4E545209016001F07B539AD"><enum>2.</enum><header>Cost savings enhancements</header> <subsection id="H689A0DDD305946D1B665EA486BE0C4D3"><enum>(a)</enum><header>Definitions</header><text>Section 4511 of title 5, United States Code, is amended—</text> 
<paragraph id="HB1CA39197C50480995CCD0848795563D"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Definition</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Definitions</header-in-text></quote>; and</text></paragraph> <paragraph id="H7E05E1298CE34953BF048B2F42A09A6F"><enum>(2)</enum><text>in subsection (a)—</text> 
<subparagraph id="H65B8D4B71B5E4458A154FFD7598BCA99"><enum>(A)</enum><text>by striking the period at the end and inserting a semicolon;</text></subparagraph> <subparagraph id="H528FB48606644861B07986E43EBA3B3E"><enum>(B)</enum><text>by striking <quote>this subchapter, the term</quote> and inserting the following: “this subchapter—</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HF64B040E7AB9417D9EB104062C174467"> 
<paragraph id="HBFFF3F280FED43CBA62B30D034C54CC9"><enum>(1)</enum><text>the term</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HE63CEEB226ED4F25A9EBF71B25653D0C"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HADD8110CEFC946539EF83244C1B50A3A"> 
<paragraph id="HFC40B57832FA4383B0F942F51493090A"><enum>(2)</enum><text>the terms <quote>improper payment</quote> and <quote>payment</quote> have the meanings given such terms, respectively, in section 3351 of title 31; and</text></paragraph> <paragraph id="HDE9A2DD3CBAE4053AF7333A2C5F7D0D6"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>wasteful expenses</term> means amounts made available for salaries and expenses accounts, operations and maintenance accounts, or other equivalent accounts—</text> 
<subparagraph id="H23E3374C9FDF459F9AD063D9E73E26A7"><enum>(A)</enum><text>that are identified by an employee of the agency under section 4512(a) as wasteful; and</text></subparagraph> <subparagraph id="HE53737A0A46A40308A88F4DC54B48604"><enum>(B)</enum><text>that the Chief Financial Officer of the agency determines are not required for the purpose for which the amounts were made available.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="HABD17C01DFB449F6916450A952EAF9D5"><enum>(b)</enum><header>Authority</header><text>Section 4512 of title 5, United States Code, is amended—</text> <paragraph id="H9547CF24F2614E1B9DEEAAC5971C2896"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by inserting <quote><header-in-text level="section" style="USC">and improper payment</header-in-text></quote> before <quote><header-in-text level="section" style="USC">disclosures</header-in-text></quote>;</text></paragraph> 
<paragraph id="H1F49238C4FCC450AB0BEA7BAE2112BED"><enum>(2)</enum><text>in subsection (a)—</text> <subparagraph id="H03CE6D61686C44F1BC8A3D2034BBF5E8"><enum>(A)</enum><text>by inserting after the first sentence the following: <quote>The head of an agency may pay a cash award to any employee of such agency whose identification of wasteful expenses to the Chief Financial Officer of such agency, through a process determined by the head of such agency, has resulted in cost savings for the agency or prevented a payment that, if made, would be an improper payment resulting in financial loss to the Government.</quote>;</text></subparagraph> 
<subparagraph id="H53ADB6AC22CF4C699894A3C080110274"><enum>(B)</enum><text>in paragraph (1) by striking <quote>$10,000</quote> and inserting <quote>$20,000</quote>;</text></subparagraph> <subparagraph id="H4144B911796B40E18E693F2236DCC3E1"><enum>(C)</enum><text>in paragraph (2)—</text> 
<clause id="H2F87E8DF72A946AEB1BA2B251E51BF94"><enum>(i)</enum><text>by inserting <quote>or prevented improper payments </quote> after <quote>cost savings</quote>;</text></clause> <clause id="H394DFDF41DF24212962EF55453D3DD32"><enum>(ii)</enum><text>by inserting <quote>Chief Financial Officer,</quote> after <quote>Inspector General,</quote>;</text></clause> 
<clause id="H5A74B86B9FAF41EEB1BD6EEB1B052133"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking <quote>subsection (b)</quote> and inserting <quote>subsection (b) or (c), as applicable</quote>; and</text></clause> <clause id="HD4E2C5D3E94D4BFB98544B5F8C7A341F"><enum>(iv)</enum><text>by inserting <quote>or identification</quote> after <quote>disclosure</quote>; and</text></clause></subparagraph> 
<subparagraph id="H701918D3B4F44E97B505C218F7B08B04"><enum>(D)</enum><text>in the matter following paragraph (2)—</text> <clause id="HA7F72024F9FE43BBA9410EECA95DA041"><enum>(i)</enum><text>by inserting <quote>, Chief Financial Officer,</quote> after <quote>Inspector General</quote>;</text></clause> 
<clause id="HFE6F53CA84BB4BF6BC9A15C9DBB2B806"><enum>(ii)</enum><text>by inserting <quote>or prevented improper payments</quote> after <quote>cost savings</quote>; and</text></clause> <clause id="H2E9C56F26AB54022890F8515F7E9CAE9"><enum>(iii)</enum><text>by inserting <quote>or identification</quote> after <quote>disclosure</quote>; and</text></clause></subparagraph></paragraph> 
<paragraph id="HB70214E53B7B404BB5C3977D5ABF6743"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HBC90C3C51E7043C0A84C1CEEEBE74D59"> <subsection id="H7BD7CB3CAD0140EC89EA74F297B24E28"><enum>(c)</enum> <paragraph id="H715C19200D3A475AA570422102E1B7ED" commented="no" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">If the Chief Financial Officer of an agency determines that potential wasteful expenses identified by an employee meet the requirements of section 4511(a)(3)(B), the head of such agency shall notify the President.</text></paragraph> 
<paragraph id="H63C7BB7DFC1E47D08D4B7257CEC23BDD" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Chief Financial Officer of an agency determines that a payment identified by an employee would, if made, be an improper payment resulting in financial loss to the Government, the head of such agency shall notify the Secretary of the Treasury of such payment for purposes of preventing similar improper payments.</text></paragraph> <paragraph id="HF79F7FB4ADB84F699186A3E0D1AFB8EC" indent="up1"><enum>(3)</enum><text>In the case of an agency for which there is no Chief Financial Officer, the head of the agency shall designate an agency employee who shall have the authority to make the determinations for identification of wasteful expenses or prevented improper payments under this section.</text></paragraph></subsection> 
