Technical amendments.</toc-entry></toc></section><section id="H54D465AC42F64FC1B7BECC49B3CBB25A"><enum>3.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 46108 of title 46, United States Code, is amended by striking <quote>$32,869,000 for fiscal year 2022, $38,260,000 for fiscal year 2023, $43,720,000 for fiscal year 2024, and $49,200,000 for fiscal year 2025</quote> and inserting <quote>$49,200,000 for fiscal year 2026, $51,660,000 for fiscal year 2027, $54,243,000 for fiscal year 2028, and $57,016,000 for fiscal year 2029</quote>.</text></section><section id="H2F56998E632A45768B8EE6A4A54D5725"><enum>4.</enum><header>Purposes</header><text display-inline="no-display-inline">Section 40101 of title 46, United States Code, is amended—</text><paragraph id="H39DDF6FBA7934A65A05BA49B6ED73525"><enum>(1)</enum><text>in paragraph (2) by striking <quote>in the ocean commerce of the United States</quote> and inserting <quote>for the common carriage of goods by water in the foreign commerce of the United States</quote>; and</text></paragraph><paragraph id="H85249C95A67347F9BA8E69BCFE0BF14A"><enum>(2)</enum><text>in paragraph (4) by striking <quote>promote</quote> and inserting <quote>support</quote>.</text></paragraph></section><section id="H1808D24D6E654E03BE3FFBCF2C878E97"><enum>5.</enum><header>Definitions</header><subsection id="H1D00D70D0FEF42C0AD9363045C6D7412"><enum>(a)</enum><header>In general</header><text>Section 40102(9) of title 46, United States Code, is amended—</text><paragraph id="H434BA5AC5C8F49058B5F49E3DD73D9AD"><enum>(1)</enum><text>in subparagraph (B) by striking the period and inserting <quote>; or</quote>;</text></paragraph><paragraph id="HD9FCD5EBEEA14FF6A5CEB26593B9A373"><enum>(2)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and by adjusting the margins accordingly;</text></paragraph><paragraph id="HCA424A6B72C34EC087C9909413CA622F"><enum>(3)</enum><text>by striking <quote>means an ocean common carrier</quote> and inserting the following:</text><quoted-block style="USC" id="H15CE0DCD6DE84373877305D3B5C8FA14" display-inline="yes-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><text>means—</text><subparagraph id="HA7C35A4DD8AC4F06B5B88DCF40FB0984"><enum>(A)</enum><text>an ocean common carrier</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="HE71A82C457F949CEB597612A636E014D"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="USC" id="HFA3AF101996B41628852C895F0D9FA48" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subparagraph id="HC827C15438174508943F743459D43839"><enum>(B)</enum><text>such a carrier that is owned or controlled by, a subsidiary of, or otherwise related legally or financially (other than a minority relationship or investment) to a corporation based in, headquartered in, or otherwise significantly linked to a country—</text><clause id="H3DB32429D2A2455AA412F14AF5ED6B4A"><enum>(i)</enum><text>identified as a nonmarket economy country (as defined in section 771(18) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1677">19 U.S.C. 1677(18)</external-xref>)) as of the date of enactment of the <short-title>Federal Maritime Commission Reauthorization Act of 2025</short-title>;</text></clause><clause id="HABF8C972E9004BB5B7DFE13C8F8DE115"><enum>(ii)</enum><text>identified by the United States Trade Representative on the priority watch list included in the most recent report required by section 182 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242</external-xref>) as a priority foreign country under subsection (a)(2) of that section; or</text></clause><clause id="HE4910DDE0C4B4A238F4A6FD7839321E2"><enum>(iii)</enum><text>subject to monitoring by the United States Trade Representative under section 306 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2416">19 U.S.C. 2416</external-xref>).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAA33E924D8C843A4988986E9120D6A89"><enum>(b)</enum><header>Conforming amendment</header><text>Section 46106(b)(7) of title 46, United States Code, is amended by striking <quote>ocean common carriers, particularly such carriers that are controlled carriers</quote> and all that follows through the period at the end and inserting <quote>controlled carriers;</quote>.</text></subsection></section><section id="HB5BF0DDF91ED44999B6A58AF6C26F60B"><enum>6.