Protection Agency to publish, concurrently with any final rule establishing or revising a national ambient air quality standard, regulations and guidance for implementing the standard, including information relating to submission and consideration of a preconstruction permit application under the new or revised standard, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H5E8CD10DA639483BA7B7D1F8AE82E4C8" style="OLC"><section id="H8959D801BAD84B2490BE18FD0AF8897F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Air and Building Infrastructure Improvement Act</short-title></quote>.</text></section><section id="H5ED8DE4AAFC54A518F5AD8FED064C715"><enum>2.</enum><header>Preconstruction permits</header><text display-inline="no-display-inline">Section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H58955CBDF9254BCA8EF3F4C916A4E30C" style="OLC"><subsection id="HB44F46904B924484BC1DB3BB520938EB"><enum>(e)</enum><header>Timely issuance of implementing regulations and guidance</header><paragraph id="H9B5586F15D204608ADC2AFA85F5B43A6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In publishing any final rule establishing or revising a national ambient air quality standard, the Administrator shall, to assist States, permitting authorities, and permit applicants, concurrently publish final regulations and guidance for implementing the standard, including information relating to submission and consideration of a preconstruction permit application under the new or revised standard.</text></paragraph><paragraph id="H4D577AAA7AED493AA6B2D87219D6CB58"><enum>(2)</enum><header>Applicability of Standard to Preconstruction Permitting</header><text display-inline="yes-display-inline">If the Administrator fails to publish final regulations and guidance under paragraph (1) that include information relating to submission and consideration of a preconstruction permit application under a new or revised national ambient air quality standard concurrently with such standard, then such standard shall not apply to the review and disposition of a preconstruction permit application until the Administrator has published such final regulations and guidance.</text></paragraph><paragraph id="HEC9F1690C62845D99590935CAD27E64F"><enum>(3)</enum><header>Rules of Construction</header><subparagraph id="HC4303EC367BB4A1C97FE07C2148BFC92"><enum>(A)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to preclude the Administrator from issuing regulations and guidance to assist States, permitting authorities, and permit applicants in implementing a national ambient air quality standard subsequent to publishing regulations and guidance for such standard under paragraph (1).</text></subparagraph><subparagraph id="HE5243EE609D04026967169C0B335B27D"><enum>(B)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to eliminate the obligation of a preconstruction permit applicant to install best available control technology and lowest achievable emission rate technology, as applicable.</text></subparagraph><subparagraph id="H12F7C717F552478E9D0CE48D46FDAD42"><enum>(C)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to limit the authority of a State, local, or Tribal permitting authority to impose more stringent emissions requirements pursuant to State, local, or Tribal law than national ambient air quality standards.</text></subparagraph></paragraph><paragraph id="H9572E86CDF0649339C93B4650F469E16"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HB3C8D28AE00D4BF4842FF729249ACA94"><enum>(A)</enum><text>The term <term>best available control technology</term> has the meaning given to that term in section 169(3).</text></subparagraph><subparagraph id="HCA1538E841AD40B59524EC735E489FF8"><enum>(B)</enum><text>The term <term>lowest achievable emission rate</term> has the meaning given to that term in section 171(3).</text></subparagraph><subparagraph id="HA178902F663D4846B3AE48C017DD77C8"><enum>(C)</enum><text>The term <term>preconstruction permit</term>—</text><clause id="H6DAA6CF3736448058632EEE09F74AC4D"><enum>(i)</enum><text display-inline="yes-display-inline">means a permit that is required under this title for the construction or modification of a stationary source; and</text></clause><clause id="H2DE7085A1D7D4F52ACA408E8A9A5FF78"><enum>(ii)</enum><text>includes any such permit issued by the Environmental Protection Agency or a State, local, or Tribal permitting authority.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HCCF1354D12F3407394A27CA083C2EBF0"><enum>3.