<section id="HD702E09E1C25451BBBF2079D38726BAB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tren de Aragua Border Security Threat Assessment Act</short-title></quote>.</text></section> <section id="H58E65CA0949A4976B81891C388982244"><enum>2.</enum><header>Homeland security border threat assessment on Tren de Aragua; strategic plan</header> <subsection id="H06BC8C113E12438CB399ED490F16B349"><enum>(a)</enum><header>Threat assessment</header> <paragraph id="H9BDE48CA0846454481139DF7F40E30EC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security, in consultation with the intelligence community and the heads of other relevant Federal departments or agencies as the Secretary determines appropriate, shall submit to the appropriate congressional committees a border threat assessment regarding Tren de Aragua (in this section referred to as the <quote>threat assessment</quote>).</text></paragraph> 
<paragraph id="H860DF0D34AEA4BE3B831E12919A3A45F"><enum>(2)</enum><header>Elements</header><text>The threat assessment shall include the following:</text> <subparagraph id="HFE24ECDBE1ED497C8EFD65F209107E1A"><enum>(A)</enum><text>An identification of current and potential criminal threats posed by members of Tren de Aragua and affiliates seeking to—</text> 
<clause id="HEB077F93DE2A4F2890C7A8D9178AE92E"><enum>(i)</enum><text display-inline="yes-display-inline">unlawfully enter the United States through the southwest, northern, or maritime border; or</text></clause> <clause id="H8B6707B74BB346B28A65BC4040BC6575"><enum>(ii)</enum><text display-inline="yes-display-inline">exploit any security vulnerabilities along the southwest, northern, or maritime border.</text></clause></subparagraph> 
<subparagraph id="H127190DC11144A66821E0FF9C1467066"><enum>(B)</enum><text>Descriptions of the following with respect to Tren de Aragua:</text> <clause id="H83EF40A48C654AE4919EC8FE29DB235D"><enum>(i)</enum><text>Origins.</text></clause> 
<clause id="H0D253E7ADE80497EBAF6BEE0D2699B05"><enum>(ii)</enum><text>Strategic aims.</text></clause> <clause id="HE1913AAFE1784863966924FA62D4337F"><enum>(iii)</enum><text>Tactical methods.</text></clause> 
<clause id="H225A187374704D0AA23E2607FF940B2D"><enum>(iv)</enum><text>Funding sources.</text></clause> <clause id="HED02830C14AC4300A842D3CDCC98B000"><enum>(v)</enum><text>Leadership structure.</text></clause> 
<clause id="H147C2DE6D7DA412AB84553DAC370EFDB"><enum>(vi)</enum><text>Chronological growth and presence in the United States.</text></clause></subparagraph> <subparagraph id="H601DEFF8101F4BB3A8E1972205319A60"><enum>(C)</enum><text>Any other matters the Secretary of Homeland Security considers appropriate.</text></subparagraph></paragraph> 
<paragraph id="HD8748A1374AB49D4895568CE425D9EB4"><enum>(3)</enum><header>Form</header><text>The threat assessment shall be submitted in unclassified form, but may include a classified annex.</text></paragraph></subsection> <subsection id="H3161AF8483E94A619589468EE7C0CB39"><enum>(b)</enum><header>Strategic plan</header> <paragraph id="H3B6E01F4270C48A8B47CFC16C3479FEF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the submission of the threat assessment under subsection (a), the Secretary of Homeland Security, in consultation with the heads of other relevant Federal departments or agencies as the Secretary determines appropriate, shall submit to the appropriate congressional committees a strategic plan (in this subsection referred to as the <quote>Strategic Plan</quote>) relating to countering the threats identified in the threat assessment, in accordance with paragraph (2).</text></paragraph> 
<paragraph id="H509B902E5A224A70BD9045D765B73793"><enum>(2)</enum><header>Contents</header><text>The Strategic Plan shall include, at a minimum, a consideration of the following:</text> <subparagraph id="H528CBF1FD5BD42759054D553E4A5F43C"><enum>(A)</enum><text display-inline="yes-display-inline">The threat assessment, with an emphasis on efforts to mitigate the criminal threats from transnational criminal organizations, including the threats identified in the threat assessment in accordance with subsection (a)(2)(A).</text></subparagraph> 
<subparagraph id="H2C5289E7CFF3407283154C73E30C27D3"><enum>(B)</enum><text>Efforts to analyze and disseminate border security and border threat information between Department of Homeland Security border security components with the following:</text> <clause id="H81AD7AB5DFA14A8280FAE94BAA5D296F" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">Other appropriate Federal departments and agencies with missions associated with the southwest, northern, or maritime border.</text></clause> 
<clause id="H5190E9A5058C48DE8A1934CE2E959471"><enum>(ii)</enum><text display-inline="yes-display-inline">State, local, Tribal, and territorial law enforcement agencies with jurisdictions adjacent to the southwest, northern, or maritime border.</text></clause></subparagraph> <subparagraph id="H56E0F5605F1D4465AEC359AF4C1C4345"><enum>(C)</enum><text display-inline="yes-display-inline">Efforts to locate, detect, interdict, and disrupt transnational criminal organizations, including Tren de Aragua.</text></subparagraph> 
<subparagraph id="H689CF0A7F7014F00B0FDCCE3CAE3429E"><enum>(D)</enum><text display-inline="yes-display-inline">Efforts to prevent transnational criminal organizations, including Tren de Aragua, from proliferating in the United States.</text></subparagraph></paragraph></subsection> <subsection id="H9E4272808AC248DF8DF4E3D45CCAEE88"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="HA5775E7F94DC47B6BD83F08F270994A1"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text> <subparagraph id="HE9CEF7BC28F842CC9DC4FF50471E8BAD"><enum>(A)</enum><text>the Committee on Homeland Security of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H4838B447E73B464F9A89009C93CF9100"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph> <paragraph id="HB3C6E60FD90B48B48528F7B542B5DD5F"><enum>(2)</enum><header>Intelligence community</header><text>The term <quote>intelligence community</quote> has the meaning given such term in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003(4)</external-xref>).</text></paragraph></subsection></section>
