R. 261</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250109">January 9, 2025</action-date><action-desc><sponsor name-id="C001103">Mr. Carter of Georgia</sponsor> (for himself, <cosponsor name-id="D000628">Mr. Dunn of Florida</cosponsor>, <cosponsor name-id="C001039">Mrs. Cammack</cosponsor>, <cosponsor name-id="K000399">Mrs. Kiggans of Virginia</cosponsor>, <cosponsor name-id="F000478">Mr. Fry</cosponsor>, and <cosponsor name-id="P000048">Mr. Pfluger</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Marine Sanctuaries Act to prohibit requiring an authorization for the installation, continued presence, operation, maintenance, repair, or recovery of undersea fiber optic cables in a national marine sanctuary if such activities have previously been authorized by a Federal or State agency.</official-title></form><legis-body id="H6C1DC4ABD3F8428F96E27E5CD717B795" style="OLC"><section id="H9DFAE0217EE64C76BB5E5C50CDB9CE74" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Undersea Cable Protection Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="HA972CD34167E415CA3D604E080D1D3D3"><enum>2.</enum><header>Prohibition on requiring authorizations for undersea fiber optic cables previously authorized by Federal or State agencies</header><text display-inline="no-display-inline">The National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431 et seq.</external-xref>) is amended by inserting after section 310 the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HD7B0422B27C44964B6AC404DBAAA892A"><section id="HAB07B540A7D048B8BD0F7290E09AB776"><enum>310A.</enum><header>Prohibition on requiring authorizations for undersea fiber optic cables previously authorized by Federal or State agencies</header><subsection commented="no" display-inline="no-display-inline" id="H823D38538716461DA99D0558D6916671"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, the Secretary may not prohibit or require any authorization for the installation, continued presence, operation, maintenance, repair, or recovery of undersea fiber optic cables in a national marine sanctuary if a license, lease, or permit has been issued by a Federal or State agency authorizing such installation, continued presence, operation, maintenance, repair, or recovery. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="H2747F9EA10BD484CBE40E074D03AFCF3"><enum>(b)</enum><header>Interagency cooperation</header><text display-inline="yes-display-inline">The Secretary may direct the National Oceanic and Atmospheric Administration to engage in interagency cooperation under section 304(d) in any Federal agency action described in that section and involving the installation, continued presence, operation, maintenance, repair, or recovery of undersea fiber optic cables in a national marine sanctuary.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