<subsection id="H3657DE9C32154B5499103964A1DAB819" commented="no"><enum>(d)</enum><text display-inline="yes-display-inline">The head of each agency shall make available, along with, and in the same manner and form as, the provision of information required under section 1116 of title 31, information on disclosures of wasteful expenses or prevented improper payments pursuant to which an award was made under this section, including—</text> <paragraph id="HD25AF504B2954FA49998E975C8BB55CF" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">a description of each disclosure of possible wasteful expenses or improper payments identified by an employee and determined by the agency to have merit; and</text></paragraph> 
<paragraph id="H0E91BDC3C366454990678CB15BE0A1F1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the number and amount of cash awards provided by the agency under subsection (a).</text></paragraph></subsection> <subsection id="H5180D2D545B044879788FAA19A92A62B" commented="no"><enum>(e)</enum><text display-inline="yes-display-inline">An individual may not receive a cash award under this subchapter if the individual is—</text> 
<paragraph id="H101809315D224E35A4ADA7FCD6FC8AAB" commented="no"><enum>(1)</enum><text>an officer or employee of the Office of the Inspector General of an agency; or</text></paragraph> <paragraph id="HE76D9342B4584F0CA20175F80D5A66FA" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">ineligible for a cash award under section 4509.</text></paragraph></subsection> 
<subsection id="H7C6F04DF18AA42D5B39D8E0470166F54"><enum>(f)</enum><text display-inline="yes-display-inline">The Director of the Office of Personnel Management, in coordination with the Director of the Office of Management and Budget and the Secretary of the Treasury, shall—</text> <paragraph id="H06DF79DC6F57448E81406FB380B3C878"><enum>(1)</enum><text>ensure that the cash award program of each agency under this section complies with this section; and</text></paragraph> 
<paragraph id="H59CB5689134A4F8C89A5C4E94F8E86BA"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate an annual certification indicating whether the cash award program of each agency under this section complies with this section.</text></paragraph></subsection> <subsection id="H1A39225ADB3949AEB7B7EFDB037D7193"><enum>(g)</enum><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of the <short-title>Bonuses for Cost-Cutters and Fraud Preventers Act of 2026</short-title>, and every 2 years thereafter for 4 years, the Comptroller General of the United States shall submit to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the operation of the cost savings and awards program under this section, including any recommendations for legislative changes.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H3B1014BA62BA42C59034B6256F4150DC"><enum>(c)</enum><header>Office of Management and Budget guidance</header> 
<paragraph id="H7DBEA524253145A09972F0158BCA1A01"><enum>(1)</enum><header>In general</header><text>Not later than six months after the date of the enactment of this Act, the Director of the Office of Management and Budget, in coordination with the Director of the Office of Personnel Management and the Secretary of the Treasury, shall issue guidance to Federal agencies on implementing the amendments made by this Act.</text></paragraph> <paragraph id="H0795ED31768149CF9535409C9035A8F6"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall include in the guidance required by paragraph (1) the following:</text> 
<subparagraph id="H74677C4BD16041AB90D85D3493A80E92"><enum>(A)</enum><text display-inline="yes-display-inline">Guidelines for employees of Federal agencies to identify and report within the agency of such employee a wasteful expense or improper payment.</text></subparagraph> <subparagraph id="H5A6C76B36FC243AAB16123C146F47B45"><enum>(B)</enum><text>Guidelines for Federal agencies to make a determination as to whether an identification of a wasteful expense or improper payment is appropriate.</text></subparagraph> 
<subparagraph id="HF51F9D8109564245A7C816AFB0F463F5"><enum>(C)</enum><text>Guidelines for determining an appropriate cash award for an employee of a Federal agency who identifies and reports a wasteful expense or improper payment, including any considerations for such employee’s grade, locality pay, and other considerations that may factor into the aggregate compensation limit applicable to such employee in a given calendar year.</text></subparagraph> <subparagraph id="HAFBCFE2E1B1645038623D48AB0D6A30F"><enum>(D)</enum><text>Procedures for reporting actions taken under the amendments made by this Act to the Office of Management and Budget, the Department of the Treasury, and the Office of Personnel Management, as appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="HF2340674D15A4E218EF127E1886C9189"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date that is one year after the date of the enactment of this Act.</text></subsection> <subsection id="H9DF1D72EE3464D43949EB9B00D35D158"><enum>(e)</enum><header>Technical and conforming amendment</header><text>The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H9FE14210329D4B32A5DAF6A3EAFE5F69"><enum>(1)</enum><text>by striking the item relating to section 4511 and inserting the following:</text> <quoted-block style="USC" id="HF134CF79EAC342E4B0D38BFDA7CBFE1C"> <toc> <toc-entry level="section">4511. Definitions and general provisions.</toc-entry></toc><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HC4853348DCA541229A85D94B82FEEDD2"><enum>(2)</enum><text>by striking the item relating to section 4512 and inserting the following:</text>
