R. 4284</legis-num><current-chamber display="yes">IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260317">March 17, 2026</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Small Tract Act of 1983 to authorize the Secretary of Agriculture to convey, without consideration, certain cemeteries, and for other purposes.</official-title></form><legis-body id="HB4E073E28628481AA522B78B39F7D840" style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="HCD9B33F88F1044008686D8CECC97B164" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Cemetery Conveyance Act</short-title></quote>.</text></section><section id="HE99D6087D5BD4E39AAA57844E146C84A"><enum>2.</enum><header>Conveyances of certain cemeteries</header><subsection id="H98F016C89F0B40818E5724FAAD64EE42"><enum>(a)</enum><header>Amendments to Small Tract Act of 1983</header><text display-inline="yes-display-inline">The Small Tract Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/521c">16 U.S.C. 521c et seq.</external-xref>) is amended—</text><paragraph id="H2895580579604CF2B2FB70A25F1F4F97"><enum>(1)</enum><text>in section 2(a)—</text><subparagraph id="H1F9B6404F8F9469CB81A9FFB8CE75189"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HE7BBACD235204366B02EC68E340D57BC"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H075EF170869A4EA189BF753DEBCE606A"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="HF3921DFE1CDF4B9E8F452225BC99156A" style="OLC"><paragraph id="HC53922EDDFBE457682FB69B539E90BF4"><enum>(3)</enum><text>to convey, without consideration, certain parcels used, or previously used, as cemeteries in accordance with section 9.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H31B10E28775B4517A27F2CA5BCD20FEC"><enum>(2)</enum><text>in section 3(6), by striking <quote>a cemetery (including a parcel of not more than 1 acre adjacent to the parcel used as a cemetery), a landfill, or</quote> and inserting <quote>a landfill or</quote>; and</text></paragraph><paragraph id="H1DC7FA384459422DB6C5DEBC7DEECF53"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H56A608EC61794246A69A639972B30873" style="OLC"><section id="H63E6347733D644BC89210792585F28AA"><enum>9.</enum><header>Conveyances of certain cemeteries</header><subsection id="HB1C7DAFFDE6840B79EF2E45D48E234ED"><enum>(a)</enum><header>In general</header><text>The Secretary may convey, without consideration, to a qualified person any parcel of land used, or previously used, as a cemetery (including a parcel of not more than 1 acre adjacent to the parcel used as a cemetery).</text></subsection><subsection id="H069FC2DB5A0B4B6C98CADEC4CC936349"><enum>(b)</enum><header>Condition of conveyance</header><text>A conveyance under subsection (a) shall be subject to the condition that the property conveyed under that subsection may only be used for the purpose of operating a cemetery.</text></subsection><subsection id="HAAF10E541F7A46F09B0D4C73B31485E3"><enum>(c)</enum><header>Reversion</header><text>If the Secretary determines that at any time a parcel conveyed under subsection (a) is used for a purpose other than the purpose required under subsection (b), all right, title, and interest in and to the parcel conveyed pursuant to such subsection, including any improvements thereon, shall, at the discretion of the Secretary, revert to the United States.</text></subsection><subsection id="H812B959B6EFC4BCC8804151AF78D9386"><enum>(d)</enum><header>Waiver of conveyance costs</header><paragraph id="H4A26FFE1493544B8A7B7B1718F6574A6"><enum>(1)</enum><header>Exception available</header><text>The Secretary may waive the application of any requirement under section 4 to a conveyance to a qualified person under this section if the Secretary determines that such a waiver is appropriate based upon the demonstrated need of the qualified person.</text></paragraph><paragraph id="H72F1727931AA4027A8F2CE298F08E9E2"><enum>(2)</enum><header>Clarification of authority</header><text>The waiver authority under paragraph (1) shall be in addition to the authority available to the Secretary pursuant to the last sentence of section 4.</text></paragraph></subsection><subsection id="H0367D4062BAD4F8F9BB5C7DA4BB4E237"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H49BB7089AEB94A59BA6864D78189F69F"><enum>(1)</enum><header>Cemetery</header><text>The term <term>cemetery</term> means a natural or prepared physical location (regardless of location below, on, or above the surface of the earth) into which human remains are deposited—</text><subparagraph id="HE9BDBC83396C44CFB91DE0472055878C"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H2CC5367E204A43C6A97674B63FB434D5"><enum>(i)</enum><text>as part of—</text><subclause id="HDF91F90C023A48839BEF070BC691AA4B" indent="up1"><enum>(I)</enum><text>a death rite or ceremony of a culture; or</text></subclause><subclause id="HD69A09F5FB1B4D27B9E68F6E781A7EEF" indent="up1"><enum>(II)</enum><text>a common burying ground of a community; or</text></subclause></clause><clause id="H02C71DE1272D42CB8F5FAA62E2ABDC91" indent="up1"><enum>(ii)</enum><text>that is determined to be a cemetery by an Indian Tribe; and</text></clause></subparagraph><subparagraph id="HA0AC47CF141A44D085CF6842D67288CA"><enum>(B)</enum><text>that, as determined by the Secretary, is a parcel of land less than or equal to 40 acres.</text></subparagraph></paragraph><paragraph id="H0A2ACFBD80E540E4B5A17DA05BD826EB"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means the governing body of any individually identified and federally recognized Indian or Alaska Native tribe, band, nation, pueblo, village, community, affiliated Tribal group, or component reservation included on the most recent list published pursuant to section 104(a) of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131(a)</external-xref>).</text></paragraph><paragraph id="H999C0AD3AFB64B00BD23C5DE8698C4CE"><enum>(3)</enum><header>Qualified land grant-merced</header><text>The term <term>qualified land grant-merced</term> means a community land grant issued under the laws or customs of the Government of Spain or Mexico that—</text><subparagraph id="HF0C1A2FAC0174A3E96F98CB75B2F1812"><enum>(A)</enum><text>is recognized under New Mexico Statutes Chapter 49, Articles 1 and 4 (or a successor statute); and</text></subparagraph><subparagraph id="HE19914BE7AA94F359D4D8C30B208BAFC"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H19E31A557D8F45719473DC4AF0E39165"><enum>(i)</enum><text>has a record of historical or traditional use on Federal land under the jurisdiction of the Secretary; or</text></clause><clause id="HFBD284E48BFB4A66A019CABA53E49794"><enum>(ii)</enum><text>has a patented exterior boundary that is or was previously located on or adjacent to Federal land under the jurisdiction of the Secretary.</text></clause></subparagraph></paragraph><paragraph id="H39F3E7C17C7F438A9DDD008A6ECD0B50"><enum>(4)</enum><header>Qualified person</header><text>The term <term>qualified person</term> means, with respect to a cemetery, a State or local government, Indian Tribe, or qualified land grant-merced that has a bona fide interest or historic claim to the cemetery.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7DC5CEBF561A42CBB56D28EBF5115D6B"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section or an amendment made by this section may be construed to modify, waive, or otherwise affect the application<pagebreak></pagebreak> of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>).</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20260316" chamber="House">Passed the House of Representatives March 16, 2026.</attestation-date><attestor display="yes">Kevin F.