</enum><header>Complaints against shipping exchanges</header><subsection id="H1E38D8ACCB11461FAADA6E1EC3BE606B"><enum>(a)</enum><header>In general</header><text>Section 40504(c) of title 46, United States Code, is amended—</text><paragraph id="H67322C684973493DA03AB48312950D55"><enum>(1)</enum><text>in the subsection heading by inserting <quote><header-in-text level="subsection" style="USC">and investigation</header-in-text></quote> after <quote><header-in-text level="subsection" style="USC">Exemption</header-in-text></quote>;</text></paragraph><paragraph id="H749118F3F2104FEDB988263A2B24396D"><enum>(2)</enum><text>by striking the period at the end and inserting <quote>; and</quote>;</text></paragraph><paragraph id="HE1FB8D5B294B4BBAA9CA62D900FF79EC"><enum>(3)</enum><text>by striking <quote>may exempt</quote> and inserting the following:</text><quoted-block style="USC" id="H27E614D4EE52492B80C9978EF792BB70" display-inline="yes-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><text>may—</text><paragraph id="H00DD31B086844F51B84CD8CB783BCDBB"><enum>(1)</enum><text>exempt</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H51B8DD2D77214C68A6AFA6CBB265F608"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H9C02A399175A4C69831A0ED80FCC6260" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H7626AFFCE7B3425FA4B17C997F876E4A"><enum>(2)</enum><text display-inline="yes-display-inline">investigate complaints submitted under section 40505.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H04FBC1F62A0F4056B2C82DD428040D66"><enum>(b)</enum><header>Complaints against shipping exchanges</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/405">Chapter 405</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H21907A81CAD34DF3AF83FAB0336B0FD0" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><section id="H061A8DEEB74B4532A0B0E5C681166817"><enum>40505.</enum><header>Complaints against shipping exchanges</header><subsection id="H08CE6FEAE72140FC98E060B86879B5F6"><enum>(a)</enum><header>In general</header><text>A person may submit to the Federal Maritime Commission, and the Commission shall accept, information concerning alleged incidents of market manipulation or other anticompetitive practices by shipping exchanges registered under section 40504.</text></subsection><subsection id="HFF69DF628C1B4B508CFE00902BF48510"><enum>(b)</enum><header>Investigation</header><text>Upon receipt of a submission of information under subsection (a), the Commission shall promptly investigate the accuracy of such information.</text></subsection><subsection id="H87DD208E84FC4FDDA3FC2E2D32C2CEE4"><enum>(c)</enum><header>Report to Congress</header><text>The Commission shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate the results of any investigation in which the Commission finds incidents of market manipulation or anticompetitive practices by shipping exchanges registered under section 40504.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H26F1183C947D4D729800ECEA9DCD88FA"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/405">chapter 405</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block id="H821F7BF51CD64B70A004F7667BA27A89" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><toc regeneration="no-regeneration" changed="added" reported-display-style="italic" committee-id="HPW00"><toc-entry level="section">40505. Complaints against shipping exchanges.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H6563E71CC01D4366A65E28FE2C7C2460"><enum>7.</enum><header>Shipping exchange registry</header><text display-inline="no-display-inline">Section 40504(d) of title 46, United States Code, is amended—</text><paragraph id="HA6DB7710396B431E96B8C1C5409E84A7"><enum>(1)</enum><text>by striking <quote>3 years after the date of enactment of the Ocean Shipping Reform Act of 2022</quote> and inserting <quote>2 years after the date of enactment of the Federal Maritime Commission Reauthorization Act of 2025</quote>;</text></paragraph><paragraph id="H9F75B1AA306541DEADBD61C26D2F7B17"><enum>(2)</enum><text>by striking <quote>set standards necessary to carry out</quote> and inserting <quote>ensure consistency with</quote>; and</text></paragraph><paragraph id="HCE476D8576074E8F9C88E2D2BDB59AE3"><enum>(3)</enum><text>by striking <quote>by</quote> and inserting <quote>via</quote>.