</enum><header>Certain preconstruction permits</header><subsection id="H683411DC1B3E4AF7B047B0B4D0600377"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The 2024 Primary Annual Particulate Matter<subscript>2.5</subscript> Standard shall not apply to the review and disposition of a preconstruction permit application if—</text><paragraph id="H9AF9FB0F6E4C488A81EA98808B56F7B7"><enum>(1)</enum><text display-inline="yes-display-inline">the Administrator or the State, local, or Tribal permitting authority, as applicable, determines the application to be complete on or before the date of promulgation of the final designation of the area involved under section 107(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7407">42 U.S.C. 7407(d)</external-xref>) with respect to the 2024 Primary Annual Particulate Matter<subscript>2.5</subscript> Standard; or</text></paragraph><paragraph id="HFBA3E483DD5F4AB68B61D41631E68EAF"><enum>(2)</enum><text display-inline="yes-display-inline">the Administrator or the State, local, or Tribal permitting authority, as applicable, publishes a public notice of a preliminary determination or draft permit for the application before the date that is 60 days after the date of promulgation of the final designation of the area involved under section 107(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7407">42 U.S.C. 7407(d)</external-xref>) with respect to the 2024 Primary Annual Particulate Matter<subscript>2.5</subscript> Standard.</text></paragraph></subsection><subsection id="HB9EBB06B48EF4F1F8F1F2F09C0787A5C"><enum>(b)</enum><header>Rules of construction</header><text>Nothing in this section shall be construed to—</text><paragraph id="H7A6EB94E926F465B90EB4956253024AA"><enum>(1)</enum><text>eliminate the obligation of a preconstruction permit applicant to install best available control technology and lowest achievable emission rate technology, as applicable; or</text></paragraph><paragraph id="H3C8D99F91B604FD28DE0BA40C4B5D36A"><enum>(2)</enum><text>limit the authority of a State, local, or Tribal permitting authority to impose more stringent emissions requirements pursuant to State, local, or Tribal law than national ambient air quality standards.</text></paragraph></subsection><subsection id="H212231B8C29140DF803069D9F3EA9ED4"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H74FCC60C32F345CBA62A078B5D7506A4"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="H5DB800F2EB3243239DC2B981392F7422"><enum>(2)</enum><header>Best available control technology</header><text display-inline="yes-display-inline">The term <term>best available control technology</term> has the meaning given to that term in section 169(3) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7479">42 U.S.C. 7479(3)</external-xref>).</text></paragraph><paragraph id="HC145A27094034FB6BDCFBDACD336732D"><enum>(3)</enum><header>Lowest achievable emission rate</header><text display-inline="yes-display-inline">The term <term>lowest achievable emission rate</term> has the meaning given to that term in section 171(3) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7501">42 U.S.C. 7501(3)</external-xref>).</text></paragraph><paragraph id="H9572A9E4464A4BD9A945E04D5B5CBC79" commented="no"><enum>(4)</enum><header>National ambient air quality standard</header><text>The term <term>national ambient air quality standard</term> means a national ambient air quality standard promulgated under section 109 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7409">42 U.S.C. 7409</external-xref>).</text></paragraph><paragraph id="HB9932AC9EBA14E40BAF23823575E3A45"><enum>(5)</enum><header>Preconstruction permit</header><text display-inline="yes-display-inline">The term <term>preconstruction permit</term>—</text><subparagraph id="H432DF37DEF9F4E80A11580BC795263EB"><enum>(A)</enum><text>means a permit that is required under title I of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) for the construction or modification of a stationary source; and</text></subparagraph><subparagraph id="HC3E99B85AC384560BE6E03B2EA752A16"><enum>(B)</enum><text>includes any such permit issued by the Environmental Protection Agency or a State, local, or Tribal permitting authority.</text></subparagraph></paragraph><paragraph id="H0B20597517DB4A5CA3E453497F4F7347"><enum>(6)</enum><header>2024 Primary Annual Particulate Matter<subscript>2.5</subscript> Standard</header><text display-inline="yes-display-inline">The term <term>2024 Primary Annual Particulate Matter<subscript>2.5</subscript> Standard</term> means the final rule titled <quote>Reconsideration of the National Ambient Air Quality Standards for Particulate Matter</quote> published in the Federal Register on March 6, 2024 (89 Fed. Reg. 16202).</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date>April 28, 2026</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
