<section id="H2FC8E45E237E4231A1B7348A1DED333E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pay Our Correctional Officers Fairly Act</short-title></quote>.</text></section> <section id="H32A7755122EF4F3A96D5FD3670D2DD4A"><enum>2.</enum><header>Providing nearest other locality pay rate for certain Bureau of Prisons employees receiving Rest of U.S. locality rate</header><text display-inline="no-display-inline">Section 5304 of title 5, United States Code, is amended—</text>
<paragraph id="H3F2C1AF771EB49FA9A5B2CDAEC680E2C"><enum>(1)</enum><text>by redesignating subsection (i) as subsection (j); and</text></paragraph> <paragraph id="H2B1817044A5B4F9CA8BD2577D997ABC7"><enum>(2)</enum><text>by inserting after subsection (h) the following:</text>

<subsection id="H43E8A6EB947341B3B582F0C2C357518A"><enum>(i)</enum>
<paragraph commented="no" display-inline="yes-display-inline" id="H0C81567EAFAB436A90F51B8ADE64DBFA"><enum>(1)</enum><text>Notwithstanding any other provision of this chapter, and consistent with paragraph (2), the official worksite of an employee of the Bureau of Prisons that is otherwise located in the pay locality designated as <term>Rest of U.S.</term> shall be considered to be located in the nearest other pay locality established pursuant to this section.</text></paragraph> <paragraph id="HFFAC682998EA4FFF84E714922D426D90" indent="up1"><enum>(2)</enum><text>For purposes of carrying out paragraph (1)—</text>
<subparagraph id="H9CF3DE6F37BB49B8807398AED67B21C2"><enum>(A)</enum><text display-inline="yes-display-inline">if more than one pay locality is within 200 miles of the official worksite of such an employee, such worksite shall be considered to be located in the pay locality with the highest comparability payment; </text></subparagraph> <subparagraph id="H2170BF15EF894ED9A592718D4755996A"><enum>(B)</enum><text>an employee of the Bureau of Prisons shall not be subject to paragraph (1) if the official worksite of such employee is not within 200 miles of any pay locality other than <term>Rest of U.S.</term>; and</text></subparagraph>
<subparagraph id="H371A072F0DBE4F4BB0D46130C502D969">
                                <enum>(C)</enum>
 <text>notwithstanding any other provision of law, the term <term>employee</term> includes any prevailing rate employee (as that term is defined in section 5342). </text>
                            </subparagraph></paragraph>
<paragraph id="HA57AC5471C204F5EB9217A2EC31B57EE" indent="up1"><enum>(3)</enum><text>This subsection shall begin to apply during any pay period beginning on or after the date that is 180 days after the date of enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
