which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name></action-desc></action><action display="yes"><action-date date="20260113">January 13, 2026</action-date><action-desc>Additional sponsors: <cosponsor name-id="F000475">Mr. Finstad</cosponsor>, <cosponsor name-id="S001214">Mr. Steube</cosponsor>, <cosponsor name-id="F000484">Mr. Fine</cosponsor>, and <cosponsor name-id="G000558">Mr. Guthrie</cosponsor></action-desc></action><action display="yes"><action-date date="20260113">January 13, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on March 31, 2025</action-instruction><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to prohibit political litmus tests in accreditation of institutions of higher education, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HED00" reported-display-style="italic" id="H9B01D53217614BEC91C896C9FBF30161"><section id="HC0A6008EB95C47209370C0B9C7A33F4D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accreditation for College Excellence Act of 2025</short-title></quote>.</text></section><section id="HB74699BA643E462283C53D895BC3075D"><enum>2.</enum><header>Prohibition on political litmus tests in accreditation of institutions of higher education</header><subsection id="HDCF52E978EF44496BC6193CBC143EAB1"><enum>(a)</enum><header>Operating procedures required</header><text>Section 496(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1099b">20 U.S.C. 1099b(c)</external-xref>) is amended—</text><paragraph id="HE4E275021B7A419F94EA607261E7020B"><enum>(1)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HC46BC2F0A1B04F81A339F3AD0B93A49A"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H49AF69E510AC40D7A7374A71F440AD33"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H2820E0AB33BB459C9F87337081060DA0" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="H514744D43844492986500BF34FA424BA"><enum>(10)</enum><text>confirms that the standards for accreditation of the agency or association do not—</text><subparagraph id="HB375484B7929459FA4E3B499E309D88E"><enum>(A)</enum><text>except as provided in subparagraph (B)—</text><clause id="HAFF39311009848749D73919C2347BE02"><enum>(i)</enum><text>require, encourage, or coerce any institution to—</text><subclause id="HDE16FF4F04E640D8B94EDC49C7FDFE19"><enum>(I)</enum><text>support, oppose, or commit to supporting or opposing—</text><item id="HA418BE9B5DCA409B80B2C8C611B4AD63"><enum>(aa)</enum><text>a specific partisan, political, or ideological viewpoint or belief or set of such viewpoints or beliefs; or</text></item><item id="H58EC967915F242889740E81B8161777E"><enum>(bb)</enum><text>a specific viewpoint or belief or set of viewpoints or beliefs on social, cultural, or political issues; or</text></item></subclause><subclause id="H0F1F3A523D8D42C790BFF0325CD75EF7"><enum>(II)</enum><text>support or commit to supporting the disparate treatment of any individual or group of individuals on the basis of any protected class under Federal civil rights law, except as required by Federal law or a court order; or</text></subclause></clause><clause id="HD11764033B43455CA801373D1AE32F9E"><enum>(ii)</enum><text>assess an institution’s or program of study’s commitment to any ideology, belief, or viewpoint;</text></clause></subparagraph><subparagraph id="H951B63E8626842F6911CACFAB7ACB80B"><enum>(B)</enum><text>prohibit an institution—</text><clause id="H7F70EB5F7C524DB38DB64E9426E08F74"><enum>(i)</enum><text>from having a religious mission, operating as a religious institution, or being controlled by a religious organization (in a manner described in paragraph (1), (2), (3), (4), (5), or (6) of section 106.12(c) of title 34, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph)), or from requiring an applicant, student, employee, or independent contractor (such as an adjunct professor) of such an institution to—</text><subclause id="H8C660AAE787C474B9F5E8A040A44DAFB"><enum>(I)</enum><text>provide or adhere to a statement of faith; or</text></subclause><subclause id="H4567403171D044B799DC22ACA8657199"><enum>(II)</enum><text>adhere to a code of conduct consistent with the stated religious mission of such institution or the religious tenets of such organization; or</text></subclause></clause><clause id="H86EC133668594D0F820A7B10177987B7"><enum>(ii)</enum><text>from requiring an applicant, student, employee, or contractor to take an oath to uphold the Constitution of the United States; or</text></clause></subparagraph><subparagraph id="HF1B97E7064C246889029B19A5C2D1E8B"><enum>(C)</enum><text>require, encourage, or coerce an institution of higher education to violate any right protected by the Constitution.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H416B06D4BBF248F4B9CF795417FAFDCF" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Limitation on scope of criteria</header><text display-inline="yes-display-inline">Section 496 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1099b">20 U.S.C. 1099b</external-xref>) is further amended by amending subsection (g) to read as follows: </text><quoted-block id="HB15B2ABF9D294C2AAF99D830CD7370F0" style="OLC" changed="added" reported-display-style="italic" committee-id="HED00"><subsection id="HBE3C52049C92412EBA181E344DF5072A" commented="no"><enum>(g)</enum><header>Limitation on scope of criteria</header><paragraph id="H5E37B2272D3D45528DED9D49164A4C27" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary shall not establish criteria for accrediting agencies or associations that are not required by this section.</text></paragraph><paragraph id="HA57D4686055D4E9086A17EE10D98F858" commented="no"><enum>(2)</enum><header>Institutional eligibility</header><text display-inline="yes-display-inline">An institution that is in compliance with the standards of its accrediting agency or association that assess the institution in accordance with subsection (a)(5) shall meet the accreditation requirements for certification as an institution of higher education under section 102 and subpart 3 of this part, regardless of any additional standards adopted by the agency or association for purposes unrelated to participation in programs under this Act. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HBB0A40BAD5174A509DB9CB62F2949074"><enum>3.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, shall be construed to prevent religious accreditors from holding and enforcing religious standards on institutions they choose to accredit.</text></section></legis-body><endorsement display="yes"><action-date date="20260113">January 13, 2026</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
