<official-title display="yes">To confer jurisdiction on the State of Utah with respect to civil causes of action arising on or within the Indian lands of the Shivwits Band of Paiutes, and for other purposes.</official-title>

<section section-type="section-one" id="HB62E216385FE4F499D15102E5934D6BF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Shivwits Band of Paiutes Jurisdictional Clarity Act</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="HDB625427F7B54CACA89756929139B2FD"><enum>2.</enum><header>Definitions</header> <subsection commented="no" display-inline="no-display-inline" id="H8107D16C2750422CB5EFA3CD96481050"><enum/><text>In this Act:</text> 
<paragraph id="H2EADDCC64C7043E0B04AA7A5AFA70C41" commented="no"><enum>(1)</enum><header>Indian lands</header><text>The term <term>Indian lands</term> means lands of the Shivwits Band of Paiutes that are—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H303D7FE9DE5844E8A52D378D4FBEEA46"><enum>(A)</enum><text display-inline="yes-display-inline">held in trust by the United States for the benefit of the Shivwits Band of Paiutes; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H44423C88B87748BA889F500FAD460172"><enum>(B)</enum><text>subject to a restriction against alienation imposed by the United States.</text></subparagraph></paragraph> <paragraph id="HA471B07156C748CEB2BD16A2E23979BF"><enum>(2)</enum><header>Shivwits Band of Paiutes</header><text>The term <term>Shivwits Band of Paiutes</term> means—</text> 
<subparagraph id="H7C5BE763EC154EBEB8A614B006462232"><enum>(A)</enum><text>the Shivwits Band of Paiutes, a federally recognized Indian Tribe restored by Congress pursuant to the Paiute Indian Tribe of Utah Restoration Act (<external-xref legal-doc="public-law" parsable-cite="pl/96/227">Public Law 96–227</external-xref>; 94 Stat. 317);</text></subparagraph> <subparagraph id="H7894756A6DDC4E75B0FA3309DFDBFDDA"><enum>(B)</enum><text>the recognized governing body of the Shivwits Band of Paiutes;</text></subparagraph> 
<subparagraph id="H528F0B738B5A4600B449F1858A7F720F"><enum>(C)</enum><text>any Shivwits Tribal enterprise, including any commercial activity, business, or entity managed, controlled, or operated by the Shivwits Band of Paiutes, and any subsidiaries thereto; and</text></subparagraph> <subparagraph id="H6370C0081991456BB2BE522E2A5AD069"><enum>(D)</enum><text>any corporation chartered by the Shivwits Band of Paiutes under section 17 of the Act of June 18, 1934 (commonly known as the <quote>Indian Reorganization Act</quote>) (48 Stat. 988, chapter 576; <external-xref legal-doc="usc" parsable-cite="usc/25/5124">25 U.S.C. 5124</external-xref>), and any subsidiaries thereto.</text></subparagraph></paragraph></subsection></section> 
<section id="H5B67A97EB30F4D3FBDE530BE4F267D2D"><enum>3.</enum><header>State civil jurisdiction</header> 
<subsection id="HED6EC89818E248CFB2D635A393F5CB66"><enum/><text>The State of Utah shall have jurisdiction over any civil cause of action—</text> <paragraph commented="no" display-inline="no-display-inline" id="HFBA3B3443DA74208839908A42F04169A"><enum>(1)</enum><text display-inline="yes-display-inline">to which the Shivwits Band of Paiutes is a party; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HEBF6874B56C7465C8E2D1D0317A7F2DD"><enum>(2)</enum><text display-inline="yes-display-inline">that arises on or within the Indian lands.</text></paragraph></subsection></section> <section id="HA592122DEB9240E7A646BA55DE7C754B"><enum>4.</enum><header>Federal court jurisdiction</header> <subsection commented="no" display-inline="no-display-inline" id="H72B951FF35B2437E87DB51805A08F9D1"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Any contract or agreement, including a lease, affecting or arising on the Indian lands, or to which the Shivwits Band of Paiutes is a party, shall be considered within the meaning of <quote>commerce</quote> as defined in section 1 of title 9, United States Code.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1317AF6F1BDD4D5894E2426FC178EC4A"><enum>(b)</enum><header>Causes of action</header><text>Any cause of action arising from any contract or agreement, including a lease, affecting or arising on the Indian lands, or to which the Shivwits Band of Paiutes is a party, shall be deemed to be a civil cause of action arising under the Constitution, laws, or treaties of the United States within the meaning of section 1331 of title 28, United States Code.</text></subsection></section> <section id="H786342173B1D4736A8D6A8D981B31F17" commented="no"><enum>5.</enum><header>Sovereign immunity not abrogated</header><text display-inline="no-display-inline">Nothing in this Act abrogates—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HE9DEC8FCAA0C43E6910C895D7447EE6A"><enum>(1)</enum><text display-inline="yes-display-inline">the sovereign immunity of the Shivwits Band of Paiutes from unconsented suit; or</text></paragraph> <paragraph id="H44A7DE9593C142F0B3C73FCB9498D96B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the authority of the Shivwits Band of Paiutes to waive that sovereign immunity.</text></paragraph></section> 
<section id="H60BD48640D2C49D1A486CB9413ECFC5C"><enum>6.</enum><header>Shivwits Band of Paiutes leasing authority</header><text display-inline="no-display-inline">Subsection (a) of the first section of the Act of August 9, 1955 (69 Stat. 539, chapter 615; <external-xref legal-doc="usc" parsable-cite="usc/25/415">25 U.S.C. 415(a)</external-xref>), is amended, in the second sentence, by inserting <quote>, land held in trust for the Shivwits Band of Paiutes</quote> after <quote>land held in trust for the Confederated Tribes of the Chehalis Reservation</quote>.</text></section> </legis-body><attestation><attestation-group><attestation-date date="20260316" chamber="House">Passed the House of Representatives March 16, 2026.</attestation-date><attestor display="no">Kevin F.