</text></paragraph></section><section id="HC598E7AC98C743B1AEEB9904EFD7E1CB"><enum>8.</enum><header>Repeal</header><subsection id="H71276B2F29544822A895D16928334B8C"><enum>(a)</enum><header>In general</header><text>Section 40706 of title 46, United States Code, is repealed.</text></subsection><subsection id="H5B76A3D2BE0941888254C8DEA21B214D"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/407">chapter 407</external-xref> of title 46, United States Code, is amended by striking the item relating to section 40706.</text></subsection></section><section id="H818D600C52724E96895344E19C1AE223"><enum>9.</enum><header>Data collection</header><text display-inline="no-display-inline">Section 41110 of title 46, United States Code, is amended—</text><paragraph id="H2EAB6851C0BC42C9BB20D3743017C2AF"><enum>(1)</enum><text>by striking <quote>The Federal Maritime Commission</quote> and inserting the following:</text><quoted-block style="USC" id="HD43347C03C4D4509B9A0C2B2A13C2C01" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H275184B6CDEB4D3882BBB9548499E31B"><enum>(a)</enum><header>Quarterly report</header><text display-inline="yes-display-inline">The Federal Maritime Commission</text></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="HA5B54A6405454FA49D740E75812D16BC"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HC11BB2D5289145618598CCD739C11182" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="HB89D64B778FA49BAA28B938A6CA83B0F"><enum>(b)</enum><header>Limitation on duplication</header><text>Unless the data described in paragraphs (1) and (2) is not available in a timely manner or in a form that allows the Commission to meet the requirements of subsection (a), data required to be reported under subsection (a) may not duplicate information submitted—</text><paragraph id="H0A41DDC671C44FCC81212B1E4A0163A5"><enum>(1)</enum><text>to the Corps of Engineers pursuant to section 11 of the Act entitled <quote>An Act authorizing the construction, repair, and preservation of certain public works on rivers and harbors, and for other purposes</quote>, approved September 22, 1922 (<external-xref legal-doc="usc" parsable-cite="usc/33/555">33 U.S.C. 555</external-xref>), by an ocean common carrier acting as a vessel operator;</text></paragraph><paragraph id="H1A318F7D4F6542BCAF02120BC45673E2"><enum>(2)</enum><text>pursuant to section 481 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1481">19 U.S.C. 1481</external-xref>) to U.S. Customs and Border Protection by merchandise importers; or</text></paragraph><paragraph id="HE38F7F0512C7494DBA7F0112D4C110DD"><enum>(3)</enum><text>to the Department of Commerce pursuant to section 301 of title 13.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H6F0BEBABDF82494C96404B30B43419D1"><enum>10.</enum><header>Investigations</header><text display-inline="no-display-inline">Section 41302 of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block id="H94CE9C84721D48E49D14C0AB45490D38" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H64C934F490EF4A35BE8648C10E6AB7BB"><enum>(f)</enum><header>Nondisclosure</header><text>Information and documents developed by the Federal Maritime Commission under this section shall not be disclosed unless the Commission determines by majority vote of the Commission that such information and documents are relevant to an administrative or judicial proceeding and agrees by a majority vote to disclose such information and documents.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H649788EFC7C844CA96D10FDFA95372F6"><enum>11.</enum><header>National advisory committees</header><subsection id="H434E92BBA1584D87BB3C7B1982A5F78A"><enum>(a)</enum><header>National shipper advisory committee</header><text>Section 42502 of title 46, United States Code, is amended—</text><paragraph id="HB5CF17F6131E4B7C96C1F3EA60B15CDF"><enum>(1)</enum><text>in subsection (a) by striking <quote>Committee.</quote> and inserting <quote>Committee (in this section referred to as the <quote>Shipper Committee</quote>).</quote>;</text></paragraph><paragraph id="HBB44A3E16ADC4348ACEE109F1254EA54"><enum>(2)</enum><text>by striking subsection (b);</text></paragraph><paragraph id="HDA3F5AB7FE5847AFAAF712B0EC89ED12"><enum>(3)</enum><text>by redesignating subsection (c) as subsection (b);
