AN ACT
To require the Attorney General to submit to the Congress a report that
includes the demographic data of persons determined to be ineligible to
purchase a firearm based on a background check performed by the
National Instant Criminal Background Check System.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``NICS Data Reporting Act of 2026''.
SEC. 2. NICS REPORT.
Not later than 1 year after the date of enactment of this Act, and
annually thereafter, the Attorney General shall submit to the Committee
on the Judiciary of the Senate and the Committee on the Judiciary of
the House of Representatives a report containing, with respect to the
preceding year, the demographic data of persons who were determined to
be ineligible to purchase a firearm based on a background check
performed by the National Instant Criminal Background Check System,
which shall include, disaggregated by the reason for the determination
of ineligibility, the following:
(1) The race, ethnicity, national origin, sex, gender, age,
disability, average annual income, and English language
proficiency, if available.
(2) In the case of each person whose determination of
ineligibility was overturned on appeal, the race, ethnicity,
national origin, sex, gender, age, dis-
ability, average annual income, and English language
proficiency, if available.
