The owner or consignee shall be responsible for the costs of such destruction.</text></paragraph><paragraph id="HD735DECAC9F2472A867CD423407FC8F0" commented="no"><enum>(3)</enum><header>Due process</header><text>The Secretary of Health and Human Services shall provide to the owner or consignee of an article subject to an order under paragraph (1) appropriate due process prior to the destruction of the article. Such due process shall be specified in regulations and include notice and an opportunity to appear before the Secretary and introduce testimony on the destruction—</text><subparagraph id="HFB9C3B9554064FE0B946F83325BA8C76" commented="no"><enum>(A)</enum><text>in combination with the notice and opportunity to appear and introduce testimony on the refusal of admission of the article under subsection (a); or</text></subparagraph><subparagraph id="H529D7B39E0CF4CEE985E23EF0B5A077C" commented="no"><enum>(B)</enum><text>separately.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H96363F83932642E3B509BF8CF3F060B3"><enum>(b)</enum><header>Prohibited acts</header><text>Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H371E004ED4B2498E81659BC511447194" changed="added" reported-display-style="italic" committee-id="HIF00"><subsection id="HF0412663500B4B299E0FC005FBB90EC7" commented="no"><enum>(jjj)</enum><text display-inline="yes-display-inline">The unauthorized movement, or introduction or delivery for introduction into interstate commerce, including export, of an article that is subject to an order for destruction under section 801(v).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4BBAB05AF49E472FB745BB68460CABBB" commented="no"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by subsections (a) and (b) shall apply to articles beginning on the date that is 30 days after the date on which the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, promulgates final regulations under subsection (d).</text></subsection><subsection id="H86526DA40FBD40D5BF84D1472F0ECC0D" commented="no"><enum>(d)</enum><header>Regulations</header><paragraph id="HBDDE5845A7574830A3971308531A5EB0"><enum>(1)</enum><header>Proposed</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall issue proposed regulations to implement the amendment made by subsection (a), allowing for notice and comment on such proposed regulations.</text></paragraph><paragraph id="H57468D746123401CA0E80B0F3346D269"><enum>(2)</enum><header>Final</header><text>Not later than 1 year after the issuance of the proposed regulations under paragraph (1), the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall promulgate final regulations to implement the amendment made by subsection (a).</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date>June 18, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
